The success of democracy depends on the formation of the social capital conducive to the maintenance of democratic patterns of behavior. Civic education is the most important instrument of the formation of such social capital and is, therefore, an essential responsibility of the democratic state. The concept of social capital, introduced in the social science theory by such authors as Pierre Bourdieu (1984) and James Coleman (1988), implies that the quality of democracy depends on the relations between citizens, particularly on the acceptance of such values as trust in others and willingness to accept them as equals. Consequently, the way in which human rights are perceived in a society has profound importance for the quality of political life and constitutes the crucial component of democratic political culture.

Opis:
The goal of the article is to determine the role played by observance of human rights in shaping the position of the European enterprise in the knowledge-based economy. It has been assumed that the condition most expected by an entrepreneur is to achieve a competitive advantage. The concept of observance of human rights in conducting business activities is connected with business ethics and the idea of corporate social responsibility, while economic well-being can be achieved in the conditions of a knowledge-based economy.  One of the conditions for the survival and development of the employer conducting business activities in the knowledge-based economy is to effectively motivate employees to reveal their knowledge and use it in practice. Non-financial motivation may involve the feeling of identification with the employer.

The question of discrimination, as far as it is considered in the field of philosophy, cannot be perceived as a problem which can be effectively combated. Even the most precise diagnosis of human nature will not restrain people from defining others as evil and inferior. The most universal and spacious conventions, declarations, cards or bills will not solve the problem either. They can be regarded as an example of applied philosophy at most. On the other hand, we should pose the question what the world would look like if political pragmatism were the main obligatory rule. Thus, the situation finds us between philosophical wishful thinking about a global order free from discrimination and macro – or micropolitical pragmatism.

One of the symbols of the Great French Revolution was the Declarations of the Rights of Man and of the Citizen-a document adopted by the National Constituent Assembly on August 26, 1789, collecting fundamental rights and the constitutional principles of a democratic state. It later became a lofty introduction to the 1791 constitution. The French had yet to receive two declarations, attached to the following basic acts-from 1793 and 1795. Their content was different, and even when some of their rights were repeated, they often differed in their approach, which indicated the changing ruling teams, their political programs, and their social background. In addition to indicating the differences between the three declarations, the article shows in particular the inspirations of the first (most important) of them-basically the influence of the Enlightenment thought and the declaration of the laws of the states of North America. The author draws attention to the differences between the American and French approaches to human rights. Despite the fact that after 1795 no further declaration of rights was ever made in France, the achievements of the Great French Revolution, and especially the 1789 document, remain today a point of reference for democrats in France and all over the world.

This article attempts to discover the key elements of the democratic principle, as described by the judges sitting in Luxembourg and Strasbourg, whose case law reveals the underlying idea of democracy at the supranational level. Until recently the debate on democracy was limited to the national level. But things are changing, and this article shows the gradual emergence of a process led by supranational courts, in which the application of the democratic principle finds multiple grades and variations. In this way the supranational/international courts have opened a new chapter in the process of constitutionalization of international law.

Contrary to expectations, the changes initiated by the ‘25 January Revolution’ have not strengthened democratic principles in Egypt. Therefore, the European Union and its member states have sought to support the stability of this state, promote democratic values and human rights. The purpose of this study is to analyse EU activities aimed at fostering the democratisation process in Egypt, as well as to assess these activities so far and identify the reasons for their ineffectiveness.

Niniejsza praca jest próbą ukazania aktywności Komisji Weneckiej względem Czarnogóry w latach 2011–2014. Komisja na rzecz Demokracji przez Prawo skupia swoją działalność przede wszystkim na prawie konstytucyjnym, analizując nie tylko projekty zmian w ustawach zasadniczych, ale także wszelkie poprawki do konstytucji oraz inne akty prawne związane z zasadniczym porządkiem ustrojowym. Opisywane w tekście działania Komisji odnoszą się do Czarnogóry, będącą demokracją parlamentarną, której ustrój polityczny reguluje Konstytucja z 2007 r. Państwo to ubiega się o członkostwo w Unii Europejskiej, która rozpoczęła negocjacje akcesyjne w czerwcu 2012 r. Jednak w kwestii dostępowania do standardów europejskich jest jeszcze wiele kwestii, które wymagają znacznej uwagi, by osiągnąć pożądany stan, zgodny z normami funkcjonującymi na Zachodzie Europy. Pierwsza część tekstu to wprowadzenie do tematyki działalności Komisji Weneckiej. Druga część dotyczy aktywności Komisji w kwestiach pomocy prawnej i jej misji na rzecz poprawy standardów demokratycznych i ochrony praw człowieka. Trzecia część tekstu to próba zaprezentowania wpływu Komisji Weneckiej, poprzez jej opinie i zalecenia, na proces prawodawczy Czarnogóry. Skoncentrowano się w nim na aktywności Komisji oraz jej ewentualnego wpływu na poprawę przestrzegania standardów demokratycznych w Czarnogórze. Myśl końcowa stanowi z kolei próbę wyciągnięcia wniosków z przeanalizowanego materiału.
This paper is an attempt to show the activity of the Venice Commission regarding Montenegro in 2011–2014. The Commission for Democracy through Law focuses its activity primarily on constitutional law, analyzing not only draft amendments to fundamental law, but also all amendments to the constitution and other legal acts related to the fundamental system order. The actions of the Commission described in the text refer to Montenegro, which is a parliamentary democracy, the political system of which is governed by the 2007 Constitution. The state is applying for membership in the European Union, which began accession negotiations in June 2012. However, there are still many issues in terms of compatibility to European standards, which require significant attention to reach the desired state, in line with the standards functioning in the West of Europe. The first part of the text is an introduction to the subject of the Venice Commission’s activities. The second part deals with the Commission’s activities in matters of legal aid and its mission to improve democratic standards and the protection of human rights. The third part of the text is an attempt to present the influence of the Venice Commission, through its opinions and recommendations, on the legislative process of Montenegro. It focused on the Commission’s activities and its possible impact on improving the observance of democratic standards in Montenegro. The final thought is in turn an attempt to draw conclusions from the analyzed material.

Since the ancient times there has been a continuing discourse on the nature and scope of freedom and civic and human right in the more or less liberal democracy. This paper contains a critical analysis and assessment of the most important opinions concerning the both political and economic freedom and the interpretations of that concept in the political practice. This article argues that, contrary to the beliefs of most people, freedom and human rights do not come from nature, but they are the result of the society’s consensus, especially that part of the society, which participates in the elections. The voters agree to allow the winning political party to realize its program also in the respect to freedom and civic (human) rights. On the other hand the politicians try to secure the appropriate equilibrium between the political and economic freedom, which supports the stabilization of a given political system and is conducive to the economic growth.
Od starożytności trwają dyskusje na temat istoty i zakresu wolności jako podstawowego filaru demokracji. W artykule przedstawiono krytyczną analizę i ocenę najbardziej reprezentatywnych opinii na temat wolności politycznej i ekonomicznej oraz podano przykłady interpretacji pojęcia wolności w praktyce politycznej. Głównym argumentem zawartym w tym artykule jest stwierdzenie, że wolność i swobody obywatelskie w demokracji nie pochodzą od natury, lecz są wynikiem konsensusu większości społeczeństwa, które uczestnicząc w wyborach, godzi się na realizację konkretnego programu zwycięskiej partii politycznej, także w odniesieniu do praw i wolności obywatelskich. Utrzymanie określonej równowagi między wolnością polityczną i ekonomiczną przyczynia się do stabilizacji danego systemu politycznego i stwarza pomyślne warunki dla wzrostu gospodarczego.

The article presents Wangari Muta Maathai’s lifetime achievements and her involvement in the environmental protection in Kenya (1977–2011). The analysis of the Green Belt Movement seeks answers to the questions concerning African grassroots movements and their opportunities in the field of natural environment conservation, including safe access to potable water sources. The organisation initiated by Wangari Muta Maathai has been promoting the idea of tree planting in order to maintain sustainable ecosystem, which also concerns the crucial issue of sufficient clean water resources. The main source book used in this article is Maathai’s autobiography that is supported by individual observations of Magdalena Dębowska, gained during numerous visits in Kenya in the following years: 2007, 2008, 2010, 2011–2012.
