    Opis:
    Most of the transgender research concentrates on transgender women (biological men who identity themselves with the opposite gender), leaving little space for the research on transgender men (biological women identifying themselves as men). This is, in particular, visible in the Polish literature on the topic, and especially surprising in the light of Godlewski’s research (1988: 547), which indicates that transgender men outnumber transgender women in the Polish population. The aim of the paper is to describe the phenomenon of transgenderism, its etiology (focusing on differences between transmen and transwomen) and the stages of transgender identity development; and to present two case studies of transgender men, describing the key moments for their identity construction and gender expression and their impact on the transmen functioning.

    Artykuł stanowi krytyczne omówienie precedensowego wyroku Sądu Okręgowego w Warszawie z 29.09.2020 r., w którym sąd uznał, że dyskryminacja ze względu na płeć według przepisów ustawy o równym traktowaniu obejmuje również dyskryminację ze względu na tożsamość płciową. Sprawa dotyczyła transseksualnej osoby – płci psychicznej (odczuwanej) żeńskiej – przed sądową zmianą oznaczenia płci. Powódka została zatrudniona do pracy w agencji ochroniarskiej jako recepcjonistka, lecz odmówiono jej możliwości pracy w damskim uniformie. Sąd uznał, że doszło do dyskryminacji i molestowania, gdyż „zwykła” kobieta w analogicznej sytuacji miałaby możliwość pracy w spódnicy. Rozstrzygnięcie jest warte omówienia w czterech ważnych aspektach: po pierwsze, dorozumianego uznania przez sąd zasady samostanowienia płci; po drugie, zrównania tożsamości płciowej z płcią biologiczną, jeśli chodzi o przesłankę dyskryminacji; po trzecie, wpływu tego założenia na funkcjonowanie systemu prawa w odniesieniu do zasady pewności prawa; wreszcie, po czwarte, potraktowanie kobiecego stroju jako wyznacznika kobiecości i uznania zakazu noszenia tego stroju za przejaw dyskryminacji ze względu na tożsamość płciową jest warte analizy w świetle zasady równości ze względu na płeć.
    The article is a critical overview of a sentence of District Court in Warsaw from 29 September 2020 in which the Court stated that sex-based discrimination on the basis of Equal Treatment Act of 2010 also embraces discrimination based on gender identity. The case was concerning a transsexual person (male to female) who was hired to work in security company as a receptionist. Upon superiors learnt she was a biological male and before legal gender recognition, she was denied working in a female uniform (a skirt and a jacket). Eventually she did not start working. The Court found that she was discriminated since a biological woman would not have been denied possibility of working in a female suit. The Court compared her situation not to her natal sex (since she was formally still a man), but to her eventual gender. The Court found that both discrimination and harassment had place. The verdict is worth discussing in several aspects. Firstly, the Court implicitly accepted the gender self-identification rule, which might be seen as an overinterpretation of the law. Secondly, the Court equates gender identity with sex as a basis of discrimination. Thirdly, such an approach has serious consequences on rule of law and gender equality rule protected by the Polish Constitution. And finally, the Court took female outfit as an indicator of someone’s gender and gender identity and consequently a prohibition of wearing a female uniform as a manifestation of discrimination based on gender identity, which is a very dubious assumption from the equal treatment and feminist perspective.

    Badania przeprowadzono w latach 2015–2020 za pomocą wywiadów fokusowych z 78 studentami specjalności nauczycielskich. Celem badań było zdiagnozowanie, w jaki sposób transformacje społeczne w zakresie tożsamości płciowej człowieka kształtują postawy studentów wobec interpłciowości i transpłciowości. Wykazano, że studenci – przyszli nauczyciele są zdania, iż postrzeganie tożsamości płciowej zmienia się wraz ze zmianami obyczajowymi, a działalność mediów, organizacji pożytku publicznego powodują zmianę negatywnych postaw społeczeństwa wobec problemów biologii człowieka w zakresie płci, przy czym studenci nie czują się przygotowani na kontakt z uczniem interpłciowym lub transpłciowym.
    The research was conducted in 2015–2020 using the method of focus interviews with 78 pre-service teachers. The aim of the research was to diagnose how social transformations in the field of human gender identity shape students’ attitudes towards intersexuality and transgenderism. It has been demonstrated that pre-service teachers claim that the perception of gender identity changes along with moral changes, and the activities of the media and public benefit organizations lead to a change in the negative attitudes of society towards the problems of human biology in terms of gender, while at the same time students do not feel prepared for contact with an intersex or transgender student.

    W tekście dokonuję przeglądu książki Poza schematem. Społeczny konstrukt płci i seksualności autorstwa Urszuli Kluczyńskiej, Wiktora Dynarskiego oraz Anny Kłonkowskiej. Jest to bardzo interesująca lektura, ponieważ opisuje uwikłanie w binarny system płciowy „męskie–kobiece” tak zwanych osób niebinarnych, zwłaszcza transpłciowych. Autorzy zastanawiają się, jakie kroki należałoby podjąć, żeby osoby niebinarne czuły się swobodnie w społeczeństwie i w sposób wolny, z dala od opresyjnej heteronormy, mogły konstruować swą podmiotowość. Autorzy przekonują, że jest to możliwe wyłącznie poza (binarnym) schematem, który należy zdestabilizować. W recenzji zastanawiam się, czy wyjście z jednego schematu nie jest, paradoksalnie, wejściem w kolejny.
    The aim of this work is to present a review of a book by Kluczyńska, Dynarski and Kłonkowska Poza schematem. Społeczny konstrukt płci i seksualności. The Authors describe nonbinary individuals who are entangled in the binary system of gender. Kluczyńska, Dynarski and Kłonkowska consider solutions which can help nonbinary people subjugated by the heteronorm. Through these solutions they could construct their subjectivity as free persons. The Authors argue that it is possible only outside of the (binary) scheme, which should be destabilized. In this review I would like to consider whether it is possible to live outside of the cultural scheme because – in my opinion – when we leave one scheme, we land in another one.
