    Opis:
    Goal – the article analyses the most important legal acts regulating the employment of foreigners in Poland. The article aims to evaluate the adequacy of the introduced legal changes to the needs of the Polish labour market. The assumed hypothesis was that the legal regulations on the employment of foreigners in Poland are adjusted to the changes in the economic reality. Research methodology – the article includes an analysis of the available literature and the current legal acts that regulate the studied problem. Moreover, observations con cerning the adaptation of Polish legal regulations to the constantly growing interest of foreigners in the Polish labour market were made in the article. Score/results – the conducted analysis allowed us to verify the research hypothesis positively. It has been acknowledged that the provisions of Polish law in the field of employment of foreigners have been adapted to the changing economic conditions, al though the procedure for obtaining work permits for foreigners remains complicated. Originality/value – the article shows a cross-section of changes that have taken place in Polish labour law in the field of employment of foreigners in recent years.Changes in the Polish labour law have been presented chronologically, which helps to organize the knowledge on the topic. Moreover, it also considers the current problem of the COVID-19 pandemic and its impact on legal aspects of employment of foreigners in Poland.

    Opis:
    Subject and purpose of work: The publication comprises the analysis of the most important legislation governing the employment of foreigners in Poland and the data of significance to developing legal solutions in this area. The purpose of the paper is to evaluate the suitability of the adopted solutions to the needs of the labour market. Materials and methods: The performed legal analysis is closely related to the statistical analysis of the transformations of the Polish labour market which have taken place over the last 6 years, with particular attention to demographic and economic data. The authors also applied qualitative methods in the form of observations concerning the adaptation of Polish laws to the demand for hiring foreigners, as well as the presentation of the results of surveys analysing the opinions and sentiments of labour market participants, labour market forecasts published on a regular basis, and inspections carried out by authorised entities. Results: The systematic decrease in the Polish population and increasing staff deficits reported by employers are among the most important challenges. The deficits are largely supplemented by Ukrainian employees, yet there are growing concerns that difficulties in acquiring new staff may aggravate, as the competition in attracting foreign staff is becoming increasingly perceptible. In Poland, relevant legal instruments concerning the employment of foreigners are mostly stipulated in the Foreigners Act, the Act on employment promotion and labour market institutions, and in secondary legislation to these Acts. The laws are very complex, they lack comprehensive solutions in the field of foreigner employment policy, while competent offices and authorities experience difficulties in fulfilling their tasks. Conclusions: It is necessary to develop and implement a comprehensive strategy as part of employment policies, taking into account the urgent and actual demand of the labour market for foreigners’ work.
    Przedmiot i cel pracy: Publikacja zawiera analizę najważniejszego ustawodawstwa dotyczącego zatrudnienia cudzoziemców w Polsce oraz danych istotnych dla kształtowanych rozwiązań prawnych w tym obszarze. Celem pracy jest dokonanie oceny adekwatności przyjętych rozwiązań do potrzeb rynku pracy. Materiały i metody: Dokonana analiza prawna związana jest ściśle z analizą statystyczną zmian zachodzących na polskim rynku pracy na przestrzeni ostatnich 6 lat, ze szczególnym uwzględnieniem danych demograficznych i gospodarczych. Autorzy zastosowali również metody jakościowe w postaci obserwacji dotyczącej adaptacji polskiego ustawodawstwa do zapotrzebowania na pracę cudzoziemców, jak również prezentacji przeprowadzonych badań opinii i nastrojów uczestników rynku pracy, publikowanych cyklicznie prognoz dla rynku pracy i zrealizowanych przez uprawnione organy kontroli. Wyniki: Jednym z największych wyzwań jest systematyczny spadek populacji Polski oraz wzrost deficytów kadrowych zgłaszanych przez pracodawców. Deficyty te w głównej mierze uzupełniają pracownicy z Ukrainy, jednak rosną obawy, że trudności w rekrutowaniu kadr mogą się pogłębiać, ponieważ coraz bardziej odczuwalna jest rywalizacja pomiędzy państwami o pracowników zza granicy. W Polsce odpowiednie instrumenty prawne dotyczące zatrudniania obcokrajowców zawarte są przede wszystkim w ustawie o cudzoziemcach, ustawie o promocji zatrudnienia i instytucjach rynku pracy, a także w aktach wykonawczych do tych ustaw. Przepisy te są bardzo skomplikowane, brakuje kompleksowych rozwiązań w zakresie polityki zatrudniania cudzoziemców, a właściwe urzędy i organy nie radzą sobie z powierzonymi im zadaniami. Wnioski: Konieczne jest przyjęcie i wdrożenie kompleksowej strategii w ramach polityki zatrudnienia, uwzględniającej pilne i realne zapotrzebowanie polskiego rynku pracy na pracę cudzoziemców.

    The work presents the results of the preliminary research on the employment of foreigners’ that were conducted among Polish banking institutions being the international corporations with a global reach. The initial results of the analysis shows the potential impact that specific employment policies exert on personal attitudes of foreign executives and operations of the companies in which they are employed. The analysis described in this work identifies the most important elements which hinder the development of those banks whose employment policies are based on the assumption that hiring foreigners is more beneficial than taking on local managers regardless of their familiarity with Polish market mechanisms. The qualitative research that were conducted in the form of the scenario-based interviews, were carried out with both, a group of managers (mainly heads of HR departments and senior executives) cooperating with the foreigners on everyday basis, and the foreigners themselves. The preliminary studies have revealed a number of trends and phenomenon that were described within this work.

    Opis:
    The purpose of this paper is to identify the (spatial) relationships between the standards of living of the population and the financial capacity of municipalities, with particular focus on rural areas, based on 2017 data. The survey covered all of the 226 municipalities of the Wielkopolskie voivodship. As a result of the multidimensionality of economic categories covered by the analysis, this study used the TOPSIS method to assess the standards of living of the population and the financial capacity of municipalities. An analysis of spatial autocorrelation between the synthetic indicators was carried out based on Moran’s I statistics (local and global) to identify the clusters of municipalities reporting a similar level of aspects covered by this study. A spatial regression analysis was carried out to assess the strength of spatial relationships between the synthetic indicators of the standards of living and the financial capacity of municipalities. A strong correlation exists between the synthetic indicators. Moreover, both the indicator of the standards of living in the municipalities considered and the indicator of the municipalities’ financial capacity demonstrate a statistically significant spatial autocorrelation. The spatial autocorrelation model developed in this study takes account of the mean error in neighbouring locations to better explain the dependencies between these aspects than a traditional least-squares model.
    Celem artykułu jest określenie zależności (przestrzennych) między poziomem życia mieszkańców a możliwościami finansowymi gmin dla danych z 2017 roku, ze szczególnym uwzględnieniem obszarów wiejskich. Badaniem objęto wszystkie 226 gmin w województwie wielkopolskim. Ze względu na wielowymiarowość analizowanych kategorii ekonomicznych, do oceny poziomu życia mieszkańców i możliwości finansowych gmin wykorzystano metodę TOPSIS. Dla skonstruowanych syntetycznych mierników przeprowadzono analizę autokorelacji przestrzennej w oparciu o statystyki (lokalne i globalne) Morana I, aby wyznaczyć skupienia gmin o podobnym poziomie analizowanych zjawisk. W celu zbadania siły związków przestrzennych między syntetycznymi miernikami poziomu życia mieszkańców i możliwości finansowych gmin przeprowadzono analizę regresji przestrzennej. Między skonstruowanymi syntetycznymi miernikami zachodzi silna zależność korelacyjna. Ponadto zarówno w przypadku miernika odnoszącego się do poziomu życia w rozpatrywanych gminach, jak i możliwości finansowych gmin zachodzi istotna statystycznie autokorelacja przestrzenna. Skonstruowany model regresji przestrzennej uwzględniający średni błąd z lokalizacji sąsiedzkich, lepiej wyjaśnia zależności między rozpatrywanymi zjawiskami niż model operaty o klasyczną metodę najmniejszych kwadratów.

    This paper aims at the assessment of the status and conditions of employment of foreigners in agriculture, in Poland, in the years 2010-2018. The analysis concerns assessing how the level of employment of foreigners in agriculture has been changing and what considerations determined the direction of such changes. For some years now the employment of foreigners in Poland has lost its marginal nature and is permanently integrated into some industries, mainly Polish agriculture. Agriculture absorbs a significant number of foreigners. Reasons for this phenomenon may be found in formal conditions for obtaining work permits by foreigners, social and economic conditions of agriculture and features of immigrants. The research covers the economic and social conditions for agriculture in Poland. Empirical analysis encompasses reports and data of the Ministry of Labour, Family and Social Affairs concerning the number and structure of granted work permits for foreigners, declarations of intention to commission work to foreigners, as well as data of the Centre of Migration Research of Warsaw University. Results of analysis show that the number of employed foreigners was significant in Polish agriculture in the years 2010-2018. Simplification of foreigner employment procedures in the migration policy was assigned to the agricultural industry. Initially, procedures facilitating employment in agriculture should be assessed positively. By 2014, the participation of foreigners employed in agriculture was increasing on a year-to-year basis. It resulted from economic and social conditions for Polish agriculture and personal features of immigrants. After 2014, the participation of employment in agriculture regularly decreased.
    Celem artykułu jest ocena stanu i uwarunkowań zatrudnienia cudzoziemców w rolnictwie w Polsce w latach 2008-2018. Podjęto próbę oceny, jak zmieniał się poziom zatrudnienia cudzoziemców w rolnictwie oraz jakie uwarunkowania decydowały o kierunku tych zmian. Zatrudnianie cudzoziemców w Polsce na stałe wpisało się w niektóre branże, w szczególności w polski sektor rolny. Rolnictwo absorbuje znaczną liczbę cudzoziemców. Przyczyny tego zjawiska tkwią w uwarunkowaniach formalnych uzyskiwania pozwoleń na pracę przez cudzoziemców i w warunkach społeczno-gospodarczych rolnictwa. Badaniem objęto uwarunkowania ekonomiczne i społeczne rolnictwa w Polsce. W analizie empirycznej wykorzystano raporty i dane Ministerstwa Rodziny, Pracy i Polityki Społecznej na temat liczby i struktury wydawanych zezwoleń na pracę cudzoziemców, oświadczeń o zamiarze powierzenia pracy cudzoziemcom oraz dane Instytutu Badań nad Migracjami UW. Wyniki analizy wskazują, że w polskim rolnictwie w okresie 2008-2018 zatrudniona była znaczna liczba cudzoziemców. Uproszczenie procedur zatrudniania cudzoziemców w polityce migracyjnej przypisane było sektorowi rolnemu. Początkowo procedury ułatwiające zatrudnianie pracy w rolnictwie należy ocenić pozytywnie. Do 2014 roku udział cudzoziemców zatrudnionych w rolnictwie zwiększał się z roku na rok. Wynikało to z uwarunkowań ekonomicznych i społecznych polskiego rolnictwa oraz cech osobowych imigrantów. Po 2014 roku udział zatrudnienia cudzoziemców w rolnictwie zmniejszał się systematycznie.
