Although refugees are offered the potential of asylum protection through the 1951 Convention Relating to the Status of Refugees, many states are attempting to curtail the number of asylum applications received each year. Several scholars have argued that even without such deterrence measures, some refugees are less likely to receive a positive asylum decision than others. Using country level data for 32 European states, this project examines the effects of various characteristics – including gender, age, and state of origin – on the likelihood of being granted asylum. This study is a first attempt at empirically testing the asylum literature’s anecdotal evidence of bias in the decision-making processes in determining the outcomes of asylum claims.

Opis:
The focus on children’s well-being is fundamental to any child-centred policy. Hence, migrating children’s interests are usually considered in a migrant context rather than in the best interests of the child, highlighting the challenges of implementing child-centred asylum policies in practice. Based on this observation, the paper focuses on the discrepancies between the legal provisions for the reception of minor asylum seekers in Poland and practice on the ground: how they serve the education opportunities for such children, as the only social area where the child-centred approach is detectable. The paper discusses the extent to which the legal provisions of the Polish migration law are suitable for adopting a child-centred approach in the asylum procedure to enable children to continue their education. It is further explored in connection to the Micreate fieldwork study with asylum-seeking children. The paper analyses specific institutions to assess their potential for implementing child-centred management in the reception and integration of asylum seekers and to highlight the obstacles in this direction. Finally, the paper formulates recommendations for necessary changes and shifts in practice to recognise the children-friendly practices in asylum procedures.

This paper explores this potential using Honneth’s theory of recognition. By employing narrative inquiry, the data shows clues of recognition in the interviewed teachers’ perceptions and values, relationships with learners, and teachers’ understanding and concern for learners.

Abstract Aim: Millions of people are displaced globally, as refugees, asylum seekers or migrants. Although, at a first glance, crisis and conflicts are considered the main trigger for these movements, the migration challenge may have different roots: demographic trends, poverty, the globalization of communication, etc. The present article is an introduction to the main concepts and terminology regarding migration and it links the migration with actual labor problems within the EU. Design: The article shows how migration terminology is reflected in the EU migration policy and how migration policy affects labor policy and vice versa. The article is to be considered a state of the art or methanalysis and explains the concepts: in-migration, out-migration, refugees, asylum-seekers. In addition, it draws attention to controversies regarding the use of concepts: illegal migration, irregular migration and return migration. Conclusions: The article presents eight main economic theories of migration. Five of them have as subject of analysis the determinants of migration and the other three have the subject of analysis the perpetuation of migration. Some of the main theories analyzed here are the neoclassical theory of migration, the human capital theory of migration, the new economics theory of migration, world system theory, network theory, migration systems theory. Originality: The article demonstrates the fact that neither of these economic theories/models explain adequately the actual determinants of migration and it proposes a new model focused more on the transdisciplinary effects of human movements.   Keywords: migration, crisis, development, asylum seekers, labor market policies JEL: J015, J61, J15

The purpose of this study was to investigate the European Union (EU) Migration and Asylum Policy, a perspective of African migrants in Europe. Attempts were made to identify the perception of Africans in the EU on its migration and Asylum policy and assess whether the policy encourages migration and Asylum in the EU. To achieve this, descriptive survey was employed and questionnaires were administered to 100 respondents in Europe from different African countries. The data collected using the online questionnaires were analyzed using percentage, mean and standard deviations. From the results, it was concluded that immigration into the EU is undertaken by male citizens of most African countries especially at their youthful ages driven by the need to pursue education and job opportunities. Their stay in the EU breeds the desire (positive perception and desire) to obtain either work status or EU nationality. Many of them desire to be integrated into the host countries rather than repatriated to their countries. Finally, most of them greatly esteem the EU migration and asylum policy and prefer to stay within the EU than be resettled or repatriated, according to the new EU Pact policy.

The security of asylum-seekers in the context of conditions of reception has not been frequently researched. This article aims to fill this gap by arguing that asylum-seekers in Poland are stuck in a grey zone between being secure and being securitised by the host society, with little opportunity to use their own agency. The basis for my study is the theory of the Welsh School of Critical Security Studies which focuses on understanding security through emancipation. The methodology contains a structural analysis of the reception system through the lenses of the agency–structure relationship and a legal and institutional study, as well as an in-depth examination of security practices combined with a reconstruction critique. The results show that the Polish reception system is a structure which is highly asymmetrical in relations of power, especially in the fundamental case of setting a security agenda. This thus constitutes a substantial constraint on migrants’ agency – with some potential for emancipation, however. In conclusion, the research points out the discrepancy between elements of the reception system driven by principles of liberal democracy and the nation-state and calls for a more inclusive, empowering and participatory security provision within the reception system in Poland.

Refugees and migrants have always been of particular concern to the Roman Catholic Church and its pastoral care. Even if the large influx of refugees happening in 2015 and 2016 is no longer the case, flight and migration are still relevant topics in Austria. The contribution deals with the historical development of canonical regulations, the situation of refugees and migrants in Austria, the legal basis, the implementation of asylum procedures and numbers, the statements of the Austrian Bishop’s Conference, the access to a Church or religious community and converting from one to another, the question of the Catholic Church’s necessity of salvation, regulations concerning catechumenate and the question of church asylum. It provides figures, data and facts, presents the canonical and state legal situation and analyses it. It tries to make weak points obvious and would like to provide help for future considerations.

The main causes of leave behind their home for unaccompanied minors are fear of persecution, human rights violations, armed conflicts and civil unrest, sexual exploitation, domestic violence, abuse, severe deprivation, gender-based discrimination, forced military service, search for new opportunities, the intention of joining the family already staying in Europe. The main aim of the study is to give a short present of the asylum procedure the minors are passing through. Summarizes the barriers to access to asylum procedures, the role of the guardian, the legal, medical and social assistance system for asylum seeker minors and the possible outcomes of the procedure and opportunities of appeal.
Głównymi przyczynami pozostawienia domu za życia dla małoletnich bez opieki są obawa przed prześladowaniem, łamaniem praw człowieka, konfliktami zbrojnymi i niepokojami społecznymi, wykorzystywaniem seksualnym, przemocą w rodzinie, znęcaniem się, poważną deprywacją, dyskryminacją ze względu na płeć, przymusową służbą wojskową, poszukiwaniem nowych możliwości, zamiar dołączenia do rodziny już przebywającej w Europie. Głównym celem badania jest krótkie przedstawienie procedury azylowej, którą przechodzą małoletni. Przedstawia bariery w dostępie do procedur azylowych, rolę opiekuna, system pomocy prawnej, medycznej i społecznej dla osób nieletnich ubiegających się o azyl oraz możliwe wyniki procedury i możliwości odwołania.

Migration, as a global phenomenon has a long history also in the Slovak Republic. Most of the migrants come, or are passing through its territory legally. There are still cases of illegal migration, too. The reasons for this form of state borders crossing are diverse. Part of illegal migrants are also people who are belonging to vulnerable groups, including unaccompanied minors. Since this is a specific and particularly vulnerable group of migrants, the European Union and subsequently the Slovak Republic adopted several legislative measures in the area of migration and asylum. Their aim is to adjust the status of unaccompanied minors and to contribute to finding lasting solutions to their current situation, taking into account their best interests.

This paper aims at the presentation of ethical and political grounds of the pedagogy of asylum, which, in its assumptions, refers to concepts of such thinkers as Emmanuel Levinas, Erich Fromm, George Steiner, Hannah Arendt, Michael Walzer, Avishai Margalit, Jacques Derrida and Janusz Korczak. Utopia of hospitality, presented in its basic assumptions, constitutes a look at the social life, life of individuals and communities, as concentrated in asylums, while its author thinks that it forms an answer to modern challenges to Western democracies, education and politics in the “Age of Migration”.

This research sets out the importance of studying the refugee crisis and the phenomenon of migration, the way refugees reach European territory and in which states they aim to settle. The first part of the article shows the evolution of illegal entries on the routes that refugees use to enter the European continent in the period between 2009-2018. The second part of the article aims to highlight the European States which were affected by the refugee crisis in light of the asylum requests submitted by the applicants for international protection in the EU between 2015-2018. Therefore the analysis led to the classification of the European States into four clusters: (i) states with a high number of asylum applications; (ii) states with a medium to high number of asylum applications; (iii) states with a small to medium number of asylum applications; (iv) states with a small number of asylum applications. The objective of this classification is to identify the states that were affected by the refugee crisis.

The article explores the use and importance of taking a biographical approach to conducting participatory action research (PAR) with asylum seekers and refugees in order to: better understand lived experiences of exile and belonging; contribute to the important field of Biographical Sociology; provide a safe space for stories to be told; and in turn for these stories to feed in to policy and praxis. The authors’ combined work on the asylum-migration nexus, the politics of representation and participatory action research methodology (PAR) as ethno-mimesisi argues for the use of biography to contribute to cultural politics at the level of theory, experience and praxis, and is constitutive of critical theory in praxis. PAR research undertaken with Bosnian refugees in the East Midlands and Afghan refugees in London will be the focus around which our analysis develops. We develop a case for theory building based upon lived experience using biographical materials, both narrative and visual, as critical theory in practice towards a vision of social justice that challenges the dominant knowledge/power axis embedded in current governance and media policy relating to forced migration. The dominant power/knowledge axis related to forced migration is embedded in current (New Labour) governance and re-presented in some media texts as identified below. New Labour governance is symbolised in the competing discourses of a) strong centralised control and b) more open systems, network and partnership based governance (Newman, 2003: 17-23; Clarke, 2004; Lewis, 2000). Open systems are made up of partnerships and networks – “joined up government”, “that transcends the vertical, departmental structures of government itself” (Newman, 2003: 20). to develop or foster a consensual style of governing. Progressive governance is defined by Newman (2003:15) as involving a significant shift from governance through hierarchy and competition to governance through networks and partnerships with an emphasis upon inclusion. Progressive governance involves the production of techniques and strategies of responsibilisation of citizens operationalised through the development of networks, alliances, and partnerships, with a strong focus upon active citizenship. Thus, spreading responsibility for social control to non state agencies and “communities” (Garland, 2001). In relation to forced migration/asylum discourses around the exclusion of the “other” (involving criminalisation, detention and deportation) and the maintenance and control of borders (developing ever more tighter controls on entry and asylum applications) exist in tension with discourses that speak of human rights, responsibilities and possibilities for multi-cultural citizenship especially in the community cohesion literature. There is a conflict at the heart of New Labour’s approach to asylum policy linked to the “alterity” of the asylum seeker that promulgates hegemonic ideologies and discourses around rights to belonging and citizenship, perceived access to resources (redistribution) and misrecognition fostering suspicion of the “stranger”. Alongside discourses of fairness and rights to enter and seek refuge, there exist regressive discourses that water down the vitally important actual and symbolic 1951 UN convention, and foster a split between “bogus” and “genuine” refugees, making it extremely hard to seek asylum in the UK.

In the late 4th century, bishops utilized the so-called ius intercessionis right to intervene in order to help those in need, be they the persecuted, the accused or the convicted. These actions of a bishop were rooted foremost in the idea of mercy and it was also due to this right that a bishop became the one to decide about the granting of the right to asylum – a right which was gradually extended to Christian churches at the time. St. Augustine encounters the issue of Christian asylum as the bishop of Hippo Regius in Africa mainly in his preserved correspondence, but he talks about seeking sanctuary in Christian churches also in one of his sermons, specifically in Sermo 302 delivered on the feast of St. Lawrence. This paper focuses on presenting the circumstances of a violent act in Hippo Regius and its implications to potentially sanctuary seeking in local Christian church, particularly on the ground of analysis of post sermonem to Sermo 302.

The totalitarian regime in Albania was considered as one of the most rigid and isolated in all of Eastern Europe from 1945 to 1991. Starting from 1990 when the system collapsed, Albania has witnessed one of the great migrations of recent times. This Balkan country has experienced the highest level of international migration after the fall of the communist regime compared to other post-communist countries in Eastern Europe. The paper seeks to understand the phenomenon of Albanian emigration (from Albania – not from other parts of the Balkans e.g. Kosovo, Macedonia) as one of the major features of post-totalitarian legacy. The first part of the text provides a brief overview of the Albanian communism system, the second part is an analysis of different waves of Albanian emigration after the collapse of communism, and the third part presents the current situation regarding Albanian migration. The article offers an overview of Albanian post-communist migration and represents a summary of up-to-date knowledge about this phenomenon.
