Opis:
Zygmunt Ziembiński was one of the most prominent theoreticians of law in Poland in the second half of the 20th century. He developed an original theory of law defined as a theory of legal phenomena, which covered both logical-linguistic as well as real aspects of law. The theory served as a base for the development of a unique so-called advanced normative conception of sources of law, one of the greatest achievements of theory of law in Poland. This conception encompasses all the indispensable elements of a coherent system of binding legal norms: 1) indication of a political justification (ideological assumptions) of the entire system of law; 2) pre judgment of law-making competence of government agencies; 3) determination of the status of custom and precedent; 4) compilation of a catalogue of permissible interpretation rules; 5) compilation of a catalogue of permissible inferential rules (permissible rules of legal inferences); 6) compilation of a catalogue of permissible collision rules.

Reguły fiskalne są narzędziem dyscyplinowania polityki fiskalnej i zapewnienia równowagi finansów publicznych. Tematyka niniejszego artykułu poświęcona została regułom fiskalnym obowiązującym w Polsce. Reguły fiskalne mogą przybierać formę reguł numerycznych lub reguł proceduralnych (zwanych także procedurami). Najszerzej opisywane w literaturze przedmiotu opisywane i oceniane są reguły numeryczne wyrażane są jako liczbowe ograniczenia nakładane na wybrane agregaty polityki fiskalnej, mające długookresowy wpływ na jej dyscyplinowanie. Niemniej jednak niniejszy artykuł przybliża również tematykę tzw. reguł proceduralnych opisywanych jako działania, które zwiększają odpowiedzialność fiskalną, usprawniają zarządzanie, poprawiają komunikację z opinią publiczną i wzmacniają przejrzystość finansów publicznych.
Fiscal rules are a tool for disciplining fiscal policy and ensuring the balance in public finances. The article is devoted to the fiscal rules in force in Poland. Fiscal rules may take either the form of numerical rules or procedural rules (also called procedures). Numerical fiscal rules, which are expressed as numerical constraints imposed on chosen fiscal policy aggregates, exerting a long term disciplining impact, are the most widely described and evaluated in the subject literature. However, this article introduces the subject of so-called procedural rules described as activities taken to enhance fiscal responsibility, improve management, improve communication to the public opinion and enhance the transparency of public finances.

This paper contains two main parts. Section 2 defines the relationship between rules, processes, and process models (the relationship between process models and processes is clear, so we omit it). Section 3 reviews some existing research on various facets of that relationship.

Although the general principles of law at first sight do not bring about numerous associations with the sphere of taxation where the processes of compliance with legal rules or applying them must end with a precise numerical result, both the relevance and the significance of these principles in the sphere of tax law are more and more noticeable. The principle of proportionality has been invoked in probably every second VAT judgment of the Court of Justice for years. The principle of legal certainty has made its way to the case law of the said court as well as the Constitutional Tribunal in Poland. The importance of other principles is definitely on the rise.

Opis:
Ownership, as a basic value of a legal state is the subject to special protection guaranteed by a basic law. However, in certain situations acting for the benefit of public interest is, according to a legislator, takes priority over private ownership. Thus, in cases when public interest is at stake limitation of ownership title to property can be permitted by regulations. Expropriation of private property for the sake of public good is the solution used for many years in Poland and in other countries. Basic preconditions for expropriation are described in art. 21 section 2 of The Constitution of the Republic of Poland. Private ownership in art. 21 of Polish Constitution was defined in a very general context without defining the subject. Thus, all the ownership is the subject to state protection without specifying the principles of this protection, which are regulated by ordinary acts. Guaranteeing right to private ownership does not mean the right is inviolable. Constitution allows for property expropriation for the benefit of public purposes after a just compensation. However, it must be emphasized that regulations relating to the rules of property expropriation as a special form of depriving ownership right by means of authoritarian state act, which is the exception from general civil and legal principles of transferring ownership title, must be applied literally, excluding admissibility of extensive interpretation. Provisions of the constitution are defined in the regulations of the Real Estate Management Act from 21st August 1997.

The article presents theory and research concerning six rules of exerting influence such as: the rule of the reciprocity, the rule of the commitment and the consequence, the rule of social evidence of the rightness, the rule of liking and the sympathy, the rule of the authority and the rule of the unavailability. Thirteen managers from the urban transport company, one of the biggest work places in Wrocław, took part in the research. The aim of the study was to examine the managers’ knowledge of the aforementioned rules.

The article aims at presenting the results of the application of multidimensional association rules to explore the potential determinants of satisfaction with services. The bases for the search are the results of a study on the importance of social engagement and attachment to the place of residence to the satisfaction of the services provided by LGUs. The article has a research nature and has been prepared on the basis of the results of the survey. The research procedure also benefited from the literature in sociology and data mining available in the form of books and articles. The results of the carried out analysis indicate that between social engagement and satisfaction with services provided by LGUs and attachment to the place of residence and satisfaction with the services there are links and they can be pointed to as determinants of customer satisfaction. One should not assume that the two mentioned relationships relate to the entire studied population, but to the selected groups.

In present research there was shown the issue of connection between reasoning and logical competence. The point of view of rules theory and mental models theory concerning discussed range of problems was presented and subsequently the prediction of rules theory was verified. The results of the survey conducted on 70 people: 37 students of philosophy and 33 students of other courses at University of Lodz let us reject rules theory as a predictive to the proceedings of reasoning process and induce to accept an alternative theory explaining the proceedings of the discussed process. The adduced research proved that the level of logical competence does not differentiate the surveyed with respect to the level of reasoning’s correctness and it does not influence the constancy of selection of the reasoning’s patterns.

The article presents a concise summary of the Catholic Social Teaching on payment of taxes. It discusses the economic policies of the state, stressing its responsibility for the economic development of the entire society. Every citizen has the right to own private property, whereas public property serves the common good of the whole society. Likewise, every person has a duty to participate actively in preserving and contributing to the growth of the common good. Catholic Social Teaching proposes that efforts to alleviate social problems be informed by the following principles: the principle of the common good; the principle of solidarity; the principle of subsidiarity and the principle of justice.

The aim of the article is the analysis of rules-in-use on an individual as well aggregated level. The taxonomic method, descriptive analysis and critical literature review is used in the article. The European Union countries have been ordered and grouped according to the set of rules in force on the labour market. For a detail analysis, four countries have been selected, one country from each group. The taxonomy method has been used to rank the countries. Descriptive analysis of particular rules-in-use in selected countries is done. The World Bank data, mainly collected within Doing Business project and Mutual Information System on Social Protection, Social Security Programs Throughout the World as the main source of information are used. The article ends with a summary of rules-in-use of selected countries.

Działania państwa wpływające na sytuację gospodarczą kraju i na jego rozwój są podejmowane poprzez realizację polityki gospodarczej. Przy realizacji polityki makroekonomicznej podstawowe znaczenie mają polityka pieniężna i fiskalna. W artykule zaprezentowano znaczenie reguł polityki pieniężnej i fiskalnej w prowadzeniu polityki makroekonomicznej. Celem artykułu jest wykorzystanie wybranego modelu dynamicznego do wyznaczenia optymalnych reguł fiskalnych i optymalnych reguł polityki pieniężnej, które mogą być pomocne przy osiągnięciu w przyszłości pożądanych wartości wybranych zmiennych, takich jak np. inflacja i produkcja.
State action affecting the country’s economic situation and its development are taken through the implementation of economic policy. In the implementation of macroeconomic policy are essential monetary and fiscal policy. In the article we present the role of the monetary and fiscal policy rules in the conduct of macroeconomic policy. Taking into account that many of the economic problems is modeled using dynamic models, the aim of this article is use these models to determine the optimal fiscal policy rules and optimal monetary policy rules. These optimal rules may be helpful in achieving the desired future values of selected variables, such as inflation and production.

W artykule scharakteryzowano najważniejsze, aktualnie obowiązujące i najczęściej stosowane zbiory zwyczajów i uzansów morskich, stosowanych w pracy spedytora, do których zaliczają się Reguły Hasko-Visbijskie, Reguły Hamburskie i Reguły Yorku-Antwerpii. W końcowej części artykułu omówiono także zwyczaje i uzanse dotyczące terminowości dostaw, ilości towarów i przewozów w transporcie morskim.
The article characterizes the most important, currently applicable and most commonly used collections of maritime custom and usage of trade used in the work of a sea freight forwarder, which include The Haga-Visby Rules, The Hamburg Rules and The York-Antwerp Rules. The final part of the article also discusses maritime custom and usage of trade regarding the conditions of delivery, the quantity of goods and transport of goods in seaborne trade.

Rules and narratives in video games had a complicated relationship for many years. In game studies this conflict became evident in ludology versus narratology debate, in video game culture critics and players talk about ludo-narrative dissonance. Both of those phenomena express the popular belief that rules and story in videogames oppose each other, that strategic or tactical engagement and narrative immersion cannot coexist in one game. The following article confronts the problem of, supposedly, opposing types of engagement. To understand different aspects of engagement several concepts of immersion are recalled, beginning with those rooted in literary studies by Janet H. Murray, Marie-Laure Ryan and Katarzyna Prajzner, through game specific concept of Laura Ermi and Frans Mäyrä to post-immersion concepts of Gordon Calleja. In the next section of the paper two analyses of specific types of engagement are presented: game formal system engagement in Angry Birds [Rovio Entertainment, 2009] and narrative immersion in The Walking Dead series [Telltale Games, 2012]. The article concludes with a list of mechanical features of a video game that facilitates either engagement in formal system of the game or game’s narrative.

Opis:
Disciplinary proceedings are these of repressive nature wherein penalties which limit the freedom and rights of a guilty person can be adjudicated. Such pro-ceedings are diversified and have no pattern for developing models of the disci-plinary responsibility of particular professions, including professions of public confidence. By focusing on the diversification of disciplinary proceedings, in-cluding the rules of such proceedings in particular models, the authoress opts for uniforming rules of the proceedings. She considers it necessary and possible to define basic rules of disciplinary proceedings which can be referred to while developing a code of disciplinary proceedings or different models of proceed-ings for particular occupation groups or professions. The article postulates rules which, according to the authoress, seem to be fundamental while not necessarily fit for all types of disciplinary proceedings. She notes that her suggestions are to be a proposal for the further discussion on developing standards of reliable pro-cedures in disciplinary proceedings.
