Opis:
How we function in social reality is determined by various types of cognitive schemas. These concern people, social events and other phenomena. According to the concept offered by various postpositivist currents, including postmodernism, poststructuralism and critical theory, such schemata cannot be objective. The most important element of postmodern considerations is the discovery of the arbitrary nature of modernity. This means rejecting the Enlightenment belief in progress. Innovation, understood as modernity resulting from human reason, is illusory in the postmodern perspective. Innovation consists precisely in a rejection of the myth of the existence of some absolute, objective truths that constitute the social order. The world is textual, made up of many alternative narratives. Definitions, including legal definitions, are socially constructed. They arise from specific social conditions, at a particular stage of development of a particular group. The assumption made by postmodernists is that language, including professional language – such as the language of law or legal language – is neither neutral nor transparent. The innovative power of this language lies in its use of narratives that influence the functioning of social groups of varying degrees of complexity. It is therefore necessary, adopting a postmodern interpretation, to look at the text of legal language in a similar way as we look at other texts. That is, to see in the narrativity of this language structural similarities with other texts that constitute social reality.

The article attempts to provide an explanation why the English legal language is so complex and so difficult to understand especially for the lay people. Also mentioned are the attempts that have been made to simplify it. The paper also describes its development throughout history. It maintains that legal English is the result of history and political and social processes ongoing in the given historical period. This language is basically the reflection of the social and political conditions of the given historical period, and each period has left its mark on the current form of the language at issue. It reflects the influence of Anglo-Saxon mercenaries, Latinspeaking missionaries, Scandinavian and Norman war tribes. As it is highlighted further in the text, English has been used in various types of legal documents at different times. Last wills and testaments started to be drafted in English around 1400. Laws were written in Latin until around 1300, in French until about 1485, in English and French for a few more years and exclusively in English since 1489. The paper contains a number of the words and expressions related to law which are used even today and provides their etymology, at least as far the language of its origin is concerned. Also provided are expressions that were replaced with new ones, simpler, more understandable legal terms within reforms.

This essay is a survey of methods applied and topics scrutinized in legal-linguistic studies. It starts with the elucidation of the epistemic interest that led to the emergence and to the subsequent expansion of the mainstream legal-linguistic knowledge that we dispose of today. Thus, the essay focuses upon the development of problem awareness in the emerging legal-linguistic studies as well as upon the results of research that might be perceived as the state of the art in the mainstream legal linguistics. Meanwhile, some methodologically innovative tilts and twists that enrich and inspire contemporary legal linguistics are considered as well. Essentially, this essay traces the conceptual landscape in which the paradigms of legal-linguistic studies came about. This conceptual landscape extends from the research into the isolated words of law and the style used by jurists to the scrutiny of legal texts and legal discourses in all their socio-linguistic complexity. Within this broad frame of reference, many achievements in legal-linguistic studies are mentioned in order to sketch the consequences of processes in which legal-linguistic paradigms take shape. The author concludes upon a vision of legal linguistics called pragmatic legal linguistics as the newest stage in the intellectual enterprise that aims to pierce the language of the law and by so doing to understand law better.

Opis:
Legal translation is a highly skilled task. It has even been described as the “ultimate linguistic challenge” (Harvey 2002: 177). However, law firms or corporations that procure translations from self- employed translation practitioners often find the intricacies of the task difficult to perceive. Following extensive fieldwork examining how legal translation is commissioned and performed in ‘outstitutional’ contexts, I have developed a multidimensional model which illustrates the legal translator’s textual agency, aimed at conveying the complexities of translation performance to clients and other stakeholders. It may also serve to train fledgling legal translators, and to heighten practising translators’ awareness of their overall task. The impetus for the model sprang primarily from findings of serious information asymmetry and goal divergence in the market, and evidence that actors involved do not grasp (a) the need for legal translators to be fully briefed, or (b) the layers of skills involved. 
Tłumaczenie prawne jest zadaniem wymagającym wysokich kwalifikacji. Zostało nawet opisane jako „największe wyzwanie językowe” (Harvey 2002: 177). Jednak firmy prawnicze lub korporacje, które zamawiają tłumaczenia od samozatrudnionych tłumaczy często nie zauważają zawiłości tego zadania. Po przeprowadzeniu szeroko zakrojonych badań terenowych, analizując, w jaki sposób zlecane jest tłumaczenie prawne i przeprowadzane w kontekście „pozainstytucjonalnym”, opracowałam wielowymiarowy model, który ilustruje złożoności wykonania tłumaczenia. Może również służyć kształceniu początkujących tłumaczy prawniczych i zwiększaniu świadomości tłumaczy na temat ich zadania.
