This article investigates the engagement of EU law with the interests represented and pursued by the Member States within the framework of the European Union. In principle, because the interests which the Member States feed into the EU governance machinery are formulated in political processes at the national level, and thus possess paramount political legitimacy, EU law may only interact with those interests when a clear and sufficient mandate has been provided for doing so. Such mandates follow from Treaty provisions or EU legislation. They embody common political agreements among the Member States by which they commit themselves to realising the specific interests they share, as well as achieving related common policy objectives. In practice, however, the boundaries of EU law’s mandate are difficult to determine with precision, and this may weaken the legitimacy of EU law’s interventions. The weaker legitimacy of the law raises particular problems in the law of the Single Market, where the interests pursued by national governments are subjected to filtering, moderation, and even transformation by the Court of Justice.

Opis:
The aim of the presented paper is to depict the approach of the European Union and its member states towards security in the countries belonging to the Visegrad Group. For V4 countries it is vital to implement such a policy that would make Western Europe aware of the threat and exert political pressure on the countries of the so-called old Union (in particular on France and Germany) to assume a greater responsibility for security and peace in the world as an international organisation and support all actions designed to establish real and effective common defence policy of the EU. Indeed, state security is presently ensured not only by the armed forces of a given country but also through the assurance of obtaining effective assistance (of different kind) from other states and international organisations guaranteed by international agreements.

Opis:
The European integration raises hopes for the future of united Europe, but it does not solve all the current problems of individual Member States. One of them is to protect the rights and interests of the State Treasury of individual European Union’s countries. Therefore, each country has its own system of protection of these interests also towards the European Union’s countries. This situation is far from the perspective of unification of the European Union’s interests. In Poland, the State Treasury Solicitors’ Office deals with the legal protection of the rights and interests of the State Treasury.
Integracja europejska rodzi nadzieje na przyszłą zjednoczoną Europę, ale też nie rozwiązuje wszystkich bieżących problemów poszczególnych państw członkowskich. Jednym z nich jest ochrona praw i interesów Skarbu Państwa poszczególnych państw unijnych. Stąd też każde państwo posiada własny system ochrony tych interesów również wobec państw unijnych. Ta sytuacja jest daleka od perspektywy ujednolicenia interesów unijnych. W Polsce prawną ochroną praw i interesów Skarbu Państwa zajmuje się Prokuratoria Generalna Skarbu Państwa (PGSP).

The article points out that the activity of conducting occasional lectures and publishing articles and books should be classified as an activity subject to copyright law within the meaning of Article 33 para. 1 of the Act on the Exercise of the Mandate of a Deputy or Senator. Members of the Presidium of the Sejm are obliged to report their income from this source in the Register of Interests and to reveal it in two statements of financial status. From the analysis of the case law of the Constitutional Tribunal it follows that even incidental lectures can be classified as “other function” within the meaning of Article 4 para. 2 of the Act on the Remuneration of Persons Holding State Management Posts. It was stated, however, that this position contradicts the historical and teleological interpretation of the rule presented in the law doctrine and the trend observed in relation to those legal solutions which take into account the principle of freedom of choice and carrying out of the profession. Therefore, it can be assumed that a member of the Presidium of the Sejm may earn income from activities subject to copyright law and obtain, at the same time, a salary due to the position of Marshal or Vice-Marshal of the Sejm. In the author’s view, the provision in question should be amended.
