Sending out holiday greetings by regular mail does not involve the exercise of rights and duties of Deputies, also within a broad meaning of this term, and could not be recognized as an activity aimed at the creation of an organizational framework for the exercise of the mandate. Therefore, it cannot be classified as the exercise of a Deputy’s mandate, or activity substantially connected with the performance of the function of a Member of Parliament. In the author’s opinion, holiday greeting cards cannot be distributed by Deputies with the use of postage-paid envelopes provided by the Sejm.

The subject of the opinion is the issue, whether a Deputy as a natural person could process personal data and whether processing the data must be notified to the Inspector General for Personal Data Protection. The author claims that parliamentary activities might involve processing personal data. However, in most situations the possibility of processing of sensitive data by a Deputy must be excluded. The duty to register a set of personal data concerns these Deputies who process such data under statutory rules beyond indicated exceptions.

The Act on the Exercise of the Mandate of a Deputy or Senator constitutes legal basis for requiring by the Deputy the access to recordings from the session of a communal council. However, there are no sanctions in case of local self-government unit’s infringement of such an obligation towards Deputies and Senators. The lack of specific legal instruments does not exclude the possibility of taking action on general terms, i.e. on the basis of provisions concerning control and supervision over local self-government. A Deputy may demand, from the chairperson of the council, an explanation of reasons for the inability of the realization of such right.

The author states that a Deputy does not have an obligation to make available document received from a private person, regardless the content of the document. Parliamentary immunity, according to the author, does not release the Deputy from an obligation to testify as a witness or does not release the Deputy from an obligation to provide public authorities with a document which may serve as an evidence. However, pursuant to Article 21 the Act on the Exercise of the Mandate of a Deputy or Senator, the Deputy might refuse to provide information about a person who has provided an information to a deputy. This principle applies to civil procedure, criminal procedure and other investigative procedures that include an obligation to testify. The scope of this privilege contains also the possibility of refusing to issue a document received within limits of exercising of the mandate whose content would reveal information of a deputy’s informer.

Opis:
Membership in international organizations does not fall into the category of additional engagement referred to in Article 33 para. 1 and 2 of the Act on the Exercise of the Mandate of a Deputy or and Senator. Consequently, the Deputy is not obliged to notify the Marshal of the Sejm his/her intention of becoming a member of a particular international social organization. The author notes, however, that in the case where that organization runs business activity and when membership would entail participation in its governing bodies, then such participation should be notified to the Marshal of the Sejm.

In the opinion of the author, the scope material immunity includes the fulfilment of Deputy’s obligation to inform voters about the work of a parliamentarian and about the activities of the body to which he or she was elected. This obligation may be fulfilled through a direct information to voters at meetings with them as well as through the media. The scope of formal immunity is covers the Deputy’s responsibility for an infringement of the rights of third parties by means of informing voters about his work and the activities of the Sejm. In the light of the Supreme Court’s findings, it can be assumed that suing a Deputy to a civil court for infringement of personal rights in a statement made at a press conference in which he or she reports on his or her activities falling within the sphere of the execution of the parliamentary mandate, requires a prior consent of the Sejm.

The concept of “non-performance of Deputies duties” covers all kinds of acts that violate legal norms determining the manner of exercising the parliamentary mandate. At the same time, this concept does not include acts leading to non-performance of such Deputies’ duties, the violation of which is threatened by a legal sanction set out in other legal provisions. It is not possible to indicate a full catalog of duties, whose breach casuses a liability under Article 22 of the Standing Orders. “Non-performance of Deputies’ duties” covers, among others, cases of violation of duties related to the participation in the composition of another state authority, related to the function of representing the Sejm in proceedings before other authorities and in interparliamentary relations.

Opis:
According to Article 5a of the Act on the Exercise of the Mandate of a Deputy or Senator at the time of deprivation of liberty the Deputy is not entitled to receive parliamentary per diem allowance or a salary. The period of preliminary custody is calculated from the date of detention. An expiry of the period of preliminary custody or repealing of the decision by a court restores to the Deputy a full enjoyment of rights and obligations, and thus enables to receive a parliamentary per diem allowance and a Deputy’s salary.

The opinion concerns formation of the new Deputies’ Club of the Polish People’s Party and the Union of European Democrats composed of Deputies from different political parties. The principle, which implies that these independent parties retain their organisational and programmatic difference, is politically binding for the new club and it is not contrary to the Standing Orders of the Sejm or other acts. Deputies have access to information concerning the content of contracts concluded by a municipality also when, certain information included in these contracts was marked by a clause excluding their disclosure due to a business secret of a party to the contract. Exceptions to this rule are set out in Article 35 of the Act on Public Finances. Refusal to reply to a Deputy’s questions will be justified only in a case, when, following to an independent assessment of an authority applying the said provisions, information covered by the contractual clause falls within that exclusion.

Membership of a Deputy in the parliamentary team is not considered a type of service or work the pursuit of which requires access to classified information. This is due to the fact that the parliamentary teams are established in order to promote certain values and attitudes, and serve to achieve cross‑party public purposes. The author explains that the exercise of a Deputy’s mandate may require the use of classified information, but each time is it a consequence of the Sejm’s decision.

The opinion deals with the question of an increasing number Deputies’ (parliamentary) groupings, which poses a real problem for the functioning of the Sejm. According to the author, the provisions of the Act on the Exercise of the Mandate of a Deputy or Senator leave no doubt that in the case of Deputies who have received the seat during the term of the Sejm, the rule on the suspension of criminal proceedings applies only to criminal proceedings initiated before date of assuming the seat, i.e. prior to the day of publication in Monitor Polski of the order of the Marshal of the Sejm concerning filling of the mandate. As indicated in the opinion, a Deputy, against whom criminal proceedings has been instituted before the day of his/her election, may apply to the Sejm with a request for suspension of criminal proceedings until the expiry of the mandate.

According to the author of the opinion, a legal basis of control activities executed individually by the Deputy with regard to the Polish Financial Supervision Authority may be found in Article 16 of the Act on the Exercise of the Mandate of a Deputy or Senator. It creates an opportunity to obtain “information and explanations on matters resulting from the performance of Deputy’s duties”. Consequently actions taken by Deputies should be related to a collegial activity of the Sejm or its bodies. In the context of Articles 19 and 20 of the above act the author points out that the Polish Financial Supervision Authority is not a governmental administration body. Thus it stays outside of the scope of the Deputies’ intervention.

The application concerns a person who held the mandate of a Deputy during the seventh term of the Sejm, but is not currently a deputy. According to the art. 105 paragraph 1 sentence 2 of the Constitution, a Deputy may be brought to a court accountability for action violating the rights of third parties, which have been taken within the scope of the mandate, only upon the consent of the Sejm. This rule applies to a possible court accountability of former Deputies concerning acts committed in the course of exercise of their parliamentary mandate. The subject of the resolution adopted by the Sejm must include a whole set of behaviors constituting a persecuted act, regardless of whether all behaviors are within the scope of the mandate. Content of the application meets the required precision only with regards behaviors belonging to the third group of activities. The behaviors of the first and second group have been indicated in the application in a very general way, what means that the application does not meet the requirement under art. 7b paragraph 4 Section 4 of the Act on performance of the mandate of Deputy and Senator.
