Opis:
The purpose of this paper is to analyse the existing model of employment arbitration in Poland in force since 2005. According to Article 1164 of the Code of Civil Procedure, arbitra¬tion clauses in employment disputes can only be established once a dispute has already arisen. In reality, this post-dispute voluntary regulation has no practical value and employment ar- bitration is an instrument used extremely rarely in Poland. On the basis of examination of applicable laws, the author shows that in given factual and legal circumstances a reasonable employee and a reasonable employer shall seldom have a cause to simultaneously agree to arbitrate an already existing dispute. By applying the com- parative method at the same time, the paper examines possible criteria of distinguishing categories of disputes, agreements, persons and other conditions that would permit a valid arbitration clause in employment agreements. In conclusion, the author demonstrates that, firstly, the existing voluntary post-dispute employment arbitration model in Poland is a fictitious one and requires reform and, sec- ondly, that both a full elimination of arbitration clauses in employment agreements and a full arbitration clause for all future disputes are too blunt a tool not taking into account the real needs and requirements of today’s employees and employers. The author calls for a more nu- anced regulation of employment arbitration in Poland.

In formulated long-term strategy “Europe 2020” attention is focussed on problems in the sphere of employment. Therefore one of the objectives of the strategy is to reach the employment rate on the level of 75% for women and men aged 20 to 64 by 2020. In National Reform Programs; individual EU member states adjusted their employment objectives to local needs while considering situations on their labour markets and practical probability of changes. Due to differences in social and economic situation in EU-28; and consequences of economic crisis particularly noticeable in individual countries; these objectives are diversified. Achieving the high level of this indicator does not reflect the full situation on the labour market because of rising unemployment and underemployment. Underemployment in the form of over-education; under-qualification or involuntary part-time jobs refers to a growing number of social group; particularly women and young people. The questions that naturally arise from these considerations apply not only to the employment rates; but also to the scale of labour underutilisation; the consequences of this phenomenon for the economy; society; both on micro and macro level. The main research questions are: “What is the scale and dynamics of employment and underemployment in the European Union?”; “How big are disparities across UE?”; “Is there a relationship between high employment and low underemployment?”; “What are the chances to achieve employment objectives in 2020?” Considering the aforementioned conditions; the goal of the paper is to present a diversity in employment and underemployment rate in EU-28 between 2008 and 2014 and to assess a potential probability of achievement of employment objectives by individual member states in the perspective of 2020. The execution of the goal formulated in this way imposed the structure of the paper that includes: 1) definition of underemployment; 2) review of employment objective in “Europe 2020” strategy; 3) analysis of the changes of employment and underemployment in EU-28 between 2000 and 2014; 4) presentation of employment objectives formulated in National Reform programs; and the assessment of their implementation.

The long-term strategic objectives of EU Rural Development Policy in the next (2014-2020) programming period are as follows: competitiveness of agriculture, sustainable management of natural resources and balanced territorial development. In this strategy, agriculture remains to be a key element solution for rural problems. In cooperation with four villages of Nograd County in Hungary, a survey, carried out in the summer of 2012, questioning the local population about their economic and social conditions, the situation of local communities and development ideas, with special focus on the role and potential of agriculture, was conducted. Having analysed the role of agriculture in employment, based on literature and research conducted, it is worth highlighting its significance in solving rural problems and ought to be considered when constructing new rural policy, especially in the following topics: the social functions of traditional agriculture based on local resources, the strengthening of viable farms, the increasing importance of diversification and labor- -intensive products with high added-value.
Długoterminowe cele strategiczne UE dotyczące Polityki Rozwoju Terenów Wiejskich na najbliższy planowany okres (2014-2020) to przede wszystkim: konkurencyjność rolnictwa, zrównoważone zarządzanie bogactwami naturalnym i zrównoważony rozwój terytorialny. Dla tej obranej strategii sektor rolny pozostaje elementem kluczowym, jako rozwiązanie problemów, z którymi borykają się tereny wiejskie. W 2012 r. przeprowadzono ankietę wśród mieszkańców czterech wsi węgierskiego regionu Nógrád. Lokalną ludność zapytano o ocenę swojego statusu ekonomicznego i społecznego, a także o pomysły na dalszy rozwój społeczności, uwzględniając rolę i potencjał rolnictwa. Należy podkreślić kluczową rolę jaką spełnia rolnictwo w rozwiązywaniu problemu zatrudnienia na terenach wiejskich. Podkreślono także funkcje polityki rozwoju tych obszarów, tj. społeczną tradycyjnego rolnictwa opartą na zasobach lokalnych, wspieranie opłacalnych gospodarstw rolnych, rosnące znaczenie dywersyfikacji oraz pracochłonnych produktów o wysokim podatku VAT

One of the prerequisites for the creation of employment opportunities is the overall condition of the economy, however, this prerequisite is not the only one required for the guarantee of the increase of employment. Factors influencing the employment rate are connected to the entrepreneurial environment, which is one of the basic factors of creation of work opportunities in the market economy. In the future, the growth of the employment rate will be connected to the quality of the work force as well as of the renewed economicpolitical concept with a priority on the knowledge economy based on the learning competence.
Jednym z podstawowych warunków dla tworzenia możliwości zatrudnienia jest ogólny stan gospodarki, jednak ten warunek nie tylko jeden wymagany jest dla gwarancji wzrostu zatrudnienia. Czynniki wpływające na poziom zatrudnienia połączone są z otoczeniem, które jest jednym z podstawowych czynników tworzenia możliwości pracy w gospodarce rynkowej. W przyszłości wzrost wskaźnika zatrudnienia będzie podłączony do jakości siły roboczej, jak również odnowionej koncepcji gospodarczo-politycznej z priorytetem w gospodarce opartej na wiedzy w oparciu o kompetencje uczenia się.

In independent Poland, the foundations for a new area of law, that is, labour law were laid, abandoning the previously crucial principle of freedom of contract underlying the contractual relationship between an employee and the employer. On March 16, 1928, the President of the Republic of Poland issued an ordinance on labour contracts, defining mutual obligations of employees and their employers under an employment contract based on which the employee undertook to perform work for the employer against remuneration. The legislator permitted the conclusion of employment contracts in writing, orally or in any other customary form accepted in a given workplace. In exchange for the work performed, the employer was obliged to pay appropriate contractual remuneration, as specified in the employment agreement. Importantly, this ordinance contained a number of protective regulations that were designed to protect the worker and make his position towards the employer more equal. They included regulations concerning remuneration protection or the employer’s obligation to specify work rules. Most importantly, however, the ordinance protected the worker from immediate and unjustified dismissal.

The latest Eurostat projections show that both population and labour force ageing change employment profiles by age in the European Union countries even in case of an increase in labour force participation and employment (The 2012 Ageing Report). My research question is how basic individual (such as age, education, household position, place of residence) and contextual characteristics (such as the business cycle and the regional labour market situation) influence on employment opportunities in Poland. I test whether the impact of different factors varies with age, which has been categorized to reflect different stages of the life course: youth and young adults (15–29 years old), prime aged (30–54 years old), and older workers (for women: 55–59, for men: 55–64). To answer the research question three types of multilevel logistic models were applied: (a) general models with age as one of the basic determinants, (b) models for each age group for non-agriculture and agriculture. The data used come from the Polish Labour Force Survey (BAEL) of the years 1998–2008 and regional labour market data. The analysis reveals that there are differences in influence of individual and context variables on employment odd ratios between age groups, sex and employment sectors.

This study presents a dynamic general equilibrium model with an explicit employment period and investigates economic fluctuations to a temporary productivity shock. Numerical experiments indicate oscillatory responses of new hiring and employment to the shock which are not observed in a standard flexible price model. The explicit employment period constructs an overlapping structure of employment which results in the oscillatory response. This study also examines the effects of change in employment period to economic fluctuations and shows that the variations in new hiring are higher when the employment period is long.

Research background: Among the determinants of the socio-economic development of the region, an important role is played by its endogenous potential. It is reflected in the industry structure of the region, formed in the process of its historical development. The industry structure is the basis for the development of regional specialisations. One of the criteria for defining specialisations is the employment structure by sections and divisions of the national economy. The definition of regional specialisations is indispensable for planning the development policy and for formulating regional strategies. Purpose of the article: The main objective of the paper is the analysis and evaluation of employment structure as a criterion for the delimitation of industries identified as smart specialisations in the region. The study covers the case of selected region in Poland at NUTS-2 level ? the voivodeship of Małopolska.  Methods: The study is based on GUS unpublished data (Statistics Poland) for 2009 and 2018. It makes use of descriptive statistical analysis methods and structure and dynamics ratios, as well as Florence?s specialisation coefficient. Findings & value added: The research has shown that the employment structure indicating the presence of the region's specialisation in given industries is an important, but not sufficient criterion for the evaluation, whether the delimitation of industries recognized as smart specialisations was appropriate. In the light of the conducted research, it seems fully justified to grant the status of smart specialisation in Małopolska to Information and Communication Technologies as well as to Creative and Leisure Industries. In the context of changes to employment dynamics and structures, the possible development-oriented smart specialisations are as follows: Manufacture of metals and metal products, Electronics and machine industry, and Chemistry. On the other hand, the identified specialisations: Life science and Sustainable energy are not in line with changes in the region?s employment structure. The paper proposes one of the possible ways of precise identification of distinctive regional industries with high development potential. The structure of employment and changes occurring in this area make it possible to determine the main forces of the region's endogenous potential, and thus may form the basis for the determination, and in the longer term, assessment of the relevance of identified regional smart specialisations. The added value of the study is, therefore, an attempt to assess, on the example of a selected region, to what extent changes in regional specialisations reflected in the existing employment structure confirm the accuracy of the selection of industries identified as regional smart specialisations. The presented case is an exemplification of the proposed method, which can also be successfully applied to other European regions.

The article presents a brief overview of the research so far and theoretical considerations on the differences that make an individual choose a non-traditional form of work. Some people deliberately choose alternative employment due to its flexibility, freedom and variety of tasks offered. Individuals preferring this type of employment mainly due to the said characteristics are referred to as voluntary employees. A coercive flexible employee is someone who perceives his/her employment as unattractive and undesirable, and it is only inability and lack of chances to find a permanent or a different type of employment that makes them choose this type of employment for a specified period of time or on short- term basis. Given the choice between a flexible form of employment and “permanent” job, assuming that conditions offered are acceptable, they do not hesitate to choose the latter.

Purpose – Self-employment is considered one of the responses to precarious employment, particularly among those who lost jobs during an economic crisis. Although starting a new business is widely available, operating new ventures remains challenging. This article aims to explore the premises of self-employment success, namely self-employment intention and proactive coping as crucial predictors of further performance. Design/methodology/approach – The authors recruited participants among initially unemployed individuals who participated in the entrepreneurial program aimed at creating self-employment. Since entrepreneurs are expected to have specific personal characteristics important for performance, the authors assessed proactive coping as the key factor for self-employment intention. Findings – The results depicted proactive coping as crucial in performing own ventures in the long run, which suggests that self-employment intention may change over time. Practical implications – Proactive coping is particularly appropriate for self-employed at any stage of the entrepreneurial process because it maintains the intention to perform own business. Thus, the findings underline the need for proactive coping training for entrepreneurs, particularly those previously unemployed. Originality/value – As the self-employment intention may differ in time, the importance of being proactive in operating small businesses increases.

Work represents a particular economical, social and psychological relevance to the worker. Because of a personal dimension of work, that involves human beings, it cannot be separated from workers. The approach to human labour as not a market product, but as a human being, is contained in the statement that ‘labour is not a commodity’, firstly expressed in the International Labour Organization’s 1944 Declaration of Philadelphia. The reference to this assumption more recently on the occasion of the 100th anniversary of ILO activities clearly evidence that the history of labour has come full circle and the idea of decent work for workers has returned to being the centre of labour law regulations. The concerns relating to the inadequate protection of workers coincided in time with the transformative change in the world of work. With this in mind, it is then worth considering more deeply whether a decent job is an ‘exclusive’ and ‘luxurious’ ideal, and leave outside its scope a number of workers who are in need of protection because of their unique situation. The position of Poland in this picture will be analysed.

In the study I exploit European Social Survey Round 5 data to identify the determinants of temporary employment in Poland. As in this country the share of employees working under contracts of limited duration is the highest among all European Union member states, identifying the determinants of temporary employment is important not only for individuals but also for the policy-makers. The results of the analysis are supplemented with an investigation of the determinants of temporary employment for people younger than 30 years old as this phenomenon is commonly associated with young employees.

The population is a source of a country’s state potential that aids the achievement of strategic plans. Well-being of the population is a guarantee of successful implementation of employment programs in the context of market economics. The main task of state regulation is to reach the desired goal and targets under the conditions of contemporary and actual environment. Research objective The objective is to review the implementation of state programmes in regards to population employment and to analyse the actual concepts of state politics development in regards to employment, its efficiency in the present environment of social tension of a region – Aktobe oblast. Methods By means of analysis the general scientific research methods have been defined – system methods based on analysis and evaluation of practical and operative data of official statistical sources of Committee on Statistics of Republic of Kazakhstan, the data of city department of Aktobe Employment Centre. Conclusions The article generalizes the systems of state principles in implementation of state programmes for elimination of social threats leading to different external and internal threats, poverty and social tension in the region. It reveals the legal steps and responsibility of the employment parties, relationship of unemployed citizens and the state.
