The main aim of the article is to confirm or disprove the hypothesis about the applicability of the methodology of analysis, which is used in the evaluation of EU projects, for economic analysis of law. According to the hypothesis, it is possible to use a methodology that considers a wide range of data. In addition to financial values, it considers human and social values. The methodology used in this way could help in assessing the impact of the regulations introduced. It’s would be an important tip for the legislator. The method of comparative law was used in the research.

Opis:
Raising the level of mobility for urban populations is of interest to the authorities of practically all major governments. Projects of European Union funding (2007–2013 and earlier) enabled the process of reclamation and regeneration of public transport as well as the necessary infrastructure to accelerate. Larger urban units such as provincial capitals faced even more difficult task – the integration of public transport in the metropolitan area.The paper aims to present three integrated projects implemented by the City of Białystok, in collaboration with its communication companies on public transport. The projects and their strategic relationships may be an example of long-term planning by financial means of different programming periods.

Purpose: Main objective of the study was to develop a map of impact of particular groups of stakeholders on the process of implementing projects co-financed by the European Union in public universities. Design/methodology/approach: The study uses methods of literature sources analysis and quantitative research with the use of questionnaire distributed among managers of EU projects implemented in public technical universities in the previous financial perspective. Findings: Based on conducted research, the impact of identified groups of stakeholders on the process of implementation of EU project was assessed. Research limitations/implications: Identification of the impact of groups of stakeholders on the process of implementation of EU project should enable necessary management actions to be taken at universities that increase their absorption capacity. Practical implications: Project implementation unit, in particular the team of contractors with the project leader at the forefront, by shaping positive relations with environment, may affect the pace and efficiency of project implementation. By acquiring support of main project stakeholders, likelihood of successful completion of the project is increased. This, in turn, reduces uncertainty and risk associated with implementation of the project and costs incurred to minimize it. Originality/value: Original map of the impact of individual stakeholder groups on implementing projects co-financed by the European Union in public universities.

The article contains theoretical considerations connected with the influence of structural funds on the development of non-profit organisations. Theoretically, the access to these funds should ensure development of these entities. However, as practice shows it is not always the case. We observe development dynamics of this sector and constantly unused social potential. These organisations are subject to continuous pressure directed towards full use of their resources and growth in effectiveness of activities undertaken. However, the pace of their development is mainly dependent on funds allocated for their development, therefore it seems legitimate to financially support activities of non-profit organisations from, inter alia, structural funds. These resources enable to earn experience which positively affects their development. However, the success of majority of non-profit organisations is not based on the structural funds. Managing persons are very careful during a process of acquiring, implementing and accounting for EU-supported projects. They think that this process is not always successful. The article draws attention to the fact that structural funds can be a key for development of non-profit organisations, yet provided that applying for financial support will not be accidental and will constitute an organised sequence of activities.

The main purpose of the study was to assess importance of the cost planning process in the procedure of applying and the practice of spending EU funds by state universities in Poland. In pursuit of this goal, the literature and EU guidelines were analysed, and a survey of EU project managers at state technical universities was additionally carried out. During the study, reference was made to issues such as determining resources needed to implement an EU project, ensuring financing for their own contribution and ineligible costs. The literature studies, the analysis of programming documents of the current financial perspective and the results of the survey, indicate the key role of cost planning in the effective acquisition and settlement of projects co-financed from EU funds. The expected reduction of EU funds for Poland under subsequent financial perspectives will result in further difficulties in obtaining funding. In order to increase the absorption capacity of EU funds, state universities should pay special attention to the cost planning process, providing project initiators with specialized support in budget construction and justification of planned costs.
Głównym celem opracowania była ocena ważności procesu planowania kosztów w procesie aplikowania i wydatkowania środków unijnych przez uczelnie publiczne w Polsce. Dążąc do jego realizacji, dokonano analizy literatury oraz wytycznych unijnych, przeprowadzono również badanie ankietowe wśród kierowników projektów unijnych zrealizowanych w publicznych uczelniach technicznych. W trakcie badania odniesiono się do takich kwestii, jak: określenie zasobów niezbędnych do realizacji projektu unijnego, zapewnienie finansowania wkładu własnego oraz kosztów niekwalifikowalnych. Przeprowadzone studia literaturowe, analizy dokumentów programowych obecnej perspektywy finansowej oraz wyniki badania ankietowego wskazują na kluczową rolę planowania kosztów w skutecznym pozyskiwaniu i rozliczaniu projektów dofinansowanych ze środków unijnych. Spodziewane zmniejszenie środków unijnych dla Polski w ramach kolejnych perspektyw finansowych spowoduje, że pozyskanie dofinasowania stanie się jeszcze trudniejsze. Uczelnie publiczne w celu zwiększenia zdolności absorpcyjnej środków unijnych powinny szczególną uwagę poświęcić procesowi planowania kosztów, zapewniając inicjatorom projektów specjalistyczne wsparcie w konstrukcji budżetu i uzasadnieniu zaplanowanych kosztów.

The implementation of infrastructural projects, funded from operational programs, is seen as an important factor in local development. The purpose of the article was to analyze the effects of ongoing changes in the municipalities adjacent to Krakow, influenced by the performance of their infrastructure projects. The funds have proven to be very important for investment decisions. Municipalities would not be able to achieve the expected benefits without the implementation of these infrastructure projects. However, there is not a strategic approach to the development of the entire suburban area of Krakow. Generated effects are rather the consequence of non-integrated treatment of municipalities of their development, rather than a deliberate and planned action.

In his article, the author discusses the system for the implementation and auditing of spending of European funds within the realisation of the Cohesion Policy in the 2014–2020 programming period, which stems from the regulations of the act on the rules for the realisation of Cohesion Policy programmes financed in the 2014−2020 financial perspective. The article takes into account the context of the EU regulations concerning the implementation of the Cohesion Policy in the following programming period. The new provisions are also discussed in relation to the differences with the present regulations on the system for the implementation and auditing of spending in the 2007−2013 financial perspective. In the first part of the article, the author focuses primarily on the analysis of the institutional system for the implementation of the EU funds, by presenting the responsibilities of individual institutions in the process of operational programmes realisation, and also by describing the designation procedure that is required for payment applications submitted to the European Commission.

In April 2017, a delegation from the Committee on Budgetary Control of the European Parliament inspected selected EU projects in Poland. Some 20 projects were examined in Wrocław, Wieluń, Bełchatów, Stryków, Warka and Warszawa, as well as some road investments. Since NIK conducts annually at least five audits directly dedicated to the management and spending of the EU funds, the Committee delegates had a meeting with the leaders of NIK so as to benefit from NIK’s expertise in EU funds utilisation in Poland.

Artykuł zawiera omówienie zagadnień związanych z zarządzaniem projektem, kierując uwagę na ujęcie procesowe projektów, obejmujące proces rozpoczęcia, planowania, wyboru wykonawcy, realizacji, kontroli i zakończenia. Przedstawiono też cechy charakteryzujące projekt oraz analizę wybranych zagadnień zarządzania w całym cyklu życia projektu. Zagadnienia te analizowano w odniesieniu do projektów unijnych, realizowanych w okresie transformacji w Polsce, które wskazują na zasadność uwzględnienia procesu wyboru realizatora projektu. Podkreślić przy tym należy, że wybór wykonawcy w drodze przetargu ma wpływ na system zarządzaniu projektem realizowanym przez wykonawcę, a zwłaszcza poprzez procesy monitorowania i kontroli oraz odbiór wyników wykonania.
The following article contains an overview of project management problems, focusing on the process approach to projects, including its initial stages, planning, selecting a contractor, its realization, control and finalization. The characteristics of the project and an analysis of selected aspects of project management throughout the period of its validity have been included as well. Those issues were realized with relation to the European Union projects realized throughout the period of Polish transformation, which indicate that the process of selecting contractors should be included in the project. It should be noted that the idea of selecting contractor of a project by way of tendering procedures has an impact on the system of managing a project realized by the contractor, especially through processes of monitoring and control of the results of a given project.
