    Opis:
    Article 2 paragraph 2 of the Polish Code of Criminal Procedure delineates the principle of material truth, recognized as an overarching principle of criminal proceedings. It is often claimed that this principle derives from the Polish Constitution, particularly from Article 2 and Article 7 (the principle of democratic rule of law) or Article 45 paragraph 1 (the right to a fair trial) and, consequently, had a status of constitutional rule. Nevertheless, such a view is disputable in the jurisprudence. The practical significance of this dispute underlies the discussion on an amendment to the Polish Code of Criminal Procedure (dated 27 September 2013). The core question, which the article seeks to provide an answer to, can be watered down to whether the legislature can interfere with the judges’ right (and duty) to accept and search for evidence as to establish material truth in a full adversarial trial, and whether such a reform could be kept within constitutional limits. Bearing in mind the essence of the principle according to which any decision (negative for the accused) must be based on objective findings, its functioning in the full adversarial system shall not be ignored.

    Opis:
    The principle of nullum crimen sine lege expresses an old idea that only the law can prescribe a particular act as punishable. It is commonly understood as a requirement of sufficient definiteness of an offence, in particular – of a statutory description of an offence before it has been committed (lex scripta, lex praevia), and of clarity and precision in criminal provisions so as to enable an individual to conform with them (lex certa), as well as their strict interpretation (lex stricta). Nowadays the principle is an internationally recognized human right to foreseeable criminalization, guaranteed by, inter alia, Article 7 of the European Convention on Human Rights. However, the European Court of Human Rights seems to formulate two slightly different requirements on its basis, namely that the application of criminal law must be foreseeable for an individual and coherent with the “essence of an offence”. One may question whether this can serve as an adequate “shield” from arbitrariness on the part of State authorities. Nevertheless, the core aim of such a flexible approach is not to promote legal security for potential perpetrators, but to achieve better protection of human rights in general.

    The provision of the Article 96 paragraph 3 of the Polish Petty Offences Code, that penalizes a failure to indicate, upon a demand by a relevant authority, the person to whom a vehicle was entrusted, has been recently analysed by the Constitutional Court of Poland in terms of its compliance with the constitutional right of the accused to defence. Although the Court stated its constitutionality, several of the judges expressed dissenting opinions. The given duty especially seems to infringe the constitutional right to passive defence, that is – to remain silent and not to incriminate oneself, as the owner (holder) of the vehicle is obligated under penalty to reveal who was driving the vehicle in a particular moment. However, when we assume that the owner (holder) must provide information that could incriminate him in anticipated criminal proceedings (or proceedings in petty offence cases) he should be entitled to the right of defence and, in particular, the privilege against self-incrimination.

    Opis:
    Talking about the economic crisis in Europe, the so called ‘European sovereign debt crisis’ (also referred as the Eurozone crisis) is an ongoing problem which most Member States of the EuropeanUnion (further referred as the EU) have been dealing with. Resulted from a combination of complex factors, it is claimed that the landmark – apart from easy credit conditions in a period of 2002–2008 that encouraged high-risk lending and borrowing practices – was the monetary union among the Eurozone without the fiscal one.1 While the setting of central bank interest rates and monetary easing was determined by the European Central Bank, taxation and government spending remained mostly under the control of national governments. Despite the fact that in 1992 Members of the EU signed the Maastricht Treaty pledging to limit their deficit spending and debt levels, the very idea to let the EU coordinate the fiscal policies of Member States conceived in the late 1990s. Notwithstanding, the Stability and Growth Pact2 – an agreement reached in order to facilitate and maintain the stability of the Economic and Monetary Union (EMU), has occurred to be unenforceable instrument and has not prevented the financial crisis among the Eurozone. What was said to cure the crisis, was – according to the abovementioned - the stricter fiscal regulation. This paper intends to shed some light on the issue.

    Twardzina układowa (SSc – systemic sclerosis) to choroba przewlekła i postępująca. Prowadzi do niewydolności wielonarządowej, niepełnosprawności chorych, a tym samym obniżenia jakości ich życia. Zwykle rozpoczyna się ona pomiędzy 30 a 50 rokiem życia, co utrudnia pełnienie ról społecznych i aktywność zawodową, szczególnie gdy choroba jest zaawansowana. Celem pracy jest przedstawienie deficytów sprawności funkcjonalnej pacjentki w przebiegu twardziny układowej. Opis przypadku odnosi się do 68-letniej pacjentki z rozpoznaną postacią uogólnioną twardziny układowej. Chora wykazuje deficyty samoopieki i samopielęgnacji oraz trudności w poruszaniu się wynikające z dolegliwości bólowych. Unika kontaktów z najbliższymi, co jest spowodowane jej niską samooceną wynikającą z poczucia bezradności w przebiegu choroby. Pielęgniarka podstawowej opieki zdrowotnej we współpracy z pacjentką oraz jej rodziną opracowuje plan opieki zmierzający do poprawy samoopieki i wydolności opiekuńczej rodziny.
    Systemic sclerosis (SSc) is a chronic and progressive disease. It leads to multi-organ failure, patient disability and thus a decrease in their quality of life. It usually starts at the age of 30-50, which makes it difficult to perform social roles and professional activity, especially when the disease is advanced. The aim of the study is to present deficits in the functional efficiency of the patient in the course of systemic sclerosis. Case study includes a 68-year-old woman with a recognized form of systemic sclerosis. We can observe self-care deficits, as well as difficulties in movement resulting from pain. The patient avoids contact with her relatives, which is due to her low self-esteem resulting from the feeling of helplessness in the course of the disease. The nurse of the primary care in cooperation with the patient and her family develops a care plan aimed at improving the self-care and care efficiency of the family.

    Introduction. Health related behaviour determines the style of human life and significantly affects health . Objective. The aim of the research was to investigate and evaluate health behavior patterns of students with consideration of selected socio-demographic preconditions. Material and methods. The research was conducted among Bachelor degree nursing students. The diagnostic survey method was applied, while the Health Behavior Inventory served as a research tool. Results. The respondents most often declared to give preference to such health behaviour as stable family life, social life, restrictions on smoking/the use of tobacco and writing down emergency services phone numbers. Still, the worrying situation is the fact of devoting too little time for resting, and the students’ continuous efforts to avoid any overworking. Conclusion. Nursing students have good attitudes and preferences in terms of health related behaviour. It was gender that differentiated respective health related behaviour patterns.
    Wstęp. Zachowania zdrowotne determinują styl życia człowieka i w znacznym stopniu wpływają na stan zdrowia. Cel. Celem pracy było poznanie i ocena zachowań zdrowotnych studentów kierunku pielęgniarstwo z uwzględnieniem wybranych uwarunkowań socjodemograficznych. Materiał i metody. Badania zostały przeprowadzone wśród studentów studiów pierwszego stopnia na kierunku pielęgniarstwo. Wykorzystano metodę sondażu diagnostycznego a narzędziem badawczym kwestionariusz Inwentarza Zachowań Zdrowotnych (IZZ). Wyniki. Respondenci najczęściej deklarowali preferowanie takich zachowań zdrowotnych jak: posiadanie przyjaciół i uregulowanego życia rodzinnego, ograniczanie palenia tytoniu, notowanie telefonów służb pogotowia. Niepokojącą sytuacją jest przeznaczanie zbyt małej ilości czasu na wypoczynek i dążenia do unikania przepracowania przez studentów. Wnioski. Studenci kierunku pielęgniarstwo prezentują dobre postawy i preferencje w zakresie zachowań zdrowotnych. Płeć różnicowała wybrane zachowania zdrowotne badanych.

    The article presents the characteristics of the romantic irony employed in Alexander Pushkin’s digressive poem Eugene Onegin and Pyotr Tchaikovsky’s opera titled alike. The analysis of selected fragments of the libretto which were based on the verses constituting the digressive (rather than storytelling) layer of Pushkin’s work allow one to conclude that the operatic version of Onegin expresses exactly the same kind of romantic irony which was used by the romantic poet. The authors of the libretto achieved something typical of Pushkin’s irony – a flow of the border between illusion and disillusion and an effortless crossing of the dialectic borders of time and space. They did so by multiplying and splitting into layers the “I” of the main character which functions both in the dramatic plane and beyond it, taking over the functions which in Pushkin’s text were performed by the narrator.
