    The article presents legal doubts related to the entrusting consuls of the Republic of Poland with notarial functions. In Poland notarial actions are carried out by notaries, who act as guarantors of the safety of legal transactions. The author emphasizes factors which affect the proper fulfillment of a duty to safeguard the rights and interests of participants in legal transactions carried out by notaries. Then the author discusses differences in legal status and responsibilities of notaries and professional and honorary consuls. In conclusion the author indicates how these differences affect the guarantees to ensure the legal safety of citizens and at the same time underlining the State’s tasks in this area.

    Artykuł stanowi efekt analizy polskiego i europejskiego porządku prawnego w zakresie wiz oraz możliwości zaskarżenia decyzji odmownych wydanych przez organy wizowe, w szczególności przez konsula RP. Autor przybliża istniejące do niedawna regulacje prawa konsularnego, uchylone na skutek wątpliwości co do ich konstytucyjności, potwierdzonych przez Trybunał Konstytucyjny, a także porusza kwestię odrębności postępowania przed konsulem RP będącego przedmiotem ustawy z dnia 25 czerwca 2015 r. – Prawo konsularne. Wraz ze wskazaniem odrębności postępowania przed konsulem autor zwraca uwagę na normę przesądzającą o wyłączeniu stosowania Kodeksu postępowania administracyjnego „w sprawach należących do właściwości polskich przedstawicielstw dyplomatycznych i urzędów konsularnych” (art. 3 § 2 pkt 4 k.p.a.) oraz na normę zawartą art. 5 pkt 4 ustawy z dnia 30 sierpnia 2002 r. – Prawo o postępowaniu przed sądami administracyjnymi, odwołującą się bezpośrednio do braku właściwości sądów administracyjnych w sprawach dotyczących wcześniej wszelakich wiz wydawanych przez ministra właściwego do spraw zagranicznych lub konsulów, a obecnie jedynie wiz krajowych w większości celów, dla których takowe można wydać. Autor przybliża także treść cyt. postanowienia NSA z dnia 19 lutego 2018 r. oraz wyroku TSUE będącego odpowiedzią na pytanie prejudycjalne zapadłe w związku ze sprawą Soufianna El Hassaniego, które to pospołu doprowadziły do refleksji na temat pierwszeństwa stosowania prawa europejskiego oraz gwarancji w nim zawartych, które nie mogą doznawać ograniczeń przez prawo państwa członkowskiego, a ostatecznie stały się katalizatorem zmian w Prawie o postępowaniu przed sądami administracyjnymi, umożliwiających odwołanie od decyzji odmownej konsula RP do sądu administracyjnego. W podsumowaniu następującym po analizie wyroku TSUE C-949/19, który potwierdził właściwość sądów administracyjnych w sprawach niektórych wiz krajowych, autor przedstawił uwagi de lege ferenda.
    The article is the result of an analysis of the Polish and European legal order in the field of visas and the possibility of appealing against refusals issued by visa authorities, especially by the consul of the Republic of Poland. The author takes a closer look at the regulations of consular law existing until recently, repealed as a result of doubts about their constitutionality, confirmed by the Constitutional Court, and also raises the issue of the distinctiveness of proceedings before the consul of the Republic of Poland being the subject of the Act of 25 June 2015 – Consular Law. Along with pointing out the distinctiveness of proceedings before the consul, the author draws attention to the norm prejudging the exclusion of the application of the Code of Administrative Procedure “in cases belonging to the jurisdiction of Polish diplomatic representations and consular offices” (art. 3 § 2 pkt 4 k.p.a.) and to the norm contained in art. 5 pkt 4 of the Act of 30 August 2002. Law on Proceedings before Administrative Courts (PPSA), referring directly to the lack of jurisdiction of administrative courts in cases concerning previously all visas issued by the minister in charge of foreign affairs or consuls, and now only national visas for most purposes for which such can be issued. The author also takes a closer look at the content of the decision of the Supreme Administrative Court (NSA) II OSK 1346/16 and the judgment of the CJEU in response to the preliminary question in the Soufianne El Hassani case, which together led to a reflection on the primacy of the application of European law and the guarantees contained therein, which cannot be restricted by the law of a Member State, and ultimately became the catalyst for changes in the PPSA allowing an appeal against a refusal decision of a Polish consul to an administrative court. In the conclusion following the analysis of judgment of the CJEU C-949/19, which confirmed the jurisdiction of administrative courts over certain national visas, the author made de lege ferenda comments.

    Michał Kleczkowski, kuzyn Cypriana Norwida, wybrał nietypową karierę sinologa. Jako zawodowy tłumacz i dyplomata w służbie francuskiej, osiągnął ostatecznie stanowisko chargé d’affaires, a po powrocie z długoletniej (1847-63) służby w Chinach – konsula generalnego ds Chin, a następnie profesora języka chińskiego w École nationale des langues orientales vivantes, którym był lat dwanaście. Reprezentował nowy typ dyplomaty-profesjonalisty, a choć korzystał ze wsparcia wpływowych osób, karierę zrobił głównie dzięki pracowitości i zaangażowaniu. Postawa profesjonalisty i prawdopodobnie dość konwencjonalna moralność powodowały napięcia w jego stosunkach z Norwidem, wyznającym nader odmienny ideał wolnego artysty, niegodzącego się na rzemieślniczą pracę na cudzych warunkach. Artykuł próbuje równoważyć dotąd negatywną ocenę postawy Kleczkowskiego wobec Norwida, wskazując na fakt, że kuzyn poety wspierał go finansowo przez 12 lat, przeznaczając na to znaczący odsetek własnych dochodów; dyskutuje też kwestię statusu Domu Św. Kazimierza, jako godnej szacunku instytucji, zapewniającej swym podopiecznym stosunkowo godny byt, zwłaszcza w porównaniu z warunkami, na które skazani byli niemający wsparcia paryscy ubodzy. Tezy artykułu są ilustrowane korespondencją Kleczkowskiego zachowaną w Muzeum Czartoryskich w Krakowie.
    Cyprian Norwid’s cousin Michał Kleczkowski chose an untypical career of a sinologist. As a professional translator and diplomat in the French service, he was finally awarded the positon of a chargé d’affaires, and after a long time spent in China (1847-63) he was made consulgeneral for Chinese affairs, eventuallybecoming professor of Chinese at the École nationale des langues orientales vivantes for a period of twelve years. He represented a new type of professional diplomat, and although he would receive support from influential figures, he owed his career mainly to diligence and engagement. His professionalism and probably rather conventional morality created tension in his relations with Norwid, who subscribed to a much different ideal of a free artist and wouldnot accept technical work on conditions dictated by others. The article attempts to balance the so far negative assessment of Kleczkowski’s attitude to Norwid by indicating that the poet’s cousin supported Norwid financially for twelve years, passing to him a significant portion of his own income. Further, the article challenges the negative view of OEuvre de Saint-Casimir, showing that it was a respectable institution that granted its inhabitants relative dignity, especially in comparison with the conditions suffered by the Parisian poor who had no support. Theses formulated in the article are illustrated with passages from Kleczkowski’s correspondence, which is preserved in the Princes Czartoryski Museum in Kraków.

    The historical work of Anna Komnene is one of the main sources which provides crucial information about John Italos. It is worth noting though that princess Komnene sketches in the Alexiad a portrait of this eminent Byzantine thinker that is anything but flattering. Despite the wide range of perspectives and diverse representations of the philosopher, it is actually quite difficult to find in her opus any comments or opinions of decisively positive nature. As a matter of fact, the final opinion regarding the famous “Consul Philosophorum” is formed solely on the basis of downright hostile statements. John Italos is not regarded as an outstanding figure, but rather as a controversial thinker that hardly deserves any recognition. While the present paper investigates the figure of Italos as shown in the Alexiad by Anna Komnene, its aim is to unravel those elements in the work that caused Komnene to express such an opinion about the philosopher.

    The purpose of this article is to analyze the tasks assigned to consuls in the course of organizing the election of the President of the Republic of Poland abroad. There is no doubt that the Polish legislator has entrusted the consuls with the role of the actual organizers of elections held abroad, which entails a significant responsibility these entities. The study also examines the supervision over the performance of tasks by consuls in the field of the organization of elections. In this range, it should be noted that there is a significant difference, consisting in the delegation of supervisory tasks over the performance of electoral activities by consuls to the minister competent for foreign affairs, with a significant limitation of the powers of the NEC, which is, after all, the main body supervising compliance with the electoral law. In these considerations, mainly the formal and legal method was used.
    Celem niniejszego artykułu jest analiza zadań przypisanych konsulom w toku organizacji wyborów Prezydenta Rzeczpospolitej Polskiej za granicą. Nie ulega bowiem wątpliwości, że polski ustawodawca powierzył konsulom rolę faktycznych organizatorów wyborów przeprowadzanych poza granicami kraju, co wiąże się ze znaczącą odpowiedzialnością spoczywającą na tych podmiotach. W pracy zbadano także, jak kształtuje się nadzór nad wykonywaniem przez konsulów zadań z zakresu organizacji wyborów. W tym zakresie bowiem zauważyć należy istotną odrębność, polegającą na przekazaniu zadań nadzorczych nad wykonywaniem czynności wyborczych przez konsulów ministrowi właściwemu do spraw zagranicznych, przy znaczącym ograniczeniu kompetencji PKW, będącej przecież głównym organem nadzoru nad przestrzeganiem prawa wyborczego. W niniejszych rozważaniach wykorzystano głównie metodę formalnoprawną.

    This paper focuses on the study of the activity of German consular institutions on the territory of Soviet Ukraine during 1922–1938. German consular representatives operating in Ukrainian cities were career diplomats, who had higher education, a perfect command of foreign languages, and deep knowledge in the fields of history, geography, statistics, political economy, and international law. While operating in Ukraine, German consuls were taking their official duties seriously: normalization of bilateral trade and economic relations, the establishment of cultural ties, as well as protection and assistance to German citizens living within the consular district. One of the important aspects of consular activity was the performance of the “honorary spy” functions.
    W artykule przeanalizowano działalność niemieckich instytucji konsularnych na terenie sowieckiej Ukrainy w latach 1922–1938. Niemieckimi przedstawicielami konsularnymi działającymi w ukraińskich miastach byli zawodowi dyplomaci, posiadający wyższe wykształcenie, doskonałą znajomość języków obcych oraz głęboką wiedzę z zakresu historii, geografii, statystyki, ekonomii politycznej i prawa międzynarodowego. Działając na Ukrainie konsulowie niemieccy poważnie traktowali swoje obowiązki służbowe: normalizację dwustronnych stosunków handlowo-gospodarczych, nawiązywanie więzi kulturowych, ochronę i pomoc obywatelom niemieckim mieszkającym w okręgu konsularnym. Jednym z ważnych aspektów działalności konsularnej było pełnienie funkcji „szpiega honorowego”.

    Among documents which were sent by General Consulate of France in Warsaw to Ministry of Foreign Affairs in Paris, on the turn of the 19th century, we can find report about priesthood. It bears a date 15 December 1905 y. and his author is Consul General, Georges Bosseront d’Anglade, and addressee, minister of Foreign Affairs in France, Maurice Rouvier. We can find the way of understanding events which have place in NearVistula Country by French diplomatic service, to lay emphasis on engaging of catholic priesthood in them. The country was under influence of revolutionary ferment, which rose from Marxism. Priests of the Catholic Church in Poland stand on the side of arising national movement against revolutionist socialism. The last, mentioned, had not pellucid views neither on the Church nor on the status of Poland on the territory of Polish Kingdom. Means of expression were processions with national and religious emblems and assembly of priesthood in Warsaw in December 1905y. Report stress high clergy presence during very important events for the future of na-tion and life of the Church on territories annexed by the Russia. Report shows that Wincenty Popiel, Warsaw metropolitan, kept distance in relation to priesthood’s growing enthusiasm towards national environment. Calling, Lublin Bishop Jaczewski, non citing in document, lets remember him in 100 anniversary of his death (died 23 VII 1914). Report, provides a background for better understanding of his bishop’s service, by laying particular stress on historical turning-point of 1905 y.

    This paper presents the senatus consultum ultimum, i.e., the final resolution of the senate passed in moments of extraordinary danger to the Roman Republic. We answer the question what was the legitimacy of such resolutions and indicate their rationale and the effects of their issuance. Senatus consultum ultimum was the most powerful weapon of the Roman senate in the fight against internal political enemies in the late republic, so it needs to be clarified whether the SCU was a legitimate measure to protect the state or it cared only for the political self-determination of the senate and the optimates.
    W niniejszym opracowaniu zostanie przybliżona senatus consultum ultimum, tj. ostateczna uchwała senatu podejmowana w momentach nadzwyczajnego zagrożenia rzymskiej republiki. Postaram odpowiedzieć na pytanie, jaka była legalność ustrojowa takich uchwał, ponadto wskazać ich przesłanki oraz skutki wydania. Senatus consultum ultimum było bowiem najpotężniejszą bronią rzymskiego senatu w walce przeciwko wewnętrznym wrogom politycznym w późnej republice, dlatego wyjaśnienia wymaga, czy SCU było zgodnym z prawem środkiem służącym ochronie państwa czy dbało tylko o polityczne samostanowienie senatu i optymatów.

    The article discusses a significantly modified regulation within administrative law applied in the consular service. There seems to be a need for a voice in the discussion regarding the legal status of a Consul of the Republic of Poland (as well as the other members of the diplomatic corpus) as seen from an administrative law point of view. In the background of two regimes of administrative and consular law, it is also undoubtedly necessary to indicate the basic procedural border problems. A very typical example are the modified administrative procedures provided for diplomacy, with particular emphasis put on the importance of jurisdictional administrative proceedings lead by the consul. The administrative procedure constructed in this way by the legislature differs in many points from the general administrative procedure performed by other Polish authorities. Therefore, to some extent, it can be perceived as a specific administrative consular law. The aim of this article is to signal the typical procedural differences and to point out their sources. “Consular administrative law” can be perceived as a special administrative procedure, which does not constitute part of the general administrative procedure applicable to all national authorities and citizens in Poland, but which still is a sub-branch of Polish consular law which applies to the Polish citizens and foreigners in a specific administrative situations. The existence of so-called “consular administrative law”, however, presupposes one fundamental condition, which is having and maintaining foreign relations in the first place.

O ile każdy z wymienionych sposobów zawarcia małżeństwa – analizowany osobno – jest materią ujętą przez ustawodawcę w sposób dość klarowny, o tyle jednoczesne zestawienie ze sobą obu wymienionych form zawarcia małżeństwa rodzi pytania i wątpliwości, które dotychczas nie były przedmiotem analiz. Pytaniem, które pojawia się niejako w punkcie wyjścia, jest to, czy dopuszczalne jest zawarcie per procura małżeństwa konsularnego przez obywateli polskich, a jeśli tak, to czy przepisy regulujące wymienione formuły „rozpoznają się” wzajemnie i czy są ze sobą zsynchronizowane. Artykuł jest próbą odpowiedzi na te pytania.
    Polish law provides for two forms of consular marriage, contracted before a Polish consul officiating in a foreign country (Article 1 § 4 of the k. r. o. [Polish Code of Family Law]), and by proxy (Article 6 of the k. r. o.). While the legislator gives a fairly clear separate description of each of these methods of contracting marriage, questions and dubieties still to be resolved appear as soon as the two forms are looked at together. The very first of these questions is whether it is admissible for Polish citizens to enter into consular proxy marriage, and if so, are the provisions regulating these formulas “mutually recognised” and synchronized? The article is an attempt to answer these questions.

    Artykuł dotyczy prawnych aspektów opieki świadczonej obywatelowi podczas pobytu za granicą w wymiarze konstytucyjnym i unijnym. Zarówno przepisy polskiej Konstytucji, jak przepisy Traktatu o funkcjonowaniu Unii Europejskiej, gwarantują obywatelowi opiekę w czasie pobytu poza granicami. Celem publikacji jest analiza zakresu podmiotowego świadczonej pomocy, a także próba odpowiedzi na pytanie, w jakich sytuacjach i przez jakie podmioty pomoc ma lub może być świadczona. W tekście dokonano porównania regulacji polskiego prawa wewnętrznego oraz przepisów unijnych. Celem prowadzonych rozważań było wskazanie na podobieństwa i różnice w zakresie pomocy oferowanej w ramach opieki konstytucyjnej i unijnej. Należy bronić tezy o konieczności ciągłej ewolucji funkcji konsularnych, z uwagi na zmieniające się dynamicznie realia otaczającej nas rzeczywistości, jak zintensyfikowane ruchy migracyjne obywateli.
    The article concerns the legal aspects of care provided to a citizen during a stay abroad in the constitutional and EU dimension. Both the provisions of the Polish Constitution and the provisions of the Treaty on the Functioning of the European Union guarantee citizens protection during their stay abroad. The aim of the publication is to analyze who the assistance is addressed to, in what situations and by what entities the assistance is or can be provided. The article compares the internal law and EU regulations. The aim of the considerations was to indicate the similarities and differences in the scope of assistance offered under the constitutional and EU care. The thesis that consular functions need to be constantly evolved should be defended due to the dynamically changing of the reality, like intensified migratory movements of citizens.

    This article presents the analysis of two initial terrorism waves proposed by an American professor, David Charles Rapoport. In the first part of the dissertation, the author is going to present issues connected with the impossibility of coining a universal definition of terrorism and postulates the need of examining the waves of terrorism. In the further part of the paper, the author presents his considerations based on selected political events which took part during two waves of terrorism. At the end, the author provides an answer to the question of what differences there were between terrorist actions before the First World War and during initial decades after its conclusion. Within the scope of the paper, references to current events strictly relating to security and methods used to deal with terrorist attacks are also provided.
