Various aspects of the anticipated (expected) breach of obligations under a contractual relationship have long been the subject of discussion with respect to the Polish Civil Code of 1964, which does not provide a general legal basis entitling the creditor to terminate the contract before it becomes due. This situation has changed with the entry of the amendment of May 30, 2014, as the introduction of Art. 4921 of the Civil Code was an important legislative step, which requires a comprehensive comment. A comprehensive linguistic and functional analysis of the said provision, regulating an inevitable non-performance, however, requires a broader view, especially from the perspective of the common law system (as an institution of Anglo-Saxon origin) or other international regulations (which are a source of inspiration for the Polish legislator). Both legal and comparative verification not only facilitates a fuller understanding of the nature of the anticipatory breach institution itself, but above all, allows one to realize the consequences and a number of contentious issues involving the practical application of the institution of art. 4921 of the Civil Code from the perspective of participants of the legal and economic market.

The term communitas, introduced into anthropological discourse by Victor Turner in the late 1960s, returned to humanist debates at the threshold of the twenty-first century by way of Roberto Esposito. Referring to Esposito’s concept of communitas, this essay brings out the anthropological tradition in thinking about the common, which Esposito had marginalized. The present author emphasized the importance of processuality and antistructural dimensions of egalitarian forms of togetherness, along with their potential to liberate human capacities of creativity. Examining the relation between munus and ludus, she shows theatricality residing immanently in the root of communitas. Focusing on the aesthetic and creative dimensions of togetherness helps in detecting multiple forms of commonality, and indicates various models of theatrical communitas. Exploring a nonnormative, transformative potential in experimental theater (Jerzy Grotowski, Sarah Kane, Ron Athey, Krzysztof Garbaczewski), she emphasizes collective, temporal, and excessive natures of theater that eschews the market-driven economy, along with the importance of a transversal communitas where the human being is only one of many actors. Some threads of the argumentation are expanded upon in a conversation with Leszek Kolankiewicz, included as an appendix.
Pojęcie communitas, wprowadzone do dyskursu antropologicznego przez Victora Turnera pod koniec lat 60. XX wieku, powróciło do debaty humanistycznej u progu XXI wieku za sprawą Roberta Esposito. Niniejszy esej przywraca zmarginalizowaną przez Esposito antropologiczną tradycję w myśleniu o tym, co wspólne. Autorka podkreśla znaczenie procesualności i antystrukturalności egalitarnych form bycia razem oraz ich potencjał wyzwalania kreatywności. Analizując relację między munus a ludus, ukazuje teatralność jako immanentną właściwość communitas. Skupienie na estetycznych i twórczych aspektach wspólnotowości pozwala odsłonić i nazwać wiele jej form oraz scharakteryzować rozmaite modele teatralnej communitas. Autorka wskazuje na nienormatywny i transformacyjny potencjał teatru eksperymentalnego (Jerzy Grotowski, Sarah Kane, Ron Athey, Krzysztof Garbaczewski), by podkreślić kolektywny, efemeryczny i ekscesywny charakter teatru wymykającego się ekonomii rynku, a także uwydatnić znaczenie transwersalnej communitas, w której człowiek jest tylko jednym z wielu aktorów. Jerzy Grotowski chose to name his College de France lecture series La „lignee organique” au theatre et dans le rituel (The „Organic Lineage” in Theatre and Ritual), and the author, who attended and documented these final public talks, contends in this article that organicity constitutes a through-line connecting Grotowski’s theatrical and post-theatrical research. The author draws from these talks, as well as from her Grotowski-based training, including her work with Rena Mirecka, and her research collaborations with Indigenous artists and scholars from Turtle Island (North America), including Floyd Favel, who worked with both Grotowski and Mirecka. The author points out that in diverse traditional cultural practices whose role it is to enhance, restore, and sustain balance between human and non-human forms of life, organicity is understood as a living force endowing performative processes with energy, power, and efficacy. The post-Grotowskian performance paradigm envisioned by the author hinges upon a non-anthropocentric perspective informed by the ecological and spiritual dimensions of relationality articulated by several generations of Indigenous scholars. She contends that such a paradigm shift, which challenges artistic practices glorifying human creative agency, can provide a viable alternative to the dominance of (Eurocentric) new materialist/posthumanist theories of non-human agency.
Jerzy Grotowski zatytułował swój cykl wykładów w College de France La „lignée organique" au théâtre et dans le rituel („Linia organiczna” teatrze i rytuale). Autorka, która dokumentowała te ostatnie publiczne wystąpienia, stawia tezę, że organiczność stanowi linię łączącą teatralne i postteatralne badania Grotowskiego. Odwołuje się do tych wykładów i do własnego treningu opartego na praktykach Grotowskiego, w tym do pracy z Reną Mirecką, a także do współpracy badawczej z rdzennymi artystami i badaczami z Turtle Island (Ameryka Północna), między innymi z Floydem Favelem, który praktykował z Grotowskim i z Mirecką. Autorka wskazuje, że w różnorodnych tradycyjnych praktykach kulturowych, których rolą jest wzmacnianie, przywracanie i podtrzymywanie równowagi między ludzkimi i nie-ludzkimi formami życia, organiczność jest rozumiana jako żywa siła nadająca procesom performatywnym energię, moc i skuteczność. Post-Grotowski paradygmat performatywności zaproponowany przez autorkę opiera się na nieantropocentrycznej perspektywie inspirowanej ekologicznym i duchowym wymiarem relacyjności podkreślanym przez kilka pokoleń rdzennych badaczy. Autorka twierdzi, że taka zmiana paradygmatu, która rzuca wyzwanie praktykom artystycznym gloryfikującym ludzką kreatywność, może stanowić realną alternatywę dla dominacji (eurocentrycznych) nowomaterialistycznych i posthumanistycznych teorii nie-ludzkiej sprawczości.

A bank, particularly in developing countries like Turkey, is one of the most important institutions in the financial sector. Therefore knowing the factors affecting the performance of banks is important for the development of the sector. One of the factors affecting the risk and profitability of banking sector is the internal factors of the banks. The aim of this paper is to investigate the board of directors’ characteristics and its effect on risk level measured by non-performing loans and on bank performance measured by asset profitability using the Generalized Method of Moments (GMM) estimator. Data from nineteen deposit banks for the period 2012–2018 were used. The result of the study determined that the board size, foreign board members and the independent board members have an effect on both non-performing loans and the return on assets.

One of the objectives of performance auditing is to examine and assess the efficiency of the audited processes, programmes and organisations. To this end, the ratio method is usually used (the relation between output and input). However, it is faulty and has several significant limitations. Simultaneously, more advanced analytical methods are often considered as too complicated. The author, apart from discussing the basic issues, including the definition of efficiency, focuses on the application of the so called non-parametric methods for assessing efficiency, especially the Data Envelopment Analysis (DEA) method. This method is known in academic circles, but it is also frequently applied in evaluation and benchmarking in business and in the public sector, and is recommended by various institutions and government agencies in many countries. Although the DEA is used by some audit institutions, it still seems to be not very common in auditing. In his article the author presents, in the most accessible manner possible, the idea of the DEA method, simple tools for its application and case studies.

Due to the possibility of using high performance concrete in the underground construction industry, e.g. for casing of tunnels and wells, the authors of this article have undertaken an attempt to check whether existing standards and instructions allow for assessing the strength of high performance concrete during its curing with non-invasive methods. This paper presents the results of non-invasive tests performed on high performance concrete samples in various curing periods (3, 7, 14, 21 and 28 days). On the basis of the results obtained, the compressive strength of the samples was estimated using base curves from the literature. The existing base curves were also scaled according to the recommendations contained in the standards and sectoral instructions. In order to be able to carry out a full analysis of test results, also authors' base curves were set. As a result, comparative material was obtained, which allows for assessing the possibility of applying the aforementioned methods for the tested high performance concrete in the time function.
Ze względu na możliwość wykorzystania betonu wysokowartościowego w budownictwie podziemnym np. na obudowę tuneli i szybów, autorzy artykułu podjęli próbę sprawdzenia, czy istniejące normy i instrukcje umożliwiają ocenę wytrzymałości betonu wysokowartościowego w czasie jego dojrzewania metodami nieniszczącymi. W pracy przedstawiono wyniki przeprowadzonych badań nieniszczących wykonanych na próbkach z betonu wysokowartościowego w różnych okresach dojrzewania (3, 7, 14, 21 i 28 dniach). Na podstawie uzyskanych wyników badań dokonano szacowania wytrzymałości na ściskanie badanych próbek bazując na literaturowych krzywych bazowych. Dokonano także skalowania istniejących krzywych bazowych zgodnie z zaleceniami norm i instrukcji branżowych. Aby móc dokonać pełnej analizy wyników badań wyznaczono także autorskie krzywe bazowe. W rezultacie otrzymano materiał porównawczy, pozwalający na ocenę możliwości stosowania wyżej wymienionych metod dla badanego betonu wysokowartościowego w funkcji czasu.

Conventionally, non-uniformly excited antenna arrays are synthesized by independently determining the excitation amplitude and phase of each single element. Such an approach is considered to be the most expensive and complex design method available. In this paper, the tilling technique is harnessed to synthesize non-uniformly excited antenna arrays. To apply this technique, the array elements are first divided into different subarray shapes, such as rectangles or squares known as tiles. The use of rectangular tile blocks instead of a single element architecture greatly simplifies the array design process and reduces array complexity. Next, the problem concerned with synthesizing sub-arrays comprising rectangular tile blocks is formulated and solved by using horizontal and vertical orientations of tiles having different shapes and sizes, and their larger integer expansions. The third approach to tiled design is a mixture of both previous tile architectures. A genetic algorithm is used to design such tiled arrays offering optimum sidelobe levels, beam width, directivity and taper efficiency. Simulation results demonstrated the effectiveness of the proposed tiled arrays.

Statistical approach to Control Performance Assessment (CPA) is of great practical importance. This is particularly visible in process industry, where there are many PID loops. They are often assessed with measures derived from the Gaussian probabilistic density function. Standard deviation, variance, skewness or kurtosis form the majority of applied indexes. The review of data originating from process industry shows, however, to the contrary, that these signals have rather non-Gaussian properties and are mostly characterized by fat-tailed distribution disable the ability. Investigations show that strong disturbances may significantly disable the capacity of proper assessment. Standard measures often fail in such cases. It is shown that non-Gaussian measures can help with this problem. Various disturbances are tested and compared. Results show that fat-tailed distributions are an interesting alternative. They are less sensitive to disturbance shadowing and still make possible loop dynamic assessment.

This paper presents one of the important stages of a research project carried out in Poland, the aim of which was to develop an integrated performance measurement and assessment system designed for Polish public hospitals and for the stakeholders of different healthcare systems. The goal for the stage described in this article was to present a flexible and comprehensive tool (a performance model) for measuring hospital performance that could be used by hospital management, the founding bodies, and other stakeholders at the regional and central levels of healthcare systems, to improve the quality of medical services, the availability of healthcare resources, and the organization of the healthcare system in Poland. This article describes the non-financial dimensions that were identified in this model. The research involves the construction of a model that consists of defined and selected dimensions (patients, internal processes, development, and finance) with key performance indicators for the analysis, measurement, and assessment of hospital performance. The model takes into account the following three levels of the Polish healthcare management system: the central level, represented by the Ministry of Health; the regional level, represented by the regional governor, the marshal’s office, and the regional offices of the National Health Fund; and the local level, represented by hospitals and their funding bodies. The performance model exceeds the scope of the financial dimension and enriches it with three non-financial dimensions: patients, internal processes, and development. It allows one to concentrate not only on the tasks of the hospital but also on the objectives of other stakeholders operating in the Polish healthcare system.

This paper presents an alternative approach to the task of control performance assessment. Various statistical measures based on Gaussian and non-Gaussian distribution functions are evaluated. The analysis starts with the review of control error histograms followed by their statistical analysis using probability distribution functions. Simulation results obtained for a control system with the generalized predictive controller algorithm are considered. The proposed approach using Cauchy and Lévy α-stable distributions shows robustness against disturbances and enables effective control loop quality evaluation. Tests of the predictive algorithm prove its ability to detect the impact of the main controller parameters, such as the model gain, the dynamics or the prediction horizon.

In recent years the question of measurement of the financial performance of an enterprise has been frequently asked. The current economic environment is characterized by constant change. The development of the business environment has bought a completely new approach to the measurement of the financial performance of enterprises. In a market-oriented economy, enterprises are especially focused on the growth of their market value, based on their corporate strategies. The evaluation of enterprise success in a simple and quick way is one of the most important requirements set by owners and investors. The latest findings from the area of company management clearly show that for the long-term success of enterprises it is not enough to evaluate the history using the financial indicators. Enterprises must be watched and evaluated systematically, whereas the main task of management should be to employ new methodologies and management tools. One of the models used for the management of company performance is the Balanced Scorecard model, also taking into account – besides the traditional financial criteria – non-financial criteria.

The paper focuses on the issue of non-financial indicators in construction companies in Slovakia through the Balanced Scorecard concept as a tool of strategic management. The main aim of the paper is to find out the current state of using the method of Balanced Scorecard in construction companies in Slovakia. Two hypotheses were established in the study which was verified using the method of proportion of the given phenomenon in the population and the method of chi-square test for independence. Another part of our research was dedicated to the barriers that prevent the use of the BSC method wchich we have also subjected to the statistical research in our paper using the standard deviations and other statitical methods. The research has shown that the Balanced Scorecard method is not use even by 15% of construction companies in Slovakia. The partial objective was to find out the existence of statistically significant relationship between the use of non-finnacial indicators in the management and the use of BSC concept, since the BSC method assigns the same importance to both financial as well as non-financial indicators. The paper offers an overview about the current state of BSC in the construction industry and seeks to present the concept as a modern business management tool that gives equal importance to both financial and non-financial indicators.
Artykuł koncentruje się na problemie wskaźników niefinansowych w spółkach budowlanych na Słowacji za pomocą koncepcji Balanced Scorecard jako narzędzia zarządzania strategicznego. Głównym celem artykułu jest poznanie obecnego stanu wykorzystania metody Balanced Scorecard w firmach budowlanych na Słowacji. W badaniu ustalono dwie hipotezy, które zweryfikowano za pomocą metody proporcji danego zjawiska w populacji i testu zgodności chi-kwadrat pod kątem niezależności. Kolejna część naszych badań poświęcona była barierom, które uniemożliwiają zastosowanie metody BSC, którą również poddaliśmy badaniom statystycznym przy użyciu odchyleń standardowych i innych metod statystycznych. Badania wykazały, że metoda Balanced Scorecard nie jest wykorzystywana nawet przez 15% firm budowlanych na Słowacji. Celem pośrednim artykułu było ustalenie istnienia statystycznie istotnego związku między wykorzystaniem wskaźników pozafinansowych w zarządzaniu i stosowaniu koncepcji BSC, ponieważ metoda BSC przypisuje to samo znaczenie zarówno do wskaźników finansowych, jak i niefinansowych. Artykuł przedstawia przegląd aktualnego stanu BSC w branży budowlanej i stara się przedstawić tę koncepcję jako nowoczesne narzędzie do zarządzania przedsiębiorstwem, które nadaje równe znaczenie wskaźnikom finansowym i niefinansowym.

Propellers usually operate in the ship’s stern, where the inflow of the non-uniform wake generates oscillating loads and changes the hydrodynamic performance. Therefore, determination of the forces on propellers and hydrodynamic performance due to a non-uniform wake field are the challenging problems for naval architects and hydrodynamists. The main objectives of the present study are to assess the hydrodynamic performance for a single blade and all the blades. The propeller is a B-series propeller under non-uniform wake field behind the Seiun-Maru (hereafter SM) ship hull. A practical approach is employed to calculate the hydrodynamic oscillating loads of the ship propeller under a non-uniform wake field. Results of the computations on the propeller behind the SM ship, due to a non-uniform wake field, are presented and analyzed using classical mathematical methods over a single cycle. The results show that a variation of thrust with the discussed parameters is the same as that shown for torque, also the blade-frequency of the total force, thrust and torque is an increasing function of radial sections, whereas these parameters decrease with increasing radial blade sections.

Background: In practice, the developers focus is on early identification of the functional requirements (FR) allocated to software, while the system non-functional requirements (NFRs) are left to be specified and detailed much later in the development lifecycle. Aim: A standards-based model of system performance NFRs for early identification and measurement of FR-related performance of software functions. Method: 1) Analysis of performance NFR in IEEE and ECSS standards and the modeling of the identified system/software performance functions using Softgoal Interdependency Graphs. 2) Application of the COSMIC-FSM method (e.g., ISO 19761) to measure the functional size of the performance requirements allocated to software functions. 3) Use of the COSMIC-SOA guideline to tailor this framework to service-oriented architecture (SOA) for performance requirements specification and measurement. 4) Illustration of the applicability of the proposed approach for specification and measurement of system performance NFR allocated to the software for an automated teller machine (ATM) in an SOA context. Results: A standards-based framework for identifying, specifying and measuring NFR system performance of software functions. Conclusion: Such a standards-based system performance reference framework at the function and service levels can be used early in the lifecycle by software developers to identify, specify and measure performance NFR.

Aim: Building upon stakeholder and institutional theory, this paper investigates the relationship between product diversification and corporate social performance (CSP), thereby attempting to make essential contributions to the current literature. Based on an extensive literature review, it was expected that related, unrelated and total product diversification are positively related to CSP. Moreover, it was hypothesized that the exposure to weak institutional host country environments negatively affects the relationship between diversification and CSP, and that the Sustainable Development Goals (SDGs) have a positive effect on the relationship. Design / Research methods: The sample selected for this research is the non-renewable energy industry, since the industry shows great divergence in terms of corporate social responsibility (CSR) performance. In addition, the industry is highly susceptible to regulatory changes, while the Sustainable Development Goals have an enormous focus on the reliability and sustainability of energy, making it a highly relevant industry to study. This study analyzed 40 a 40 non-renewable energy firms over a time frame of seven years, by using OLS regression. Conclusions / findings: The results reveal that unrelated diversification is positively related to CSP, while the other forms of diversification show insignificant results. Contrary to expectations, the Sustainable Development Goals negatively affect the relationship between product diversification and CSP, while the moderating effect of exposure to weak institutional environments is insignificant. Originality / value of the article: Research on the relationship between product diversification on corporate financial performance is well-established, but the way in which product diversification influences a firm’s behavior towards stakeholder demands and social concerns remains largely unexplored. Accordingly, the results of this study challenge existing theories while adding more context to the existing relationship, and in turn provide promising avenues for future research.
