This article discusses the role of context in arts and aesthetic theory and demonstrates that contextual analysis broadens our understanding of these two realms. It demonstrates a codification of an important controversy in aesthetic theory and arts between formalist and contextualist theories. It serves as a means to highlighting some moments in the development of aesthetics and arts that contributed to the rejection of old paradigms (disinterest theory, formalism) and instigated a move towards a more context-focused analyses of art and aesthetics.

The article explores the polarisation within the body of twentieth century criti-cism surrounding Samuel Beckett’s work: A polarisation between strict forma-list approaches which tend to see Beckett as very much part of a modernist tradition and poststructuralist theorists who seek to categorise his work in terms of postmodernism. As an unfortunate result of extreme critical standpoints, the philosophical thinking of Schopenhauer, which had such a profound and lasting influence on both Beckett’s approach to writing as well as to the theatre, has been largely ignored or simply pushed to one side.

The paper analyzes the elements and strategies of Russian formalism applied to the Russian avantgarde zaum poetic experiment of Alexei Kruchenykh and Viktor Khlebnikov. In futuristic tendencies to create a trans-rational language or zaum language lies the idea of a new voice, sounds and semantic meaning. According to Russian poets the new semantic meaning of the word is obtained only in the process of performing a poem. Also, according to Russian formalism, sound of poem, in the performing process, has its own independent meaning. In this sense zaum experiment in its printed form does not possess a fixed resolution of meanings, but only has potential of meanings. The function of fixed forms, that during the process of performing is to form a new movable semantic meaning.

The essay deals with the complex issue of voluntary formalism, regulated in the articles 1326 paragraph 4 and 1352 of the Italian Civil Code, and the exegetical problems connected to it. The study aims to verify whether the voluntary formalism occupies the same role or not and fulfills the same functions as the legal formalism. Then the relationship between the voluntary forms and the classic pathologies related to contracts has been investigated in order to verify the possibility of tracing the whole theme of the forms chosen by the parties within the different problem of the formation of the contractual agreement.

The article focuses on Russian constitutional ideology with overview of its historical preconditions and analysis of recent significant cases of the Russian Constitutional Court. There is a discussion of gay activist Alekseyev’s case and “foreign agents’ law” case in constitutional practice as most significant examples of positivistic way of legal reasoning. The paper argues that legal positivism through its form – legal formalism is the main ideology in the modern constitutional practice in Russia. This ideology is based on the assumption that constitutional justice can find social truth. German positivistic and Soviet Marxist views have strongly determined the modern Russian constitutional discourse.

The investigation results of the emission of noises accompanying the diesel engine powertrain running in unloaded condition at low or idle speed, are presented in the hereby paper. The multifractal nature of the tested signals was confirmed by means of two groups of parameters. The proposed local parameters are based on the distribution of the probability density of measures, segregated into subsets according to pointwise Holder exponents. The obtained spectra constitute a set of multifractal measures related to singularities representing the local scaling of measures in various points of the time series. Global parameters were defined on the basis of multifractal measures of the parametrised Renyi’s entropy. These are properties treating summarily the whole spectrum of the emitted noise and reflecting changes of the vibroacoustic energy levels generated by noise sources. The tests encompassing simultaneous application of both groups of parameters confirmed their efficiency in the comparative analysis as well as in the subjective assessment of the noise level generated in the drive system of vehicles with diesel engines. This opens new possibilities within the simulation range of vehicle noises, for the needs of constructing the passive and active reduction systems of the effects of the vibroacoustic energy propagation.

Opis:
To calculate the transmission coefficient of ultrasonic waves through a multi-layered medium, a new approach is proposed by expanding it into Debye’s series. Using this formalism, the transmission coefficient can be put in the form of resonance terms series. From this point of view, the relative amplitude of the transmitted wave can be considered as an infinite summation of terms taking into account all possible reflections and refractions on each interface. Our model is then used to investigate interaction between the ultrasonic plane wave and the N-plane-layer structure. Obviously, the resulting infinite summation has to be reduced to a finite one, according to some level of accuracy. The numerical estimation of the transmission coefficient using the exact expression (Eq. (1)) is then compared to the one of our method in the case of two or three plane-layer structure. The effect of the order of the finite summation on the calculated value of the transmission coefficient is, as well, studied. Finally, our proposed method may be used, with the decomposition into Gaussian beams of a pressure field created by a circular source, to draw a 3D image of the pressure field transmitted through a multilayered structure.

The professional mathematician is a Platonist with regard to the existence of mathematical entities, but, if pressed to tell what kind of existence they have, he hides behind a formalist approach. In order to take both attitudes into account in a possibly serious way, the concept of suprasubjective existence is proposed. It involves intersubjective existence, plus a stress on objectivity devoid of actual objects. The idea is illustrated, following William Byers, by the phenomenon of the rainbow: it is not an object but can be said to possess a subjective objectivity.

The paper gives second order sufficient conditions for the strong local optimality of a bang-singular extremal in a minimum time problem. The conditions are given in terms of regularity assumptions on the extremal and of the coercivity of the extended second variation associated to the minimum time problem with fixed end-points on the singular arc. The conditions are close to the necessary ones in the usual sense, namely we require strict inequalities where necessary conditions have mild inequalities.

Two methods for calculating transport parameters in semiconductor superlattices by applying Green’s functions are compared in the paper. For one of the methods, the Wannier functions method, where computations in the complex space and Wannier functions base are required, the Hamiltonian matrix is small in size and its elements depend solely on the energy. For the real space method, as it operates in the floating point domain and uses the Hamiltonian containing the elements dependent both on energy and position, the Hamiltonian matrix is larger in size. The size makes the method computationally challenging. To find the consequences of choosing one of the methods, a?direct comparison between the computations, obtained for both methods with the same input parameters, was undertaken. The differences between the results are shown and explained. Selected simulations allowed us to discuss advantages and disadvantages of both methods. The calculations include transport parameters such as the density of states and the occupation functions, with regard to scattering processes where the self-consistent Born approximation was used, as well as the spatial distribution of electron concentration for two superlattices structures. The numerical results are obtained within the non-equilibrium Green’s functions formalism by solving the Dyson and the Keldysh equations.

Time-symmetric formulation of quantum mechanics—the two-state vector formalism—is presented as a tool for studying past behaviour of quantum systems. A role of weak measurement and weak values in the Cheshire Cat effect and a nested (Vaidman) three-path interferometer are discussed. Interpretation of a particle’s faint trace indicating possibility of discontinuous paths of particles passing the Vaidman interferometer is given. Consistent histories are presented as one of alternative approaches. Multitude of controversial issues is briefly reviewed and discussed.

Translation history has always played an important role in Slovak literary and translation studies. In our paper we discuss the beginnings of Slovak translation historyresearch, which have their roots in formalism and structuralism, and reconstruct lines of influence to the present when translation history is a lively, open, interdisciplinary,and empirical discipline. With the past in mind, we look at several of the most recent and significant research initiatives in Slovak translation history research and evaluate their potential for the future.
Historia tłumaczeń zawsze była bardzo ważna dla słowackiej literatury i badań nad tłumaczeniami. W niniejszym artykule omawiamy początki słowackiej historii badańnad tłumaczeniami, których korzenie odnajdziemy w formalizmie i strukturalizmie. Również poddajemy rekonstrukcji linie wpływów aż do obecnych czasów, w których historię tłumaczeń można opisać jako żywą, otwartą, interdyscyplinarną i empiryczną dziedziną. Biorąc pod uwagę również przeszłość, przyglądamy się kilku najnowszym i najistotniejszym słowackim inicjatywom w historii badań nad tłumaczeniami i oceniamy ich potencjał na przyszłość.

This article demonstrates the inadequacy of legal deduction as a method that guarantees the certainty and predictability of law and its outcomes in concrete instances. Inter alia, the Author brings our attention to the far smaller role that the deductive pattern of inference plays in legal thought than one may suppose, since it is rather only a schematic illustration of the decisions that were previously made by recourse to the mental operations of a non-logical nature. In return, he proffers legal analogy as an alternative, by which he understands a mode of thinking which helps the reasoner to take into account a mass of different factors that are traditionally deemed to be relevant for legal thought and decision-making.
