The article describes changes in social awareness concerning social system, in particular the sphere of work. In theoretical dimension, the article refers to concept of social system and the perception of normative models: social, political, and economic. The empirical part presents the results of research into the field of social awareness, especially the awareness of members of a generation functioning in a liberal-democratic social system. The respondents were young residents of Warsaw with higher education. The research was carried out with a few-year time interval. The sphere of work is treated here as a key element of the wider social reality and included empirically through the individual orientation of the respondents in the normative models of society. In the light of research the sphere of work is clearly specific. In particular, the labour market regulations differs significantly from the reception of the remaining components of the social system.

Analiza semantyczna terminu „legitymizacja” jest zagadnieniem szczególnie doniosłym z uwagi na to, że ustalenie rozumienia tego terminu ma fundamentalne znaczenie dla dalszych rozważań nad tak ważnymi kwestiami, jak legitymizacja władzy sądowniczej czy pozycji ustrojowej sędziego. W doktrynie prawa konstytucyjnego brakuje pogłębionych analiz semantycznych, które pozwoliłyby na precyzyjną eksplikację tego, co myślą prawnicy, gdy używają terminu „legitymizacja”. Nawet pobieżna analiza literatury z tego zakresu pozwala na wyciągnięcie wstępnego wniosku, że w znacznej części rozpatrywanych spraw brak jest refleksji nad znaczeniem samego pojęcia „legitymizacja”. W niniejszym opracowaniu autor dokonał analizy definicji tego pojęcia, które pojawiają się w słownikach języka polskiego, a następnie skonfrontował ustalone znaczenia z rozumieniem „legitymizacji” w języku prawnym i prawniczym. We wnioskach autor wskazuje na dwa podstawowe sposoby rozumienia pojęcia „legitymizacja” i zaproponował ich rozróżnienie poprzez przypisanie jednemu z tych znaczeń terminu „legitymizacja”, a drugiemu „legitymacja”.
The semantic analysis of the term “legitimisation” is a particularly major issue, because determining the understanding of this term has a fundamental meaning for further considerations of such important issues as the legitimisation of the power, the judiciary or the systemic position of a judge. In the doctrine of the constitutional law there are lacks in-depth semantic analyzes that would allow a precise explication of what lawyers think when they use the term “legitimisation”. Even a cursory analysis of the literature in this field could allow us to draw a preliminary conclusion that when we discuss about this term, in a significant part of the cases considered, there is no reflection on the meaning of the concept of “legitimisation” itself. In this study, author analyzed definitions of this concept, which appears in the dictionaries of the Polish language, and then confronted the established meanings with the understanding of “legitimisation” in the legal and lawyers’ language. In conclusions, author points two basic ways of understanding the term “legitimisation” and proposed to distinguish them by assigning the phrase “legitimacy” to one of these meanings, and “legitimisation” to the other.

Opis:
Analyses on sources of legitimization bear, mostly, on theoretical reflection. The author aims to assess underpinnings of legitimacy in a quantitative way. This is an empirical study which examines determinants of subjective legitimization of government and social system in 21 European societies. Data comes from the first edition of European Social Survey carried out on national random samples in 2002. Legitimization is defined in terms of support for government, democracy, and economic policy of a given state. He aims, first, at assessing relative “levels” of legitimization throughout analyzed societies. Second, various sets of individual measures of social characteristics and attitudes are employed in order to establish some universal requirements of legitimacy. Third, an attempt is made to define macro-structural determinants of variations in legitimacy related to economic development, political system, degree of corruption and social structure. Finally, these findings are discussed in reference to most recent hipotheses concerning the relations between legitimization, welfare state and decreasing confidence and trust.
Rozważania poświęcone legitymizacji formułowane są na ogół w języku hipotez. Pewnym krokiem naprzód byłaby próba ich ilościowego ujęcia. Jest to celem analiz, które przedstawiam poniżej. Empiryczną bazą tych ustaleń są wyniki międzynarodowego badania European Social Survey zrealizowanego w 2002 roku w 21 krajach na reprezentacyjnych próbach, dobranych metodą losową. Legitymizacja definiowana jest jako postawa wyrażająca określony stopień poparcia dla polityki ekonomicznej, rządu i demokracji. Opierając się na tych danych spróbujemy ustalić generalne prawidłowości, jeżeli chodzi o poziom i czynniki legitymizacji w tych krajach.

As a consequence of the presence of immigrants in Poland various types of organizations provide them with services, assist them or supervise their integration process. Together those organizations constitute an organizational field. The actions of the actors must be legitimized according to the regulations, norms and cognitive mechanisms binding in the given organizational field. Therefore, legitimization is a process of acquiring legitimacy, which can be understood as a generalized perception or assumption that the actions of an entity are desirable, proper or appropriate within some socially constructed system of norms, values, beliefs and definitions. The actors carrying out the „integration” define the term in many different ways, and often consider it to denote different actions. This is not only because the concept of „integration” is open, but also because organizations and their officials use the term in a manner strikingly contrary to its academic definitions. The paper examines three cases of the legitimizing usage of the term „integration;” firstly, how the members of the organizations in the field refer to the literature about „integration” to name their practices; secondly, how the terms „integration” and „assimilation” are used in order to legitimize or delegitimize; and finally, how the formal requirements of the European funds exert coercive pressure for isomorphism on the organizations applying for resources and legitimization of their actions under the term „integration”.

The subject of the foregoing considerations will be the adequacy of constitutional and political competences of the President to the investiture method of a given person assigned to act in this office. Political and legal view of this issue will comprise, in particular, reflection on the division of powers, the impact that citizens may have on the state, the analysis of relations between entitlements and elections, as well as the study of opinions in the referred scope. The aspects of the states of emergency have been omitted here. In the article uses formal-dogmatic, comparative, and historical method. The aim of limiting the President’s influence on politics is to maintain state balance. However, according to the syntactic and chronological construction of the Art. 10 sec. 2 of the Constitution, the institution of the President should be strengthened so that it would be a real organ of the „first place”.
Przedmiotem rozważań jest adekwatność konstytucyjno-ustrojowych uprawnień Prezydenta do metody inwestytury danej osoby wybranej do pełnienia tego urzędu. Politologiczno-prawnicze ujęcie tego zagadnienia obejmować będzie, w szczególności refleksję nad podziałem władz, wpływem obywateli na państwo, analizę relacji pomiędzy uprawnieniami a wyborami, a także badaniu poglądów w powyższym zakresie. Pominięte zostały aspekty stanów nadzwyczajnych, aby móc zwrócić uwagę jedynie na aspekty typowego funkcjonowania państwa. W artykule użyto metod formalno-dogmatycznej, komparatystycznej oraz historycznej. Wydaje się, że celem ograniczania wpływu Prezydenta na politykę jest chęć zachowania równowagi państwowej. Jednak stosownie do syntaktyczno-chronologicznej konstrukcji art. 10 ust. 2 Konstytucji, należałoby wzmocnić instytucję Prezydenta tak, aby był on rzeczywistym organem „pierwszego miejsca”.

The aim of the following article is to present the role of the individuals or so called great men as well as the origin myths (founding myths) in legitimizing the power in sub-Saharian African states in the pre-colonial times. In the beginning, the notion of legitimization of power in sociology and political science as well as the discrepancies over the character of this phenomenon (Weber, Easton, Beetham) will be presented. Then, the causes and conditions for the formation of the states in pre-colonial Africa, particularly in the light of political anthropology, will be described. Next, the selected methods of legitimizing the power in these states will be analyzed. At the end, the role of the individuals or ‘great men’ in the formation of the states in pre-colonial Africa will be discussed. In this context the founding myths of two different countries — centralized state of Benin and one of the Hausa city-states — in which the personage of ‘great man’ plays a crucial role, will be presented.

In sociological analysis of crisis in Poland during the 1980s the author distinguishes 3 phases of the conflict: the period prior to 1980 (latent development of conflicting interests and aspirations), years 1980-1981 (the outbreak of the conflict and open articulation of interests) and the period that started with the introduction of martial law (an attempt of settling the conflict by eliminating one of its sides). Studying the dynamics of the conflict the author pays attention to the shift from dissatisfaction by the distribution system to the dissatisfaction with the efficiency of the economic system, on the one hand, and to the shift from anger directed at powerful elite to the critique of the methods of coming into power and limitations for authentic political participation, on the other. Conflict has evolved from a conflict of interests of particular groups into the global conflict involving the whole society. Moreover, beside the resistance to the system the crises brought about the grass root program of reforms. Although deprivation theory party explains the dynamics of the Polish conflict, the latter also possesses several unique features (e.g. high non-conformism of the working class; low level of adaptive reactions to conflict). The author suggests considering factors that might influence the unique course of the conflict in Poland and speculates on the potential means of overcoming conflict that could account for these unique features.

W artykule opisano znaczenie stosowania prostego języka w komunikacji konstytucyjnej i wynikających z tego korzyści. Autorka inspirowała się obserwacjami sytuacji politycznej w Polsce i na świecie, które wykazały istnienie coraz silniejszych tendencji manipulacyjnych i populistycznych zniekształcających przepisy prawa, wartości i zasady konstytucyjne. W artykule pokazano rolę konstytucji w państwie i społeczeństwie, istotę i dynamikę procesów legitymizacyjnych, a także pozytywy płynące z uproszczonej komunikacji o konstytucji dla akceptacji porządku prawnego, konstytucyjnych zasad i wartości. Główny wniosek z artykułu jest następujący: praktyczna znajomość prawa konstytucyjnego zwiększa świadomość społeczeństwa, skuteczność jego funkcjonowania w systemie politycznym oraz zmniejsza prawdopodobieństwo wystąpienia ideologicznych manipulacji i nadużyć władzy.
The article aims to describe the importance of using plain language in constitutional communication and the resulting benefits. It was inspired by observations of the political situation in Poland and in the world, which showed the existence of growing manipulative and populist tendencies distorting the law, value, and constitutional principles. The article shows the role of the constitution in the state and society, the essence and dynamics of legitimizing processes, as well as the benefits of simplified communication about the constitution for the acceptance of the legal order, constitutional principles, and values. The main conclusion from the article is that the practical knowledge of constitutional law increases the awareness of society, the effectiveness of its functioning in the political system, and reduces the likelihood of ideological manipulations and abuses of the authorities.

The author, utilizing the apparatus of systems and decision analysis, reviews and interprets the results of the research on the link between legitimacy and systemic stability that are included within the source literature. On this basis, the author attempts to construct a model of the dependency between systemic stability and legitimacy of power – such measure allows for presenting conclusions on the nature of political legitimacy (understood as a determinant and as a tool of performing the social functions of political power).

The article summarizes panel discussions led at the Polish Scientific Networks conference. It covers the topics of social and (un)social innovations, their sources, and applications, as well as the new approaches to the concept of the wisdom of the crowds (as opposed to swarm mentality). The article draws on academic research on trust and distrust, declining reliance on formal expertise and a turn against the science, and posttruth society phenomenon. Opis:
The paper analyzes relations between the law and the system of politics of memory in Poland, integrating legal and political research. The main objective is a discussion of co-dependencies between the law – including the constitutional law – and the government’s involvement in the politics of memory. The paper summarizes the legal status, the remembrance system’s formal framework and political decisions executing the constitutional obligation of commemorating the past. Considering the complexity of the remembrance policy system in Poland, its foundation in the legal system, and the dynamics of policymaking, the Authors present that the seeming servitude of law to politics is an apparent complex interdependence based on the constitutional bases of memory politics.
Przedmiotem artykułu jest analiza związków prawa i polityki historycznej w Polsce w ujęciu systemowym, integrującym narzędzia nauk prawnych i politycznych. Głównym celem jest ukazanie wzajemnych zależności między prawem – ze szczególnym uwzględnieniem prawa konstytucyjnego – a zaangażowaniem państwa w politykę pamięci. Artykuł podsumowuje obecny stan prawny i jego ramy formalne dla systemu polityki historycznej oraz decyzje polityczne dotyczące realizacji konstytucyjnej powinności upamiętnienia przeszłości. Dyskutując elementy systemu polityki historycznej w Polsce, ich umiejscowienie w ramach prawnych oraz dynamikę działań politycznych autorzy ukazują, że pozorna służebna funkcja narzędzi prawnych wobec polityki jest w rzeczywistości złożoną współzależnością wynikającą z konstytucyjnych fundamentów prowadzenie polityki historycznej przez państwo.
