    W dyskursie prawniczym używane są przynajmniej trzy pojęcia odpowiedzialności, a mianowicie: odpowiedzialności sprawczej, zobowiązaniowej i normatywnej. Mówiąc o „ponoszeniu odpowiedzialności prawnej”, mamy na myśli odpowiedzialność normatywną. Przypisanie odpowiedzialności normatywnej sprowadza się do stwierdzenia, że wobec danego podmiotu może być zastosowana sankcja społeczna. Zastosowanie sankcji nie zawsze wiąże się z czynem podmiotu, wobec którego stosowana jest sankcja. Tak więc sankcja społeczna może być zastosowana bez związku z czynem: na zasadzie ryzyka lub na zasadzie słuszności. Jednakże gdy sankcja prawna stosowana jest ze względu na czyn, to warunkiem koniecznym jej stosowania jest to, że czyn ten narusza normę prawną. Inaczej jest np. w wypadku sankcji moralnej, która może być stosowana również ze względu na czyn, który nie narusza normy. W takim wypadku mówimy o odpowiedzialności słusznościowej. Pojęcie odpowiedzialności słusznościowej może być użyteczne również w rozważaniach prawnych.

    Opis:
    This work introduces ANB (Ant Algorithm for Non-Bifurcated Flows), a novel approach to capacitated static optimization of flows in connection-oriented computer networks. The problem considered arises naturally from several optimization problems that have recently received significant attention. The proposed ANB is an ant algorithm motivated by recent works on the application of the ant algorithm to solving various problems related to computer networks. However, few works concern the use of ant algorithms in the assignment of static flows in connection-oriented networks. We analyze the major characteristics of the ANB and try to explain its performance. We report results of many experiments over various networks.

    The eigenvalues assignment problems for descriptor linear systems with state and its derivative feedbacks are considered herein. Necessary and sufficient conditions for the existence of solutions to the problems are established. The Euler and Tustin approximations of the continuous-time systems are analyzed. Procedures for computation of the feedbacks are given and illustrated by numerical examples.

    Opis:
    Missing traffic data is an important issue for road administration. Although numerous ways can be found to impute them in foreign literature (inter alia, the most effective method, that is Box-Jenkins models), in Poland, still only proven and simplified methods are applied. The article presents the analyses including an assessment of the completeness of the existing traffic data and works related to the construction of SARIMA model. The study was conducted on the basis of hourly traffic volumes, derived from the continuous traffic counts stations located in the national road network in Poland (Golden River stations) from the years 2005 – 2010. As a result, the proposed model was used to impute the missing data in the form of SARIMA (1.1,1)(0,1,1)168. The newly developed model can be used effectively to fill in the missing required days of measurement for estimating AADT by AASHTO method. In other cases, due to its accuracy and laboriousness of the process, it is not recommended.

    Opis:
    Aim of this study is to show the dangers of filling missing data - particularly medical data. Because there are many dedicated medical expert systems and medical decision support systems, a special attention must be paid on the construction of classifiers. Medical data are almost never complete, and completion of the missing data requires a special care. The safest approach of dealing with missing data would be removing records with missing parameters and/or removing parameters that are missing in the records. Unfortunately reducing data set that is already very small is not always an option. Dangers coming out from data imputation are shown in the article, which presents the influence of selected missing data filling algorithms on the classification accuracy.

    It is shown that in uncontrollable linear system x = Ax + Bu it is possible to assign arbitrarily the eigenvalues of the closed-loop system with state feedbacks u = Kx, K ∈ ℜn⨉m if rank [A B] = n. The design procedure consists in two steps. In the step 1 a nonsingular matrix M ∈ ℜn⨉m is chosen so that the pair (MA,MB) is controllable. In step 2 the feedback matrix K is chosen so that the closed-loop matrix Ac = A − BK has the desired eigenvalues. The procedure is illustrated by simple example.
