Programie Ramowym. Wskazane zostały również obszary zainteresowania polskich instytucji dziedzinami badań objętych 7. PR. Krótko opisano perspektywy uczestnictwa Instytutu Obróbki Plastycznej w projektach 7. Programu Ramowego.
In the article, the assumptions and objectives of the starting 7th Framework Programme are presented. Main thematic areas, within which institutions and researchers may apply for the European Union financial grants, are shown. Moreover, the authors discuss instruments and the 7th FP budget distribution according to the established priorities. Poland’s expectations regarding the participation in the 7th FP are characterized. In addition, Polish expressions of interest on the research areas included in the 7th FP are indicated. A brief description of the Metal Forming Institute’s prospects for participation in the Programme’s projects is given.

The paper focuses on presenting the research results of a community-based project titled ‘ICT Guides’, in which we investigated the features and functions of intergenerational learning with the use of ICT tools, which open the way for the virtual word. This was accomplished by surveying 267 youth and seniors attending 16 ICT courses in Gothenburg (Sweden), Sheffield (the United Kingdom), Madrid (Spain), and Berlin (Germany), with the use of a questionnaire. Both groups perceive intergenerational learning with the use of ICT as a chance to get to know the other group, despite age and cultural differences. With the use of ICT tools in intergenerational learning, mobile devices make up for a lack of a good command of language when communication problems occur, through application of texts, pictures, movies and music available online. ICT also facilitates mutual understanding and contributes to breaking the polarization that can occur between immigrant youth and unrelated adults, to the mutual benefit of both parties.

Opis:
Underdiagnosis of childhood asthma is a well known problem in many countries. In Poland the estimated occurrence of this problem reaches 50% and is similar to fi ndings published in foreign literature. The causes of the problem are not unequivocally recognized and are addressed by few authors. Among potential causes there are circumstances related to organization and practice of pediatric health care, including application of standard diagnostic criteria of asthma, availability of diagnostic tests, nozologic preferences, etc. Another category of circumstances in charge of underdiagnosis of childhood asthma stems from environmental infl uences, including family-related factors. Findings published in foreign literature show that underdiagnosis is more frequent in children of low socio-economic status, in rural setting or in families burdened by stress. Evidence however is far from being complete. There is a lack of Polish data on the subject and it remains unknown to what extent underdiagnosis of childhood asthma in this country is related to the above mentioned factors. Scientific investigation into the problem is necessary for a number of reasons and justifies implementation of subject-oriented epidemiological studies. Identification of factors associated with an increased probability of underdiagnosis of childhood asthma should facilitate planning of proper preventive measures, above all involving screening programs addressed to selected groups of population.
Prawo swobodnego przepływu osób oraz usług, będące podstawą funkcjonowania Unii Europejskiej, spowodowało konieczność zapewnienia obywatelom Unii Europejskiej, przemieszczającym się wewnątrz Wspólnoty, dostępu do świadczeń wynikających z zabezpieczenia społecznego, a w szczególności usług medycznych na terytorium innego kraju niż kraj pochodzenia. W celu całościowego przedstawiania zastosowania przepisów o koordynacji systemów zabezpieczenia społecznego przez Narodowy Fundusz Zdrowia, dokonano analizy podstawowych aktów prawnych, ustanawiających obowiązujące rozwiązania formalno-proceduralne, niezbędne dla zrozumienia niniejszego zagadnienia. Opracowanie stanowi teoretyczno-empiryczną analizę faktów, w oparciu o ustawowe zadania i ich realizację prowadzoną przez Narodowy Fundusz Zdrowia, z wykorzystaniem danych statystycznych pochodzących z raportów przygotowywanych przez Centralę Narodowego Funduszu Zdrowia, zgromadzonych w Centralnym Wykazie Ubezpieczonych NFZ.

This article examines, in a comparative perspective, the integration policy of the two, in many respects, very similar, neutral states, with particular emphasis on the period after the signing of the Single European Act. Despite the converging political and economic objectives, the decisions of both countries were determined by different economic and political conditions. For Austria, the integration processes were perceived as an important step, towards reconstruction of the economy, the abolition of trade barriers with the most important economic partner. In political terms integration – enhanced Austria’s position within European Community. Unlike the Austrian Government, the authorities in Bern have acted under much more polarized conditions. Neutrality played still very important role in its international policies and the social fears connected mostly to the loss of political and economic independence were vivid. The Swiss authorities were thus forced to choose the bilateral path, which was not preferred by EU countries, but more socially acceptable, and therefore easier to implement.

Association Agreements (AA) are specific tools invented by the EC for shaping relations with third countries. They may provide for preferential trade and economic cooperation but also may support political, economic and social reforms, may prepare them for membership or may substitute for being the EC member country. They reflect the center - perihery relations. Since the first AA with Greece and Turkey in the early 1960’s they grew in number and became more complex. The most important extension relates to political dialogue with associated countries. Still they do not cover security issues. The EC uses them to promote fundamental “European values”. Such policy serves to build her sphere of influence in order to increase economic and political stability in the continent. From this point of view the AA were only partly successful in the 1990’s. The biggest achievement was preparing 8 former communist countries for membership in relatively short time. The EC failed however in stabilizing relations in other sub-regions, like the Balkans and the Middle East.

Celem niniejszego artykułu jest prezentacja wybranych działań podejmowanych w ramach programu URBACT. Przedstawiono przykłady, których problematyka koncentrowała się na zagadnieniach uczestnictwa społecznego w kształtowaniu przestrzeni miejskiej. W artykule wykorzystano materiały dostępne w witrynie internetowej programu URBACT (http://urbact.eu), w tym w szczególności materiały podsumowujące doświadczenia projektów: PARTECIPANDO, UDIEX – UDIEX ALEP, raport URBACT CCTWG, a także materiały dostępne w witrynach internetowych instytucji prowadzących poszczególne projekty. Dla prezentacji i oceny wybranych projektów wykorzystano aparat pojęciowy zaczerpnięty z teorii planowania komunikacyjnego (Healey 1997), a także z opracowania Innes J.E., Booher D.E. (2000).
URBACT was set up in 2003 as a Community Initiative programme – a platform of exchange of experience between the cities of European Union concerning the integrated development of cities. In October 2007 the European Commission accepted the URBACT II Operational Programme for 2007-2013. The URBACT I initiatives focused on social cohesion within deprived areas of the cities. The networks composed of cities, government representatives, NGOs and local universities and research institutes fostered exchange of good practises and creation of common and accessible for other European urban practitioners base of knowledge. The integrated approach to tranformation of urban areas including the local specific and the practical experience of other centers had been worked out. The issues of citizens participation and social exclusion were one of the essential thematic area of URBACT city networks: Young Citizens Project, Partners 4 Action, MED-INT, CITIZ@MOVE, REGENERA , SECURCITY and Young People – from Exclusion to Inclusion. The paper refers to the experience of former programme editions (URBAN PP (pilot projects), URBAN I, URBAN II and URBACT I), concentrating on the examples of citizens participation in the local authorities activities which concerned the issues of shaping of city space. The few methods are described in details: le contract de quartier which was applied in Bruxell, the consultations to General Urban Distribution Plan - Cardedeu (Barcelona region, Spain), the citizens participation in General Plan of Urban Arrangement - Sewill, the Participatory Budget - Sewill, the rehabilitation of modernist housing estates – Rome, and planning workshops techniques: Planning for Real, Pattern Language, Action Planning. The conclusions include a list of the most popular participatory techniques used in the cities of PARTECIPANDO network.

In January 1994, the European Community and Australia signed the Agreement on Trade in Wine. Considering the dramatic changes in the international wine market, this strategy of policy coordination is hardly surprising. In the late 80s and early 90s the dynamic and highly competitive newcomers from countries like Australia and the USA have broken the domination of European producers for the first time. What is astonishing though is the fact that the arrangement was reached in the final phase of the Uruguay Round negotiations, three months before the signing of the Marrakech Agreement that regulated the trade of agricultural products. But neither Brussels nor Canberra settled for this first arrangement, and fourteen years later they signed another Wine Agreement. The article presents the results of analysis of the political debate and legal actions preceding the two Wine Agreements between the EC and Australia. The main focus is on the political and economic factors explaining the 1994 EC-Australia Agreement on Trade in Wine as well as the motivation for the update of this arrangement in 2008. The author argues that the agreement can be explained in terms of the interests of wine producers. The proposed explanation is based on Andrew Moravcsik’s theory of national preference formation.

The aim of the article is to analyze the impact of the Belt and Road Initiative on the integrity of the EU community. The research problem boils down to the following questions: Has this initiative contributed to increasing the influence of the PRC in Europe? How did the EU react to Chinese ideas? What was Italy’s reaction to Chinese proposals and declarations? The article uses the descriptive method and a case study. The first part of the article will focus on the analysis of the intensification of Chinese activity in Europe by demonstrating cases of buy-outs of Old Continet’s key companies by PRC enterprises. The Belt and Road initiative and Chinese projects will be then briefly described. Aiming to demonstrate the impact of the initiative “Belt and Road” on the EU was selected for detailed analysis of Italy due to the geographical location of the country, long-term cooperation within the framework of the European Union and the fact that Italy was the first member of the G7, who “joined” Initiative Belt and Road. In the last part, the author will try to determine whether China has influence on the process of disintegration of the EU.

The article deals with the concept of fiduciary activity of an attorney-at-law. The author analyzes foreign experience, in particular, the EU and the USA on fiduciary activity, and conducts a comparative legal analysis. The author examines the prospects for introducing such activities into national legislation on the advocacy. The author focuses on European legislation, in particular, the Common Code of Practice for Lawyers of the European Community. The author examines in detail the procedure for fiduciary activities in the EU and the USA, with special attention paid to the procedure for providing such activities by attorneys. The author emphasizes the advantages and disadvantages of fiduciary activities in foreign countries. The author examines the draft amendments to the national legislation on the Advocacy regarding the introduction of fiduciary activities. The author emphasizes that although the experience of foreign countries with regard to fiduciary activities is quite positive, one should not try to quickly and blindly implement European standards into national legislation, as this will take time. The author determines that a lawyer who manages client’s funds in the course of performing professional duties in the territory of one of the Community States must comply with the rules for managing client’s funds and maintaining financial records established by the competent authorities of the State of registration. The author of the article also establishes that the competent authorities of all Community countries have the right to control and confidentially examine the financial documents of an attorney-at-law on the client’s funds placed at his disposal in order to identify cases of violation of the rules to be observed by the attorney- at-law and to impose sanctions on him in case of the above violations. The advocate, who manages the client’s funds in the course of the performance of his or her professional duties in the territory of one of the Community states, shall comply with the rules for the management of client’s funds and the maintenance of financial records established by the competent authorities of the state of registration.

Proces adaptacji norm europejskich z zakresu konstrukcji aparatury przeciwwybuchowej zbiega się z wprowadzeniem do stosowania nowej dyrektywy Wspólnoty Europejskiej the ATEX Directive 94/9/EC, która jest dyrektywą nowego podejścia. W nowej dyrektywie sformułowane są zasady integralnego bezpieczeństwa przeciwwybuchowego. Dyrektywa stanowi podstawę do opracowania zharmonizowanych norm, których techniczne wymagania zapewnią zgodność z zasadniczymi wymaganiami dyrektywy.
Adaptation process of European Standards concerning construction of explosion-proof equipment coincides with introduction a new directive of the European Comminity - the ATEX Directive 94/9/EC, which is named as a New Approach directive. The new directive formulates the principles of integrated explosion-proof safety. The directive makes a base for elaboration of the harmonized standards. The technical requirement of the harmonized standards assure a persumtion of conformity to the essential requirements of a directive.

The European integration processes have had over the years many shapes, faces and, masks. European politicians noticed, as late as at the turn of 70s and 80s of 20th century that culture can signifi cantly influence the social life, economy, as well as international relations. At that time, however, they did not formulate any proposals of specific activity which could have lifted culture to supranational position, and the culture remained in the realm of national policies. In the early 80s, Ministers of Culture of the European countries, dissatisfied with cultural policy of the European Community, or rather lack of it, informally established intergovernmental Council of the Ministers. The council was announcing resolutions and recommendations for the European Commission, European Parliament, and European Council. The objective of this paper is analysis of the pioneering role of Ministers of Culture in integration processes at culture level. The research reveals that the intellectual and political work and influence of Ministers played a pivotal role in formulating the first paradigm of the Community’s cultural policy. They were also instrumental in creating fi rst programmes directed to culture and cultural operators in Europe.
