This paper concerns the process of negotiating author and reader roles in the blogosphere. The starting point of this article is the theory of Roland Barthes that the death of the author is necessary for the birth of the reader. This idea notably responds to changing relations between the author and the reader in the new nedia era. The exemple of the blogosphere allows us to see that the roles of the author and the reader are not pre-defined and the filed of their "laws" is negotiated (two models of negotiations are described in this paper). In the blogosphere, wkich is an exemple of participatory culture, knocking the author off his pedestal does not result in the reader replacing the author, as R. Barthes would like. On the empty pedestal, after dumping the author, the reader does not appear - but communication does.

Opis:
The process of reading, rereading, scrutinizing, re-scrutinizing and appraising an author’s work is not fi nite; moreover it is very dynamic and full of suprises. No doubt that the appraisal and re-appraisal is too complex, including cultural, literary, gender and genre components. This becomes more obvious when referring to an author whose works had been locked up in library stacks during the whole 45 years of totalitarian rule in Albania, and whose appraisal process cannot help facing up to the critical thinking led by biased politicization. In this study the appraisal of the works of one of the most outstanding Albanian writers of the 30s of the twentieth century, Etëhem Haxhiademi, will be done by presenting them in rapport with the present-day school, pre-university and university level readers. This re-appraisal is conducted with a cold logic, devoid of the vindictive political principles which brought the distorted evaluation of the authors’ works, as it happened for many other au-thors as well, and is striving to place the writer into the system of the genuine literary values. Once the reader’s inquisitiveness has been satisfi ed, even after reading a less-known or, moreover, an oblivious or banned literary work, he/she begins reading and rereading it, looking closely into it, essaying to fi nd a proper place for this work in the general system of the national, inter-balkanic and international literary values.E. Haxhiademi’s literary work was known by an older generations of readers whose es-thetic satisfaction it brought forth was confi ned in their consciousness: it was unknown or partly known, not by direct reading but by several interpretations of others, by a middle generation of readers who displayed a certain artistic uncertainty and indifference. However, nowadays it is intently being studied although in excessively fragmentary ways and in many cases even unsuitable ones, by the younger generation of readers who should have a more motivated curiosity for divulging its real values.In the history of the Albanian literature, as well as in the other East European Countries, the authors’ biographies and especially their political aspects, were used as selective criteria to appraise authors and their works, instead of being pure cognitive and studying means. This study intends to reveal the present-day school readers’ affi rmative attitudes or even the non-affi rmative ones, regarding Haxhiademi’s literary works, in the process of re-dimen-sioning the author’s values and those of his literary works.

The article discusses selected texts of different genres by Milo Urban (1904–1982). The first text level is represented by fragments from his memoirs written in the 1970s and only published in the 1990s. An analysis of Urban’s journalistic activities during the Second World War provides us with another point of view. The article wishes to show different language versions elaborated by one author when dealing with one particular historical moment (the solution of the Jewish question and the Holocaust). This points at a significant change in Urban’s attitude to historical tragedies of the 20th century, and raises the question about a personal tragedy of an individual as well as his ability to cope with guilt and responsibility.

The present paper constitutes a qualitative discursive investigation of the nineteenth century case reports from ophthalmology derived from a specialist American medical journal, and focuses on citation as well as on authorial and patient’s presence. Regarding the first aspect, the present study generally confirms the results of the previous research, i.e. significant subjectivity, directness and informal character of the texts at hand. However, it also provides another insight into the scholarly communication in the nineteenth century, focusing on how patients are positioned therein, which has not received significant attention in the literature of the subject. Additionally, the paper offers an overview of the studies on specific aspects of scientific prose of the nineteenth century, including the medical context, as well as attempts to show the relation between the texts analysed and the context of their production and functioning, following the tradition of Genre Rhetorical Studies.

The aim of this article is to develop a postmetaphysical conception of reading by following Kierkegaard’s Either/Or Part I (1843) through such Derridian concepts as secret, hospitality, and spectrality. The work focuses on the three essays addressed to the Symparanekromenoi (“the community of the dead”), a fellowship neither young nor old with an aphoristic way of life (2010b: 137-225) that can be understood as a figure of alterity. Special attention is paid to paratextual features of the book: the texts are actually presented as old papers found in a secretary desk by a pseudonymous editor (“Victor Eremita”), which suggests that every text is a posthumous paper, that is to say, it will always be read after the death of its author. Instead of finding a solid author who holds the semantic weight of the text, these papers are based in a blank of sense, a specter, a secret: if they are sustained on its author, then they are sustained in a mystery, not in a sort of revelation of meaning.

Unlike the author’s economic rights, the authorship of a work as well as other moral rights should not necessarily be classified as a kind of intellectual property. If literature presents the problems of copyright as an element of intellectual property, this is done in reference to economic rights. The issues connected with moral rights appear then as the background condition for economic rights to arise. However, according to the will of the legislator, the nature of these rights was formed in a different way. While economic rights are a kind of intellectual property, the authorship of a work should rather be viewed as a phenomenon at the intersection of the right to privacy (particularly at the stage of an already established but not yet completed work) and the right to freedom of expression (from the moment of the exercise of other moral rights and the moment of taking a decision to make a work public under the author’s own name). The right to withhold authorship cannot be interpreted as the right to change the author by agreement of the interested parties.

This article outlines selected shifts in thinking about authorship and authority that have occurred in literary and cultural studies in the aftermath of Roland Barthes’s proclamation of the death of the author, followed by the author’s many revivals. Reconsidering Barthes’s seminal essay and confronting it with Michel Foucault’s query about the author-function, the article comments on Seán Burke’s polemical stance concerning situated authorship. Against these general considerations, several areas in which authorship and authority have been reconceptualized are briefly discussed, referring to the themes addressed in this volume. These areas embrace the problems of representing and using somebody else’s story in visual arts and testimonial theatre, the challenges of individual and cultural situatedness of writing within one’s own output and in reference to more general cultural hauntings as well as the processes of self-formation in the interactions between a variety of texts forming life-writing.

The review process of texts submitted for publication in scientific journals is one of the main ways of evaluating the scientific output of their authors. Any disruptions in this process can have serious and far-reaching consequences, not only in terms of the credibility and integrity of the author themselves, but – most importantly – in terms of the confidence in their achievements. Attempts to distort the review process have so far occurred most often in medical and exact sciences. The case of “The Critique of Law” discussed herein shows that attempts at scientific fraud affect also legal sciences. The purpose of the article is to inform the scientific community worldwide about subsequent attempts of unethical scholarly activities, to describe instances of malpractice, and to point out some of the possible ways to prevent the fraud in question

The author of the article, one of the acclaimed Polish cinematographers, describes his practical eforts involved in making two short documentary films on Holocaust directed by him. The first one,Sonderzug (1978), was based on Stok’s idea to recreate his first emotional reaction to the landscape around Treblinka in the film that lasts 9 minutes, as long as the way of the Jews from the ramp to their end in the death camp. The other film, Prayer (1981), is the portrayal of a Japanese Buddhist monk praying at the site of the former Auschwitz-Birkenau concentration camp. The formal inspiration of the film came from Japanese visual art.

This research paper concerns the copyright-law consequences of generating literary and artistic creations resulting from the “creative activity” of artificial intelligence (AI). The essence of the problem that rapidly gains practical significance boils down to the question whether, at present (de lege lata) and in the future (de lege ferenda), such creations can be protected under copyright law and who should possibly be considered to be the author. The legal-dogmatic analysis of the normative matter, the current state of science and the case law in force applicable here, shows that under the current legislation the creations generated by AI do not fall within the definition of creative work and do not form the subject of copyright as they were not created by human being. Therefore, the AI may not be considered to be the author and thus endowed with a copyright and even more a moral right to the work. In the de lege ferenda perspective, the proposals to cover AI-generated assets by protection outside the copyright law area, e.g. through related rights or the institution of work made for hire, are not fully convincing for axiological reasons, i.e. the difficulty of identifying a person who deserves to benefit from such protection. Nor can the proposal to grant subjective rights to AI itself be supported, since this would mean changing the axiom of the copyright law, namely that only a human being can be the author. If copyright is to survive as a right of a human creator, which should be advocated, then in the light of this regulation the literary and artistic creations generated by AI should remain in the public domain.
Niniejsza wypowiedź o charakterze naukowo-badawczym dotyczy prawnoautorskich konsekwencji powstawania dóbr o cechach literackich i artystycznych, będących rezultatem „twórczości” sztucznej inteligencji (AI). Istota problemu – gwałtownie zyskująca znaczenie praktyczne – sprowadza się do odpowiedzi na pytanie, czy obecnie (de lege lata), a także w przyszłości (de lege ferenda) dobra tego typu mogą stanowić przedmiot ochrony prawa autorskiego i kto ewentualnie powinien być uznany za ich twórcę. Przeprowadzona analiza dogmatyczna obowiązującej i znajdującej tu zastosowanie – nie tylko krajowej – materii normatywnej, dorobku nauki i orzecznictwa wskazuje, że de lege lata dobra niematerialne wygenerowane przez AI nie mieszczą się w definicji utworu i nie stanowią przedmiotu prawa autorskiego z tej racji, że nie zostały stworzone przez człowieka. W związku z tym sztuczna inteligencja nie może być uznana za twórcę i przez to wyposażona w podmiotowe prawa autorskie – majątkowe, a tym bardziej osobiste. W perspektywie de lege ferenda postulaty przyznania dobrom AI ochrony poza obszarem prawa autorskiego, np. w ramach praw pokrewnych czy instytucji work made for hire, nie przekonują w pełni ze względów aksjologicznych, tj. trudności związanych ze wskazaniem osoby zasługującej na czerpanie korzyści z takiej ochrony. Nie można też wesprzeć propozycji przyznania praw podmiotowych samej AI, albowiem oznaczałoby to zmianę aksjomatu prawa autorskiego, że twórcą może być tylko człowiek. Jeżeli prawo autorskie ma przetrwać jako prawo twórcy-człowieka – za czym należy się opowiedzieć – to w świetle tej regulacji dobra literackie i artystyczne wygenerowane przez AI powinny pozostać w domenie publicznej.

Drugie „ja” autora czy zestaw implicytnych norm — pojęcie autora implikowanego i problemy z nim związane Mimo że pojęcie autora implikowanego jest standardowym elementem poetyki formalistycznej, nie poddaje się ono łatwej konceptualizacji. Niniejszy artykuł analizuje klasyczne, zachodnie omówienia tego pojęcia i odnosi je do zbliżonych polskich studiów historycznoliterackich w celu określenia jego przydatności. Analiza wykazuje, że autor implikowany może być konceptualizowany jako antropomorficzny byt, (re)konstruowany przez czytelnika na podstawie sygnałów tekstowych. Takie rozumienie pojęcia autora implikowanego pozwala na podkreślenie braku prostej korelacji między rzeczywistym autorem a figurą autora wywiedzioną z tekstu i tym samym odsłania jego użyteczność jako narzędzia teoretycznoliterackiego.
Despite being a standard element of formalist poetics, the notion of the implied author actually resists easy conceptualisation. This paper analyses classical Western theorisations of the implied author and relates them to relevant Polish literary-theoretical studies in order to assess the utility of the concept. It demonstrates that the implied author can be construed as an anthropomorphic entity (re-)constructed by the reader on the basis of textual signals. Thus understood, the notion of the implied author throws into sharp relief a lack of straightforward correlation between the real author and the idea of author derived from the text, and therefore proves to be a useful literary-theoretical tool.
