This article examines distance learning in individual European countries and the Czech Republic. It analyses and compares the development of distance learning, and the supply of study options in the form of distance learning in European countries; it covers the development, conditions, and history of distance learning in European countries. The carried out analysis shows that currently there is an emphasis on lifelong learning, and the development of distance learning has become a priority. It can be further stated there are significant differences in the development of distance learning in individual European countries, and in the Czech Republic distance learning has only started to develop in the past twenty years.

The topic of brownfield regeneration has been the focus of planning debate for years. However, the aspect of institutional cooperation and strengthening the institutional capacity in order to cope with a complex task of brownfield regeneration is considered a challenge. This is particularly true for the post-socialist countries and, hence, the Czech Republic, Hungary and Serbia are chosen as the case studies of this research. By implementing a concise survey of both the institutions and policies related to the topic of brownfield regeneration in the selected countries, the research aims at determining the form, extent and nature of collaboration between different sectors, disciplines, and institutions. Based on such insights, it is finally possible to provide the recommendations for more effective institutional design within specific political and socio-economic context.

The paper entitled ‘Reform of the Notaries between 1929 and 1933’ discusses the process of formation of the Polish notary after the country regained its independence. The Codification Commission as well as some eminent lawyers gathered around Leopold Wladyslaw Jaworski and Jakub Glass undoubtedly had a great influence on the creation of organizational and legal structures. The Decree of President Ignacy Moscicki, signed on 27th October 1933 terminated a difficult process which had been permanently investigated by the lawyers and politicians in the Second Republic. The notary solutions developed by them were one of the most modern ones in Europe at that time
Artykuł Reforma notariatu w latach 1929 – 1933 przedstawia proces kształtowania się polskiego notariatu po odzyskaniu niepodległości. Ogromny wpływ na tworzenie się Reform of the Notaries between 1929 and 1933 struktur organizacyjnych i prawnych miała Komisja Kodyfikacyjna oraz wybitni prawnicy, kierowani przez Władysława Leopolda Jaworskiego i Jakuba Glassa. Rozporządzenie Prezydenta Ignacego Mościckiego, podpisane dnia 27 października 1933 r., zakończyło trudny proces kształtowania się notariatu realizowany przez prawników i polityków w II Rzeczypospolitej. Wprowadzone przepisy były jednymi z najnowocześniejszych w tym czasie w Europie.

In the Muslim Religious Union there is a dispute over the establishment of the Mufti office. From 2016, a schism has arisen in this religious community. This situation is a source of challenges for the authorities of the state administration and the courts in the application of a number of principles of the 1997 Constitution of the Republic of Poland. There are principles: autonomy and independence of religious associations in their scope, legalism, legal certainty or confidence of citizens in the state and their rights. The legal status of the Union is based on anachronistic legislation: the Act of April 21, 1936, on the relationship of the State to the Muslim Religious Union in the Republic of Poland and the statute approved by the Council of Ministers by way of an ordinance of August 26, 1936. In practice, the Muslim Religious Association applies the 2009 internal statute. Religious authorities and courts try to remain neutral and not interfere in the internal dispute in the Muslim Religious Union. This is in line with the standards stemming from the judgments of the European Court of Human Rights and the constitutional principle of autonomy and independence of religious associations in their own rig However, there is a state of legal uncertainty. It is urgent to repeal the Act and the Statute of 1936. This can be done either by a Constitutional Court decision or by passing a new law on the basis of the Muslim Religious Union Agreement with the Council of Ministers.

The primary purpose of this paper is to ascertain the degree to which the Republic of Serbia is ready for full membership of the European Union. Therefore the criteria set by the European Union for the countries aspiring to membership have been examined, including in particular the Copenhagen criteria of 1993. The assessment expressed in the European Parliament resolution of 18 April 2013 has also been taken into account. In many respects, the Republic of Serbia is not yet fully prepared for membership in the European Union, but on 20 January 2014 negotiations started on Serbia’s accession to the EU. Their results will be conditional on the course and pace of the talks concerning the normalisation of relations between Serbia and Kosovo. The date of Serbia’s eventual accession to the European Union is expected to be 2020.

For long, the military was a cog in the wheel of democratic governance in Nigeria. Its intrusion into the politics of the nation resulted to its domination of the political space and imposition of arbitrary rule for an aggregate period of 29 years out of the nation’s 47 years of existence. The last disengagement of the military from politics was effected on 29, May 1999. The Fourth Republic was thus inaugurated, heralding yet another phase in the nation’s quest for democratic governance. The restoration of democratic rule was not achieved on a platter of gold. The military junta was subjected to intense domestic and international pressure. Along with myriad civil society groups, the church added its voice to the clamour for democracy. But inspite of its visible role in this struggle, the efforts of the church remain unsung. This study is intended partly as a redress for the marginal attention paid to the patriotic struggle of the church, but more significantly, it is an attempt to illuminate the increasing concern of the church with the secular welfare of its flock.

1. Objective The objective of this article is to present the need to control society in order to ensure security both to the society itself and to the state, and to draw an extremely fluid boundary line between what is necessary and what is unnecessary, which may turn into unnecessary surveillance which sometimes becomes caricatural. The duty to ensure security to the society, particularly in the era of increasing religious terrorism in Europe (resulting from simple relationships in the society), is an obligation aimed at permanence of existence of a given social group (national, supranational) functioning within the state and as such should be connected with aptly chosen methods of supervision. 2. Introduction Security is the overriding need of humans and it determines their other needs and the motives for the actions they take. It manifests itself not only in the lack of hazards (which constitutes its basic principle related to the assurance of existence) but also in the need to take action to ensure appropriate conditions for development of individuals as well as smaller and larger social groups. Hence, today’s understanding of security is not exclusively linked with the existence of humans or social groups (lack of hazards); it must be analysed from the point of view of its development, which in turn determines the evolution of such categories of security as economic, scientific cultural security, or job security. However, such secondary categories of security, which ensure the development of individuals and various social groups, cannot be pursued without eliminating potential threats to the existence of humans, particularly those related to their life and health, and ensuring continuity of generations. In order to meet this objective, especially in the era of increasing terrorism, it is necessary to supervise the society, which is more and more culturally and religiously diverse, in the right way, and the supervision may not become caricatural as was the case with the German Democratic Republic. 3. Methodology The authors identify the need to exercise permanent supervision in the society, particularly in areas threatened with terrorism, and, at the same time, point out that it is possible to overstep the necessary surveillance in a manner leading to its caricatural forms, which occurred in the German Democratic Republic, non-existent today. The adopted comparative historical method allows for direct analysis of needs regarding security in comparison with the potential threat of adopting wrong methods to meet them. A glance at current threats to social security, including terrorism, confronted with the surveillance that was common in the German Democratic Republic, which ceased to exist over twenty-five years ago, throws doubt on the boundaries of the needed and acceptable social surveillance. 4. Conclusions The authors prove that it is difficult to draw a clear line between what is permissible and what is impermissible in social surveillance, especially in view of terrorism threats. Therefore, the actions of national authorities should be marked by far-reaching carefulness in the selection of surveillance methods so that a democratic state does not turn into a police state. They agree, however, that supervision in the form of well administered surveillance is one of the methods of ensuring security to individuals and society.

Wydanie zezwolenia na pobyt cudzoziemców na swoim terytorium jest od zawsze jedną z najważniejszych prerogatyw suwerennego państwa. Jednakże uprawnienie do kontrolowania ruchu osobowego nie jest uprawnieniem bezwarunkowym, musi bowiem uwzględniać normy praw człowieka wynikające z wiążących państwo traktatów międzynarodowych, a także norm konstytucyjnych. Niniejsze opracowanie podejmuje problem regulowania pobytu cudzoziemców z perspektywy zasady ochrony rodziny zawartej w Konstytucji RP, a także w wiążących Polskę umowach międzynarodowych. Zasada ta i jej wpływ na relacje między osobami fizycznymi a organami państwa ukazane są przez pryzmat najnowszych orzeczeń sądów administracyjnych wydawanych w sprawach skarg na decyzje pobytowe. Celem pracy jest ukazanie, w jaki sposób kontrola sądowoadministracyjna wpływa na przestrzeganie zasady ochrony rodziny przez organy administracji. Polskie sądownictwo administracyjne niewątpliwie stoi na straży zasady ochrony rodziny. Co do zasady organy administracji, prowadząc postępowanie w sprawach pozwolenia na pobyt, uwzględniają zasadę ochrony rodziny zawartą w Konstytucji RP. Wyjątkowo bywa jednak, że organy błędnie lub zbyt rygorystycznie interpretują zebrany materiał dowodowy i odmawiają stronom należnej im ochrony życia rodzinnego. Prowadzi to do uchylenia takich zbyt rygorystycznych decyzji przez kontrolujące je sądy administracyjne
The issuance of a residence permit to individuals entitled to reside on its territory tends to constitute a major prerogative of a sovereign country. Nevertheless, the right to control the flow of persons executed by the state is not unconditional since it should take account of the human rights resulting from the relevant binding international treaties as well as constitutional norms. The focus of this paper is on the problem of regulation of foreigners’ stay in the light of the family protection principle contained in The Constitution of the Republic of Poland and the relevant binding international agreements. The aforementioned principle and its influence on relations between physical persons and organs of the state are analysed from the point of view of the latest administrative court jurisdiction in residence-related claims. The aim of this paper is to examine the influence of court and administrative supervision on the implementation of the family protection principle by administrative bodies. Undoubtedly, Polish administrative judicial system acts as the guardian of the family protection principle. As a rule, the administrative bodies issuing residence permits tend to respect the principle in question contained in The Constitution. Nevertheless, in isolated cases, the aforementioned bodies fail to interpret the evidence at their disposal correctly or they take an excessively strict approach, which results in their refusal to protect family life to a sufficient extent. Such particularly strict decisions tend to be overruled by the administrative courts executing control over those bodies

There is a stereotype that the Republic of Belarus is a country where pluralism does not exist in all spheres of life. However, this statement is not precisely correct, as contemporary Belarus demonstrates political neutrality and pluralism in the foreign policy and multiculturalism inside the country. Multiculturalism is viewed in the paper as mutual tolerance among the population and respect to the Otherness in cultural life. Two major spheres of pluralistic phenomenon are discussed: ethnic composition of Belarus and its religious confessions. Although a major part of the believers belongs to two Christian confessions, Orthodox and Catholic, many other confessions and new religious movements also exist. Religious pluralism is a practical reality in Belarus which has the reputation of the most religiously tolerant post-Soviet country. Contemporary laws provide the legal basis for tolerant relations in the country, and there is a historical tradition of religious tolerance in Belarus.

This article discusses the manner of shaping the concept of the notary in the period following the restoration of Polish independence until 1923. Artykuł Pozycja prawna notariusza w II RP – projekty reform. Okres 1918 –1923 omawia sposób kształtowania się notariatu i jego koncepcji bezpośrednio po odzyskaniu przez Polskę niepodległości do roku 1923. Okres ten z uwagi na obowiązujące na poszczególnych terenach rozwiązania prawne państw zaborczych charakteryzował Tomasz Chłopecki 143 się różnorodnością przepisów prawnych oraz problemami w ich egzekwowaniu. W wyniku tego istniała pilna potrzeba unifikacji polskiego sytemu prawnego, w tym również przepisów o notariacie, które na nowo określiłyby pozycję prawną notariusza w II Rzeczypospolitej. Artykuł przedstawia rozważania na temat koncepcji i idei prezentowanych przez poszczególne Izby Notarialne oraz samych notariuszy ze Stefanem Górą i Władysławem Leopoldem Jaworskim na czele.
