The paper constitutes an attempt at presenting the views of legal scholars and commentators and the judicature on the possibility of attributing criminal liability under Article 197 of the Polish Criminal Code and Article 198 of the Polish Criminal Code to the perpetrator in the case of alcohol consumption by the injured party. This issue is the basis of a crucial dogmatic problem, extremely up-to-date from the point of view of the study of criminal law, since the solution thereof determines the criminal liability of the alleged perpetrator. Therefore, the analysed issue raises the question of the limits of impunity for violations in the sphere of sexual life of the injured party in comparison with the features and circum- stances directly related to the victim. Thus, the paper attempts to answer the question wheth- er actions belonging to so-called sexual offences should be predominantly assessed with the use of a literal interpretation or taking into account the formal-dogmatic interpretation.

The article on selected aspects of sexual abuse prevention presents the subject matter from the legal perspective and discusses the issues concerning prevention and control of sexual offences in Poland. The article refers to the status of the child in criminal law and applicable provisions under the Directive 2011/92/EU and the Lanzarote Convention concerning prevention, assistance and support for juveniles. In this context, presented have been the obligations of the state (public authorities), including the police, to prevent this type of crime as well as the difficulties associated with the implementation of relevant tasks. The conclusions indicate the problems that require practical solutions.

Sexuality is most natural and healthy when it is part of an emotionally genuine relationship, not even as its central part but rather as an upgrade of the intimacy of two people who are mutually loyal, committed, loving and respectful. However, if an individual was sexually abused in childhood, they may have suffered the severest consequences of sexual abuse trauma in the area of sexuality, and their experience of sexuality will be completely different from those who were not sexually abused. The article first describes what children learn about sex if they have been sexually abused, as this experience is very much related to the most common behaviours and experiences in adult sexuality. Then we present a theoretical overview of research on sexuality in adults who suffered childhood sexual abuse. The theory will be supplemented and supported by the statements of individuals who have been attending a therapeutic group for the sexually abused in childhood for two years. The statements quoted in the article refer to the period prior to the therapeutic process. Clinical experience shows that, until the victim has resolved the trauma of sexual abuse, the dynamics between the offender and the victim during childhood abuse is most often very similar to the dynamics of the abused with their partner, even in their sexual life.

In both of her novels, Sapphire depicts disadvantaged gifted children and adolescents. Precious, the illiterate protagonist of Push (1996), eventually starts to write poetry. In The Kid (2011) her son Abdul becomes a passionate dancer. Both protagonists are also victims of sexual abuse and social neglect. While they try to use their gifts as a way of coping with trauma, only Abdul grows up to be a victimizer. This essay shows that Sapphire challenges the stereotypical understanding of the child’s innocence. She also depicts social isolation of abused Black children, and, instead of condemning Abdul, makes her readers try to understand the causes of the rage, anger, and abusive behavior of a victim who becomes a victimizer.

Artykuł ma charakter przeglądowy. Przedstawia działania prewencyjne podejmowane w Kościele katolickim w związku z kryzysem ujawnień wykorzystywania seksualnego osób małoletnich przez duchownych. Charakteryzuje kroki podejmowane przez Stolicę Apostolską obowiązujące w całym Kościele katolickim. Następnie omawia ochronę dzieci i młodzieży w niektórych Kościołach lokalnych, zwłaszcza w USA, by na końcu przedstawić rozwój myślenia o prewencji w Kościele w Polsce. Analizując sposób wdrażania prewencji w Kościele, zauważa się, że pierwszy etap działań ma charakter prewencji interwencyjnej. Z czasem przechodzi się do działań profilaktycznych o charakterze uniwersalnym. Artykuł wskazuje również na pytania, na które należy odpowiedzieć, aby działania prewencyjne w Kościele były podjęte w sposób bardziej kompleksowy.
The article is a review. It presents preventive measures taken in the Catholic Church in connection with the crisis caused by disclosure of sexual abuse of minors by clergy. It characterizes the steps taken by the Holy See (Vatican), which are in force throughout the Catholic Church. Then the article discusses ways of protecting children and young people in some local Churches, especially in the US, and finally it presents the evolution of thinking about prevention in the Church in Poland. Analyzing the way of implementing prevention in the Church, it is noted that the first stage of activity iinterventional prevention. Over time, one proceeds to preventive actions of a universal nature. The article also indicates the questions that should be answered in order to take more comprehensive preventive measures in the Church.

W artykule analizowane są ustalenia badawcze Ogólnopolskiej diagnozy problemu przemocy wobec dzieci dotyczące doświadczeń wykorzystywania seksualnego w dzieciństwie. Retrospektywne deklaracje nastolatków w wieku 11–17 lat ujawniły, iż 12,4% z nich padło ofiarą przynajmniej jednej formy wykorzystywania seksualnego. Zdecydowanie częściej wykorzystywanie było doświadczeniem dziewczyn (15,7%) niż chłopców (9,2%). Wykorzystywania seksualnego z kontaktem fizycznym doświadczyło 6,4% młodych ludzi, zaś bez kontaktu fizycznego — 8,9%. Wyniki Diagnozy opisujące doświadczenia polskiej młodzieży w wielu wymiarach zbliżone są do badań bazujących na podobnej metodologii przeprowadzonych w ostatnich latach w Wielkiej Brytanii i Stanach Zjednoczonych.
This article examines research fi ndings National Survey of Child and Youth Victimization in Poland on the experience of sexual abuse in childhood. A retrospective declarations of teenagers aged 11-17 years revealed that 12.4% of them were victims of at least one form of sexual abuse. Defi nitely more often it affects girls (15.7%) than boys (9.2%). Sexual abuse with physical contact was experienced by 6.4% of young people, and without physical contact - 8.9%. Diagnosis results describing the experiences of Polish youth in many dimensions are similar to studies based on similar methodology carried out in recent years in the United Kingdom and the United States.

The sexual abuse of a child is a crime which demands a response on various levels. On the one hand, it requires psychological support for the victims, while on the other, it requires concrete legal and penal measures against the perpetrators, as well as broad social education and preventive measures in order to prevent similar tragedies from recurring in the future. The document entitled “Protection of Minors in the Pastoral Work of the Diocese of Tarnów – Norms and Rules” refers to the actions of the universal Church. The document on the protection of minors is a guideline for the Diocese of Tarnów to be used in all parishes, communities and works of the diocese, both by clergymen, consecrated persons and laity who undertake ministry among children and young people.

W artykule podjęto problematykę umiejętności pomagania, jakie powinien posiadać nauczyciel-pedagog pracujący z dzieckiem wykorzystywanym seksualnie. W części teoretycznej artykułu zostały zdefiniowane umiejętności pomagania istotne dla procesu rozumienia trudnej sytuacji dziecka oraz dokonano deskrypcyjnego ujęcia ich podstawowych rodzajów. Przedmiotem badań uczyniono umiejętności pomagania nauczyciela-pedagoga w zakresie pracy z osobami, które doświadczyły przemocy seksualnej, zaś celem określenie i opis umiejętności profesjonalnych nauczyciela-pedagoga – wzmacniających opowiedzenie historii przez dziecko oraz wyciszenie emocji towarzyszących opowiadanej historii. W badaniach posłużono się metodą narracyjną z wykorzystaniem analizy treści. Problem badawczy przyjął postać pytania: Co stanowi komponenty umiejętności nauczycieli-pedagogów w zakresie pomagania dziecku wykorzystywanemu seksualnie? Badania przeprowadzono w 2019 r. wśród 23 słuchaczy studiów podyplomowych, przygotowujących się do pracy poradniczej. Uzyskane wyniki badań pozwoliły na wyłonienie w ramach badanych kategorii subkategorie unaoczniające specyfikę i wartość opisywanych przez badanych umiejętności pomagania oraz wyodrębnienie komponentów decydujących o skutecznym pomaganiu, udzielaniu wsparcia przez nauczycieli-pedagogów dziecku doświadczającemu przemocy seksualnej. Ponadto, wnioski z badań są wartościowe dla praktyki pedagogicznej, szczególnie w zakresie wzbogacania oferty kształcenia do zawodu nauczyciela oraz pedagoga w odniesieniu do działań wspierających osoby z doświadczeniami przemocy.
The article deals with the issue of helping skills that a teacher and pedagogue should have when working with a sexually abused child. The theoretical part of the article defines helping skills essential for the process of understanding a child's difficult situation and their basic types were described. The subject of the research was the helping skills of a teacher and pedagogue in working with people who experienced sexual violence. The purpose of the study was to determine and describe the professional skills of a teacher and pedagogue ‒ strengthening the storytelling by the child and calming the emotions accompanying the story. The study used the narrative method with the use of content analysis. The research problem took the form of the question: What are the components of a teacher and pedagogue skills in helping a sexually abused child? The research was conducted in 2019 among 23 postgraduate students preparing for counselling work. The obtained research results allowed for the selection of subcategories within the studied categories that visualize the specificity and value of the helping skills described by the respondents, and for the identification of components that determine effective help and support by teachers and pedagogues for a child experiencing sexual violence. In addition, the conclusions from the research are valuable for pedagogical practice, especially in the field of enriching the educational offer for the teaching and pedagogical profession with regard to activities supporting people experiencing violence.

Opis:
Criminalizing sexual contacts with minors is by all means justified, as there is no “good pedophilia”. Sexual activity between an adult and a child is always based on the use of power towards a child, and this has its special expression when it occurs on the part of professions of public trust, such as clergy. Such activity must therefore be treated as sexual abuse of a minor. The social sense of justice requires that this protection be effectively implemented by both church and state institutions. On the basis of canon law, the protection of minors against sexual abuse by clergy is ensured by can. 1398 of the Code of Criminal Procedure, while in Polish law this is primarily served by Art. 200 of the Penal Code The severe criminalization of sexual abuse of minors, both in canon law and in Polish criminal law, indicates that both lawmakers recognize the seriousness of these behaviors. Both legal systems complement each other, having the tools to hold the perpetrators of crimes accountable and punishing them for ailments appropriate to their specificity.
Penalizacja kontaktów seksualnych z małoletnimi jest ze wszech miar uzasadniona, gdyż nie ma „dobrej pedofilii”. Seksualna aktywność pomiędzy dorosłym a dzieckiem zawsze opiera się na wykorzystywaniu władzy wobec dziecka, a ma to swój szczególny wyraz, gdy dochodzi do niej ze strony osób pełniących profesje zaufania publicznego, takich jak duchowni. Aktywność taka musi być zatem traktowana jako seksualne wykorzystanie małoletniego. Społeczne poczucie sprawiedliwości wymaga, by ochrona małoletnich przed wykorzystywaniem seksualnym była skutecznie realizowana przez instytucje zarówno kościelne, jak i państwowe. Na gruncie prawa kanonicznego ochronę małoletnich przed wykorzystywaniem seksualnym przez duchownych zapewnia kan. 1398 § 1 n. 1 KPK, zaś w prawie polskim służy temu przede wszystkim art. 200 k.k. Surowa penalizacja wykorzystywania seksualnego małoletnich, zarówno w prawie kanonicznym, jak i polskim prawie karnym, wskazuje na uznanie przez obu prawodawców znacznej ciężkości tych zachowań. Oba systemy prawne uzupełniają się nawzajem, mając narzędzia pociągania do odpowiedzialności sprawców przestępstw i wymierzając kary o dolegliwości właściwej dla ich specyfiki.

Opis:
Projective tests have unflagging popularity, especially among forensic psychologists. They have to deal with measurement of psychological variables among people who try to show themselves in a better light. In their opinion, projective tests may help to investigate deep-seated personality traits which may not be recognized consciously and allow children to present their trauma in a symbolic way. A growing amount of research shows, however, that indicators used in projective tests have nothing to do with the characteristics that they are supposed to represent. This is particularly important in case of child abuse diagnosis and diagnosis of child sexual offenders. Up till now, there is no evidence to support the thesis that projective tests may be useful for forensic diagnosis of sexual abuse. Thus, the following tests should be banned: the Tree-Drawing Test, the Rorschach Inkblot Test, the Thematic Apperception Test, the Human Figure Drawing, the House-Tree-Person Drawing, the Family Drawing, Luscher Colour Test, the Colour Pyramid Test and Szondi Test.
Testy projekcyjne cieszą się niesłabnącą popularnością, szczególnie wśród biegłych psychologów sądowych, którzy każdego dnia muszą mierzyć się z tendencją osób badanych do pokazywania się w lepszym świetle. W ich mniemaniu testy projekcyjne pomagają zbadać „rzeczywiste” cechy osobowości badanych, a w przypadku diagnozowania dzieci umożliwiają im symboliczną prezentację przeżytej traumy. Rosnąca liczba badań pokazuje jednak, że wskaźniki stosowane w testach projekcyjnych nie mają nic wspólnego z cechami, które rzekomo reprezentują. Jest to szczególnie ważne w przypadku diagnozy wykorzystania seksualnego dziecka oraz diagnozy potencjalnego sprawcy. Ze względu na brak jakichkolwiek badań uzasadniających zastosowanie do tego celu testów projekcyjnych, powinno być zabronione stosowanie następujących narzędzi: Testu Drzewa Kocha; Testu Plam Atramentowych Rorschacha; Testu Apercepcji Tematycznej (TAT/CAT); rysunku postaci; Testu Dom–Drzewo–Człowiek; rysunku rodziny; Testu Barw Luschera; Testu Barwnych Piramid Schaie, Heissa oraz Testu Szondiego.

In recent years, thanks to rapidly developing medicine, it is becoming possible to detect, treat and diagnose diseases that for many decades were considered incurable. Consequently, we are dealing with a significant increase in life expectancy and a rapid increase in the number of the elderly in the society in recent years. As the statistics show, this number will increase even more in the coming years, so there is a need to pay attention to this social group. Elderly people, especially those living alone and suffering from cognitive and memory disorders that accompany Alzheimer's disease, are a group particularly vulnerable to various forms of violence. In Polish literature on the subject and in the media, much attention is paid to the physical, mental and financial form of abuse. Sexual abuse is not mentioned at all in the context of this social group, which does not mean that it does not exist. This situation is often caused by stereotypes according to which, the elderly are asexual and not attractive enough to be victims of sexual violence. This article pays attention to the definitions of sexual abuse against the elderly, the scale of the problem, risk factors for this form of violence or its consequences, including: physiological-somatic, psychological-emotional, sexual and socio-cognitive ones. The last part of the text is devoted to prevention of sexual violence among the elderly.
W ostatnich latach za sprawą dynamicznie rozwijającej się medycyny możliwe staje się szybsze wykrywanie, leczenie oraz diagnostyka chorób, które do niedawna uznawane były za nieuleczalne. Co za tym idzie, mamy do czynienia ze znacznym wydłużeniem długości życia oraz gwałtownym przyrostem osób starszych w społeczeństwie w ciągu ostatnich lat. Jak wskazują statystyki, liczba ta w najbliższych latach będzie jeszcze bardziej wzrastać, istnieje zatem potrzeba zwrócenia uwagi na tę grupę społeczną. Osoby starsze, w szczególności zaś te mieszkające samotnie oraz cierpiące na zaburzenia poznawcze i pamięci, które towarzyszą chorobie Alzheimera, są grupą szczególnie narażoną na różnego rodzaju formy przemocy. W polskiej literaturze przedmiotu oraz w mediach wiele uwagi poświęca się fizycznej, psychicznej oraz jej finansowej formie. O przemocy seksualnej w kontekście tej grupy społecznej nie mówi się wcale, co nie oznacza, iż ona nie istnieje. Powodem tego stanu rzeczy są często stereotypy. Według nich osoby starsze są aseksualne oraz mało atrakcyjne, aby paść ofiarą przemocy seksualnej. W artykule zostanie zwrócona uwaga na definicje dotyczące przemocy seksualnej wobec osób starszych, skalę problemu, czynniki ryzyka tej formy przemocy czy też konsekwencje, jakie ona niesie za sobą. Wśród nich należy wymienić: fizjologiczno-somatyczne, psychologiczno-emocjonalne, seksualne oraz społeczno-poznawcze. Ostatnia część tekstu zostanie poświęcona zapobieganiu przemocy seksualnej wśród osób starszych.

Na podstawie tej analizy rekomendowane jest korzystanie przede wszystkim z podejścia konstrukcjonistycznego w nurcie umiarkowanym.
The article analyzes the objectivist approach of Merton and the constructionist approach of Spector and Kitsuse in the context of the study of sexual abuse of children in Poland as a social problem. Based on this analysis, it is recommended to use primarily a modernist constructional approach.
