Opis:
The article discusses a Joseph Ratzinger’s stance (maintained by Pope Benedict XVI) on sources and essence of law in comparison to the current dominant positivist perspective on legislation. Publications and statements of the theologian show that thesis about religious roots of law making should be acknowledged as justified and standing on historical grounds. This point of view allows one to perceive an individual that is rational and has free will as the source of moral natural law, by which positive law should bound. Developed by the Christian thought, this hierarchy of laws ensures, effectively and permanently, the state has the right to sanction inviolable dignity and subjective rights everyone is entitled to. However, the promoted concept substantiated by universal religious axiology stays in contrast to the currently propagated formalistic, utilitarian, and relativistic view of the law making system. In the Pope’s conviction, current preference of idea of law not connected to religion and ethics supports the ambivalence of human rights (and of their interpretation) rather than considering them as a common and absolutely binding ground in the European tradition.
Artykuł omawia stanowisko kardynała Josepha Ratzingera (kontynuowane przez papieża Benedykta XVI) w kwestii źródeł i istoty prawa na tle obecnie obowiązującego, dominującego pozytywistycznego ujmowania porządku prawodawczego. Z publikacji i wypowiedzi tego teologa wynika, że za uprawnioną i historycznie umotywowaną należy uznać tezę o religijnych korzeniach stanowionego prawa. Takie ujęcie pozwala bowiem dostrzec w rozumnej i obdarzonej wolną wolą jednostce źródło moralnego prawa naturalnego, które powinno stanowić moc wiążącą dla prawa pozytywnego. Wspomniana zależna hierarchia praw, wypracowana przez chrześcijańską myśl, dostarcza skutecznej i trwałej gwarancji do sankcjonowania przez państwo nienaruszalnej godności i praw podmiotowych przysługujących każdemu człowiekowi. Propagowana koncepcja umotywowana uniwersalną aksjologią religijną pozostaje jednak w kontraście do aktualnie promowanego formalistycznego, utylitarnego i relatywnego postrzegania systemu stanowienia prawa. W przekonaniu papieża obecnie wyrażana preferencja idei prawa oderwanego od religii i etyki raczej służy ambiwalencji praw człowieka (i ich interpretacji) niż traktowaniu ich jako wspólnej oraz bezwzględnie obowiązującej płaszczyzny europejskiej tradycji.

In a post-modern, multicultural world, the present head of the Roman Catholic Church, similarly to his predecessor Benedict XVI, consistently promotes natural rights theory as a common, universal, moral heritage which determines and reflects on the individual, social and political orders of life. What underpins the Pope’s view is the philosophical anthropology that reflects the immutability of being in its duration and structures, and that exposes, more distinctly than promoted by his predecessors, the need for related- ness with other human beings. His theory of natural law, not only on a philosophical but also religious level, presupposes recognition of this concept on the basis of faith in revealed truth. For the Pope, this approach translates to recognizing the supremacy of morality over the law that may obtain universal qualities if it accepts its subordination to ethical values. For Pope Francis, such a prospective is a basis for dialogue between differ- ent cultures and religions. Simultaneously, it allows to formulate canons of common law in the public and private dimension, whose sources should be sought in the idea of dig- nity and in immutable human rights that arise from it. However in the context of the in- terpretation of some fundamental rights, it should be noticed that the emphasis present during transmission to the public is slightly different in terms of their contents, which causes numerous ambiguous comments. Undoubtedly, the theory of law proposed by Pope Francis arises out of the need to identify an effective counterbalance to the current culture of so-called subjective and shallow truths which implement individual, selfish projects of social, economic and political existence.

In the social considerations of Benedict XVI, the point of reference was Christian anthropology. It is from its perspective that the Pope analyzed current social and political relations as well as economic relations prevailing in specific countries and in international relations. He recognized that these spheres of human existence must permeate ethics rooted in the personal and transcendent nature of individuals. This humanistic idea of morality gains special significance in the context of now visible atomization of societies, weaknesses of law in individual countries or dominance of soulless business, which ultimately fuel the global economic crisis. The Pope, therefore, saw the need to update this spiritual aspect of human existence in order to strengthen solidarity and subsidiarity in socio-economic relations, and to stimulate proper cooperation of the state with the economy on the local and supranational scale. He also noted that its principles allow people to realize their own potential responsibly, but also sensitize them to the needs of other individuals. In the Pope’s recognition, Christian ethics is in particular in the realities of the crisis to mobilize states, economic enterprises and international organizations to undertake joint activities for the general public good, without – at the same time – suppressing the activity of individuals and communities.

The article attempts to reconstruct the concept of an ethical state of law present in the teaching of Pope Benedict XVI. The Authors remind us that prior to becoming the Bishop of Rome Joseph Ratzinger levelled thorough critique at the project of modernity that came into being in the wake of the Enlightenment world view. He was also critical of the antihumanistic aspects of intellectual trends associated with post-modernism. Among the crucial aspects under criticism was a tendency in law and politics to capture a human being in a reductionist and one-dimensional manner as a being that is capable of functioning in isolation from God. Rejecting the postulate of creating a state and legislation based solely upon supposed indications of the reason or upon the unlimited power of public authority, Ratzinger stressed the importance of ethical guidelines grounded in rules of appropriate conduct for a person or society, which in his view have a universal reference, proclaimed by Christianity. Isolating those rudimentary principles of conduct, Benedict XVI outlined the basis for a concept of an ethical state of law. The novelty of this perspective was that he consistently combined the positivist and modern construct of a state of law with a system of ethical principles of religious and natural-law nature. The import of his deliberations is strongly felt in the context of current debates and in the scope of lawful interference of state law in the basic existential spheres, such as life, family, or marriage.

Background: The issue of grandparents’ support provided to their families is undertaken in Polish literature very seldom. There are no studies concerning single mother families. The purpose of the article is to examine the extent to which grandparents provide support to grandchildren brought up in single mother families, and determine the relationship between the grandparents’ support and the grandchildren’s quality of life. Materials and Methods: The survey data were collected from 119 people from single mother families. The Student’s Life Satisfaction Scale SLSS was used to test the quality of life and the Social Support Scale (SWS) was used to test the strength and type of support from grandparents. Results: Mother’s parents are involved in each of the considered types of support in a higher degree than father’s parents, regardless of the place of residence of the single mother family. In small towns maternal grandparents provide information support more often than paternal grandparents, maternal grandmothers engage in instrumental aid to grandchildren more often than paternal grandparents. In cases of families living in large cities, when the paternal grandfather gives instrumental, emotional or evaluative support, grandchildren assess their quality of life significantly better. The assessment of quality of life is also higher in cases of maternal grandfather’s emotional engagement in support for grandchildren. Conclusions: The results suggest that the grandfathers’ (particularly paternal grandfather’s) support in the single mother family is positively connected with quality of life of grandchildren. It can be assumed that supporting grandparents contribute to strengthening the resilience of whole family.
