    Polish National Health Care Fund may sign contracts for medical services with private institutions (both natural and legal persons). The President of the National Health Care Fund has issued decree which sets down the precise rules of evaluation of offers made by private institutions. All medical service providers, who want to enter into contract with National Health Care Fund are treated equally and their offers are evaluated according to this decree. Among other criteria standard of provided services is taken into account and bonus points are awarded to health care providers who received ISO certificate as a proof of keeping high standards.

    Opis:
    There is no doubt that public authorities may be directly or indirectly involved in economic activity. A traditional way of distinguish state activity which is not subject to the rules of the market is to decide when the state acts as public authority. In case of state activity two category of situations should be distinguished: these where the state is engaged in an economic activity (sphere of dominium) and these when the state acts by exercising of public powers (sphere of imperium). In the opinion of the author of the article, the distinction between imperium and dominium is still relevant. According to the Competition and Consumer Protection Act of February 16, 2007, an entrepreneur is inter alia natural and legal person, as well as an organisational unit without a legal status to which legislation grants legal capacity, organising or providing public utility services which do not constitute economic activity in the meaning of the provisions on freedom of economic activity. The President of the Office of Competition and Consumer Protection found that public authorities exercising their administrative powers (sphere of imperium) may be classified as entrepreneurs. In the recent decisions which were subject of judicial review the President of UOKiK decided that the National Health Fund – a state authority responsible for organization and management of health care services in Poland – is an entrepreneur in the meaning of the Polish law (act on competition and consumer protection). The aim of this article is to answer the question whether competition rules should be applied to the state activity in the imperium sphere. This article will focus on the notion of an entrepreneur (undertaking) in polish and EU law in the context of the activity of the state.

    The protection of individuals regarding to the processing of personal data is one of the fundamental rights. The General Data Protection Regulation (GDPR) lays down rules relating to the protection of natural persons with regard to the processing of personal data and rules relating to the free movement of personal data. Data concerning health is one of the areas the GDPR defines as special personal data, the so-called sensitive data. With regard to these data, the GDPR allows their processing only on an exceptional basis, in certain situations. According to Art. 6 sec. 1 let. e GDPR and art. 9 sec. 2 let. b GDPR, data processing is allowed, inter alia, when such processing is necessary for the purposes of meeting the obligations and exercising specific rights of the controller or of the data subject in the field of employment and social security and social protection law. In turn, Art. 9 sec. 2 let. h GDPR permits the processing of health data that is necessary for the purposes of providing health or social care or treatment, or for managing health or social care systems and services on the basis of European Union or Member State law. The article discusses the national legal regulations regarding the collection and processing of personal data concerning health in the light of the organization of the health care system and the tasks of the National Health Fund (NFZ) as a placeholder, whose task is only to manage financial resources and conclude health care contracts on its own behalf with independent healthcare providers and their accounting. Against the background of the GDPR, the author discusses the provisions of the acts on health care services financed from public funds and on the information system in health care. Finally, specific regulation regarding the COVID-19 pandemic are presented.

    This article focuses on the analysis of the legal and financial framework in which the National Health Fund functions in Poland. It has been confirmed that the Polish health care system is a structurally and relationally complicated entity and that the public authorities are responsible for the health security of citizens. Public tasks in this area are implemented through the use of strategic documents. The National Health Fund plays a key role in this field. However, it does not exercise a coordinating role, and still, it has an actual impact on the state of health security in Poland. Consideration should be given to the changes of contracting procedures proposed by scientists and practitioners, bearing in mind that simply increasing the amount of funding will not automatically improve the current situation without the drive towards more efficient spending of public funds. The main objective of this article is to analyse the existing contradiction in the Polish health care system, which comes down to the dilemma: how to reconcile patient’s welfare with the economic efficiency of public health care providers. The undertaken research problem has been reflected in the selection of research methods. For the purposes of this article, the following research methods have been used: critical analysis, the examination of documents, and observation. The undertaking of considerations was preceded by a preliminary survey of publications related to security and health sciences as well as management and social policy. A lot of articles, binding legal acts, internal legal acts, judicial decisions, official documents that are significant for the reasoning process presented in the article have been insightfully analyzed. In this area, a comparative analysis has proved to be particularly helpful. 
    W niniejszym opracowaniu dokonano analizy ram prawnych i finansowych funkcjonowania Narodowego Funduszu Zdrowia. Potwierdzono, że system ochrony zdrowiaw Polsce jest strukturalnie i relacyjnie tworem skomplikowanym, zaś władze publiczne odpowiadają za zapewnienie bezpieczeństwa zdrowotnego swoich obywateli. Zadania publiczne w tym obszarze wdrażane są przez realizację dokumentów strategicznych. Kluczową rolę w tym zakresie odgrywa Narodowy Fundusz Zdrowia. Nie pełni on funkcji koordynujących, ale realnie wpływa na stan bezpieczeństwa zdrowotnego w Polsce. Należy rozważyć postulowane przez naukowców i praktyków zmiany procedury kontraktowania, uwzględniając fakt, że proste zwiększenie strumienia finansowania, bez działań zwiększających efektywność wydatkowania środków publicznych, automatycznie nie poprawi aktualnego stanu rzeczy. Głównym celem artykułu jest analiza sprzeczności występującej w polskim systemie opieki zdrowotnej, która sprowadza się do następującego dylematu: jak pogodzić dobro pacjenta z ekonomiczną efektywnością publicznych placówek ochrony zdrowia. Na potrzeby niniejszego artykułu wykorzystano następujące metody badawcze: analiza krytyczna, badanie dokumentów oraz obserwacja. Podjęcie rozważań zostało poprzedzone kwerendą publikacji z zakresu nauk o bezpieczeństwie, nauk o zdrowiu, jak również zarządzania oraz polityki społecznej. Gruntownie przeanalizowano liczne artykuły naukowe, obowiązujące akty prawne, orzeczenia sądowe oraz inne oficjalne dokumenty, które miały znaczenie dla toku rozumowania zaprezentowanego w publikacji. W odniesieniu do zagadnień poruszanych w artykule szczególnie użyteczna okazała się analiza porównawcza.

    Public special purpose funds are of a significant importance for the economy. Both National Health Fund and Social Insurance Fund play a particular role. Because of the fact that the financial policy of state special purpose funds is not a subject of strict rules characteristic for the principles of state budget, it is especially important to evaluate its efficiency and effectiveness. The article presents results of a study on the effectiveness of the financial policy of NHF Region Branch Offices, understood as relation between expenditure and outcome.
    Publiczne fundusze celowe mają istotne znaczenie dla gospodarki. Szczególną rolę pełnią te związane z różnymi formami ubezpieczeniowymi – Fundusz Ubezpieczeń Społecznych oraz Narodowy Fundusz Zdrowia. Z uwagi na fakt, iż gospodarka finansowa państwowych funduszy celowych nie podlega rygorom charakterystycznym dla gospodarki budżetowej, szczególnego znaczenia nabiera ocena jej skuteczności i efektywności. W artykule zaprezentowano wyniki badań efektywności Oddziałów Wojewódzkich NFZ, rozumianej jako relacja między osiągniętymi wynikami a wykorzystanymi zasobami.

    Określenie tendencji badanego zjawiska ekonomicznego odgrywa niezwykle ważną rolę w podejmowaniu decyzji dotyczących zarządzania ochroną zdrowia i kreowania polityki zdrowotnej. Zatem celem artykułu jest przeprowadzenie regionalnych analiz wydatków publicznych na opiekę medyczną w województwach Polski. W artykule podjęto próbę określenia tendencji krótkoi długookresowej dla województw oraz zależności wydatków publicznych, m.in. od przychodów Narodowego Funduszu Zdrowia czy PKB dla województw. Badanie przeprowadzono na danych rocznych dla lat 2004-2014. Dane pochodzą z publikacji NZF-u i GUS-u.
    The identification of trends of the examined economic phenomenon plays a major role in taking decisions concerning health service management and the creation of health care policy. Therefore, the aim of this paper is to carry out regional analysis of public expenditure on health care in the Polish voivodeships - the study attempts to determine the short-term and longterm tendencies for voivodeships and dependence of public expenses on health care among others on revenues of the National Health Fund from contributions to health insurance or the GDP for the voivodeships. The study was conducted on annual data for the years 2004-2014. The data come from the NHF and the CSO.

    Celem niniejszego artykułu jest ogólna analiza możliwości inwestycji w zdrowie publiczne na rzecz jednostki w obecnym systemie zdrowotnym w Polsce. Podstawę analizy stanowiły odpowiednie akty prawne dotyczące zasad ustalania składki ubezpieczenia powszechnego oraz sprawozdania z działalności NFZ za lata 2003–2011. W przeprowadzonej analizie przyjęto założenie, iż możliwości inwestycyjne w zdrowie publiczne mogą być wyrażone poziomem, strukturą oraz dynamiką przychodów NFZ, a kierunki tych inwestycji mogą wyrażać poniesione nakłady/koszty na poszczególne kategorie działalności wynikające z przyjętej przez rząd polityki ekonomiczno-społecznej, w tym polityki zdrowotnej i zdrowotnej.
    The purpose of this article is the general analysis of investment opportunities for the benefit of public health units in the current health care system in Poland. The basis of the analysis were relevant legislation on the rules for setting insurance premiums, and public statements of operations for the years 2003-2011 National Health Fund. The analysis assumes that the investment opportunities in public health can be expressed by the level of income structure and dynamics of the NHF, and the directions of these investments can express expenditures/expenses for each category of activity resulting from the adoption of the government economic and social policy, including health policy and health care.

    W wyniku wielu reform systemu ochrony zdrowia obecnie jednostką odpowiedzialną za finansowanie świadczeń zdrowotnych osobom ubezpieczonym jest Narodowy Fundusz Zdrowia (NFZ). Pomimo coraz wyższych środków finansowych, które płatnik przeznacza na opiekę zdrowotną, system ochrony zdrowia w Polsce nadal odznacza się znacznym nie dofinansowaniem. Narzędziem, które ułatwia poznanie i ocenę złożonych zjawisk oraz procesów zachodzących zarówno w omawianej, jak i innych jednostkach gospodarczych systemu jest analiza finansowa. Narodowy Fundusz Zdrowia jest monopolistą na rynku ubezpieczeń zdrowotnych, dlatego też gospodarka finansowa prowadzona przez ten podmiot powinna opierać się na racjonalizacji wydatków względem osiąganych przychodów oraz na generowaniu stabilnego wyniku finansowego. Z przeprowadzonej analizy finansowej wynika, że w latach 2005-2011 w majątku całkowitym jednostki dominowały aktywa obrotowe, co ma swoje uzasadnienie w specyfice prowadzonej działalności. Struktura kapitału własnego względem kapitałów obcych nie wykazywała korzystnych tendencji. Od 2009 roku na złą kondycję finansową podmiotu wskazywały: wynik finansowy, który osiągnął wartości ujemne oraz koszty przewyższające przychody. Przeprowadzona analiza wskaźnikowa wykazała wysoki poziom zadłużenia płatnika systemu ochrony zdrowia przy jednoczesnym prawidłowym wskaźniku płynności finansowej, który świadczył o zachowaniu przez jednostkę zdolności do regulowania bieżących zobowiązań.
    After many reforms of the Polish health care system, the current entity responsible for financing medical services to the insured patients is the National Health Fund. Despite the constantly increasing funds being allocated to the health care system, it still remains underfunded. A tool that facilitates the evaluation and assessment of the viability, stability and profitability of a business is called the financial analysis. The primary source of data necessary for the preparation of the financial analysis comes from the financial statement which includes the balance sheets, profit and loss account, notes, cash flow statement, and statement of changes in equity. On the basis of the information contained in these documents one can understand the structure of assets, earnings, revenues and expenses, as well as the level of indebtedness and liquidity. The National Health Fund has a monopoly on the health insurance market. Therefore, the financial management conducted by this entity should be based on the rationalization of the expenditure in terms of revenue and stable income generation. The financial analysis carried out between 2005 and 2011 showed that the total assets of the entity were dominated by the current assets which can be justified by the nature of the business. The structure of equity relative compared to the foreign capital did not show positive trends. Since 2009, the bad financial situation was manifested by the profit and loss accounts, which reached negative values and costs exceeding the revenue. The ratio analysis showed a high debt rates experienced by the health care payers. At the same time, however, the liquidity has been maintained.
    В результате многочисленных реформ системы здравоохранения в настоящее время ответственной единицей за финансирование медицинских услуг застрахованным лицам является Национальный Фонд здравоохранения (НФЗ). Несмотря на всё высшие финансовые средства, которые плательщик предназначает на медицинские услуги, система здравоохранения в Польше по-прежнему отличается значительным недофинансированием. Инструментом, который облегчит познание и оценку системы заходящих явлений, а также процессов, охватывающих как обсуждаемую, так и другие экономические единицы, является финансовый анализ. Национальный Фонд здравоохранения - монополист на рынке системы страхования здоровья населения, поэтому финансовая экономика, проводимая этим субъектом, должна базироваться на рационализации расходов относительно достигнутых приходов, а также на генерировании устойчивого финансового результата. Из проведённого финансового анализа вытекает, что в 2005-2011 годах в полном владении субъекта деятельности главенствовали оборотные активы, что имеет свое обоснование в специфике проводимой деятельности. Структура собственного капитала по отношению к чужому капиталу не обнаружила выгодных тенденций. От 2009 года на слабую финансовую кондицию субъекта указывали: финансовый результат, который достигнул отрицательных значений, а также издержки превышающие приходы. Проведённый коэффициентный анализ показал высокий уровень задолженности плательщика системы здравоохранения при одновременном положительном коэффициенте финансового текущего состояния, который свидетельствовал о сохранении способности регулирования текущих обязательств.

    The article deals with the legal basis for enforcement of claims by independent public healthcare facilities against the National Health Fund (NFZ) due to the execution of the act of 22 December 2000 on changing the law on the negotiation system of controlling the increase of average salary paid by entrepreneurs and on changing selected acts and the act on healthcare facilities (J.L. of 2001, No. 5, it. 45). The act, known as Lex 203 Act, introduced a pay increase for workers of public healthcare facilities without naming the sources of funding. The author makes an assumption that several liability for the execution of the act rests upon the aforesaid facilities and the NFZ, and the liability of the latter is restricted to the assets that remain after the health benefits guaranteed by the Constitution have been provided.

    The aim of this study is to identify the legal characteristics of contracts for the health care services provided by a public payer, i.e. the National Health Fund (NFZ) as part of treatment covered by universal health insurance, as compared to those provided by the health care providers with public or private legal status. This issue is discussed in relation to the legal conditions for the treatment of patients on a commercial basis in those institutions (private or public) which have contracts for the provision of healthcare services under the general health insurance (so-called contracts). The discussion is presented based on author’s own observations, resulting both from his scientific studies in the field of medical law and his work in various entities operating in the health care system.

    Opis:
    W Polsce ok. 10% łącznego popytu stanowi indywidualne spożycie publiczne. Najważniejszym segmentem tego spożycia jest opieka zdrowotna. Znaczenie sektora zdrowotnego będzie coraz większe, na co wskazują tendencje światowe. Reforma ochrony zdrowia w 1999 r. niezbyt trafnie skupiła się na utworzeniu wyodrębnionego publicznego płatnika - NFZ, a później na przekształceniach własnościowych. Mają one ustrzec władzę publiczną przed finansową odpowiedzialnością za długi powstające w tym sektorze. Po latach można już zauważyć, że sposób finansowania NFZ jest nieprzejrzysty, co wyraża się w pomijaniu w Rocznikach Statystycznych GUS danych finansowych dotyczących NFZ i nakierowaniu czytelników do statystyk odrębnych - Narodowych Rachunków Zdrowia. Finanse ochrony zdrowia można uczynić bardziej przejrzyste, zlikwidować składkę zdrowotną i zadania finansować wprost z budżetu państwa i budżetów samorządowych. Prywatne podmioty lecznicze finansowane również ze środków publicznych powinny mieć status instytucji non-profit, po to, by przekształcenia własnościowe w ochronie zdrowia nie spychały na margines pacjentów opłacanych z tego źródła.
    In Poland, approximately 10% of the aggregate demand is constituted by public individual consumption. The most important segment of this consumption is healthcare. The financial importance of the healthcare sector will be growing what is indicated by the global trends. The 1999 healthcare reform not accurately focused on establishing a separate public payer, the National Health Fund (NFZ), and later on ownership transformations. They are to safeguard the public authority against financial responsibility for debts occurring in this sector. After years, one can already notice that the way of financing NFZ is not transparent what is expressed in omitting in the CSO's Statistical Yearbooks of the financial data concerning NFZ and directing the reader to separate statistics - National Health Accounts. Health care finance can be made more transparent, there can be liquidated the health care contribution and the tasks may be financed directly from the state budget and self-governmental budgets. Private medical entities also financed by public funds should have the status of non-profit institution in order to prevent the situation where ownership transformations in health care marginalise the patients paid from this source.
