    In the correspondence between the governor of Bithynia-Pontus and emperor Trajan in the years 111–113 one can find an exchange on whether to allow a buried body to be exhumed and transported to be buried in a different place. Pliny, who was familiar with Roman practices in this respect, turned to the emperor seeking advice on what policy he should adopt with regard to the inhabitants of the province. The emperor’s answer upheld the common practice that it was possible to move a body to a different burial site only when there was a strong reason for doing so (especially when the tombs were being violated or otherwise under threat). Trajan’s judgement influenced the decisions by subsequent rulers who took their stance in this matter.
    W korespondencji pomiędzy namiestnikiem Bitynii i Pontu w latach 111–113 n.e. oraz cesarzem Trajanem znalazł się wątek związany z dopuszczalnością ekshumacji oraz przenosin zwłok do innego miejsca pochówku. Pliniusz, który był zaznajomiony z rzymskimi praktykami w tym zakresie, zwrócił się do cesarza z prośbą o radę, jaki model postępowania ma przyjąć odnośnie do mieszkańców prowincji. Odpowiedź władcy utrzymała w mocy dotychczasową praktykę polegającą na dopuszczalności przeniesienia zwłok w inne miejsce jedynie wówczas, kiedy istniała po temu słuszna przyczyna (zwłaszcza, kiedy groby były zdewastowane lub zagrożone). Rozstrzygnięcie Trajana wpłynęło na decyzje kolejnych władców zabierających głos w tej sprawie.

    On April 19th, 2009 Pope Benedict XVI erected the Pontifical University. The next vital step was to introduce the university, that is, both the fact of its existence and its activity, into Polish law.The required procedure was held in both chambers of the Polish Parliament in cooperation with the Polish Government. The special financial law was enacted by the Sejm (380 members of the chamber were in favor, 412 were voting), and by the Senat (86 members of the chamber were in favor, 87 were voting).The law in question recognized the decision of the Pope and introduced the name of the academic institution, which is the Pontifical University of John Paul II in Cracow, into Polish law system and granted the university funds from the public finance according to the same rules, which apply to the public universities in Poland.

    The article describes the issue of the relationship between the Catholic Church’s judicial system and the national law enforcement authorities and judiciary powers after 6 December 2019, when Pope Francis lifted the so-called “pontifical secrecy” concerning canon criminal cases of clerics accused of sexually abusing minors. After a brief outline of the regulations re- ferring to the institution of secrecy in the canonical legal order and arguments justifying the need to keep it, the author presents certain provisions on pontifical secrecy and the conse- quences of lifting it for the relationship between the state and the Church’s system of justice.

    Ecclesiastical law interpretation has significant meaning in law application. The most important function of the Pontifical Council for Legislative Texts is an authentic interpretation. The Author explains what the interpretation and authentic interpretation is. According to the can. 16 § 1, the legislator authentically interprets laws as does the one to whom the same legislator has entrusted this power. The Pontifical Council for Legislative Texts is competent to public authentic interpretations confirmed by pontifical authority. Activity of the Pontifical Council for Legislative Texts means how dynamic canon law is. On the other side, this Pontifical Council activity is indispensable due to the technological progression.

    The crowning achievement of the development of the Ponti cal University of John Paul II and especially the Institute of Canon Law was erection on March 19th, 2014 by the Apos- tolic See the Faculty of Canon Law. The faculty in question is an academic community to which belong: the authorities of the Faculty, the academic teachers, and, of course, the students. The main aim of the institution is caring out the scienti c research in the eld of canon law, graduation of the students and granting them the degrees in canon law, and preparation the stu for the work in the diocesan tribunals or other church institutions.
    Ukoronowaniem rozwoju Uniwersytetu Jana Pawła II w Krakowie, a szczególnie Instytutu Prawa Kanonicznego, było erygowanie dnia 19 marca 2014 roku przez stolicę Apostolską Wydziału Prawa Kanonicznego. Wydział, o którym mowa, jest wspólnotą akademicką, do której należą: władze Wydziału, nauczyciele akademiccy, i oczywiście studenci. Główny cel tej instytucji to troska o naukowy rozwój na polu prawa kanonicznego, promowanie studentów i nadawanie im stopni i tytułów naukowych z prawa kanonicznego, a także przygotowanie personelu do pracy w sądach diecezjalnych lub innych kościelnych in- stytucjach.

    Legislation is an art. It requires a vast knowledge of the principles of law and also of the technique of legal drafting. Due to the special importance of law in the Church, a church lawgiver must try hard to do his job duly. Any critique of the outcome of his activity should be seen as an expression of sincere care for the Church. In the perspective of law drafting techniques, the paper offers an analysis of the new statute of the Pontifical University of John Paul II in Kraków, that went into force on June 8th 2015. The general conclusion is that the statue in question was made without much respect for rules of the good legislation and should be amended soon.
    Prawodawstwo jest sztuką. Wymaga ona ogromnej wiedzy na temat zasady prawa, ale także znajomości techniki redagowania aktów prawnych. Ze względu na szczególne znaczenie prawa w Kościele, każdy prawodawca kościelny musi dołożyć wszelkich starań, aby należycie wykonywać swoją pracę. Krytyka wyników jego działalności powinna być zawsze postrzegana jako wyraz szczerej troski o Kościół. W perspektywie technik legislacyjnych w niniejszym artykule przedstawiono analizę nowego statutu Uniwersytetu Papieskiego Jana Pawła II w Krakowie, który wszedł w życie 8 czerwca 2015 roku. Ogólny wniosek z rozważań jest taki, że statut, o którym mowa, został napisany bez większego poszanowania zasad dobrego prawodawstwa i powinien zostać wkrótce zmieniony.

    Foundation of the Pontifical University of John Paul II on 19 June 2009 required a new statute. It was adopted by the university senate on 23 February 2009 and handed over to Cardinal Zenon Grocholewski, the prefect of the Congregation for Catholic Education, on 26 May 2009. After entering the observations of the congregation by the Pontifical University of John Paul II in Cracow, it was approved by the congregation on 2 May 2010. The statute regulates the activity of the entire academic community and its individual faculties. It emphasizes evangelisation tasks of the university, its independence and autonomy to the civil authorities and compatibility of the canonical norms and the regulations of state for the universities.

    This work is a conference in the Institutum Utriusque Iuris of the Pontical Lateran University that want to consider the report of Canon law and Laws of religions in the academic and scientic viewpoint. In this perspective, I focused upon the tradition of Pontical Lateran University about Laws of religions studies and the important “message” of Novo Codice Decree in order to a new “academic statute” of the Laws of religions stu- dies, in relation to Canon law, in our multicultural societies of the third millennium. 
    Il presente contributo, frutto della conferenza tenuta in occasione della 8° Giornata Canonistica Interdisciplinare, Diritto canonico tra fondamenti e prassi (a 10 anni da: “Novo Codice”), Pontificia Università Lateranense (Città del Vaticano, 5 marzo 2013), prende in esame il rapporto fra il diritto canonico e i diritti delle altre religioni. La prospettiva da cui partire è senz’altro la tradizione dell’Institutum Utriusque Iuris della Pontificia Università Lateranense circa lo studio del diritto delle religioni, aggiornata sulla base del Decreto Novo Codice di riforma degli studi canonistici, in relazione alle società multiculturali del terzo millennio.

    The development of the Ponti cal University of John Paul II in Krakow requires a change in law that regulates the church university. The Apostolic See approved a new statute of the school in question in 2015. The new law is based on the Apostolic Constitution Sapientia christiana and puts an emphasis on the following ideas: church and evangelizing characteristics of the school. The law also underlines autonomy of the University towards Polish state and, at the same time, it declares the openness of the school for multidimensional cooperation with the state.
    Rozwój Uniwersytetu Papieskiego Jana Pawła II w Krakowie wymaga zmian w akcie prawnym, który dotyczy tego kościelnego uniwersytetu. Stolica Apostolska zaaprobowała nowy statut tej uczelni w 2015 roku. Nowe prawo oparto na konstytucji apostolskiej Sapientia christiana. Kładzie ono nacisk na kościelny i ewangelizacyjny charakter uczelni. Nowy statut podkreśla także autonomię uniwersytetu względem państwa polskiego, a jednocześnie deklaruje otwartość uczelni na wielowymiarową współpracę z państwem.
