In questo studio l’Autore ha centrato l’attenzione sull’analisi dettagliata delle situazioni contenute nel. can. 16 §§ 1–3 CIC, ovvero sulla questione dei soggetti ablitati a compiere l’interpretazione autentica a modo di legge e sugli effetti retroattivi o meno delle sue singole forme, nonchè sulla problematica della rilevanza dell’intrepretazione fatta a modo di senetenza giudiziale o di atto amministrativo. Dall’analisi condotta risulta che la forma specifica dell’interpretazione dipende soprattutto dal suo autore. In conformità ai principia fondamentali dell’ ordinamento canonico, l’interpretazione autentica compete esclusivamente al legislatore o a chi il legislatore l’ha delegata. In linea di massima tale interpretazione ha valore di legge. Invece l’interpretazione fatta a modo di senstenza giudiziale o di atto amministartivo non è ro- conosciuto come inrterpretazione autentica. Potrebbe avere tuttavia tale valore nel caso della deci- sione emessa dallo stesso legislatore.

The article discusses the issue of theological-moral basis of the ecclesiastical law. The analysis begins with a presentation of theology as an auxiliary source of the ecclesiastical law. Taking into consideration the sense and the meaning of the law in the Church, its starting point is its relation to the sources that shape the life of the Church as God’s people, that is to the teaching of the Church and about the Church with the theologically defined authority of the legislator. Hence, the law of the Church plays a secondary role and it cannot reach beyond the frames defined by theology in general and also specifically moral theology. It is exactly theological reflection that formulates the doctrine. The law of the Church is aimed at guaranteeing to this doctrine its right place and due respect in the life of the believers’ community. From the theological point of view, the law of the Church constitutes deeply moral reality and as such it assumes an obligatory character for the community of believers because at its bases stands the authority of the legislator, revealed law of God and natural law as well as the mission of the Church. The relationship between Church law and the moral obligation can be very close, when the law of the Church constitutes the direct transmission of God’s law into the life of believers. In other case this relationship can assume an indirect character, when the Church law is related to God’s law on the basis of the authority of legislator that derives from God’s appointment. The difference mentioned above plays an important role in the reflection concerning the obligatory character of the Church law. When this law appears to be a direct expression of God’s law it excludes any form of exemption. In the case of the law enacted by the ecclesiastical legislator the exceptions are allowed. The most frequent form of these exclusions are dispensation and epikeia.

The paper presents the concept of the internal forum in the framework of the Church law. First of all traces the birth of the concept of internal forum and the latest evolution in the legal canon law; particular attention is devoted to the developments of the Code of this institution. It goes on to analyze the skills and functioning of the court seised in the inner hole: the Tribunal of the Apostolic Penitentiary. 
Il contributo presenta la nozione di foro interno nell’ambito dell’ordinamento giuridico ecclesiale. Ripercorre anzitutto la nascita della nozione di foro interno e presenta la sua evoluzione giuridica nel diritto canonico; particolare attenzione è dedicata agli sviluppi codiciali di tale istituto. Si passa poi ad analizzare le competenze ed il funzionamento dell’organo giudiziale chiamato a giudicare nel foro interno: il Tribunale della Penitenzieria Apostolica.

Changes made over the centuries in ecclesiastical law are usually forced through the changing world, through cultural trends. A church living in a society is somewhat doomed to the review of its law and its updating. The critical point is the changing moral and social norms in societies that are very often against the norms of church law. Nevertheless, from the very beginning of the Churchʼs existence, he has the main goal: Salus animarum suprema lex, Jesus Christ is the only Savior of all mankind and the highest law is the salvation of man. The world is moving forward and changing its laws and the Church goes ahead without changing her main goal, but takes into account the existing conditions, hence we see changes in church law. Changes in church law, however, must be perceived as a response to the needs of time, but they are never changes that would in any way affect the implementation of the Church’s salvific mission.

Niniejszy artykuł przedstawia problem apostazji z punktu widzenia prawa kościelnego, ze szczególnym uwzględnieniem norm zawartych w Kodeksie Prawa Kanonicznego z 1983 r. Zjawisko apostazji stanowi nie tylko problem teoretyczny, lecz przede wszystkim duszpasterski. Przeprowadzona analiza ukazuje rozwój interpretacji tego zjawiska, zawarty w dokumentach Kościoła. W sposób szczególny wzięto pod uwagę dyspozycje zawarte w dokumencie Papieskiej Rady Tekstów Prawnych z 2006 r. oraz motu proprio Omnium in mentem Benedykta XVI z 2009 r., określające formę oraz skutki tego aktu. Ponadto dokonano analizy dokumentów wydanych przez Konferencję Episkopatu Polski. Szczególną uwagę zwrócono na skutki usunięcia odniesienia do aktu formalnego odłączenia się od Kościoła z treści kan. 1086 § 1, 1117 i 1124 oraz zmiany dokonane w samej procedurze składania oraz przyjmowania formalnego aktu wystąpienia z Kościoła.
The article presents problem of apostasy according to the Church law. The paper is especially focused on the rules from the 1983 Code of Canon Law. The apostasy implies pastoral problems. The research presents idea of apostasy and it’s evolution based on the Catholic Church documents. It takes into account contents and influence the latest documents: Pontifical Council for Legislative Texts (2006), motu proprio of Benedict XVI Omnium in mentem (2009) and the documents of Polish Bishops’ Conference. In this part of the article the special attention was paid on the effects of remove the reference to the formal act of apostasy from can. 1086 § 1, 1117 and 1124 and changes in procedure of submission and receive the formal act of apostasy.

The aim of the article is to present the beginnings and the subsequent development and evolution of church law in the sphere of education from the 4th to the beginning of the 16th century. The roots of the acts of law presented by the Popes, synods and councils were based on the traditions of Roman law, but a variety of reasons from the field of policy, economy and society led to the need to establish a church school system. The aim of the Church was to create an independent school system with its own purposes, different from civil schools. The article shows the main factors in the development of the legislation in the sphere of education and the functioning of the schools, and the relationship between civil and Church leaders. Another field of analysis is to search for the inspirations, aims and reception of the law in cathedral, collegiate, parish and monastic schools.

The paper is a kind of yet another reflection on the mystery of people offering themselves to God. By responding to the voice of vocation, they at the same time accept the condition which they are obliged to fulfil living as celibates. Celibacy has had a long and complex history. Its requirement was introduce at the Synod of Elvir, ca. 300-306. Principally, the paper discusses the following issues: 1. Introduction in which it is stressed that the subject matter of celibacy in the Latin Church is of topical importance and how celibates' life is pout in danger. It is noteworthy that the topic of celibacy is taken and discussed from many points of view. 2. Celibacy in the teaching of Vatican Council II at which celibacy was presented as a gift from God for those who sacrifice themselves to God in their service. The Priesthood summons to higher perfection, as the priest - by receiving the sacramental vows - resembles Christ the High Priest. The Council speaks about celibacy that the virtue of chastity is a sign and stimulus of pastoral love and a special source of spiritual fertility in the world. It is through virginity or celibacy that priests are sacrificed to Christ for new and exceptional reasons. Their heart is undivided with Him, and it is easier for them to sacrifice themselves in Him and through Him for the service to God and people. Thereby they are more effective in their service to His Kingdom and to the supernatural work of regeneration. Thus they become more suitable to accept the broader fatherhood in Christ and His mission. Initially, celibacy was recommended in the Latin Church by the law imposed on all who were to be ordained. The dogmatic Constitution of Vatican Council II Lumen Gentium, John Paul II's adhortation Pastores dabo vobis, the Bible, Paul VI's encyclical Sacerdotalis caelibatus, the Synod in Elvir and the Synod of 1971 were the main sources for this paper. The author used also various studies written by theologians and canonists. One should remark that celibacy does not result from the very sacramental priesthood, but is a charisma given to the Church by the power of the Holy Spirit. In his letter to the Priests in 1979, Pope John Paul II writes about three motivations on behalf of celibacy in the Church. They are as follows: theological, ecclesial, and anthropological. The point is to justify celibacy, that is a gift from God, and then that it is to be a source for human integral development, and, ultimately, that it is accepted by priests on behalf of a more fruitful service to the fellowship of the Church. Celibacy in the church is a treasure carried and held in earthen vessels. On the one hand we can see its power as it is given from God, and at the same it shows human weakness, for the man, because of his or her own weakness, never grows to this dignity of life to with God every day. One she understand it as a gift and attitude in giving oneself to God for the service the to brothers and sisters. One observes in the contemporary world and the Church a crisis in keeping to celibacy. The paper mentions it as well. 3. Another point is the historical outline of how celibacy for the clergy was introduced in the Church. 4. Another part of the paper deals with requirements of celibacy in the code projects and in the code of John Paul II. In canon law celibacy is a requirement taken by candidates to higher vows in the Catholic Church. This occurs at the moment diaconal vows, when the future deacons swear to live in celibacy to their bishop. There are references to code schemes from various versions of John Paul II's code, and, finally, the norms of John Paul II's Code have been discussed. They deal with the issue of celibacy in the life of priests and seminarians of the Latin Church. 5. Eventually, the paper lays stress on the need for an integral formation designed for candidates to celibacy. John Paul II in Pastores dabo vobis says that each candidate to the priesthood should feel like an indispensable and irreplaceable advocate of his appropriate formation to life in celibacy. The freedom of living in celibacy means that somebody has entrusted himself to the Holy Spirit and allowed Him to guide his own person in everyday life. The gift of celibacy is to be confirmed by the intimate unity of the alumnus with Christ.

From the point of view of the validity of the purely church law it is of crucial importance to define its personal range. One of the basic criterium is membership to the Catholic Church acquired by receiving baptism in the Church of by the formal act of joining a Christian non-Catholic to the full fellowship with the Catholic Church. Such acts of religious character produce also juridic effects in the form of, among other things, being included into a concrete rite and the church sui juris. The principles of that membership are included in the Code of the Canon Law of 1983 and in the Code of the Canons of the Eastern Churches of 1990. The norms in both codification define the principles in which to acquired membership in relation to various categories of persons, e.g. children to age 14. people above 14; children born to Catholic parents and mixed marriages, and also children of non-baptized persons. The principles which are currently binding continue the legislation of the popes in previous centuries.

W artykule ukazano możliwości zastosowania regulacji Kodeksu Prawa Kanonicznego z 1983 r. w systemie prawnym Ukrainy. Przedstawiono rys historyczny kształtowania się struktur Kościoła łacińskiego od uzyskania niepodległości przez Ukrainę w 1991 r. oraz ich obecny stan. Następnie ukazano kanoniczny status struktur Kościoła łacińskiego na Ukrainie oraz przeanalizowano prawny sposób istnienia i działania tychże struktur w ukraińskim porządku prawnym. Podkreślono, że wadą w systemie prawnym Ukrainy jest nieuznawanie osobowości prawnej Kościoła wynikającej z jego natury. Zasugerowano, że podpisanie konkordatu ze Stolicą Apostolską pozwoli uniknąć zbytecznych i karkołomnych sformułowań w statutach organizacji religijnych, aby te mogły cieszyć się uznaniem osobowości prawnej w ukraińskim ustawodawstwie zachowując swój prawno-kanoniczny status.
The article presents the possibilities of applying the provisions of the 1983 Code of Canon Law in the legal system of Ukraine. A historical outline of the shaping of the structures of the Latin Church from the achievement of independence by Ukraine in 1991 and their current state is presented. Then the canonical status of structures of the Latin Church in Ukraine was shown and the legal way of existence and creation of these structures in the Ukrainian legal order was analyzed. It was emphasized that the disadvantage in the legal system of Ukraine is the failure to recognize the legal personality of the Church resulting from its nature. It was suggested that signing the concordat with the Holy See would avoid unnecessary and dreadful wording in the statutes of religious organizations, so that they could enjoy the recognition of legal personality in Ukrainian legislation while maintaining their legal and canonical status.

In Western Europe the Church as an institution was integrated into the military system and was obliged to serve the monarchy. Apart from performing vassal duties, the Latin clergy frequently participated in military actions. Although the Church laws forbade clergymen to shed blood, there were many examples of the violation of this rule. The attitude of the Orthodox Church in the Byzantine Empire concerning the possible participation of the clergy in war differed significantly from that of Latin Europe. The Byzantine priesthood did not become involved in military actions. The Greek Church possessed neither military units nor vassal commitment to the Empire. Despite a very close relationship with the Byzantine Church the attitude of the Georgian Church to the issue differs from that of Byzantium and is closer to the Western practice. The feudal organization of Georgia conditioned the social structure of the Georgian Church and its obligations before the monarchy. Despite the fact that the Georgian Church enjoyed many advantages, it had to take part in military campaigns. The upper circles of Georgian Church dignitaries were accustomed to both conducting military campaigns or taking part in the combat. In regard to military activities of clergy, Georgian law was much more lenient than Byzantine, and in the case of necessity, it even modified Greek legal norms. The conflict with the Christian canons was decided in favor of military necessity, and it was reflected in the legislation.
