In this paper, I show that Aristotle’s refutation of the Eleatic argument in Physics I.8 is based on the idea that a thing at the starting point of coming to be is composite and is made up of what underlies and a privation. In doing so, I clarify how the concept of accidentality as used in his solution should be understood in relation to the composite nature of what comes to be. I also suggest an explanation of why Aristotle’s discussion of the Eleatic dilemma in Physics I.8, unlike his discussion in the previous chapter, is not clear.

This paper contextualizes and analyzes the main emerging approaches to the understanding of the right to be forgotten and its application in praxis, using legislation and judicial practice of the European Union and Ukraine as reference scales. By bridging the gap between positive and interpretative orders of law implementation, which were previously imperatively opposed and considered mutually exclusive in the Ukrainian legal system, the paper supports the arguments that the process of mastering the protection of right to be forgotten requires a further mindset shift equally for-Internet providers and all involved law enforcers.

The article discusses the decisions “Right to be forgotten I” and “Right to be forgotten II” of 6 November 2019 by the Federal Constitutional Court, which redefine the relationship of cooperation between the Federal Constitutional Court and the European Court of Justice in the area of fundamental rights. The Court has decided for the first time that where EU fundamental rights take precedence over German fundamental rights, the Court itself can directly review, on the basis of EU fundamental rights, the application of EU law by German authorities. In the first part, the article presents the previous system, including the precedence of application of EU law and its exceptions (ultra-vires review; identity review), as well as the controversial question of the interpretation of Article 51 (1) of the Charter of Fundamental Rights, which is decisive for the applicability of the fundamental rights under the Charter. The focus is on the constitutional background of the German Basic Law for the protection of fundamental rights in the European multi-level system. Against this background, the second part of the article presents the facts and reasons for the decisions “Right to be forgotten I” and “Right to be forgotten II”. This is followed by an analysis of the consequences of these decisions for the protection of fundamental rights and cooperation between the European Court of Justice and the Federal Constitutional Court. In particular, the way in which fundamental EU rights can now be enforced before the Federal Constitutional Court is described in greater detail. The concluding part provides an overview of the open questions, risks and opportunities of this approach. Here the article illustrates the significant impact of the two decisions on dogmatic and procedural matters.

This paper tries to get a response to the following question: When can a narrowband power amplifier (PA) be considered to be memoryless and when can it not be considered memoryless? To this end, a thorough and consistent analysis of the notions and definitions related with the above topic is carried out. In the considerations presented, two models of the narrowband PA are exploited interchangeably: the black box model widely used in the literature and a model developed here, which is based on the Volterra series. These two models complement each other. In this paper, the conditions for a linear or nonlinear narrowband PA to be memoryless or approximately memoryless or possessing memory are derived and illustrated. They are formulated in terms of the signal delay as well as in terms of the amplitude-to-phase (AM/PM) conversion of the amplifier. Furthermore, the two possible interpretations of the amplitude-to-amplitude (AM/AM) and AM/PM conversions are given a mathematical framework. That is these conversions are presented through some operations. One set of these operations allows to treat the AM/AM and AM/PM conversions as distortions of the modulating signals. Or equivalently as distortions of a given signal constellation when it passes through the PA. Finally, it is proved that the Saleh’s and Ghorbani’s models of the AM/AM and AM/PM conversions occurring in the PAs, which were published in the literature, are not memoryless ones.

The aim of the article is to explain interconnectivity between corporate culture and safety culture, which aim to utilize motivation to prevent work accidents and other unwanted events in an enterprise. The article deals with ways how to improve approaches to Occupational Health & Safety, OH&S, at work place through proper direction of corporate culture. It introduces internal and external determinants of corporate culture, which have a significant effect. The article introduces common features of corporate culture and safety culture as an element of the OH&S management system with emphasis on system effectiveness. The final portion of the article presents the hierarchy of needs model, which may serve as a basis motivating employees to follow safety and health rules at work place.
Celem artykułu jest wyjaśnienie wzajemnych połączeń między kulturą korporacyjną i kulturą bezpieczeństwa, które mają na celu wykorzystanie motywacji w celu zapobiegania wypadkom przy pracy i innych niepożądanych zdarzeń w przedsiębiorstwie. W artykule wskazano na sposoby poprawy podejścia do bezpieczeństwa i higieny pracy, BHP w miejscu pracy, poprzez właściwą stronę kultury korporacyjnej. Wprowadzono wewnętrzne i zewnętrzne determinanty kultury korporacyjnej, które mają znaczący wpływ. W artykule wskazano na wspólne cechy kultury organizacyjnej i kultury bezpieczeństwa, jako element systemu zarządzania BHP z uwzględnieniem efektywności systemu. Końcowa część artykułu przedstawia hierarchię modelu potrzeb, które mogą służyć jako podstawa motywowania pracowników do przestrzegania zasad bezpieczeństwa i ochrony zdrowia w miejscu pracy.

Since the dawn of time people have felt the need to protect their private lives. Contemporarily, the right to privacy remains one of the basic human rights. There are very few voices advocating that an individual shall be deprived of a possibility to keep any information about them in secrecy. Such views receive strong criticism as the majority of social groups and circles is likely to accept some constraints only due to the necessity to provide safety to communities. However, the issue whether other living creatures are entitled to be granted with the right to privacy does not remain a widely discussed matter. First signals pointing to the fact that functioning of animals may result in establishing some sorts of private spheres by them date back to as early as a few decades ago. They did not, however, bring about any wider interest whatsoever. Several years ago Brett Mills, Ph.D. raised the aforementioned question with regards to the manner in which the groups producing wildlife documentaries operate. His position stood up against strong opposition from numerous environments and backgrounds, including such ones acting in favour of animals. Animals’ right to privacy remains an interesting issue and ought to be analysed in a more profound manner. My article aims to present in detail the issue of animals’ right to privacy with special emphasis put over physical distance and the right to be let alone.

The concept of procedural fairness plays an important role in the enforcement of competition law, which must not only be effective but also fair. Thus, legal institutions should guarantee a proper level of protection of the values of procedural fairness. This paper is dedicated to the possible conflict between the guarantees of procedural fairness that find their expression in the right to be heard and in the protection of confidential information. Both guarantees, the right to be heard on the one side, and the protection of confidential information on the other, should be properly balanced. Unlike EU law, Polish legislation and jurisprudence proves to be inefficient in this respect. Article 69 of the Competition Act fails to show clearly what the limits of the protection of confidential information are in situations when the right to be heard of other parties of antitrust proceedings is at stake. Business secrets are predominantly protected over the right to be heard also in the jurisprudence of Polish courts. By contrast, the Competition Act does not seem to properly protect confidential information other than business secrets. Such situation poses a risk for the adequate level of protection of procedural fairness in Polish antitrust enforcement. Moreover, neither Polish legislation nor jurisprudence explains to companies what shall prevail in the case of a concrete conflict between the protection of business secrets and the right to be heard. An answer to this questions is needed seeing as proof of a competition law infringement which should be accessible to the parties, can at the same time constitute a business secret.
Le concept de l’équité procédurale joue un rôle important dans le renforcement de la loi de la concurrence, qui, outre d’être efficace, doit aussi aussi être équitable. Pour cela, les institutions légales devraient garantir le niveau de protection de l’équité procedurale nécessaire. L'objet de cet article est d'étudier les conflits possibles entre les garantis de l’équité procédurale qui trouvent leur expression dans le droit d'être entendu et dans la protection des données confidentielles.

This article analyses Polish competition procedure from the perspective of a) the right to be heard, and b) the right to receive information about the proceedings. It points out problems with access to information about competition proceedings which influence the level of protection of the right to be heard in these proceedings. In order to appraise this issue, the article embarks upon an examination of the rules governing the right to be heard in Polish competition enforcement proceedings. It then focuses on the extent of the competition authority's obligation to inform undertakings about the actions addressed to them. The article includes discussion of the rules that circumscribe the parties’ right of access to evidence in the proceedings. Finally, proposals for changes in the practice of the competition authority, as well as in the Polish legal framework, are put forth. The new rules governing competition proceedings before the European Commission serve as an example for improvements in Polish competition procedures.
Dans cet article, la procédure polonaise de concurrence est analysée dans l’optique du droit d’être entendu et du droit à l’information. Le but en est d’identifier les problèmes en matière d’accès à l’information sur la procédure de concurrence, susceptibles d’impact sur le niveau de protection du droit d’être entendu dont jouissent les entreprises qui sont les parties de la procédure. Les considérations contenues dans l’article se focalisent d’abord sur les dispositions qui règlent le droit d’être entendu pendant la procédure de concurrence. Ensuite, l’attention porte sur l’obligation qu’a l’autorité de concurrence d’informer les entreprises sur les actions intentées contre elles. L’article analyse aussi l’étendue de l’accès des parties de la procédure de concurrence aux éléments de preuve recueillis par l’autorité de concurrence. On formule également dans l’article des propositions de changements législatifs et pratiques en matière d’application du droit. Les règles nouvelles qui régissent les procédures de concurrence devant la Commission européenne sont prises en compte en tant qu’indications utiles à l’évolution de la procédure polonaise.

Objective: The current study aims to investigate, which of the factors are directly and indirectly associated with disordered eating in a non-clinical population of university students in Slovakia. Methods: 302 university students (52.3% female, M age=21) filled in a questionnaire assessing the perceived pressure to be thin, the internalization of appearance ideals, disordered eating, satisfaction of basic psychological needs and the regulation of exercise. The hypothesized model was tested with a parallel multiple mediation analysis using PROCESS macro. Results: The pressure to be thin from partner, the internalization of appearance ideals and the controlled regulation of exercise were directly associated with disordered eating. The pressure to be thin from media was indirectly associated with disordered eating through the internalization of appearance ideals. The pressure to be thin from partner and from family as well as satisfaction of the need for competence were indirectly associated with disordered eating through the controlled regulation of exercise. Conclusions: The results of the current study support the focus of the existing eating disorder interventions at decreasing the internalization of sociocultural appearance ideals. The results suggest the usefulness of incorporating the promotion of autonomous regulation of behaviour, especially with regard to exercising, within the prevention and intervention field.

The study presents a stochastic epidemic model applied to the model of indigenous language extinction. The Susceptible-Infectious-Removed (SIR) categorization of an endemic disease has been reformulated to capture the dynamics of indigenous language decline, based on the assumption of non-homogeneous mixing. The time in which an indigenous language is expected to be extinct was derived using a modified SIR model with the population segmented into several sub-communities of small sizes representing family units. The data obtained from the 2016 indigenous language survey conducted in several parts of Nigeria and from the 2013 Nigeria Demographic Health Survey (NDHS) were used to estimate the key parameters of the model for Nigeria’s several indigenous languages. The parameters of interest included the basic reproduction number, the threshold of endemicity, and the time in which a language is expected to be extinct, starting from the endemic level. On the basis of the time in which a language is expected to be extinct, several of the surveyed languages appeared to be in a precarious condition, while others seemed virile, thanks to a high language transfer quotient within families.

The article deals with the problem of training specialists in the field of petroleum engineering ready to work in interdisciplinary teams and projects. Interdisciplinary approach including globally conditioned interdisciplinarity has been discussed in the context of engineering education since the beginning of the 21th century. This approach contains a number of basic components, namely: structure, process, language, identity, and technologies. Efficiency of interdisciplinary training depends on the general dynamics of a team. The international community has not disputed on the significance of interdisciplinary approach for engineers, but the key issue remains – how to apply theory for practice in both curricula development and learning process itself. Interdisciplinarity in the petroleum education is considered as a basis for critically new competitive engineering solutions. The indicators proving the presence of interdisciplinary management system at university are outlined. Based on the elaborated principles of interdisciplinary activities a set of required tools and elements to manage interdisciplinary training of petroleum engineers is presented. The significance of an interdisciplinary approach in professional training for future petroleum engineers is grounded. It has been proved that interdisciplinarity in its broadest sense is the trend, challenges of a global nature, which are updated set of circumstances, reasons that are multifaceted, varied and contradictory. It has been substantiated that the methodological part, multidisciplinary update of economics has become a constructive synthesis of theoretical research in this area, which includes not just interdisciplinary cooperation and mutual enrichment at the methodological level, forming a systematic, holistic vision of the economy, the problems and contradictions of development.
