Presidential clemency is also the least appreciated and most misunderstood of presidential powers – the Constitutionplaces no limits on the way the President exercises his power to pardon,except in cases of impeachment.The article gives a historical overview of the power of clemency in theU.S. Constitution. It also examines the evolution of the Supreme Court’sviews on clemency over the years, both substantively and procedurally,and how the Court has interpreted the power to grant pardons, conditional pardons, as well as amnesties, commutations of sentence, remissions of fines and forfeitures, and respites. It discusses the procedurefor clemency, including the role of the Pardon Attorney, and concludeswith a proposal of certain reforms to reinvigorate the federal pardonprocess and restore its moral force.

    Opis:
    The study deals with the procedure and practice of granting pardons by the President of Republic of Poland Bolesław Bierut to persons convicted ty mortial courts. Analyzed have been the years 1947–1952, that is President Bierut’s term in office. Before, in the years 1944–1947, he was President of the National People’s Council, and afterwards, from 1952 till his death in 1956 – President of the Council of State. The 1947–1952 period has been selected for analysis not only for the above formal reason of President Bierut’s term in office. Bierut had the powers to grant pardons also as President of the National People’s Council (1944–1947) and, later on, as President of the Council of State (1952–1956). Thus the years 1947–1952 have been chosen for substantive reasons, too, as they were the period of particularly intense penal repression applied by courts mortial in Poland. It was directed chiefly against political opponents – real and alleged alike – of the new regime. Finally, the archival resources of the Civil Chancellery of President of Republic of Poland, kept in the Archives of New Files in Warsaw, make it possible in principle to fully reconstruct the procedure and practice of granting pardons. In the years 1947–1952, while holding the office of President of Republic of Poland, Bolesław Bierut was also leader (lst Secretary) of the ruling Colmmunist Party: first the Polish Workers’ Party and then, from December 1948 on, Polish United Workers’ Party. The author discusses the particularly repressive nature of law as applied by courts mortial to which also common courts reported. He also points out that the law was infringed quite freely by the investigating agencies, public prosecutors, and finally by courts mortial. Severe penalties were therefore imposed not only on the real but also on alleged opponents of the new regime. The investigating and prosecuting agencies concocted criminal cases of persons who were innocent under the law, and the courts sentenced those persons. This way, the Polish administration of justice was involved in political struggle. Its ideological justification was provided by Joseph Stalin’s theory of intensification of class struggle with progressing building of so-called “socialism” which found it legal expression in a theory, formulated by a Soviet politician and lawyer Andrei Vishinsky, on the defendant’s admission of guilt (forced by torture, of course) as the crown evidence in judicial proceedings. The author stresses that in his capacity as leader of the ruling Party and at the same time Head  of State, Bolesław Bierut actually initiated many political trials based on faked investigation and often leading to the defendant being sentenced to death by a court mortial. According to the statutory procedure, such defendants then petitioned President Bierut for pardon which means that the case actually made a full circle. The author states that the middle level agencies of administration of justice notified the leaders of the ruling Party of glaring breaches of the law but the information never met with any response. The author points to numerous formal defects in the application of the pardon procedure; for example, some decisions refusing pardon do not even bear the President’s signature. The petitions, filed by the convicted person or his family or examined ex officio were in most cases accompanied by a negative opinion of the Supreme Military Court and Chief Military Prosecutor’s Office. There were cases in which a person sentenced to death in summary proceedings was actually executed without the obligatory pardon procedure. In one case, pardon was probably refused after the actual execution. The opposite also happened: convicted persons were not executed despite the fact that pardon had been refused to them. The reason was that they were needed in other penal proceedings. The duration of pardon proceedings – of special importance in the case of death sentences – was not regulated by law and ranged from three days to three months. The author analyzes petitions for pardon filed by persons convicted by courts mortial. There were the total of 2,591 such petitions, including 1,813 (about 70%) filed by persons sentenced to capital punishment. The President of Republic of Poland pardoned 589 persons or 32% of all those sentenced to death. There were among them both common criminals and political offenders. It is most difficult to guess the motives of the President (or his closest associates) which guided his decisions on pardon. In some cases, he simply followed the opinion of persons with whom he reckoned. The President’s discretion – the essence of the right of pardon – can be supposed to have played the smallest part. The procedure and practice of the exercise by President of Republic of Poland of his right of pardon was among the elements of the practice of lawbreaking in Poland in the years 1947–1952.

    Artykuł podejmuje problematykę pojęcia, zakresu oraz ustrojowego charakteru prawa łaski i amnestii w korelacji z instytucją ekstradycji. Prezentuje rozbieżne stanowiska przedstawicieli doktryny w zakresie interpretacji charakteru tytułowych środków oraz możliwe sposoby ujmowania statusu osoby, którą objęto ułaskawieniem lub amnestią, a jednocześnie której dotyczy wniosek o wydanie, przez reprezentatywne umowy międzynarodowe regulujące obrót ekstradycyjny. Celem artykułu jest analiza prawnych uwarunkowań ułaskawienia i amnestii w zestawieniu z wiążącymi normami w zakresie ekstradycji, zarówno tych które kwalifikują przeszkodę ułaskawienia i amnestii jako obligatoryjną przeszkodę ekstradycyjną, jak i tych które nie nadają jej wskazanego charakteru. W ramach pracy zastosowano tradycyjnie wykorzystywane w naukach prawnych metody badawcze, a mianowicie metodę formalno-dogmatyczną, metodę komparatystyczną oraz metodę historyczno-prawną.
    The article addresses the issue of the concept, scope and systemic character of pardon and amnesty in correlation with the institution of extradition. It presents the divergent positions of the doctrine regarding the interpretation of the nature of the title measures and possible ways of recognizing the status of a person who has been pardoned or amnestied, and at the same time the request for extradition applies, by international agreements regulating extradition transactions. The aim of the article is to analyze the legal conditions of pardon and amnesty in comparison with binding standards in the field of extradition, both those that qualify the impediment to pardon and amnesty as an obligatory extradition impediment, and those that do not give it the indicated character. As part of the work, research methods traditionally applied in legal sciences were used, the formal-dogmatic method, the comparative method and the historical-legal method.

    The article shows how the law of pardon was regulated and how it was applied in two quasi-states, the Duchy of Warsaw (1807–1813) and the Congress Poland (1815–1831) during the constitutional period. These two entities were dependent on France and Russia respectively, which was not irrelevant to the regulations on pardon, since those powers were closely related to monarchs. Both the Polish king (prince of Warsaw) and the Russian emperor (tsar) in the context of the prerogative of the law of pardon have had a profound influence on the course and outcome of individual judicial proceedings so issues of abolition, amnesty and abolition of a punishment are also raised in the article. At the end, the elements of pardons operating in the territories of the three states that made partitions of the Republic of Poland are mentioned.
    Artykuł przedstawia sposób uregulowania prawa łaski i praktykę jego stosowania w dwóch tworach quasi-państwowych: Księstwie Warszawskim (1807–1813) oraz w okresie konstytucyjnym Królestwa Kongresowego (1815–1831). Oba te podmioty były zależne odpowiednio od Francji i Rosji, co nie pozostawało bez znaczenia dla uregulowań dotyczących ułaskawienia, gdyż kompetencje te były ściśle związane z osobami monarchów. Zarówno król polski (książę warszawski), jak i cesarz (car) rosyjski w ramach prerogatywy prawa łaski uzyskali ogromny wpływ na przebieg i wynik indywidualnych procesów sądowych, artykuł podejmuje więc również kwestie abolicji, amnestii oraz zatarcia skazania. Na końcu wspomniane zostają elementy ułaskawienia funkcjonujące na obszarach trzech państw zaborczych.

    A statistical report of 1906 evaluated the place of death sentences in the judicial system, with the main purpose of supporting the bill of abolition of the death penalty (finally rejected). This report showed the negligible role of the capital punishment in the penal repression – as if the guillotine had already fallen into abeyance. According to the Penal Code of 1810, aggravated murders (premeditated murders, murders accompanied by another crime, murders of a public officer), parricides, poisonings, arsons of houses, as well as complicity in and attempt of such crimes, were all punishable by the guillotine. However, a large implementation of the principle of mitigating circumstances allowed to avoid the enforcement of death penalty. Moreover, two thirds of the people sentenced to death were pardoned, often with the support of the juries. The substitute penalty was a perpetual imprisonment, but this “perpetuity” became shorter and shorter after 1945.

    Niniejszy artykuł stanowi krótką charakterystykę prezydenckiego prawa łaski, jego zakresu przedmiotowego i podmiotowego oraz przede wszystkim próbę spojrzenia na tę instytucję z perspektywy osoby nim objętej i rzeczywistych skutków, jakie dla niej wywołuje. Z uwagi na aktualne orzecznictwo Trybunału Konstytucyjnego sytuację beneficjenta aktu łaski rozpatrywano z założeniem funkcjonowania abolicji indywidualnej w polskim porządku prawnym. W konsekwencji dokonano podziału prawa łaski na ułaskawienie – stosowane wobec osoby skazanej prawomocnym wyrokiem sądu oraz abolicję indywidualną – stosowaną zanim doszło do prawomocnego skazania. Następnie przeprowadzono analizę zarówno statusu prawnego osoby objętej prezydencką abolicją, jak i osoby objętej ułaskawieniem.
    This article is a short description of the presidential pardon law, its objective and subjective scope and, above all, an attempt to look at this institution from the perspective of the person covered by it and the real effects it causes for them. Due to the current case-law of the Constitutional Tribunal, the situation of the pardon’s beneficiary was considered with the assumption that amnesty granted in individual cases would function in the Polish legal order. As a consequence, the right of clemency was divided into pardon applicable to a person convicted by a final court judgment and amnesty granted in individual cases used before a final conviction was made. Next, an analysis was carried out of both the legal status of the person covered by the presidential amnesty and of the person covered by the pardon.

    The article presents resolutions and rulings of the Supreme Court Criminal Chamber adopted as a result of deciding prejudicial issues requiring fundamental interpretation of statutes, raising doubts concerning the interpretation of the provisions which are grounds for a judgment issued or which raised discrepancies in their interpretation. These concern: admissibility of a complaint about a court’s ruling on lack of competence (Article 35 § 3 CPC); the requirements for appeal courts for asking the Supreme Court prejudicial questions concerning issues that need fundamental interpretation of a statute (Article 441 § 1 CPC); the scope of the power of pardon (Article 139 Constitution of the Republic of Poland and Article 560 CPC) and the scope of application of the Criminal Procedure Code in disciplinary proceedings against attorneys-at-law (Article 741 para. 1 Act on attorneys-at-law). Assessing the opinions expressed in those judgments, the author reviews statements made on those issues in the legal doctrine and judicature and adds his own thoughts to the quoted arguments.
    Przedmiotem artykułu są uchwały i postanowienia Izby Karnej Sądu Najwyższego, podjęte w wyniku przedstawienia do rozstrzygnięcia zagadnień prawnych wymagających zasadniczej wykładni ustawy, budzących wątpliwości co do wykładni przepisów prawa będących podstawą wydanego rozstrzygnięcia lub które wywołały rozbieżności w ich wykładni. Dotyczyły one: dopuszczalności zażalenia na postanowienie sądu stwierdzające niewłaściwość (art. 35 § 3 k.p.k.); przesłanek występowania do Sądu Najwyższego przez sądy odwoławcze o rozstrzygnięcie zagadnień prawnych wymagających zasadniczej wykładni ustawy (art. 441 § 1 k.p.k.); zakresu prawa łaski (art. 139 Konstytucji RP i 560 k.p.k.) i zakresu stosowania kodeksu postępowania karnego w postępowaniu dyscyplinarnym radców prawnych (art. 741 pkt 1 ustawy o radcach prawnych). Autor, oceniając wyrażone w tych orzeczeniach poglądy, dokonał przeglądu wypowiedzi na te tematy w doktrynie i judykaturze, a przytoczoną argumentację wzbogacił własnymi przemyśleniami.

    Opis:
    Celem opracowania jest analiza trzech postawionych problemów badawczych. Pierwszy problem badawczy dotyczy zakresu przedmiotowego pojęcia „postępowania po uprawomocnieniu się orzeczenia” w kontekście postępowań następczych oraz ich założeń konstrukcyjnych w celu odpowiedzi na pytanie dotyczące adekwatności uregulowania instytucji wyroku łącznego w systematyce kodeksowej. Drugi ogniskuje się wokół próby zrekonstruowania kryteriów, jakimi kierował się ustawodawca wprowadzając do polskiego porządku prawnego procedury stanowiące odstępstwo od zasady niepodważalności prawomocnych orzeczeń sądowych. Trzeci stanowi zaś poszukiwanie ratio legis wprowadzenia instytucji wyroku łącznego do ustawy karnoprocesowej. Na zakończenie formułowano postulaty de lege ferenda.
    The focus of this study is on three problems. The first area of concern is the substantive scope of the concept of “proceedings following a final court decision” as a type of follow-up proceedings, as well as with their underlying interpretative framework, with a view to assessing the adequacy of legislation governing aggregate sentence. The second area of concern is to reconstruct the criteria that the legislature relied on when introducing into the Polish legal system procedures derogating from the principle of incontestability of final court decisions. The third problem relates to the rationale of applying the institution of aggregate sentencing to penal litigation. The paper closes with a number of de lege ferenda postulates.
