The author provides an analysis of the phrase “the closest municipality or district”, which appears in Article 90 para. 3 of the Act and points out – following the Supreme Administrative Court – that it has the traits of a vague concept and does not always have to mean a neighboring (the closest) municipality or district. It may also refer to the municipalities with similar demographic or economic characteristics. In addition, it was pointed out that the correction of the annual settlement of grants provided by the local government unit for a private school under the provisions of the Tax Code are not permitted.

The article focuses on the functions, types, transfer rules and principles of granting of subsidies and specific grants from the state budget to local government units in Poland, however, it also contains international references. The author indicates the key issue related to the use of transfer revenues in financing local government units. Special attention is given to the analysis and assessment of importance and the change in the share of transfer revenues for municipalities, cities with powiat status, powiats and voivodeships for creating their budgetary revenues in 2010–2020. The research was based on data obtained from the database of Statistics Poland.

The aim of this paper is to critically analyze introduced in 2008 changes in the rules of subsidizing employment of people with disabilities and their impact on the sector sheltered workshops and employment of people with disabilities. Subsidies for the employment of people with disabilities, introduced in 2004, provided an important instrument for the support of all employers that employ disabled people. However, the allocation of large sums of sheltered workshops than employers operating in the open labor market, would be compensation for expenditure on the creation of special working conditions and rehabilitation in the sheltered workshops. The reduction of these amounts and equalization grants transferred to sheltered workshops with employers from the open labor market was particularly unfavorable for sheltered employment sector and has become the major cause of the resignation of sheltered workshop of this status.

The aim of the article is to present and assess new solutions of financing local government units in Poland. Problematyka prezentowana w niniejszym artykule odnosi się do konkluzji wynikających z analizy kwestii finansowania zadań publicznych, które są przedmiotem porozumień zawieranych między jednostkami samorządu terytorialnego oraz tymi podmiotami a wojewodą. Poza zakresem rozważań pozostają natomiast inne porozumienia, a w szczególności takie, których stronami są samorządowe osoby prawne nie mające statusu jednostek samorządu terytorialnego. Po zarysowaniu zagadnienia przedmiotu porozumień autor przechodzi do rozważań na temat gospodarki finansowej jednostek samorządu terytorialnego. W dalszej kolejności omawiana jest kwestia dotacji oraz innych środków otrzymywanych przez podmioty w celu finansowania zadań publicznych objętych porozumieniami. W tym celu dokonywana jest wykładnia odpowiednich przepisów, tj. art. 8 ust. 1 pkt 2, art. 46 i art. 47 ustawy z dnia 13 listopada 2003 r. o dochodach jednostek samorządu terytorialnego, a także art. 168, 169, 251 i 252 ustawy z dnia 27 sierpnia 2009 r. o finansach publicznych. W końcowej części rozważań autor wskazuje, że w aktualnie obowiązującym stanie prawnym dopuszczalne jest dofinansowanie ze środków unijnych tzw. projektu określonego w art. 5 pkt 9 ustawy z dnia 6 grudnia 2006 r. o zasadach prowadzenia polityki rozwoju. Dodatkowo, na marginesie zasadniczego nurtu rozważań, zwrócono uwagę na etap przedakcesyjny do Wspólnot Europejskich oraz rolę, jaką w zakresie pozyskiwania środków na realizację zadań publicznych odgrywał program PHARE.
The issues presented in this article refer to the conclusions resulting from the analysis of the financing of public tasks that are the subject of agreements between local government units and these entities and voivode. Outside the scope there are other agreements, particularly those whose parties are local legal entities not having the status of local government units. After outlining the issues the subject of agreements author proceeds to a study of the financial management of local government units. Furthermore, the author considers the issue of grants and other funds received by the entities in order to finance public tasks covered by the agreements. For this purpose, the author interprets the relevant provisions, namely article 8 paragraph 1.2, article 46 and article 47 of the Act of 13 November 2003 on income of local government units, as well as article 168, 169, 251 and 252 of the Act of 27 August 2009 on public finances. In the final part of the discussion, the author shows that in the current legal situation it is possible to acquire the EU funds to implement the project defined in article 5.9 of the Act of 6 December 2006 on the principles of development policy. In addition, on the margins of the mainstream discussion, the author notes the noticeable role of obtaining funds for the implementation of public tasks, played by the PHARE program during the time of pre-accession to the European Communities.

The bill aims at paying respect and remembrance to persons who died during a period of peace due to natural causes, but who took part in struggles for the independence and sovereignty of Poland. The bill envisages the creation of a collective record of graves of veterans of struggles for the independence and sovereignty of the Poland, carried out by the President of the Institute of National Remembrance, and the introduction of the system of a financial support for entities that take care for such graves. In the opinion of the author of the impact assessment, the procedure for making entries in the record of graves, and granting or refusing grants or pecuniary benefits should to be regulated in a more detailed way. It has a fragmentary character and does not contain any significant elements enabling the proper functioning of the procedure, which will significantly and permanently charge the state budget.

The bill regulates matters related to the protection of historical memory about persons of mertit participating in struggles for the independence and sovereignty of Poland, in particular in the Warsaw Uprising. Entry into force of the proposed act will cause financial effects for the state budget in the form of increased spending. The explanatory statement to the bill not include any information about the costs, even estimated ones, of maintaining and renovating burial places covered by the prohibition on reburial, as well as about the criteria for distribution of funds intended for financing the purposes determined in the Act. Moreover sources of funds of the state budget from which the undertakings provided in bill would be financed have not been specifies. The author also expresses doubts about the compatibility of the procedure for issuing the decision on the prohibition of using the grave for reburial with Article 2 of the Constitution of the Republic of Poland, due to its rudimentary character, which results in the lack of legal certainty.

Financing of parties is an issue that interests and excites many, not only members of specific parties, but also, or perhaps especially, the so-called regular Joes. Emotions may not come as a surprise, as financing parties has provided material for many surprising stories in the past. After 1989, the rules for financing of political parties in Poland were modified several times until they were regulated in the fullest way in 2001, with the introduction of party financing from the state budget. The article takes a closer look at the evolution of the rules on the financing of political parties and analyses the doubts that have arisen during more than 20 years of the current statutory regulation.
Finansowanie partii jest zagadnieniem, które interesuje i emocjonuje wielu, nie tylko członków konkretnych partii, ale także, a może zwłaszcza tzw. szarych obywateli. Emocje nie mogą dziwić, bowiem w przeszłości finasowanie partii dostarczało materiału na wiele zaskakujących opowieści. Po 1989 r. zasady finansowania partii politycznych w Polsce kilkakrotnie ulegały modyfikacjom, aż w 2001 r. zostały uregulowane w najpełniejszy sposób, wprowadzając finansowanie partii z budżetu państwa. Artykuł przybliża ewolucje zasad finansowania partii politycznych oraz poddaje analizie wątpliwości, które pojawiły się podczas ponad 20 lat obowiązywania aktualnej regulacji ustawowej.

Celem opracowania jest ukazanie dotacji jako źródła finansowania systemu ochrony zabytków w Polsce. Przyjęto tezę, iż jednym z wielu czynników przesądzających o niwelowaniu negatywnych zjawisk w obecnym stanie systemu zabytków jest zdolność państwa do finansowania zasobu zabytków. Należy stwierdzić, że ostatnim okresie czasu nastąpił wzrost wykonanych wydatków w budżecie państwa w cz. 24 KiODN. Weryfikacja danych liczbowych pochodzących z opracowań Ministerstwa Kultury i Dziedzictwa Narodowego prowadzi do wniosku, iż w wydatkach na ochronę zabytków przeważają wydatki bieżące zaś udział wydatków majątkowych jest niestety niepokaźny.
The aim of the study is to present grants as a source of funding for the monument protection system in Poland. It has been argued that one of the many factors determining the suppression of negative phenomena in the present state of monuments system is the ability of the state to finance the monument. It should be noted that in the last period of time there was an increase in expenditures made in the state budget in part. 24 KiDNA. The verification of the figures from the Ministry of Culture and National Heritage results in the fact that expenditures on preservation of monuments are predominant in current expenditures and the share of wealth is unfortunately unprofitable.

The article explores the approach of the European Union to financing of scientific research. It begins by outlining strategic documents of the EU concerning research policy and developments in financial support addressed to this kind of activities. In 2017, the new funding formula for distribution of block grants for Polish universities came into force. Based on the figures, we discuss the impact of the new funding formula on block grants for universities. Besides the analysis of both size and structure (partition into different components) of the grants, we present accurate calculations concerning gains or losses for individual universities resulting from the introduction of elements of the algorithm such as: a reduction of the student component if the student-academic staff ratio is greater than 13, multiplication of the staff component by the academic category (based on the evaluation of the research activity) or benefiting the university for enrolling foreign students. The new funding formula provides powerful and fast-acting incentives, and so will have a great influence on the higher education system in Poland.

Profesor Jerzy Hausner, były minister rządu RP i ekspert Ministra Kultury jest autorem projektu reformy w sektorze kultury w Polsce. Według Jerzego Hausnera ograniczenia dotacji publicznych w kulturze i wzrost znaczenia form organizacyjnych - skoncentrowanych na prywatnych źródłach finansowania - są obecnie w Polsce koniecznością. Zdaniem J. Hausnera działalność artystyczna i kulturalna, która opiera się na trwałych źródłach finansowania publicznego powinna zostać ograniczona. Autor nie podziela tego punktu widzenia i uważa, że orientacja prorynkowa w kulturze w Polsce jest obecnie wystarczająca, a schlebianie gustom i likwidacja tradycyjnych barier pomiędzy kulturą masową a elitarną są raczej rezultatem częściowej komercjalizacji instytucji artystycznych w Polsce.
Professor Jerzy Hausner, former minister of Polish government and an expert of the Minister of Culture is an author of a reform project in the sector of culture in Poland. In his opinion—reduction of public financial support in culture and a growth of meaning of new organizational forms focused on private financing sources—are currently necessary (an economic crisis) in Poland. According to Professor Hausner—artistic and cultural activities, which require constant public financing, should be limited. The author does not share this point of view and thinks, that culture in Poland is currently sufficiently market-oriented and pandering to bad taste and liquidation of traditional barriers between the elite and mass culture—in the author's opinion—are rather a result of partial commercialization of performing art institutions.

Artykuł podejmuje rozważania teoretyczno-praktyczne dotyczące roli i skali związku funduszy pomocowych z działalnością trzeciego sektora. Na tle rozważań literaturowych, krytycznie oceniających nadmierne zbliżenie organizacji pozarządowych do biznesu, a w rezultacie rozmycie tożsamości sektora, badaniu podane zostały krajowe fundacje i stowarzyszenia. Przedmiotem szczegółowej analizy statystycznej została objęta struktura ilościowa projektów zrealizowanych w ramach Programu Operacyjnego Kapitał Ludzki 2007-2013. Milionowe granty i rodzaj realizowanych zadań okazały się odległe od teoretycznego wzorca organizacji pozarządowych reprezentujących interesy słabszych i niedostrzeganych przez państwo.
The article makes theoretical and practical considerations on the role and scale of aid funds in the activity of the third sector. The detailed statistical analysis covered the quantitative structure of the projects implemented under the Operational Program Human Capital 2007-2013 by associations and foundations. The quantitative study was included in the theoretical reflections critical of the excessive convergence of non-governmental organizations to business. As a result, the identity of the sector is blurred. Millions of grants and types of tasks have turned out to be far from the theoretical model of NGOs representing the interests of the weaker and unnoticed by the state.
