The process of European integration has contributed to a significant concentration of member states’ political power in the hands of a bureaucratic-executive elite. This has been a result of European Union institutions discriminating in favor of national administrations rather than respective parliamentary institutions. Thereby, a European pattern of supremacy of the executive elite has been established, based on a mechanism of strict cooperation, and a system of institutional links between European and national bureaucracies. Unfortunately, national parliaments and the European Parliament were significantly late in responding to this process. This resulted in a lack of efficient methods to monitor political decision-makers and officials as regards their activity in the European forum. Not only has the integration system undermined the general powers of nation-states, but it has created a powerful bureaucracy whose competences have significantly increased on account of its international connections.

In 2003, the Council of Europe, the highest political organ of the European Union, resolved to adopt the European Security Strategy. This document outlined three fundamental objectives for the EU: stability and good governance in the area of the EU’s closest neighbors; creating an international order that would be based not only on bilateral relations, but primarily on efficient multilateral relations; and preventing threats, whether new or traditional. The Strategy assumed that the EU would take the responsibility for international security both in the realm of ‘peace keeping’ (peace and defensive missions) and ‘peace-making’ (peace and offensive missions). Defining the threats that the European Union needs to defy, the Strategy enumerates local conflicts, terrorism, the proliferation of weapons of mass destruction and their potential use against the territory of the EU and its member states, collapsing states, and conflicts breaking out in such states and their neighborhood, as well as organized crime. The assessment of numerous threats to internal and external security, presented in the European Security Strategy, remains up-to-date. There have also emerged new threats for Europe that result from the need to ensure energy security, primarily with respect to the diversification of energy sources. The significance of climate change to international security has increased. The same applies to IT security or piracy. The EU has been rather anxious about the intensification of frozen conflicts, in particular the outbreak of war between Russia and Georgia. The Polish Ministry of Foreign Affairs has indicated that the enlargement process is a significant stabilizing factor in the EU neighborhood. Fundamental importance is also attached to the review of cooperation principles with the USA, the crucial role of the UN in the international system, and cooperation with regional organizations, such as the African Union. There is also the need to develop a strategic partnership with NATO, in particular in terms of operational cooperation. Another key factor in the strengthening of the EU’s global position is the development of a civil and military crisis response system.

It is very important to try to predict the future development of the EU which led the following scenarios. The first of them, called the negative “hold-back scenario”, is based on the assumption that the process of transfer of the competences to take decisions to the institutions of the EU and the Communities reaching certain point will be held back, and then it will undergo stagnation. The second scenario, called “the imperative one”, takes into account the necessity of further, gradual concentration of the integration power caused by inactivity of supervisory authorities of member states and bigger effectiveness of decision making in integrated community. We can include here also further, parallel development of the model of European integration which would be based on intergovernmental cooperation and supranational method. The third scenario was based on such fundamentals as: - transparency of institutional decision making systems; – acceptance of the EU by the citizens; - more personalized integration activities; – strengthening of the democratic legitimization (e.g. connection of the institutional development with the process of the expansion); – looking for compromises and common preferences. The element which binds subjects of integration in realization of this scenario is conviction that it is necessary to intensify the political union. Continuing process of corrections and reforms in the system, the EU must still have multilayer (multilevel) character, joining not only supranational and international elements, but also national ones (the inclusion of national parliaments). This unification must have not atomizing but synergetic character, and it should be based on mutual penetration of methods, rules, mechanisms and institutions. As a final result, the authorities and institutions of the EU, and its procedures must become more effective. The realization of this scenario will increase the chance for the future EU not to lose the ability to shape its internal environment and to influence effectively on the international arena. The Assembly of Europe and the draft of the Treaty for the European Constitution confirm the attempt to realize this scenario. The scope of changes can only be compared to the dismantling of the building and then its reconstruction, reconstruction which would be based upon what is left from the building, using new techniques and elements. Bu before, the EU expanded by new member states will undergo, the most difficult in its history, process of regaining balance. Disorder in the system, connected with the expansion of the Union, difficult economic and complicated international situation, and controversial bills included in the draft of the Constitution Treaty accumulated, which led to the fiasco of the first stage of intergovernmental conference in 2003. Due to this fact, the return to the balance in the system will be more complex and take more time. As a result we will have a new quality of European integration which will match, both in form and content, the challenges of modern world. The decisons which are taken by the EU today cannot diminish its potential in the future. The Communities and then the EU have always been able to start debates about its shape. Aiming at the “final” reform of the EU is difficult, actually unrealistic undertaking. It is inevitable that we should continue the concept begun by the Common European Act and the European Union Treaty from Maastricht. This concept was based on permanent and evolutionary change helping to keep the right dynamics of the process of European integration.

Przedmiotem badań zawartym w artykule jest proces instytucjonalizacji aktywności parlamentów narodowych w systemie Unii Europejskiej. Natomiast celem badawczym stał się wpływ Unii Europejskiej na proces wyodrębniania parlamentów narodowych ujmowanych jako aktorów systemowych i funkcji przez nich sprawowanych, prowadzący do autonomicznego modelu koordynacji zarządzania kompetencjami UE. W artykule udowodniono hipotezę, iż parlamenty narodowe w Unii Europejskiej przez 30 lat integracji wytworzyły wspólnotę, będącą efektem zastosowania szczególnych form deterministycznej instytucjonalizacji, formalizujących więzi między nimi i instytucjami UE. Instytucjonalizacja ta opierała się na zapewnieniu właściwej realizacji ich wspólnych wartości, interesów i celów. Zastosowana w artykule metodologia instytucjonalizmu historycznego umożliwia wyjaśnienie procesowego przystosowania ram instytucjonalnych parlamentów narodowych do zmian w środowisku wewnętrznym UE, które skutkuje powiązaniem rzeczywistości integracyjnej z preferencjami jej poszczególnych aktorów instytucjonalnych. Przeprowadzona analiza doprowadziła autora do wniosku, iż aktywności parlamentów narodowych w UE warunkuje determinizm historyczny w postaci uzależnienia od dokonanych w przeszłości wyborów (path dependency). Z tego punktu widzenia należy uznać, że traktat o powołaniu Unii Europejskiej z Maastricht i zawarta w nim formuła instytucjonalna przesądziła o miejscu parlamentów w systemie integracji europejskiej.
The subject of the research included in the article is the process of institutionalization of the activity of national parliaments in the European Union system. However, the research goal was the influence of the European Union on the process of distinguishing national parliaments perceived as systemic actors and the functions performed by them, leading to an autonomous model of coordination of the management of EU competences. The article proves the hypothesis that national parliaments in the European Union, over 30 years of integration, have created a community resulting from the use of specific forms of deterministic institutionalization, formalizing the bonds between them and EU institutions. This institutionalization was based on securing the proper implementation of their common values, interests and goals. The methodology of historical institutionalism used in the article helps to explain the process of adapting the institutional framework of national parliaments to changes in the internal environment of the EU, which results in linking the integration reality with the preferences of its individual institutional actors. The analysis carried out led the author to the conclusion that the activity of national parliaments in the EU is dominated by historical determinism in the form of path dependence. From this point of view, it should be recognized that the Maastricht Treaty establishing the European Union and the institutional formula contained therein determined the place of parliaments in the system.

Głównym celem przygotowanej analizy w ujęciu konstruktywnego neorealizmu jest wnikliwa i wielowariantowa analiza możliwości wprowadzenia w życie postanowień Dyrektywy Parlamentu Europejskiego i Rady UE 2019/1937 z 23 października 2019 r. w sprawie ochrony osób zgłaszających naruszenia prawa Unii. Dyrektywa ta powinna była zostać poddana transpozycji do prawa polskiego (w postaci przepisów ustawowych, wykonawczych i administracyjnych) do dnia 17 grudnia 2021 r. Kolejne projekty ustawy o ochronie osób zgłaszających naruszenia prawa przygotowany przez rząd nadal nie zostały rozpatrzone ani przez Radę Ministrów ani przez polski parlament.
The main goal of the prepared analysis in terms of constructive neorealism is a thorough and multi-variant analysis of the possibilities of implementing the provisions of Directive 2019/1937 of the European Parliament and of the Council of October 23, 2019 on the protection of persons reporting violations of Union law. This directive should have been transposed into Polish law (in the form of statutory, regulatory and administrative provisions) by December 17, 2021. Further drafts of the act on the protection of persons reporting violations of law prepared by the government have still not been considered by either the Council of Ministers or the Polish parliament.

The scientific aim of the article is to identify the principles relating to the power of national parliaments in the European Union system. The research problem is the analysis of the process of establishing and interpreting rules by national parliaments, examined using functional analysis. The research argument here is based on the theoretical perspective of neorealism and refers to the rules of competence influencing the further functioning of the European Union. In terms of research results, the article answers questions about the consequences of strengthening the competences of national parliaments in terms of setting and interpreting the principles of the European Union. The originality and relevance of the problem contained in the article is based on the empirical belief that the expanding power of national parliaments in the EU directly affects the quality and legitimacy of the decision-making process by the EU institutions.
Celem naukowym artykułu jest identyfikacja zasad odnoszących się do władzy parlamentów narodowych w systemie Unii Europejskiej. Problemem badawczym jest natomiast analiza procesu stanowienia oraz interpretowania zasad przez parlamenty narodowe, badanych przy użyciu analizy funkcjonalnej. Wywód naukowy opiera się tu na perspektywie teoretycznej neorealizmu i odnosi się do reguł kompetencyjnych wpływających na dalsze funkcjonowanie Unii Europejskiej. W zakresie wyników badawczych artykuł odpowiada na pytania dotyczące konsekwencji wzmacniania kompetencji parlamentów narodowych w zakresie stanowienia i interpretowania zasad funkcjonowania Unii Europejskiej. Oryginalność i aktualność problemu zawartego w artykule oparta jest na empirycznym przekonaniu, że rozszerzająca się władza parlamentów narodowych w UE wpływa bezpośrednio na jakość i legitymizację procesu podejmowania decyzji przez instytucje UE.

The separation of theory and practice of the European integration created a very dangerous situation for the European Union. The article presents this crisis from the points of view of philosophy, political science and journalism. The“European poison of thought” expressed by a lack of trust of citizens towards the EU institutions perceived as inadequate in addressing the most fundamental problems of the EU citizens, as well as scepticism towards the enlargement of the Union, aversion to financial solidarity with weaker Member States, and disappointment with legal overregulation and money wasting, are just a few out of a long list of problems that make people lose their trust in the European integration. The author also considers the greatest weaknesses of the European Union: preferring interests of those who are present and well-organised on the political arena and the fact that the real majority of EU citizens stays outside the formal democratic structures thus becoming a part of the process of exclusion and fragmentation. The state of affairs in the EU, following according to Karl Jaspers, is called a limit situation, where it possible either to withdraw or rise and exceed restrictions. The author considers hope and radicalism as two forces that power the European political activists; in order to unite them, a new faith, values and hope based on the traditional foundations are needed. This new way of thinking about the EU, the joined-up thinking, is possibly a response to the demand for a radical revival in the EU.

In this article, the author deals with the issues of legal protection of the Communities' financial interests. 280 of the Treaty establishing the European Community (TEC), which became the basis for issuing more detailed regulations. Researchers have posed questions concerning the dynamics and crisis of European integration since its beginnings. They have proposed and continue to propose new research fields and questions on the theoretical and empirical approaches to the issue of irregularities in the Euro- pean Union, in particular the most recent ones. The author of this paper joins this trend, and takes a standpoint with respect to the (dependent and independent) variables that define the distorted dynamics of EU integration which have been analytically determined. The author intends to expose the distorted dynamics of the EU system and European integration, as well as the crises that accompany them, fuelling numerous academic, political and media debates and polemics. The research agenda of both an epistemological and empirical nature concerns the academic search for an anti-crisis finalité politique. The paper confirms the pluralistic nature of integration ideology, where no single theory or theoretical concept suffices to explain the increasingly complex, multi-directional crisis-related phenomena and interactions following from European integration. Therefore “the Union as described and academically analysed” is not always equivalent to “the Union in action.” That is why we are dealing with the growing detachment of theoretical concepts from the practical activities within the process of European integration. This paper demonstrates that the theoretical attempts at presenting European integration and its crises result in a certain permeation of paradigms between different concepts and in spontaneous promulgation and ‘merging’ of selected elements of theoretical outlooks that were assigned to quite different, or even contradictory theories and concepts.

The link between security and development is a key underlying principle of the EU’s comprehensive approach to external conflicts and crises and complementary to the internal security policies. As stated in the treaties, the EU’s external action objectives are to preserve peace, prevent conflicts and strengthen international security and also to foster the sustainable economic, social and environmental development of developing countries, with the primary aim of eradicating poverty. The primary objective of the EU’s development policy is the reduction and, in the long term, the eradication of poverty, but development policy also addresses sustainable development, inequalities, social injustice and human rights violations. This is essential in addressing the root causes of insecurity and conflict. The EU may use the Common Foreign and Security Policy and the Common Security and Defence Policy missions outside its territory for peacekeeping, conflict prevention and strengthening international security. The need for mutually reinforcing interventions in the areas of security and development is clear. The EU has consistently underlined that security is a precondition for development and that without development and poverty eradication there will be no sustainable peace. Creating and fostering the political, social and economic conditions for stability is essential for a country’s security and a prerequisite for its development. This security-development nexus is central to maximising the effectiveness of the EU’s external action. Current security capacity building efforts in partner countries span across a number of policy areas. They call on different instruments and focus on building effective, legitimate and sustainable institutions, including effective justice and security sectors, border control and coast guards. Capacity building activities include access to international instruments, political dialogue, technical cooperation (including joint research and innovation), training (knowledge transfer and skills development) and the provision of essential equipment and material. Training in the security sector seeks to improve a partner’s ability to ensure stability and the protection of citizens.
Zdaniem instytucji Unii Europejskiej – co wykazuje niniejszy tekst – konieczność wzajemnie uzupełniających się interwencji w obszarach bezpieczeństwa i rozwoju jest efektem nowych zagrożeń dla Europy. UE konsekwentnie podkreśla, że „bezpieczeństwo jest niezbędnym warunkiem rozwoju” i że „trwały pokój nie jest możliwy bez rozwoju i eliminacji ubóstwa”. Tworzenie i wzmacnianie warunków politycznych, społecznych i gospodarczych dla stabilności ma zasadnicze znaczenie dla bezpieczeństwa i jest warunkiem wstępnym rozwoju. Ta współzależność między bezpieczeństwem i rozwojem odgrywa kluczową rolę w zwiększaniu skuteczności działań zewnętrznych UE. Każde państwo, które dąży do zapewnienia bezpieczeństwa i rozwoju, musi posiadać lub nabyć odpowiednie zdolności we wszystkich istotnych obszarach, w tym w obszarze bezpieczeństwa i obrony. Umożliwi to nie tylko ustabilizowanie sytuacji w danym kraju, ale również przyczyni się w sposób konstruktywny do zaprowadzenia pokoju, uzyskania stabilizacji i zapobiegania kryzysom w jego regionie. Na przestrzeni ostatnich lat UE w coraz większym zakresie wspierała tę współzależność między bezpieczeństwem i rozwojem, prowadząc interwencje w różnych obszarach polityki unijnej i korzystając z różnych instrumentów. Bieżące działania na rzecz budowania zdolności w zakresie bezpieczeństwa w państwach partnerskich obejmują szereg obszarów polityki. W trakcie ich realizacji wykorzystywane są różne instrumenty i kładzie się nacisk na budowanie skutecznych, legalnych i trwałych instytucji, w tym na wydajny system sprawiedliwości i bezpieczeństwa, kontrolę granic oraz straż przybrzeżną. Działania te obejmują m.in. dostęp do instrumentów międzynarodowych, dialog polityczny, współpracę techniczną (w tym wspólne badania naukowe i innowacje), szkolenia (transfer wiedzy oraz rozwój umiejętności) oraz dostarczanie podstawowego sprzętu i materiałów.

In situations of real danger, Europe should be stronger and faster in action. Solidarity and resilience require the EU to be united and to act jointly and systematically in consultation with allies, partners and third countries. Preventing, sharing sensitive data, ending armed conflict, overcoming widespread human rights violations, spreading democracy and the rule of law, and combating terrorism are priorities of the EU and its citizens, and should be carried out both within the EU and abroad. It is extremely important to make rapid further progress in the development of civilian capabilities. This includes the need to increase responsiveness to ensure more efficient, faster and more flexible deployment of civilian missions in the field of the Common Security and Defense Policy, which are key as one of the pillars of the EU’s comprehensive approach.
