The author analyses the impact of the law reforming the spatial planning system on issues of shaping agricultural production space and, more broadly, on spatial management in rural areas. Passed on 7 July 2023, the Act represents the largest and most ambitious reform of the spatial planning system in at least 20 years. The new law introduces a number of provisions relating strictly to agricultural areas. The most significant change from this point of view is the expansion of the catalogue of values that must be taken into account by entities participating in spatial planning to include issues related to the shaping of agricultural production space and the development of agricultural production. The consequence of these changes will be an increase in the importance of agricultural space-shaping issues in the spatial planning process. The author also analyses other changes affecting agriculture, including, above all, a further extension of the protection of agricultural land from uncontrolled use for non-agricultural purposes.

The significant amendment of the Slovak constitution deals with the protection of the land which it newly characterises as a non-renewable natural resource and provides additional legal protection of it. The article analyses the importance of this amendment from multiple perspectives with emphasis on legislative changes it has brought. The main topics of the article are the need for more effective legislation in the area of land protection and also the long-standing need to carry out land consolidations in the Slovak Republic.
Istotna zmiana słowackiej konstytucji dotyczy ochrony ziemi, którą na nowo charakteryzuje jako nieodnawialne zasoby naturalne i zapewnia jej dodatkową ochronę prawną. Artykuł analizuje znaczenie tej poprawki z wielu perspektyw, z naciskiem na zmiany legislacyjne, które przyniosła. Głównym tematem artykułu jest potrzeba bardziej efektywnego ustawodawstwa w dziedzinie ochrony gruntów, a także długotrwała potrzeba przeprowadzania scaleń gruntów w Republice Słowackiej.

The aim of the article is to give an insight to the problems of the Hungarian organic farming and to highlight the areas which should be developing in order to improve the domestic market and access more export market. This article presents the results of two surveys. Questionnaires were sent to the Hungarian organic farmers. The questions in the questionnaires differed from each other since the aims of the surveys varied. The answers received and the information gathered served as a good basis for the analyses of the state of the sector and the factors which impede competitiveness. No obvious relation can be found between the increase of stakeholders integrated in the supply chain and the extent of the farmers’ share from the profit on products. In organic animal keeping, long-term relations are characteristic, which rarely work without problems. According to the farmers’ opinion, the most important hindering factors of production are the lack of solvent demand and adequate promotion activities, also underpinned by the two empirical surveys.
Celem badań było przedstawienie problemów ekologicznej produkcji zwierzęcej na rynku węgierskim, ze wskazaniem obszarów, które powinny być rozwijane w celu poprawy dostępu do rynku krajowego i na eksport. Przedstawiono wyniki dwóch badań. Kwestionariusze skierowano do hodowców zwierząt ekologicznych i do rolników uprawiających rośliny ekologiczne. Otrzymane informacje posłużyły do analizy stanu sektora oraz określenia czynników hamujących konkurencyjność. W związku z naciskiem na ochronę środowiska, bezpieczeństwo żywnościowe i znakowanie produktów, rolnictwo ekologiczne jest alternatywą dla niektórych ogniw łańcucha dostaw (interesariuszy). Krajowa produkcja artykułów ekologicznych straciła jednak na znaczeniu po przystąpieniu Węgier do UE. 80-90% węgierskich produktów ekologicznych eksportuje się do państw ościennych. 60% gruntów (13 069,73 ha) kontrolowanych przez Biokontroll Hungária z o.o. stanowią łąki, pastwiska i ugory. Inwentarz żywy, taki jak: bydło, owce i gęsi nie przekracza 1 SD na 1 ha, mimo że oczekiwana wartość powinna osiągać 2,75% całego inwentarza. Według opinii badanych rolników, głównymi barierami ekologicznej produkcji są brak popytu na taki towar i brak odpowiednich działań promocyjnych.

The purpose of this article was to evaluate the procedure for excluding land from agricultural production in the context of disclosing land use changes in the land and building records. In order to examine the problem presented, a descriptive analysis of existing legal acts and publications was performed, and a case study was analized. The research was based on data from 2010-2019 obtained from the District Eldership and District Center of Geodetic and Cartography Documentation in Kazimierza Wielka (Świętokrzyskie Voivodeship). The work presents subsequent stages related to the disclosure of changes in land development created on the land as a result of the start of the investment process. Attention was drawn to the extension of the investment process by the applicants for excluding land from agricultural production. Studies have shown that only 15% of decisions authorizing the exclusion of land from agricultural production in the Kazimierz District in the years 2010-2018 were actually implemented and completed with updating the land and building records. However, this is not a value corresponding to the real number of excluded areas, because based on the field interview, it can be indicated that only on 12% of the analyzed plots, the investment process was not started on the land. This is primarily due to the obligation to pay a fee for the sole exclusion of land from agricultural production, but also to a change in the method of calculating the tax from agricultural tax, to a several times higher property tax.

The subject of the considerations presented in the article is the shape of modern regulations on the protection of agricultural land. The analysis is conducted primarily in the field of protective provisions regarding the so-called quantitative and qualitative protection of agricultural land, as well as economic instruments correlated with these provisions for the protection of agricultural land. Other regulatory areas, including predominantly the existing and discussed solutions of European Union law regarding closer linking of agricultural producer support instruments with requirements in the field of environmental protection, within the scope of the so-called conditionality and greening. The subject of the study is not only the analysis of traditional directions of agricultural land protection as a means of production in agriculture, but also an attempt to determine the areas and directions for further development of this regulation.
Przedmiotem rozważań prezentowanych w artykule jest kształt współczesnej regulacji dotyczącej ochrony gruntów rolnych. Analiza prowadzona jest głównie w zakresie przepisów ochronnych dotyczących tzw. ochrony ilościowej i jakościowej gruntów rolnych, a także skorelowanych z tymi przepisami instrumentów ekonomicznych ochrony gruntów rolnych. Przedmiotem rozważań są również inne płaszczyzny regulacyjne, w tym przede wszystkim istniejące i dyskutowane rozwiązania prawa Unii Europejskiej dotyczące ściślejszego powiązania instrumentów wsparcia producentów rolnych z wymaganiami w zakresie ochrony środowiska naturalnego, w zakresie tzw. warunkowości i zazieleniania. Przedmiotem opracowania jest zarówno analiza tradycyjnych kierunków ochrony gruntów rolnych jako środka produkcji w rolnictwie, jak i próba określenia płaszczyzn dalszego rozwoju tej regulacji.

The increasing risk of wind erosion in the context of climate change represents a highly pressing issue. This increase is a result of the growing occurrence of droughts and elevated temperatures in the intensively farmed areas. Effective protection against the wind erosion can be provided by windbreaks, especially during the period when the soil is not protected by the vegetation cover of crops. In this report, the authors wanted to compare the methods defining the windbreak protection zones. The optical porosity and the windbreak height were the basic parameters for defining the protection area. The various methods differ among themselves by using the windbreak height parameter or not. The optical porosity of the windbreaks was determined based on photographic documentation. For the comparison, the cadastral area of Micmanice was selected due to the wide network of windbreaks in this locality. A database of windbreak height and optical porosity for each windbreak was set up. Our report thus presents the application of the new knowledge aimed at updating the methods and procedures for assessing the vulnerability of the area by wind erosion. The application of the method involving the optical porosity and windbreak height parameters resulted in a significant reduction of the windbreak protection zone compared to the method omitting the windbreak height.

Opis:
The experience of creation and functioning of the urban cadastre as a structural element of modern highly developed state abroad is analyzed. It is found out that in the European Union virtually absent analogues of the urban cadastre in our understanding. However, there are widespread cadastral systems, that solve problems of registration and storage of information on real property, as well as planning restrictions and easements. In the states of the former Soviet Union (especially the Russian Federation, Kazakhstan, Belarus) town-planning cadastre is developed in forms that are close to the Ukrainian model. Since the formation of the urban cadastre system in Ukraine is in its infancy, so there is a possibility of using the experience of foreign countries with their achievements and mistakes that can be avoided.

The fertilizer management is one of the greatest challenges of agriculture in the 21st century. The growing demand for food, along with the similar amount of arable land, creates the necessity of increasing the crop yields in a given area. Due to the fact that the production and use of mineral fertilizers often influence the environment in a negative way, for many years more attention has been paid to natural and organic fertilizers. Their advantage is the transfer of not only organic matter but also nutrients to the soil. In connection with the structural changes in agriculture, the production of natural fertilizers, especially manure decreases, but at the same time, the production of other organic fertilizers, e.g. composts or biochar increases. The aim of the work was to present the possibility of using biochar in the production of organic fertilizers. Moreover, the project concept for obtaining an organic fertilizer containing biochar and its application in the processes of biological transformation of waste was presented.

Knowledge of a land cover is very essential to understand and know relations between a man and an environment. The land cover is closely related to the rest elements of geographic environment. It also illustrates the variety of the structure of geographic environment. Till the end of the last century, there were no data representing full, reliable and covering the whole country information about the land cover. Maps and studies over this element of landscape were based on other methods of mappings, various scales and spatial ranges. This fact made it impossible to make comparison analysis and to have proper conclusions concerning processes that were taking place. The realization of National Geographic Information Systems (NSIG) and works connected with the creation of CORINE Land Cover (CLC) is a big help in this field. It was impossible without the development of spatial imagery, universality of the application of spatial information systems, and the use of army materials in the civilian, formal cases. Source spatial data used on the paper, mutually supplement and cover one another. Research connected with the analysis of a landscape structure was done in the chosen protected areas in Kujawsko-Pomorskie Voivodeship. All (8) landscape parks were in the Voivodeship. Total area of the preserved territories is almost 12% of the total Voivodeship area, and represent various types of a natural landscape. The structure of the landscape in landscape parks was analyzed with the application of landscape indices. The following indices describing the structure of landscape were calculated and compared: a number of land cover classes, a number of patches, total length of the edge, a shape index, a fractal dimension, and Shannon’s diversity index. Comparisons of indices among parks were done in relation to various scales of source materials.

The aim of the paper is to define the key spatial conflicts regarding planning relations be- tween the plans of protection tasks for Natura 2000 areas and local tools of spatial policy. The contents of all administrative court’s decisions related directly to the plans of protection tasks for Natura 2000 areas are analysed. The judgements issued in 2010 - 2019 are taken into account. Sixteen of such judgements have been distinguished in the Central Database of Judicial Decisions of the Supreme Administrative Court (in principle, grouping all of such rulings). They are classified, and the allegations made in the cases, as well as the contents of specific plans of protection tasks, are analysed. A quantitative and qualitative analysis of the contents of the judicial decisions is conducted. Based on the analyses carried out, two main conclusions can be drawn up: - on the occasion of spatial conflicts pending before administrative courts, related to the contents of plans of protection tasks for Natura 2000 areas, space users, as a rule, submit very similar objections to those concerning the direct tools of spatial policy; - the contents of plans of protection tasks directly related to the contents of spatial policy tools are very often underdefined both in subjective and formal terms.

The object of the paper is to analyze the spatial structure of land and identification of the needs of consolidation works and exchange of land in the villages of the Sławno municipality, lying in the district of Opoczno, in the Łódzkie Voivodship. The authors use the method of zero unitarisation for the purposes of determining the order of undertaking consolidation works and exchange of land in the area of research. The basis for calculation is the database of 19 factors (x1–x19) characteristic for the listed five groups of issues, describing each of the following villages. The obtained results, in a form of synthetic meter for each village, allowed creating the hierarchy of the urgency of carrying out consolidation works. The problem of excessive fragmentation of farms, constituting the collections of a certain number of parcels, in a broader sense, is one of the elements that prevent the acceleration of reforms by conversion of the Land and Buildings Register (EGiB) in a full valuable real estate cadastre in Poland. The importance of the problem is highlighted by the fact that there are ecological grounds in the study area, significant from the point of view of environmental protection.

The aim of our work on the Kysuce region was to map the incidence of preserved TAL elements, assessment of their contemporary usage and assessment of the threat to them under the influence of anthropogenic and natural stress factors. To do so, it was crucial to understand space and time intersection of TAL existence, the interaction of socio-economic, abiotic and biotic systems of the landscape and assess correctly the contemporary trends of the evolution of society and the threat to the agrarian heritage resulting from it. High proportion of TAL, covering 12% of the whole area, is typical for the monitored region. There were two types of TAL: TAL with dispersed settlement, covering 2261.4 ha of the area (3%) and TAL of arable-land, grasslands, covering 6990.3 ha of the area (9%). In the agricultural country, TAL makes up for important stabilizing elements and their presence increases biodiversity in these regions. It is of high importance to classify TAL as significant landscape features that are important as local bio-centres (because of their benefits for society and the environment).

The aim of the considerations is to determine how the concept of land take and the related EU target of no net land take by 2050 function in the law (especially in Poland), and then to assess to what extent the perception of this formula in the law is relevant to the model of land protection and whether it has the potential to increase the effectiveness of the legal regulation in this respect. Land take is a concept that describes one of the main threats to the protection of land as an environmental resource. First attempts to incorporate this formula into the legal system of land protection have already been made. In European Union law, this was done by setting the goal of no net land take target by 2050. This objective, however, is neither binding nor specified in secondary legislation. The concept of land take and the target related to it may have a positive impact on the effectiveness of the land protection system. However, it is essential that the legal instruments are integrated and are of a binding character. The Polish legal system has reiterated the concept of indirect land take, and no national target in this respect has been adopted. This model is an example confirming the thesis that special and extensive legal regulations do not always guarantee that the protection measures are effective. Also, while it illustrates the importance of integrating individual legal regulations, it shows as well that the weaknesses of one of them (in Poland the inefficiency of spatial planning) cannot be compensated for by developed instruments in another area of law.
L’articolo si propone di determinare come il concetto di occupazione dei terreni/consumo di suolo (land take) e il relativo obiettivo dell’UE di arrivare a quota zero entro il 2050 funzionino nel diritto (soprattutto polacco) e, di seguito, di provare a valutare in che misura la percezione di questa formula in diritto sia importante per il modello di tutela dei terreni e se abbia il potenziale per aumentare l'efficacia giuridica dei regolamenti in questo ambito. La land take è una concezione sviluppata, descrive una delle principali minacce alla tutela della terra come risorsa. I primi tentativi, per includere questa formula nel sistema giuridico di tutela della terra, sono stati intrapresi. Nel diritto dell'Unione Europea ciò è stato fatto fissando l’obiettivo di arrivare, per quanto riguarda l’occupazione dei terreni, a quota zero entro il 2050. Tuttavia, esso non è vincolante, né specificato nelle disposizioni di diritto derivato. La concezione di occupazione dei terreni e il relativo obiettivo possono influenzare positivamente l'efficacia del sistema di tutela dei terreni. Tuttavia, è necessario combinare gli strumenti giuridici sotto molteplici aspetti e a multilivello, e renderli vincolanti. Il sistema giuridico polacco ha adottato la concezione di occupazione dei terreni in maniera indiretta, nessun obiettivo nazionale al riguardo è stato prefissato. Il modello polacco è un esempio di conferma per la tesi che una regolazione giuridica specifica ed estesa non garantisce l'efficacia della tutela stessa. Illustra inoltre quanto è importante collegare le singole regolazioni giuridiche, nonché l'incapacità di compensare le debolezze di una di esse (in Polonia l’inefficienza dei piani regolatori) con strumenti sviluppati in un'altra area del diritto.

More and more frequently, one witnesses these days the appearance of a new approach to historical cultural landscapes. Not only do they now embrace objects of historical and environmental value, but also the potential for local and regional development. However, such an understanding of historical cultural landscapes, as a potential for local and regional development, necessitates additional instruments, plans, approaches, and methodologies. The article presents an analysis of a landscape plan in Germany and a case study on the potential of historical cultural landscapes for local and regional development in Poland. Conducted studies reveal the usefulness of activities for the protection of historical cultural landscapes in the context of land management. Such activities contribute to the improvement of landscape protection and conservation methods, taking into consideration their potential for local and regional development at the same time.
