The goal of the article is an attempt to give an answer to the question whether the concepts of compromise on the management of the public administration may be used in the management of the justice system and if so to what extent? The article presents selected concepts of the management of the public sector with regards to their possibilities of adaptation for the needs of the justice system. It also shows the specificity of justice system Justice system plays an important role in the course of shaping an efficient state. In the light of the praxeological understanding the state is an organization, i.e. the entirety consisting of linked different networks contributing to the success or inducing failure of the entirety. A poorly managed justice system as a part of the entirety may be a serious obstacle on the way to modernize the management of the country. Therefore the discussion over the optimal model of management of justice system becomes an urgent challenge in the science of management. The prevailing role of justice system is meting out justice and other functions must comply with the prevailing role – ergo they play an ancillary role to the main role. No one and nothing may interfere in the competences of the independent court in meting out justice even the internal and external administrative supervision. It seems that the response to the needs of the justice system may be the model of participative bureaucracy as a combination of different bureaucratic models and other organizational models with the awareness of the needs of the responsible court.

One can look at the improvement of the effectiveness and efficiency of the justice system from three perspectives: macro, mezo, and micro. After all, the general goal is to enhance the effectiveness and efficiency of the justice system as a whole (the macro perspective), the courts (the mezo scale), and court proceedings (the micro scale). The need to improve the effectiveness and efficiency of the justice system was noticed in the Strategy of modernization of justice in Poland in the years 2014–2020 prepared by the Ministry of Justice incorporates the three abovementioned perspectives. From the perspective of this paper, emphasis has been placed on courts. The Strategy, as a matter of fact, assumes that the improvement of the effectiveness and efficiency of courts may occur by introducing a model of management based on the idea of “managerialism” to run them. Effective and efficient courts, just like the proceedings they operate, are particularly important in the face of globalization, regulatory arbitration, as well as forum shopping. Based on a case study, this paper outlines the results of an innovative pilot project of implementing management methods of running common courts, and sets out to answer the question of the extent to which the state of institutional development of courts allows one to employ good practices in courts already successful in the world of business. During the pilot study, in 60 selected regional, district, and appellate courts, with the support of external experts, „good practices” were implemented to serve as management enhancements (Final report…, 2014). The results of the pilot study prove that the level of institutional development of courts determines the possibility of introducing good management practices that have already been approved in the world of business. This situation is further complicated by the diverse level of institutional development among courts. The type of a given court (its size, regional, district, appellate) may impact the possible upgrade of the maturity of the way a given practice functions. Also, not all business practices are eligible for implementation, given the different level of managers’ competence, as well as the frequently clear process of taking on the management staff.

Responsibility Court (RC) is a court, which is aware of its role in society and institutional environment, and the court, which takes responsible actions to build its value, its social responsibil-ity and authority. This article aims to explain, how the action promoted by business as part of its social responsibility, may be adapted by the judicature, and more precisely by different courts. The basic research method used in this work are the literature studies, and the case study method was applied to analyze the good practice “A court in a social surrounding”.
Responsibility Court (RC) to sąd, który jest świadomy swojej roli w społeczeństwie i w otoczeniu instytucjonalnym, oraz sąd, który podejmuje odpowiedzialne działania służące budowaniu jego wartości, społecznej odpowiedzialności i autorytetu. Celem artykułu jest wyjaśnienie, na ile działania propagowane przez biznes w ramach jego społecznej odpowiedzialności mogą być adaptowane przez wymiar sprawiedliwości, a ściślej przez poszczególne sądy. Podstawową metodę badawczą wykorzystaną w opracowaniu stanowią studia literaturowe, natomiast do analizy dobrej praktyki Sąd w otoczeniu społecznym, wykorzystano metodę studium przypadku.

The development of the concept of the network, which is used both to explain complex decisions made in the area of implemented policy and as a basis for introducing innovations, is currently of significant importance for organizations. The analysis of network relations may contribute to increasing the efficiency of managing complex interactions that also arise in the sphere of entities participating in activities aimed at satisfying social needs, which is why the common courts that constitute the system of justice is the subject of interest. The purpose of this article was to determine the levels of organizational maturity of common courts for the practice of cross-referencing within the justice system, the formulation of general recommendations in this area, and indication of potential benefits. The research involved direct interviews and participant observations as a result of the project POKL 05.03.00-00-012/11, entitled PWP Education in the field of time management and court proceedings costs – Case management. Nearly 10% of all courts in Poland were subject to the survey. The research results became the basis for determining the levels of organizational maturity of the courts. The results obtained indicate the potential for the judiciary to create horizontal organizational links, the purpose of which is to connect members of the organization, facilitate joint activities and learning, and consequently create new solutions to existing problems. The research shows that the level of maturity is varied, but judicial cooperation is possible, cutting hierarchical subordination as a voluntary inter-organizational network.

The goal of this paper is to analyse the organizational structure of the justice system in order to provide the answer to the basic question about the possible network relations, as well as their force and their way of influence. As part of the paper, I have defined public inter-organisational court networks, dividing them into regulatory inter-organisational networks and facultative inter-organisational networks. Emphasis has also been placed on the benefits and threats of the functioning of court-based facultative inter-organisational networks. The phenomenon of forming networks within the justice system is new, and so far has not been subject of any academic enquiry. Given the benefits and background, as well as no real threats for the functioning of public court networks, it is a desired form of cooperation which enables to boost bottom-up initiative. Public court networks serve to build the organization of the justice system as a knowledge-based organisation. This paper addresses the important and topical issue of public networks - the example of inter-organizational area of justice. In the current literature, identifying the network of relations in the organization of justice has not been the subject of scientific inquiry.

Purpose: The purpose of this study is to identify the problem of sustainability of public-sector organizational networks on the example of common courts and what it implies for further research. Methodology: The study used qualitative research tools in the form of structured interviews. Interviews were conducted with 36 presidents and directors of common courts. After conducting and transcribing each interview, their content was analyzed to capture data related to network durability. Based on the proposed methodology, 5 elements of network sustainability were distinguished: goal continuity, reliability, communication, network capability, fairness. Findings: It was found that the judiciary has the potential to take advantage of network cooperation mechanisms, which may involve different relationships and interactions. However, after the pilot project, voluntary court networks formed during the implementation of the project gradually dissolved, ceased to exist. The identification of the elements of network was an additional outcome of the analysis of the results of a pilot study PWP Edukacja w dziedzinie zarządzania czasem i kosztami postępowań – case management. Originality/value: Research on the networking of public organizations, and in particular common courts, is still a cognitive gap. The results of research carried out for the purposes of the article are trying to fill this gap. within the study, the causes of failures in maintaining network relationships in common orchards were identified.
