Traditional conceptualizations presume that landscape and nature in general are characterized by a striving for balance. In consequence, environmental protection chiefly consists in conservation of the existing state, without making allowances for the dynamic changes caused by vital processes taking place in those landscapes, human and non-human alike. The current dispute concerning the protection of the Białowieża Forest is nothing but an upshot of the differences between the involved with respect to what should be protected on top of how it should be done. This study outlines the problems deriving from conceptualizations of nature and landscape as static entities and comes forward with a proposal of conceiving landscape not as an “image of the land”1 but a corporeal experience of being in a space, on which climate change, civilizational and social transformation, political decisions, and bark beetles all have their impact.

Opis:
Space may be divided into two basic components: the natural environment and the anthropogenic environment. Both components permeate one another. The desire for constant development exposes the natural environment to numerous threats; therefore, particularly important areas are included under legal protection. To make more efficient use of limited space, planning documents are adopted, the content of which has to take into account the environmental determinants, including issues related to environmental protection. The paper presents the Polish system of nature conservation and spatial planning, along with mutual dependencies that connect both systems and their reciprocal influences.

Specialized authorities in the field of environmental protection have existed since the beginning of the creation of the system of organization of environmental services and the amount of them has been steadily widening. This has been particularly evident in case of nature conservation law which is a part of environmental law. The fact of existence of authorities having specialized knowledge is particularly important in the context of new environmental tasks resulting from the implementation of European Union legal norms often using professional knowledge. The purpose of this article is to present the specialized authorities functioning in the field of nature conservation, the scope of taking advantage of their professional knowledge potential. The article also aims at taking of trial of assessment of adopted regulations accuracy concerning the division of tasks and competences of public authorities with regard to administration of forms of nature  conservation, as well as presenting de lege ferenda comments aiming at nature conservation tasks performing more effectively.

Contemporary nature conservation is the subject of serious disputes, with biocentrists emphasising the superiority of the good of nature, while anthropocentrists believe that conservation space should also take account of the good of humankind. The dispute concerns two very important values perceived differently, and not resolvable within any scientifi c framework. The authors postulate a return to the Christian roots of our civilisation. It was God who gave human beings the goods He had created, expecting them to be used in line with His plan. The man who lost God’s plan, destroys the life of nature as well as his own. The postulated solution is the proper shaping of conscience, to condition biodiversity conservation in line with the idea of sustainable development.

The article analyses the provisions of the Polish law regulating various forms of nature conservation, authorised organs, and instruments of nature conservation. The act of 16 April 2004 regulates the goals, principles, and forms of protecting the flora and fauna, inanimate nature, and landscape. According to the legislator, a form of nature conservation is a legal institution serving to achieve goals related to nature conservation. Such a form involves isolating a particular object (area, landmark, species) that is distinguished by some features, declaring it as protected, attributing to it a special legal regime in which it is strongly prohibited to act to the detriment of this object, and determining criminal liability for infringement of such prohibitions. The latest comprehensive regulation in this area is embodied by provisions associated with the area of Natura 2000. However, the overlap of competences that arise from these regulations makes it difficult to undertake investments, which are vital for the development of areas that enjoy special status.

Grasslands provide wide range of ecosystem services, however, their area and quality are still diminishing in Europe. Nowadays, they often create isolated patches inside “sea” of other habitats. We have examined basic structural landscape metrics of grasslands in Poland using CORINE land use database. Characteristics for both all individual patches as well as average values for 10 × 10-km grid covering Poland were examined. We also assessed the percentage of grasslands within protected areas and ecological corridors. We found that in Poland rather small patches (0.3–1 km²) dominate, usually located 200–500 m away from each other. The grasslands had clumped distribution, thus in Poland exist large areas where grasslands patches are separated kilometers from each other. Almost all indices calculated for 10 × 10-km² were correlated, i.e., in regions with high percentage of grasslands, the patches were large, more numerous, placed close to each other, and had more irregular shapes. Our results revealed that the percentage of grasslands within protected areas and ecological corridors did not differ from the average value for Poland. On the other hand, forests were significantly over-represented in protected areas and ecological corridors. These findings suggest that there is no planned scheme for grassland protection at the landscape scale in Poland. Development the scheme is urgent and needs high-quality data regarding distribution of seminatural grasslands patches. In practice, nature conservationists and managers should consider spatial processes in their plans in order to maintain grassland biodiversity.

The article presents selected issues of mutual acts relations that are referred in the Nature Conservation Act and Spatial Planning and Land Development Act with regard to agriculture. It points out the position of systemic farmer in natural areas of precious value. Particular attention was put on implementing restrictions on the exercise of agricultural property ownership rights as a result of established acts of planning and conservation plans.
