Poland is a country of the so-called “young democracy” type. As provided for in art. 2 of The Constitution of the Republic of Poland dated 2 April 1997, “The Republic of Poland is a democratic state of law, fulfilling the principles of social justice”. Art. 4 of The Constitution of the Republic of Poland gives superior authority to the Nation. This authority can be exercised “through representatives or directly”. But Poland does not have much experience with the institution of a people’s initiative, nor with other forms of direct democracy. The Polish national law provides for two types of people’s initiative. One type is a people’s initiative of putting a bill before the parliament as provided for in art. 118 subpar. 2 of the Constitution of the Republic of Poland and the Act dated 24 June 1999 on the use of a legislative initiative by citizens. The second type is a people’s initiative of putting forward a motion to hold a legislative referendum regulated by the Act dated 14 March 2003 on holding a national referendum. The legislature did not provide for, however, a people’s initiative for the purpose of amending the constitution or its abrogation. The subject of this paper is the institution of a people’s initiative of putting forward a motion to hold a legislative referendum.
Polska jest państwem tak zwanej młodej demokracji. Art. 2 Konstytucji Rzeczypospolitej Polskiej z dnia 2 kwietnia 1997 r. stanowi, iż „Rzeczpospolita Polska jest demokratycznym państwem prawnym, urzeczywistniającym zasady sprawiedliwości społecznej”. Art. 4 Konstytucji RP daje władzę zwierzchnią narodowi, który może ją sprawować „przez swoich przedstawicieli lub bezpośrednio”. Jednakże polskie doświadczenia z instytucją inicjatywy ludowej, jak również z innymi formami demokracji bezpośredniej są niewielkie. Polskie prawo ogólnokrajowe przewiduje dwa rodzaje inicjatywy ludowej. Jest to inicjatywa ludowa w sprawie złożenia ludowego projektu ustawy w parlamencie przewidziana art. 118 ust. 2 Konstytucji RP i ustawą z dnia 24 czerwca 1999 r. o wykonywaniu inicjatywy ustawodawczej przez obywateli. Drugim rodzajem jest inicjatywa ludowa w sprawie złożenia wniosku o przeprowadzenie referendum ustawodawczego uregulowana ustawą z dnia 14 marca 2003 r. o referendum ogólnokrajowym. Ustawodawca nie uwzględnił jednak inicjatywy ludowej w sprawie zmiany konstytucji lub jej abrogacji. Tematem niniejszego opracowania będzie instytucja inicjatywy ludowej w sprawie złożenia wniosku o przeprowadzenie referendum.

The paper analyzes media coverage of Hong Kong’s anti-government protest movement triggered by the proposal of amendments to the extradition law in 2019 as presented in the “People’s Daily”, the main online English-language state media in the People’s Republic of China. This article focuses in particular on the analysis of the narrative related to the international aspects of the protests, i.e., on descriptions of foreign attempts to influence the internal affairs of Hong Kong and China, undermining the principle of “one country, two systems”, or attempts to conduct the so-called color revolution. The way the protests are presented in the “People’s Daily” is therefore interesting as an example of a narrative related to the protection of China’s territorial integrity and defense against foreign interference in China’s internal affairs, especially in the context of Beijing’s pursuit of the full unification of the country.

The work concerns the restitution of museum remains as a special cultural asset found in archaeological museums. The research problem concerns reverence towards human remains constituting museum exhibits on the example of Singapore museums. This type of museum inventory has become the subject of intensified restitution activities on the part of tribal minorities, indigenous peoples, who claim the right to them based on the right to worship after their deceased ancestors, the right to protect cultural, religious, and traditional heritage. Such law is based particularly on the Declaration on the Rights of Indigenous Peoples. The research objective focuses, first of all, on the legal grounds resulting from the Declaration, and secondly, on the analysis of the inventory of selected Singaporean museums, which contain exhibits that are human remains in their collections. The main research hypothesis focuses on the statement that Singapore, as one of the few Asian countries, maintains a special regime of pietism towards the deceased, which is manifested in the way of treating and storing human remains as museum exhibits. It may be due to the country’s cultural conditions on the one hand, and religious and legal conditions on the other. That, in turn, translates into the approach of museums to restitution claims, which are increasingly being put forward by representatives of indigenous peoples in connection with the return of the remains of their deceased ancestors. These claims find their legal basis in acts of international law and collective human rights. Therefore, the work answers the questions whether museums in Singapore duly respect international law in protecting human remains and the rights of indigenous peoples, and how this translates into reverence for this type of exhibits in museum practices in connection with ICOM regulations.

The author presents selected ventures in the area of climate change mitigation and adaptation that negatively affect indigenous peoples. Against this factual background, she analyzes relevant international legal regulations. Such an analysis enables the answer to the main research question: can climate change adaptation and mitigation actions be the justification for disrespecting the rights of indigenous peoples? The research method adopted is legal- -institutional analysis which includes an examination of the content of legal and other documents. Combined with critical analysis of literature and media reports this analysis allows representation of the reality – violations of the rights of indigenous peoples as a part of efforts to counteract climate change. Recommendations and main findings include: climate change adaptation and mitigation measures may not justify violations of the rights of indigenous peoples; such measures have to be developed in collaboration with indigenous communities; indigenous peoples’ rights may not be perceived as a factor hindering the State’s economic development or an obstacle to environmental protection; indigenous knowledge should be included in the strategies to combat climate change. Indigenous peoples should be regularly consulted by policy makers so that the their traditional knowledge is incorporated in decisions regarding these matters.

In contemporary international relations, the issue of energy security is becoming fundamental. Access to energy resources is an existential need of every country, conditioning its economic and social development. In such a situation, states try to construct long-term energy security policies to ensure smooth supplies of raw materials. The research problem is the analysis of the energy security policy of the People’s Republic of China towards the Caspian states of Central Asia: Kazakhstan and Turkmenistan. In the research process, a hypothesis was verified, assuming that China’s energy security policy in the Caspian region of Central Asia is determined by the increased demand of this superpower for energy resources and geographical proximity to oil and gas deposits located in Turkmenistan and Kazakhstan. The People’s Republic of China (PRC) became interested in the hydrocarbon resources of the Central Asian region right after the collapse of the USSR. At that time, the energy security policy of this superpower was implemented in several stages: from gaining access to the oil and gas reserves of the countries of the region to the construction of export pipelines supplying the absorptive Chinese market. Thus, the analysis presents the conditions of the PRC’s energy security policy, its institutional dimension and actions towards Kazakhstan and Turkmenistan, both in upstream and midstream terms.

This paper concentrates on a particular example of cooperation between European cities and indigenous peoples of the Amazon river basin, namely that of Climate Alliance. The New Urban Agenda adopted at the UN Habitat III conference in October 2016 emphasizes that cities and other human settlements should meet the challenges and take advantage of the opportunities for current and future sustainable and economic inclusive development. Cities should also take measures to address climate change and protect and manage their ecosystems, water resources, the environment and biodiversity. Indigenous peoples, just like cities play a crucial role in the fight against climate change. 80 % of the territories with high biodiversity level are indigenous lands. Their indigenous ecological knowledge may serve as a valuable tool in initiatives aimed at fighting climate change. The aim of the paper is to show whether there are any benefits of such cooperation and what is its significance in the fight against climate change. The main research question is: what are the forms of cooperation between European cities and Amazonian indigenous peoples in the framework of Climate Alliance? In which way can European cities support indigenous peoples in their fight for their rights and consequently for the nature’s preservation? The hypothesis is that European cities may learn from indigenous peoples of the Amazon how to combat climate change.

Opis:
The armed conflict in eastern Ukraine and establishing the Donetsk People’s Republic (DPR) and the Luhansk People’s Republic (LPR) resulted in many complications and tensions, both in international relations, and within the territories of those self-proclaimed republics. Violation of rights of religious minorities is one of such problems. It includes various forms of unlawful deeds, ranging from intimidation to killings. Such a situation creates grounds for legal responsibility of subjects involved in above mentioned violations. However, a crucial difficulty in this respect is enforcement of justice in practice. The difficulty results from two factors. First factor is that territories in question are beyond the effective control of Ukraine; it prevents Ukrainian authorities from taking legal steps against individuals who committed crimes. The second problem is that both self-proclaimed republics do not exist in the light of law, and thus they cannot take responsibility, also under international law. A change of this state of affairs would be possible only after ultimate settlement of legal status of eastern regions of Ukraine, and it requires a good will of all sides being engaged in the conflict.
Следствием военного конфликта на востоке Украины и установления Донецкой Народной Республики (ДНР) и Луганской Народной Республики (ЛНР) стали многочисленные осложнения, а также напряженность - как в международных отношениях, так и в пределах двух сепаратистских республик. Одной из таких проблем являются нарушения прав религиозных меньшинств, которые принимают различные формы неправомерных поступков - от запугивания по убийства. Отсутствие реакции руководящих органов ДНР и ЛНР на такие нарушения, а иногда даже и их вдохновляющая роль в этих действиях, как и создание условий для дискриминационных практик дают основы для юридической ответственности не только непосредственных исполнителей, но и руководящих органов двух квази-государств. Однако, практическая возможность совершения правосудия за эти неправомерные действия составляет крайнюю трудность. Изменить положение дел можно лишь путем окончательного урегулирования юридического статуса восточных районов Украины, но это требует доброй воли всех сторон конфликта.

The article aims to analyze the role of economic sanctions in the People’s Republic of China’s overall approach to achieving its security objectives in the international arena. During the last two decades, Beijing used this instrument on numerous occasions to exert pressure on a varied group of actors. China’s current strategy toward a range of disputes and conflicts it is engaged in (the South China Sea territorial disputes most prominently stand out) is often described using the popular vocabulary of “hybrid warfare” or “grey zone conflicts”. Putting the conceptual complications aside, the author agrees that the PRC’s approach can be viewed as part of a growing trend for great powers to employ what can be called “hybrid strategies” toward its opponents. As part of a broader category of economic statecraft, economic sanctions form an important element of this approach. Considering current scholarship on both “hybrid” (or “grey area”) warfare and economic sanctions, the article answers the question of why the PRC increasingly resorts to hybrid strategies (including economic coercion) and identifies the main characteristics of Chinese economic sanctions. It also provides preliminary conclusions on their effectiveness.

The paper concentrates on the right to self-determination of indigenous peoples on the basis of the Nisga’a Nation. The author analyzes the most important provisions of the Nisga’a Final Agreement, in particular those envisaging self-determination of the Nisga’a Nation. Then the author briefly examines the Nisga’a Constitution which may be regarded as a means to implement the Nisga’a Final Agreement. It shows how the Nisga’a selfgovernance model fits into the provisions on self-determination of indigenous peoples. The thesis of this paper is that the Nisga’a self-governance is consonant with international legal standards expressed in the UN Declaration on the Rights of Indigenous Peoples. Nisga’a selfgovernment model is much more than just cultural autonomy: it actually amounts to political autonomy. This subject is worth exploring because it may serve as a pattern to be followed with reference to other indigenous peoples, not only in Canada.

Polskie prawo ogólnokrajowe przewiduje dwa rodzaje inicjatywy ludowej. Jest to inicjatywa ludowa w sprawie złożenia ludowego projektu ustawy w parlamencie przewidziana art. 118 ust. 2 Konstytucji RP i ustawą z dnia 24 czerwca 1999 r. o wykonywaniu inicjatywy ustawodawczej przez obywateli. Drugim rodzajem jest inicjatywa ludowa w sprawie złożenia wniosku o przeprowadzenie referendum ustawodawczego uregulowana ustawą z dnia 14 marca 2003 r. o referendum ogólnokrajowym. Ustawodawca nie uwzględnił jednak inicjatywy ludowej w sprawie zmiany konstytucji lub jej abrogacji. Tematem niniejszego opracowania będzie instytucja inicjatywy ludowej o zasięgu ogólnokrajowym.

The People’s Republic of China is one of the states focusing intensively on building its soft power and shaping its international image. However, China’s image is still negative and primarily based on stereotypes. In recent years, this country is willing to change such perceptions and present itself as an efficient, intensively developing, capable country that is much more than just a global production plant. The article aims to review China’s different manifestations of development aid regarding changing this type of public diplomacy and its meaning to the Chinese government. Is it only motivated by good intentions, or maybe its goal is to only provide an advantage to China? It is evident that owing to significant development, China needs to expand its economic contacts. However, the tested hypothesis states that behind Chinese development aid, political motivation is hidden as well. The research is based on content analysis of official documents and Foreign Ministry’s statements referring to development aid.

Saami are the only indigenous people in Europe. Today they live in tundra, taiga and coastal zones in the far north of Europe. Their reach cultural identity is endangered. The Saami are the inhabitants of four countries: Norway, Sweden, Finland and Russian Federation (Kola Peninsula). Preserving the Saami culture and languages is a part of European Union policy. The Saami culture is closely related to the nature so the policy of environment protection is also a part of preserving endangered Saami cultural identity. In the article the author gives examples of regulations and realized projects financed by EU funds that aim for improving living conditions of the Saami living in traditional way.

Opis:
The purpose of this article is to introduce Jan Lityński, Polish oppositionist active from late ‘60s to 1989 and to describe his beliefs and opinions about politics, society and his environment. Lityński became an oppositionist against communist government as a student at University of Warsaw and was involved in events known as “March 1968” which led to his imprisonment and made continuing his education impossible. But despite this, Lityński remained in the opposition until the collapse of the communist regime in Poland. He collaborated with the most prominent members of the opposition and wrote texts on political and social issues for various periodicals published in the illegal circulation. As a member of KOR and “Solidarność”, he lost his freedom many times but never let himself be broken or to betray his beliefs. In 1989 he took part in Polish Round Table Agreements that led to the change of the political system. This article was written based on Lityński’s publications from the 1980s and things he wrote and said years after those events. Other sources of information were interviews conducted with Lityński and statements made about him by associates from the opposition period.
Celem artykułu jest przybliżenie postaci Jana Lityńskiego, polskiego opozycjonisty aktywnego od końca lat 60. XX w. do 1989 r. oraz opisanie jego poglądów i opinii na temat polityki, społeczeństwa i jego otoczenia. Lityński stał się częścią opozycji jako student Uniwersytetu Warszawskiego i był zamieszany w wydarzenia znane jako „Marzec 1968”. Ich konsekwencją było więzienie i brak możliwości kontynuowania nauki. Ale mimo tego Lityński pozostał w opozycji aż do zmiany systemu politycznego, która nastąpiła 20 lat później. Współpracował z najbardziej znanymi członkami opozycji i był autorem tekstów poświęconych kwestiom polityki i społeczeństwa w różnych pismach ukazujących się w nielegalnym obiegu. Jako członek KOR-u i „Solidarności”, wielokrotnie tracił wolność, ale nigdy nie dał się złamać. W 1989 r. brał udział w obradach Okrągłego Stołu, które prowadziły do zmiany systemu politycznego w kraju. Artykuł napisano w oparciu o publikacje Lityńskiego z lat 80. XX w. i jego wypowiedzi oraz publikacje rozpowszechnione lata po tamtych wydarzeniach. Innym źródłem informacji były wywiady przeprowadzane z Lityńskim i wypowiedzi współpracowników z okresu opozycji na jego temat.
