The article critically assesses the decision of the Polish Supreme Court in Natoniewski v. Federal Republic of Germany. It argues that the decision as such reflects contemporary international law practice. Consequently, the holding of the Supreme Court that State immunity is applicable to acts de iure imperii committed on the territory of the forum State during an armed conflict even though they may amount to war crimes seems to be correct. This conclusion also means that the Court refused to engage in law-making activity by declining to endorse interpretation, which would permit to reject State immunity by attaching superior importance to human rights. Although the article recognizes that the reasoning of the Supreme Court as well as the choice of arguments is well-balanced and convincing, it also identifies certain instances in which the Court is not entirely persuasive. In the opinion of the author, one of the most important drawbacks in the reasoning relates to the characterization of State immunity as a procedural, rather than substantive, issue.

Opis:
The Polish public procurement procedure currently includes the following elements: the proceeding in cases for the award of a public contract, the appeal proceeding in cases for the award of a public contract, the grievance proceeding in cases for the award of a public contract, and the amicable proceeding in cases for the award of a public contract. Naturally, the element all these proceedings have in common is their subject-matter, which covers a public procurement case, but they clearly differ as regards the status of the adjudicating entity. Consequently, the public procurement procedure turns out to be a hybrid procedure, since it assumes combining separate proceedings from the point of view of their nature. Moreover, the public procurement procedure must also be regarded as a regulatory procedure, as it is characterised by properties typical of the regulatory function of the public administration. The Polish Supreme Court effectively exercises judicial supervision over adjudication in public procurement matters.
Procedura zamówień publicznych obejmuje dzisiaj: postępowanie w sprawach o udzielenie zamówienia publicznego, postępowanie odwoławcze w sprawach o udzielenie zamówienia publicznego, postępowanie skargowe w sprawach o udzielenie zamówienia publicznego oraz postępowanie polubowne w sprawach o udzielenie zamówienia publicznego. Te wszystkie postępowania łączy oczywiście wspólny przedmiot, który obejmuje sprawę o udzielenie zamówienia publicznego, natomiast różnią się one wyraźnie statusem podmiotu rozstrzygającego. W konsekwencji procedura zamówień publicznych okazuje się być procedurą hybrydową, ponieważ zakłada mieszanie odrębnych z punktu widzenia charakteru postępowań. Ponadto trzeba procedurę zamówień publicznych uznać zarazem za procedurę regulacyjną, ponieważ można w niej doszukać się cech właściwych dla funkcji regulacyjnej administracji publicznej. Sąd Najwyższy efektywnie sprawuje w niej nadzór judykacyjny nad orzecznictwem w sprawach o udzielenie zamówienia publicznego.

The article discusses the decision of the Polish Supreme Court of 2 June 2022, I KZP 17/21. The ruling of the Supreme Court was issued based on a legal question submitted by a common court in relation to the European Investigation Order (EIO). The Author refers to the ruling by discussing broadly both the issues of the legal question and the authority issuing the European Investigation Order within the framework of pre-trial proceedings. Of paramount importance are the characteristics of the subjective sphere, i.e. the authority empowered to issue a European Investigation Order from the point of view of legally protected confidential information, in particular bank secrecy constituting the subject matter that served the basis for the ruling of the Supreme Court being commented herein.

This article is a critical gloss to the order of the Supreme Court of 25 June 2020, by which the Court in question refused to decide on the following legal question: “Can the victim, who is a minor, be represented by one of the parents in cases where the offence of non-alimony takes place and the accused is the other parent, or should a guardian be appointed for such a minor?”. The text examines the above issue on several levels. The first part of the article presents the factual and legal background of the present case, namely the proceedings before the court of first instance, the legal question posed and the decision of the Supreme Court resulting from the said legal question. The second part contains the author’s own substantive comments on what a legal act is within the meaning of family law, the regulation of Articles 98 and 99 of the Family and Guardianship Code and Article 51 Section 2 of the Code of Penal Procedure. In its Judgement of 17 February 2016, the Polish Supreme Court adjudicated the case of Polish soldiers accused of crimes committed in the village of Nangar Khel in Afghanistan in 2007. Ultimately, the Supreme Court found that Polish soldiers were guilty of, inter alia, breach of Article 318 of the Polish Penal Code, which stipulates that a soldier commits a crime even when executing an order if he is aware of this crime. However, the part of the judgement devoted to the problem of unlawful orders is very limited and almost completely lacks references to international law. The Supreme Court could have referred to a number of international legal acts, starting from the beginning of 20th century and up to the more recent regulations, including those in the Rome Statute. Moreover, the Supreme Court did not use international case law. As a result, the argumentation of the Supreme Court should be assessed as limited and unconvincing.

The voted ruling of the Supreme Court concerns the issues related to the entry into force of the law of 23 March 2017. The Supreme Judicial Authority in Poland indicated that to assess the act of a person obligated to alimony, whose obligation was determined in terms of the amount by a court decision, a settlement concluded before a court or another authority or another agreement, and committed before 31 May 2017, it is possible to apply the provisions of Article 209 of the Code of Criminal Procedure, both in its current and current wording. The condition is to establish that the perpetrator has exhausted the features of the offence of non-alimination required by the current wording of this provision, and at the same time has fulfilled the features required for this offence in the wording given to this amendment. In such a situation, after such a double assessment of the act, the procedural authority will either apply the new act or the act previously in force as being more relative to the offender.

In the commented ruling, the Supreme Court considered some of the problematic aspects of the Polish photo lineup procedure, stating that improprieties in organising or conducting identifi cation procedures do not necessarily render eyewitness identifi cation evidence inadmissible. This commentary discusses the assessment of the probative value of identification evidence, as well as critically analyses the current laws regarding photo lineup practices in Poland. Finally, the commentary argues that significant and research-based changes in the Polish legal standards for eyewitness identifi cation are necessary to prevent potential miscarriages of justice, briefly discussing the most urgent of them.

The aim of this paper is to investigate the distribution of exponents of modality in the justifications of judgments passed by the Court of Justice of the European Union (CJEU) and judgments passed by the Supreme Court of the Republic of Poland (SN) in the post-accession period of 2011 to 2015. In particular, the paper aims to establish the degree of convergence between translated EU judgments and non-translated national judgments in terms of the employment of modality markers. The research material consists of a large corpus of Polish-language versions of 897 judgments passed by the Court of Justice (CJ), 384 judgments passed by the General Court (GC), a corpus of 2564 non-translated judgments delivered by the SN, and a reference corpus of contemporary Polish (NKJP). The quantitative data point to the high salience and divergent distribution of a number of various markers in both EU and national judgments, such as the value-laden modal verbs należy [(one) must/should] and trzeba [(one) should/must]. It is argued that the frequent use of markers of modality constitutes a generic feature, as it raises the perceived level of authoritativeness of judicial argumentation. The findings may contribute to raising awareness of language patterns which involve the expression of modal stance.

In one of the court proceedings concerning a cassation appeal, brought against the decision of the President of the Office of Competition and Consumer Protection (UOKiK), the Polish Supreme Court expressed in its judgment of 29 July 2020 (I NSK 8/19) a view on the role of expert evidence in the definition of the relevant market, and more specifically, in the determination of product substitutability. By dismissing the corporate applicant’s cassation appeal, the Court stated that admission of expert evidence was not necessary, given that the substitutability of products is decided mainly by customer adoption and not their chemical composition. This article aims to present the arguments cited to this end by the Supreme Court and to analyze them through the prism of defining the relevant market and the specificity of expert evidence in determining the boundaries of the relevant market for the purposes of applying competition law.
Substituabilité des produits dans la détermination du marché pertinent et preuves d’expertise – commentaires sur la base de l’arrêt de la Cour suprême du 29 juillet 2020. (I NSK 8/19). Dans l’une des procédures concernant un pourvoi en cassation formé dans une affaire contre une décision du président de l’Office polonais de la concurrence et de la protection des consommateurs, la Cour suprême, dans son arrêt du 29 juillet 2020 (I NSK 8/19) a exprimé son point de vue sur le rôle des preuves d’experts dans la définition du marché pertinent, et plus particulièrement dans la détermination de la substituabilité des produits. Rejetant le pourvoi en cassation du commerçant, il a déclaré qu’il n’était pas nécessaire de procéder à l’expertise demandée dans le cadre d’une procédure judiciaire, car l’élément décisif pour déterminer la substituabilité des produits est leur perception par les acheteurs et non leur composition chimique. L’objectif de cet article est de présenter l’argumentation de la Cour suprême et de l’analyser sous l’angle de la définition du marché pertinent et de la spécificité des preuves d’experts dans le contexte de la détermination du marché pertinent pour l’application de la loi antitrust.
