The individual rights in the health care sphere are ensured, among other things, by overcoming uncertainty in legal regulation. The problem of ambiguity, filling gaps, contradictory to legal regulation is of relevance in the court hearings of specific cases in the health care sphere. The health care sphere is one of the most important spheres of the legal protection of individual’s rights, because it concerns all the population. In modern medical law, the standardized approach to the regulation of relations in the health care sphere has received widespread recognition. The notions “standard” and “order” are widely applied to the regulation of medical activity and patients’ rights. In the health care sphere the ambiguity of legal regulation is connected with requirements of getting from patient informed consent to treatment. The informed consent must be given by the patient voluntarily and before the medical treatment.

The Supreme Court, in the ruling which is subject to this commentary, addresses the notion of an employee referred to in Article 218 § 1a of the Criminal Code. The court discussed the issue of the designation and limits of the notion of “employee” and the subject-matter of protection of the provision referred to above along with its scope. The commentator – in this context – analyses the Supreme Court’s thinking. The commentary’s author agrees in most part with the belief that “the scope of Article 218 § 1a CrC covers only persons who are employees within the meaning of Article 2 LC and Article 22 § 1 and § 11 LC”, though he deems it incomplete as one also needs to take into account Article 8(2a) of the act on social insurance, where – with regard to social insurance – the notion of an employee is slightly broader than the one included in the provisions of the Labour Code. The commentator believes it legitimate that the subject-matter of protection of Article 218 § 1a CrC includes all employee rights resulting from an employment or social insurance relationship. The commentator shares the de lege ferenda postulate for the “protection under Article 218 § 1a CrC to include also persons in employment relationships other that a contract of employment” and, which the Court did not address in the discussed resolution, the civil law relationship referred to in Article 8(2a) of the Social Insurance Act.

This article is devoted to the application of law in the legal order of the Council of Europe. It presents guidelines for the decision-making process of the application of law applied in the legal area of the European Convention on Human Rights and the European Social Charter. The aim of this article is to present the characteristics of the decision-making process of the application of law in terms of human rights protection on European and supranational level, as well as the differences between such processes carried out on the basis of the ECHR and the ESC.
Niniejszy artykuł został poświęcony problematyce stosowania prawa w porządku Rady Europy. Przedstawia on założenia procesu decyzyjnego stosowania prawa realizowanego w obszarze prawnym Europejskiej Konwencji Praw Człowieka i Europejskiej Kary Społecznej. Zamierzonym celem artykułu było pokazanie specyfiki procesu decyzyjnego stosowania prawa w przedmiocie ochrony praw człowieka na europejskim poziomie ponadnarodowym, ze szczególnym uwzględnieniem różnic tego procesu, realizowanego na podstawie EKPC i EKS. Ich pokazanie wymagało przedstawienia ogólnej charakterystyki Rady Europy i jej aktywności w obszarze europejskiej ochrony praw człowieka. Następnie w ramach zagadnień szczegółowych analizie poddano: sądowy mechanizm kontrolny poszanowania praw człowieka przez państwa, inicjowany na podstawie skargi indywidualnej, realizowany przez Europejski Trybunał Praw Człowieka w ramach typu sądowego stosowania prawa; pozasądowy mechanizm kontrolny, realizowany przez Komitet Niezależnych Ekspertów, którego istotą jest ocena realizowania przez państwa-strony zobowiązań z EKS, a nie dochodzenie przez podmioty indywidualne praw z karty, do których gwarantowania państwo się zobowiązało. Te dwa zdecydowanie odmienne prawnie mechanizmy kontrolne wyznaczane są jako systemowe konsekwencje dla państw, związane z przystąpieniem do EKPC i EKS, charakterem zobowiązań z nich wynikających oraz możliwością ich gwarantowania i dochodzenia na drodze prawnej przez jednostki. W sposób zasadniczy wpływają one na przebieg procesu decyzyjnego stosowania prawa w porządku Rady Europy i rodzaje rozumowań wykorzystywanych w ramach tych procesów.

David J. Gunkel in his latest book Robot Rights presents the opportunities and challenges of integrating robots into moral and legal systems. The research question asked by the author is “Can and should robots have rights”? Following the Humean distinction between “is” and “ought”, Gunkel creates four statements that either opt for or against incorporating robots into legal discourse. The four modalities group contrasting opinions developed by different scholars on the subject of the eponymous robot rights. The author provides readers with yet another alternative approach to the question of legal recognition of robots which is based on Levinasian philosophy.

Objectives: In Poland, 95% of medical personnel had not received legal education before they completed their studies. Having been given these facts, we have started questioning legal awareness of people providing medical services. Aim of the study: The study aimed at evaluating the knowledge of allergists and pulmonologists. Material and Methods: The group consisting of 328 allergists and/or pulmonologist completed the questionnaire. Results: The participants possess the best knowledge in providing information to patients about their health status (CV1). Sixty nine % of responders replied correctly, and the difference was significant (p < 0.001) in comparison with next aspect referring to the principles of providing medical services following guidelines created by think-tanks and also possibilities to take autonomous decisions by physicians (CV2). The correct answers in relation to CV2 were given by 57% of responders. The third compared aspect was physicians' awareness of patients' right to giving a consent or refusal before undertaking the medical procedure CV3. Only 55% of physicians gave correct answers and the difference was significant compared to CV1 (p < 0.001) as well as CV2 (p < 0.05). Younger doctors showed to have better knowledge than their older colleagues (p < 0.05). Working in urban workplaces proved to be more associated with better knowledge than in rural ones (p < 0.05). Discussion: Insufficient knowledge results in a low quality of provided services and puts the doctors at risk of being liable. The rates indicate that doctors are not aware of the fact that only legal regulations are binding, while standards not published by the Minister of Health are not legally valid. Half of the respondents have the wrong belief that the opinions expressed by experts make the doctor feel exempt from liability. Probably there are specialities, like occupational medicine which are specially linked with awareness of valid legal rules.

The Rule of Law serves, under a broadly accepted notion of justice, the enforcement of property rights and a relative predictability of citizen affairs, i.e. it fosters Public Value. However, it is subject to risks that materialise in weakened institutions, uncertainty and transaction costs. The connection between Public Value and the Rule of Law becomes salient when understanding how the latter degenerates at the expense of the former. This article provides two theoretical frameworks that explain the connection between the two concepts, as well as three manifestations of the Rule of Law’s decay. These comprise the excess of legal-formalism, the excess of discretion in enforcement and the instrumentalisation of the law, i.e. when it embodies injustice. Although they vary depending on the legal system, these aspects build a conceptual body that illustrates how contingent legal outcomes affect society, developing Daly’s (2019) concept of democratic decay in the economics and business literature.

This article aims to analyze the contemporary problem of respecting human rights in the actions of public administration. To that end, it aims to show the causes of the issue in question and propose solutions. The article opens with a description of the legal aspect of human rights from the general perspective as a matter of rules and elements of the legal system. This part of the article presents the legal grounds for and obstacles to incorporating human rights and the acts that regulate them into the actions of public administration. In the subsequent sections, the analysis shifts to a detailed perspective. The first one concerns the reliance of the public administration’s actions on Art. 6 point 1 of the European Convention on Human Rights and shows the issues with applying it to administrative cases, as noted in the literature and jurisprudence. The second addresses the issues associated with incorporating human rights regulations into the application of the substantial law. This problem is analyzed from the standpoint of legal regulations, values and interpretation. At the same time, the article aims to show that while on the one hand public administration is responsible for safeguarding rights, on the other it is also entitled to breach and limit.

Orientation sentences for the remark 1. In the case of non-fully harmonised EU law, the fundamental rights of the Basic Law constitute the primary standard of assessment. Within the diversity of fundamental rights provided for by European law, the presumption is that the fundamental rights of the Charter of Fundamental Rights of the European Union (GrCh) are co-guaranteed by those of the GG(German Constitution). That presumption can only be rebutted if there is concrete and sufficient evidence to support it. 2. Threats from the dissemination of personal reports and information as part of public communication affect the scope of protection of the expressions of general personality law, not that of the right to informational self-determination. 3. The general right of personality does not give way to filtering and restricting publicly available information about one’s own person according to his own ideas. The unlimited public confrontation with previous positions, statements and actions, on the other hand, is not appropriate. 4. On the contrary, it is necessary to strike a balance with the interests of the content provider, with specific emphasis on the temporal aspect, availability and context of the information in relation to the communication conditions of the Internet.

The current legal categorisation of animals as property has its historical roots in Roman Law. The long history of this status prompts one to wonder whether it reflects modern community attitudes. It is, however, difficult to answer this question, as there is a dearth of empirical data on attitudes towards the legal status of animals. In light of the widely-accepted relationship between law and community attitudes, particularly in democratic societies, this paper highlights the need for empirical examinations of social attitudes towards the legal status of animals. It is suggested that such empirical exercises can help scholars and lawmakers more accurately understand whether a change in the legal status of some or all animals is politically achievable. Empirical studies of community attitudes can also provide direction to scholars, who theorise legal frameworks to define the legal status of animals, and animal advocacy groups, which seek to educate the community about the legal status of animals.

Is there, in the context of the recent developments related to the Lisbon Treaty, a need for substantial change with respect to the scope and application of legal professional privilege (LPP) and the privilege against self-incrimination (PASI) in competition law proceedings before the European Commission? To answer this question this article first briefly describes the current scope of LPP and PASI in EU competition law enforcement proceedings. This is followed by a presentation of the impact that the binding effect of the Charter of Fundamental Rights of the European Union (Charter) and the EU’s prospective accession to the Convention for the Protection of Human Rights and Fundamental Freedoms (Convention) may have on LPP and PASI. This analysis includes reasons why it may be necessary for the Commission and the EU Courts to reconsider the current scope of the privileges, and examines what could be considered as significant changes in this respect. In the event arguments for radical reform do not find the requisite political support, the article elaborates some nuanced improvements which could be implemented.
Dans le contexte des changements récents liés au traité de Lisbonne, est-il nécessaire de procéder à des modifications substantielles par rapport au champ d’application du principe de confidentialité des communications entre avocats et clients (LPP) et du droit de ne pas contribuer à sa propre incrimination (PASI) dans les procédures de concurrence menées par la Commission européenne ? Pour répondre à cette question, le présent article donne d’abord une définition sommaire du champ actuel d’application du principe de confidentialité des communications entre avocats et clients et du droit de ne pas contribuer à sa propre incrimination lors d’une procédure communautaire de concurrence. On présente ensuite l’impact possible que peuvent avoir sur les principes LPP et PASI le caractère juridiquement obligatoire de la Charte des droits fondamentaux de l’Union européenne ainsi que l’adhésion prochaine de l’Union européenne à la Convention de sauvegarde des droits de l’homme et des libertés fondamentales. L’analyse tient compte des causes pour lesquelles il peut se montrer nécessaire que la Commission et les juges communautaires révisent le champ actuel d’application des principes susmentionnés et qu’ils étudient ce qui pourrait être considéré comme une modification substantielle en la matière. Dans une situation où les arguments à l’appui d’un changement radical quant à l’approche de ces principes ne trouveraient pas le soutien politique nécessaire, l’article propose certaines « améliorations » susceptibles de mise en œuvre.

This paper sets out a new reconstruction of indigenous rights as a field of sociological research. Questioning the dominant pluralist paradigm in such inquiry, it claims that indigenous rights are primarily the results, not of socially embedded customs, but of interactions between international law and national law. It then proceeds to explain that, to capture such rights, a focus on social integration and national citizenship is required. It uses this framework to explain indigenous rights as elements of a global legal order that facilitates the construction of citizenship, especially in societies in which citizenship has been subject to deep strain.
