Elementy konstrukcyjne w trakcie wieloletniej eksploatacji są narażone na różne uszkodzenia, prowadzące w sytuacjach ekstremalnych do awarii, a nawet katastrof budowlanych. Szczególnie niebezpieczne są pęknięcia lub nieciągłości struktury materiałowej, diagnozowane w konstrukcjach metalowych, które charakteryzują się wysoką wrażliwością na tego typu defekty. Lokalne koncentracje naprężeń, do których dochodzi w otoczeniu wierzchołków pęknięć, inicjują ich rozwój, co może prowadzić do globalnej redukcji nośności danego elementu, a czasami nawet całego ustroju nośnego. W sytuacji stwierdzenia tego typu uszkodzeń niezbędne jest wykonanie ekspertyzy technicznej obejmującej analizę nośności i bezpieczeństwa pracy konstrukcji.
Over the course of many years of use, structural components are exposed to various types of damage, which in extreme situations may result in accidents or even catastrophic failure. Cracks or discontinuities in the material structure that can be diagnosed in metallic structures, which are highly susceptible to this type of defect, are particularly dangerous. Local stress concentrations around the top of fractures trigger their development, and may result in a global reduction in the load capacity of a given element—sometimes even the entire superstructure. When this type of damage is confirmed, it becomes necessary to perform a technical evaluation that includes analysis of structural load capacity and safety.

This article presents a brief analysis of the Regulation (EU) 2015/2283 of the European Parliament and of the Council of 25 November 2015 on novel foods. The aim of this analysis is to understand how the objective of free movement of foodstuffs in the EU and the objective of public health protection are achieved within this Regulation. In this context, it is important to establish how the European legislation provides for the safety of novel foods. Also, the analysis of the preliminary rulings of the Court of Justice of the European Union is crucial to understand what are the main issues of European legislation related to novel foods.

According to the author, creating the possibility of selling real estate by means of an electronic auction should be considered advisable and the direction of the adopted solutions should be generally assessed positively. Some of the proposed solutions need to be clarified or re-examined. Accepting the necessity of holding “remote” hearings and public sessions in a “distant” form, particularly during the state of epidemic danger or the state of epidemics, seems to be a correct solution. On the other hand the proposed regulations regarding the possibility of holding a closed hearing, are questionable. Changes concerning the possibility of communicating with the court by electronic means should, in principle, be considered desirable. This study concerns visual assessment of the degree of damage done to Pinus sylvestris L. wood blocks by Reticulitermes lucifugus Rossi, in an experiment conducted according to ASTM D 3345-08:2017. The six evaluators made their assessments individually. The differing results obtained from the evaluators are a cause for concern. Visual assessment of the degree of wood damage can vary significantly from person to person. Measurement of weight loss seems to be a better way of evaluating the degree of damage done to wood samples by termites in laboratory tests.

In the context of the presented bill there is a conflict of two socially and legally significant values. One of them is the rapidity of proceedings before the Supreme Court, while the other one is the need to ensure protection of the rights and interests of entities submitting cassation complaint, in case such rights and interests have been violated as a result of the appealed decision. The abolition of the institution of a pre-trial and the transfer of all cassation appeals to the substantive recognition by the Supreme Court will cause a significant increase in the number of pending civil cases and will also extend the average duration of proceedings before the Supreme Court. In order to implement the proposed regulations, the possibility of increasing the number of judges or judicial assistants in the Civil Chamber and the Chamber of Labor and Social Insurance should be considered.

One of the natural stages of development of the enterprise is the desire to expand its business abroad. Globalization, global trade integration, technology development, the emergence of political, economic, customs unions, the existence of international courts of arbitration, the emergence of elements of world culture and other factors reduce the barriers between potential investors and countries to internationalization. This phenomenon has a positive impact on the decisions of companies in different parts of the world about the expansion abroad. The main goal of a foreign investor who plans to internationalize is making the most optimal choice of a foreign market where prevailing realities on business environment will enable the achievement of competitive advantage. Because of this, before internationalization, foreign investors should evaluate the investment attractiveness of all potential directions of internationalization in order to be able to realistically assess their own capabilities in these markets and assess all the risks and opportunities that may arise during the operation. The quality of the analysis which assess the level of investment attractiveness of potential directions has a large impact on the success of the company abroad. The article presents the procedure of comparative analysis taking as an example former USSR countries at the macro level.

Opis:
Designing objective and subjective methods of studying the abilities of disabled people is one of the most important things to be done before employing them. That is why new assessment methods are proposed. Evaluation as a testing procedure used for defining the abilities of disabled people - general capacity, range, and strength of the main groups of muscles and extremities, psychological tests, and many others—were developed by an interdisciplinary team. In total, 48 testing procedures, including physiological, psychological, and biomechanical ones, were prepared. We also propose another subjective assessment method because it is also very important to know what an individual person with disability needs, wants to do, or what kind of job he or she prefers. The subjective evaluation of abilities, possibilities, and needs might be done by using a questionnaire. These testing procedures offer a chance to use the same methods in all diagnostic centres so the criteria of health and work ability will be the same and easily comparable. Using the same tests for assessment will be helpful in observing the results and progress of medical, social, and vocational rehabilitation, too.

Zgodnie z art. 9 ust. 2 rozporządzenia Prezydenta Rzeczypospolitej z dnia 22 marca 1928 r. o postępowaniu administracyjnym osoby posiadające interes prawny w danej sprawie były upoważnione do uczestniczenia jako strona, zarówno w postępowaniu administracyjnym wszczynanym na jej żądanie, jak i przez organy władzy z urzędu. Zasadniczym i ciągle nierozstrzygniętym pytaniem, towarzyszącym tej konstrukcji prawnej, jest wskazanie, kto w istocie ma uprawnienie do dokonania wiążącej prawnie oceny, czy wskazywany przez stronę interes prawny istnieje, a w konsekwencji, kto decyduje o jej dopuszczeniu do postępowania. Zagadnienie to zostało przeniesione na grunt ustawy z dnia 29 sierpnia 1997 r. – Ordynacja podatkowa wraz z implementowaniem omawianego rozwiązania prawnego, bez wzięcia pod uwagę specyfiki prawnej postępowania wymiarowego, w szczególności procedury samowymiaru zobowiązań podatkowych, do postępowania podatkowego. Ponadto, zgodnie z systemem ontologicznym zaprezentowanym przez Romana Ingardena w dziele Spór o istnienie świata, przedmiot, jakim jest wszczęcie postępowania podatkowego stanowi zdarzenie, a nie przedmiot trwający w czasie, proces, przedmiot intencjonalny czy ideę. Proceduralne prawo podatkowe nie rozróżnia i nie nazywa właściwie różnych form przedmiotowych, co powoduje poważne problemy na płaszczyźnie wykładni prawa. Celem niniejszego artykułu jest wskazanie kilku podstawowych prawnych i filozoficznych kierunków rekonstrukcji instytucji wszczęcia postępowania podatkowego.
Pursuant to article 9 clause 2 of Ordinance of the President of the Republic of Poland on Administrative Procedure of 1928, persons which possessed so-called legal interest in the case, were entitled to participate in the administrative procedure as a party. Both in procedure initiated by the authority ex officio and initiated on their own demand. The essential and still unsettled question of this construction is: who is authorised by the law to establish the existence of that legal interest, and consequently who decides on the admission of the applicant to the proceeding. This issue has been transferred to the Tax Code of 1997 with the implementation of that scheme, without taking into consideration the legal specificity of the tax assessment, especially self-assessment, to the tax procedure. Furthemore, pursuant to the ontological system, presented by Roman Ingarden in his work Controversy over the Existence of the World, an object which is the initiation of the procedure is an event, not a thing, processes, purely intentional object or an idea. Tax procedural law does not distinguish and name various types of objects properly, which causes serious problems as to legal interpretation. The aim of this work is to give some basic legal and philosophical directions for the reconstruction of the institution of the tax procedure initiation.

The paper presents a commercial potential method to be used for the assessment of technical innovations. The method is an element of the evaluation system in the "Innovative Systems of Technical Support for Sustainable Development of Economy" Strategic Research Programme. The tool developed aims at the support of the management processes in the area of technical innovations. The commercial potential method can be used at all stages of the innovation development process, i.e. the concept stage, the development stage, and the final product stage, but also some years after the development of the solution. The use of the commercial potential method can contribute to the improved efficiency and effectiveness of the innovation implementation process.
W artykule zaprezentowano metodę oceny potencjału komercyjnego innowacyjnych rozwiązań technicznych, stanowiącą element systemu ewaluacji Programu Strategicznego pn. "Innowacyjne systemy wspomagania technicznego zrównoważonego rozwoju gospodarki". Opracowane narzędzie wspomaga procesy zarządzania w odniesieniu do innowacji technicznych. Metoda oceny potencjału komercyjnego może być wykorzystana na wszystkich etapach powstawania innowacji, tj. na etapie koncepcji, w trakcie opracowania rozwiązania, w momencie uzyskania gotowego produktu, ale również w kilkuletnim okresie po zakończeniu prac nad rozwiązaniem. Wykorzystanie metody oceny potencjału komercyjnego może przyczynić się do wzrostu innowacyjności i konkurencyjności gospodarki poprzez zwiększenie efektywności i skuteczności wdrożenia rozwiązań innowacyjnych do gospodarki.

This paper discusses the problem of atmosphere composition assessment related to entrance and inspection of a vessel cargo tank after washing, gas-freeing and ventilation. A correct assessment of the atmosphere before an entrance into the cargo tank or other enclosed spaces is a basic condition for the possibility of safe crew working. An assessment of the flammability hazard, presence of toxic or dangerous gases for human, and the oxygen concentration should be completed. In this regard, the ship-owner should prepare adequate procedures before an entrance, during work, and in emergency situations. The officers responsible should perform an assessment onboard the vessel their decisions are crucial for the safety of successive operations. A proper assessment of oxygen concentration in the air into the cargo tank or an enclosed space after the measurement is one of the primary problems which should be properly interpreted. This concerns such situations when the measured oxygen concentration into the tank reaches the value over 22% and below 20.6% of volume (mole) contribution (v/v). Air temperature in the 5–25°C range may create additional threats. This manuscript clarifies the controversial information included in manuals concerning the safety of entrance into enclosed spaces on vessels and the ship-owners procedures concerning the safety precautions for preparing, entrance, protection, and work inside the cargo tanks.

Background. X-ray examination is a popular and universally used injury and disease diagnostic method. A distinctive X ray examination feature is that it can be done quickly which is extremely important in case of the need for rapid diagnosis of patients in life threatening condition. Another advantage of the X-ray examinations is also relatively low cost of carry. However, X-ray examination involve adverse health effects. During the examination the patient is subjected to ionizing radiation that might have impact on his health. Objective. The aim of this study has been to determine and assess the size of the entrance surface doses (ESD) received by patients during selected X-ray examinations performed on the basis of the medical working procedures available in healthcare entities in Masovian Voivodeship in Poland. Materials and Method. The examinations were conducted for 71 X-ray units located in the Masovian Voivodeship. Measurements of doses received by the patients were based on our own validated test methods. Results. It was found that the range applied to the high voltage in healthcare entities does not always coincide with the values specified in the standard procedures. It was found in the skull projection radiography AP and LAT that the recorded values were from range 60 to 82 kV (the average value of 74 kV) while in accordance with a standard procedure they should be in the range from 65 to 75 kV. Only in case of cervical spine radiography in the AP projection, the LAT exposure conditions were matching with the standard obligatory procedures in Poland. The consequence of selecting exposure conditions are significant differences in the size of the doses the patient receive during the same medical procedures. The greatest range of ESD doses was found during radiography of the thoracic spine in the projection AP and LAT. The projection LAT measured values were in the range of 523 to 10550 μGy (average value 2175 μGy). Conclusions. It is necessary to update immediately the standard procedures and to develop detailed guidelines for the preparation of working procedures in X-ray rooms.
Wprowadzenie. Badania rentgenowskie są powszechnie stosowaną metodą diagnozowania urazów i schorzeń występujących u pacjentów. Największą zaletą tych badań jest szybkość ich wykonania, co jest niezwykle istotne w przypadku konieczności postawienia szybkiej diagnozy medycznej u pacjentów w ciężkim stanie zagrażającym ich życiu. Badania rentgenowskie niosą jednakże ze sobą także negatywne skutki zdrowotne. W trakcie ich przeprowadzania pacjent poddany jest działaniu promieniowania jonizującego, które nie jest obojętne dla zdrowia. Cel. Celem badań było oszacowanie wielkości wejściowej dawki powierzchniowej (ESD) jaką otrzymują pacjenci podczas wybranych badań rentgenowskich przeprowadzonych w oparciu o procedury robocze obowiązujące w placówkach ochrony zdrowia na terenie województwa mazowieckiego. Materiał i metody. Zbadano 71 aparatów rentgenowskich wykorzystywanych w placówkach ochrony zdrowia na terenie województwa mazowieckiego. Pomiary dawek otrzymywanych przez pacjentów podczas badań rentgenowskich przeprowadzono własnymi zwalidowanymi metodami badawczymi. Wyniki. Stwierdzono, iż zakres wartości wysokiego napięcia dobieranego przez personel medyczny na aparatach rentgenowskich w placówkach ochrony zdrowia nie zawsze pokrywa się z wartościami określonymi w procedurach wzorcowych. Stwierdzono, iż w radiografii czaszki w projekcji AP i LAT wartość wysokiego napięcia była od 60 do 82 kV (wartość średnia 74 kV), zaś zgodnie z procedurą wzorcową powinny mieścić się w zakresie od 65 do 75 kV. Najlepszą zgodność pomiędzy wartościami wysokiego napięcia stosowanymi w pracowniach rtg a tymi określonymi w procedurach wzorcowych obowiązujących w Polsce stwierdzono w przypadku radiografii kręgosłupa szyjnego. Konsekwencją tak dobieranych warunków ekspozycji są znaczące różnice w wielkości dawek promieniowania otrzymywanych przez pacjentów dla tych samych procedur medycznych. Największą rozpiętość dawek ESD stwierdzono w trakcie radiografii kręgosłupa piersiowego w projekcji AP oraz LAT. W projekcji LAT zmierzone wartości były w przedziale od 523 do 10550 μGy (wartość średnia 2175 μGy). Wnioski. Niezbędne jest jak najszybsze uaktualnienie procedur wzorcowych oraz opracowanie szczegółowych wytycznych dotyczących przygotowywania procedur roboczych w pracowniach rentgenowskich.

W artykule przedstawiono historię zmian przepisów normowych dotyczących zagadnienia przebicia płyt żelbetowych. Wskazano różnice w procedurach obliczeniowych i skomentowano zmiany najbardziej istotne z punktu widzenia praktyki inżynierskiej. Omówiono zasady dotyczące zarówno tradycyjnego zbrojenia na przebicie w formie zamkniętych strzemion lub prętów odgiętych, jak również coraz popularniejszych trzpieni dwugłówkowych.
In the paper the history of changes in the standards concerning the issue of punching shear of reinforced concrete slabs was presented. The most important differences in design provisions were noted and the changes most relevant from the perspective of engineering practice were commented. The regulations concerning traditional punching shear reinforcement in form of closed stirrups or bent up bars as well as more and more popular double headed studs were discussed.
