    Opis:
    The purpose of the article was to identify the most important barriers to the functioning of the Polish public procurement market for contractors. The main research method used was a diagnostic survey, in which an in-depth, categorized, open-ended interview was used. The survey was conducted in the first quarter of 2017 among 34 entities from the Opolskie Voivodeship. The analysis of the results shows that the main barriers to the public procurement market are: the complex procedure for submitting offers, the procedure for selecting contractors, the primacy of the price as the main criterion for selecting bidders, too wide a range of contractual penalties, and a complicated and costly appeal procedure. In order to improve the competitiveness of the Polish public procurement market, it was recommended, among others, to undertake educational activities, facilitate access to information, extend the obligation to publish orders, extend the time for submitting the offer, and counteract bid rigging.
    Celem artykułu była identyfikacja najważniejszych barier funkcjonowania polskiego rynku zamówień publicznych dla wykonawców. Główną metodą badawczą wykorzystaną w pracy był sondaż diagnostyczny, w ramach którego zastosowano wywiad pogłębiony, skategoryzowany o charakterze jawnym. Badanie przeprowadzono w pierwszym kwartale 2017 r. wśród 34 podmiotów z województwa opolskiego. Analiza wyników przeprowadzonych badań wykazała, że głównymi barierami rynku zamówień publicznych są: skomplikowany tryb składania ofert, procedura wyłaniania wykonawców, prymat ceny, jako głównego kryterium wyboru oferentów, zbyt szeroki zakres kar umownych oraz skomplikowany i kosztowny tryb odwoławczy. W celu poprawy konkurencyjności polskiego rynku zamówień publicznych rekomendowano m.in.: podjęcie działań edukacyjnych, ułatwienie dostępu do informacji, rozszerzenie obowiązku publikacji zamówień, wydłużenie czasu składania oferty oraz przeciwdziałanie zmowom przetargowym.

    Opis:
    Social clauses in public procurement allow for achieving social objectives related to public procurement. However, social clauses are hardly ever used, despite the changes introduced to the Public Procurement Law. In his article, the author attempts to find out whether this is due to the fact that social clauses are in vogue among more socially conscious buyers only, or due to little awareness of the existence of social clauses and the benefits they can give. Another potential reason may be the lack of knowledge and experience as for what clauses and in what way should be included in public procurement documents.

    Na skutek reformy unijnego systemu zamówień publicznych z 2014 r. doszło do zmiany paradygmatu prawa zamówień publicznych. W dyrektywach z 2014 r. podkreślono, że zamówienia publiczne odgrywają kluczową rolę w realizacji strategii EUROPA 2020, ponieważ są jednym z instrumentów rynkowych wykorzystywanych w celu osiągnięcia inteligentnego, trwałego wzrostu gospodarczego, sprzyjającego włączeniu społecznemu, przy jednoczesnym zagwarantowaniu najbardziej efektywnego wykorzystania środków publicznych. Strategiczne zamówienia publiczne, związane z realizacją zasady zrównoważonego rozwoju oraz promowaniem innowacji, zostały uznane za jeden z podstawowych elementów środowiska inwestycyjnego i strategiczny instrument w zestawie narzędzi polityki gospodarczej każdego państwa członkowskiego. W konsekwencji przyjęcia dyrektyw z 2014 r. doszło do zmian w polskim prawie zamówień publicznych. Ustawa z 11 września 2019 r. położyła większy nacisk na realizację zasady Best Value for Money z jednoczesną realizacją zasady zrównoważonego rozwoju. Jednakże samo unormowanie instrumentów prawa zamówień publicznych nie jest wystarczające do wykorzystania potencjału strategicznych zamówień publicznych na potrzeby polityki rozwoju. Artykuł wskazuje, że potrzebna jest skoordynowana i przemyślana polityka państwa w tym zakresie, uwzględniająca podejście z wykorzystaniem ekonomii behawioralnej oraz behawioralnej ekonomicznej analizy prawa, aby wykształcić właściwe praktyki na rynku zamówień publicznych, pozwalające na korektę dysfunkcji mechanizmów rynkowych i osiągnięcie celów rozwoju społeczno-gospodarczego.
    As a result of the 2014 reform of the EU public procurement system, there has been a paradigm shift in public  procurement law. The 2014 Directives underlined that public procurement plays a key role in implementing the EUROPA  2020 strategy, as one of the market-based instruments used to achieve smart, sustainable and inclusive growth while ensuring the most efficient use of public funds. Strategic public procurement, related to the implementation of the principle of sustainable development and the promotion of innovation, has been recognized as one of the basic elements of the investment environment and a strategic instrument in the economic policy toolkit of each Member State. As a consequence of the implementation of the 2014 directives,changes have been made to the Polish public procurement law. The Act of 11 September 2019 put more emphasis on the implementation of the Best Value for Money principle while simultaneously focusing on the principle of sustainable development. However, the mere regulation of public procurement law instruments is not sufficient to use the potential of strategic public procurement for the needs of development policy. This article suggests that a well-coordinated state policy should be taken into account in order to improve the efficiency of the procurement process. It also states that the adopting of behavioral economics tools and behavioral law & economic analysis, in order to develop appropriate practices on the public procurement market, might be crucial for correcting the dysfunctions of market mechanisms and achieving socioeconomic development goals.

    Opis:
    Properly conducted forest management is one of the essential conditions for the forests protection. The state of the natural element in Poland is affected, in various scale, by a number of factors, including those causing the formation of unfavorable changes in the forests condition. In this study, we would like to focus on a group of anthropogenic factors, whose negative impact, in our opinion, can be limited by the well−managed green public procurement policy. The aim of this study is to show the legal possibilities offered by the new EC directives on public procurement in relation to the protection of legal good which are forests, in order to stimulate the national legislator to proper implementation of these provisions into national legal order. Contents provided in this study are based on analysis of the provisions of normative acts and views expressed in the science of law on the ground of considered issues. At the same time, the analysis conducted in such a way allowed us to obtain the following results and conclusions. First of all, the environment protection, including forests, is becoming an increasingly important part of any modern economic policy of the state. Emphasizing the achievement of environment protection aims, including forests, through public procurement, requires the activity of the state, in particular the activation of particular groups of public entities. Only a coherent and integrated policy for public procurement in the state, can give the desired results. From our point of view, the President of the Public Procurement Office has a crucial role in the creation of public procurement environmental policy. At the same time, with the existence of legislation enabling the use of public procurement to protect the environment, including forests, the entities granting public procurement often do not benefit from these opportunities. In our opinion, there is some kind of mental barrier of people responsible for public procurement procedures that focus on the current cost of purchase, not interested in further operating costs and any maintenance and repair. It is therefore advisable to add more attention and care in the preparation of specification of terms of procurement, in order to take into account possible criteria relating not only to the current cost of purchasing, but also including subsequent operating costs. To this the new legislation contained in Directive 2014/24 EC and Directive 2014/25 EC should significantly contribute.

    Praca ma na celu weryfikację instrumentów Zintegrowanej Polityki Produktowej realizowanych przez kraję Unii Europejskiej. Dokonuje przedstawienia najważniejszych elementów ZPP: ekologicznej oceny cyklu życia, oznakowania ekologicznego, systemu ekozarządzania i audytu, zielonych zamówień publicznych, opłat i podatków ekologicznych oraz społecznej odpowiedzialności biznesu. Zawiera badania na temat identyfikacji percepcji czynnika ekologicznego jako kryterium wyborów konsumenckich. Wskazano, także poziom umiejętności identyfikacji produktów o lepszych parametrach środowiskowych, wśród konsumentów polskich, belgijskich i niemieckich.
    The paper assesses the progress of the implementation of the Integrated Product Policy in European Union. It presents the main elements of the IPP: LCA, ecolabeling, EMAS, green public procurement, ecotaxes and corporate social responsibility. It contains a study on the perception of the ecological factor identification as a criterion of consumer choices. It has also shown the level of the ability of identification products which has better environmental parameters, among Polish, Belgian and German consumers.
