Opis:
Each of the artefacts mentioned in the title is an exemplification of products of the anthropological “Other”. Each of them comes from a distinct geographical region and represents an entirely different culture. However, all of them have been connected together in the Western culture realia as a result of a particular type of displacements. The first displacement involved their physical migration – first to European museums of natural history and ethnological museums. The next one resulted in their emergence on the market of exotic “oddities” whereas yet another displacement located them within the conceptual framework delimited by the artistic discourse. This last displacement shows that it is very difficult to understand or “translate” one culture into another because the conceptual framework of the “translator” is always determined by their own culture.

The present study was the first to investigate the influence of artistic images of women on adolescent girls’ body attitude. The results have shown that a 10-minute exposure to artistic images of women by such great masters as Titian, Botticelli or Degas significantly changed body attitude in teenage girls, which was expressed through increased body satisfaction, decreased body dissatisfaction, and weakening of negative body emotion. Those outcomes have also confirmed the results of the existing studies exploring the negative influence of magazine advertising on teenage girls’ body experiencing. The comparison of two study groups has shown that girls looking at women in works of art expressed a significantly higher level of body satisfaction than girls exposed to women in advertisements.

This document is a continuation of the reflections on issues related to the phenomena surrounding the reception of contemporary art, initiated in the scientific study Around Art Reception. A Model of Empirical Cognition of Early School Education Teachers’ Attitudes to Modern Art – A Project Study. The article presents basic assumptions regarding the exploration of attitudes of early school education teachers towards contemporary art, and its main part is an attempt to present the author’s research tool in the form of a measure to identify the attitudes of early school education teachers towards contemporary art in the early school education process. The presented research tool consists of 50 test positions grouped in three dimensions: thoughts and beliefs about the characteristics of the object of an attitude, sensations and emotions associated with the object of an attitude, as well as actions and behaviours towards the object of an attitude, aimed at determining the attitudes of early school education teachers towards contemporary art in the early school education process within the following system: acceptance – ambivalence – rejection. The projected research tool is the initial proposal for further attempts by researchers of the subject to create their original tools for identifying audiences’ attitudes towards contemporary art.

The paper results from considerations on art reception and reflection on the current position of art recipients, their dispositions, and behaviours towards modern artistic activity, including the emotional, cognitive and behavioural orientation of early school education teachers in modern art. It begins with reflections on modern art understood as artistic activity created based on various means of expression and avant-garde and neo-avant-garde artistic solutions, which reacts to the huge potential, possibilities, threats of the surrounding world, and the situation of the recipient of modern artistic activity. The study’s further part presents the basic findings on the theoretical and conceptual framework of the phenomenon and a model of empirical cognition of early school education teachers’attitudes towards modern art. The study is addressed to researchers of the subject area and pedagogues. Even though it can hardly be regarded as a handy compendium, it provides a theoretical base and a research perspective. Therefore, it can serve as a guideline for future research explorations.

In the scientific article, the author explores the influence of Bauhaus aesthetics and ideology on the formation of contemporary artistic and design culture. It is noted that Bauhaus, which operated during the interwar period in Germany, became a key moment in world culture, promoting innovative approaches and the synthesis of art and design. The article discusses key aspects of Bauhaus, its influence, and relevance to contemporary art, architecture, and design. The progressive ideas of this school, such as the synthesis of art and design, experimental approach, functionalism, and visual communication, are considered in the context of their impact on the development of the artistic and design sphere. The school advocated for the combination of different art forms, the creation of functional and simple forms, and the use of new materials and technologies. Artists inspired by these ideas use the synthesis of art and design to create innovative works. They experiment with forms, materials, and concepts to create unique visual impressions. Contemporary artistic culture reflects the diversity of Bauhaus, adapting its principles to the challenges and opportunities of the 21st century. In addition to art, the author also examines the influence of Bauhaus on contemporary design. The ideas of functionalism and industrial design, emphasizing simplicity and purity of forms, have become the basis for present-day designers. Creating objects that meet the needs of modern life is an essential part of contemporary design trends. The article also investigates how Bauhaus influences architecture. Bauhaus representatives believed that architecture should be functional while embodying aesthetic principles. This concept is reflected in contemporary architectural trends, where simplicity of form and the use of new materials and technologies combine with the desire to create a functional and aesthetic environment. In the conclusions, the author emphasizes the importance of Bauhaus in shaping contemporary artistic and design culture. The influence of Bauhaus is manifested in an open, experimental approach to creativity, the use of new materials and technologies, and a focus on the functionality and simplicity of forms. Bauhaus ideas continue to inspire artists, architects, and designers, contributing to the development of contemporary art and design. All of this highlights the relevance and significance of Bauhaus in the modern world, where the traditions of the past and the innovations of the present come together to create a new dimension of art and design.

Opis:
Over the past 70 years, the art market in China has achieved remarkable growth. This rapid development has brought China to the spotlight of the international art world. Initially, state-owned antique stores played a key role in acquiring works of art. It wasn’t until the 1980s that professional art galleries began to be opened, and the first auction houses did not appear until the early 1990s. The two largest auction houses: China Guardian (founded in 1993) and Poly Auctions (founded in 2005) occupy the third and fourth place in size of auction houses after Christie and Sotheby’s. Currently, Chinese art market has become the second largest in the world. Chinese paintings and works of art are the dominant selling category, and the largest group of buyers are Chinese collectors who perceive art as a way to locate their capital in the country. Due to the active acquisitions of artworks in both domestic and international art markets, Chinese art collectors have gained worldwide attention.
За последние 70 лет рынок искусства в Китае достиг значительного роста. Это быстрое развитие сделало Китай центром внимания международного мира искусства. Первоначально ключевую роль в приобретении произведений искусства играли государственные антикварные магазины. Лишь в 1980-х годах начали открываться профессиональные художественные галереи, а первые аукционные дома появились только в начале 1990-х. Два крупнейших аукционных дома: China Guardian (основан в 1993 году) и Poly Auctions (основан в 2005 году) занимают третье и четвертое место по размеру аукционных домов после Christie и Sotheby’s. В настоящее время рынок китайского искусства стал вторым по величине в мире. Китайские картины и произведения искусства являются доминирующей категорией продаж, а самая большая группа покупателей - это китайские коллекционеры, которые воспринимают искусство как способ инвестиции своего капитала в стране. Благодаря активному приобретению произведений искусства как на внутреннем, так и на международном арт-рынках, китайские коллекционеры искусства привлекли внимание всего мира.

The study is devoted to the main musical symbol of the Ukrainian people. It is revealed that the work has a high prophetic symbolism regarding the evolutionary development of the country. The method of analysis of the spiritual content of melodies helps to identify a systematic objectification of its potential, based on the category of “spiritual reality”, and is considered from a musicological point of view. The melody reveals a symphonic technique of proto-intonation development. The genre basis of the melody is prayer. The system reproduces the basis of musical drama of Ukrainian folklore. The method of microminiature art, typical of Ukrainian folk masters, is embodied. The methodological basis helps to focus on the development of the sacredness of space-time content. The program potential of this work is able to lead the transformation of the spiritual state of man. Sacred symbols are placed in the center of energy development. The music conveys the idea of a renewed pulse. The people recognize Nature as the Temple in which man exists. The world of spirituality is sanctified by its living perception. The music of the “Anthem of Ukraine” perfectly combines the world and consciousness of people who woke up from eternal slavery. The melody contains courage and tenderness, firmness of spirit and faith in a good awareness of Truth and Joy. The cosmic law of consonance, the law of analogy is embodied. In the microstructure of the thematic core of the melody there is a point and its energy “engine” – dotted rhythm, a microelement of the iambic foot of the One Whole, which serve as two symbolic parameters of the formed core of themes. They perform in the energy layer the fundamental microfunction of the level of the heart, the function of the highest prayer to the Spirit, which helps the manifestation of spiritual consciousness in the density of the musical structure. the masculinity of the major is affirmed and ends with the gentle, feminine softness of the parallel minor, which indicates the systematic fluctuations of their paired periodicity in melodic-syntactic structures. A peculiar system of expressive symbolism of artistic and figurative drama of Ukrainian folklore, a reflection of the powerful genre of youth lyrics, the core of the spiritual greatness of culture, which is still preserved in the folk traditions of family education. The most popular image of the Mother of God is inspired by the Ukrainian prayer site, a sacred symbol of the famous icons “Protection of the Blessed Virgin” of the Zaporozhian Cossacks. The highest feminine principle encourages the protection of the male community, the whole nation, endows the Almighty with an effective symbol of patriotism, covers with its omophorion, gathers an army of men on the battlefield, the sanctity of monasticism, which protects spiritually. Intuitively and intelligently, the composer-priest conveyed that the invisible Hierarchy of Light stood up for the protection of hearts that dream and know of dignity and honor, honesty and spiritually high justice in the reality of earthly existence.

The relevance of the study is determined both by the insufficient study of the diplomatic ceremonials of the USSR, and the fact that knowledge of the laws of their functioning expands our ideas about the cultural component of the life of Soviet society. Taking into account the absence in Russian historiography of a special study devoted to the problem of the interaction of arts at diplomatic ceremonies, the author set the goal to conduct a comprehensive research of the problem of the interaction of arts in diplomatic ceremonials. The article considers the stay of the Diplomatic Corps in Moscow from the point of view of the influence of foreign policy priorities on the norms of the diplomatic protocol. Examples of balls, sports, receptions, organized by the embassies of Germany and Italy, which in the 20–30s played a leading role in the life of the Diplomatic Corps, are given. The content of concert programs of official foreign visits, which contributed to the creation of a positive image of the country on the world stage, is analyzed. For the first time the term “diplomatic counterculture” is introduced into scientific circulation – an intentional violation of the diplomatic protocol and diplomatic etiquette in order to achieve a specific result in international communication. It was revealed that the diplomatic ceremonial in itself is a synthesis of arts – the picturesque design of space, music, choreography, costume. Already in the first years of Soviet power, symbols of power entered the “struggle for power.” At diplomatic ceremonies this struggle was in the form of a confrontation between European protocol traditions and the rules of the Soviet diplomatic protocol and etiquette newly created by the employees of the Protocol Division of the USSR People’s Commissariat for Foreign Affairs. Dress code, concert programs, a list of dishes served – everything had to meet the standards of Bolshevik ideology. Hospitality is an important component of national politics. The Protocol Division, through its work, tried to destroy stereotypes about the USSR as an evil empire. The multinational Soviet culture contributed to the creation of a positive image of the state on the world stage.

The following text is dedicated to early medieval strongholds built in Mazovia between the end of the 9th and the end of the 11th c. At least 39 sites can be dated to that period, among them 14 were built in the so-called “tribal” period, while the other ones are associated with the early Piast state structures. One should emphasize the small number of “tribal” strong¬holds and their concentration to the north of the middle Vistula river. The standardized form of the oldest fortifications refers directly to the so-called Tornow type. Apparently, the first strongholds associated with the expansion of the early Piast state appeared at the end of the 10th c. in the western Mazovia and the main building activity was limited to that area until the end of the 11th c. Noteworthy, at least up to the mid-11th c. both “tribal” and early-state strongholds existed near to each other.

In the article an influence of sacred art on Ukrainian painting of the late twentieth century, as exemplified by works of NAFAA teachers, was studied. In the professional literature, an idea was established that Ukrainian art, including painting, in the late twentieth century is closely connected with popular art and folklore, sometimes it is also about the influences of fine arts of previous epochs. Herewith, the influence of sacred art on the formation of a new art is mentioned only cursorily or its significance is completely neutralized. The goal of the work was, first of all, to determine the influence of sacred art on the creation of Kyiv painters in the late twentieth century. To achieve the targeted goal the works of painters, who were representatives of different generations and different stylistic trends, were reviewed and formally analyzed. The pieces of art presented in the work give grounds to state that the influence of sacred art on the formation of Kyiv painting is significantly underestimated. Even a cursory overview of the works suggests that sacred art responded not only narratively. Artists examined and actively used icon-painting and composition building, turned to specific recognizable images and combined them with modern themes. In the study, a special attention is paid to M.A. Storozhenko, the founder of the Department of Sacred Painting, who was not only a prominent artist, but also a teacher, and he managed to educate a number of artists who continue the work of the mentor, teaching sacred painting to a new generation of artists.

Bankowy tytuł egzekucyjny bez wątpienia należy do najbardziej kontrowersyjnych instytucji w polskim systemie prawa. Wyrazem tego są dające się słyszeć w opinii publicznej doniesienia na temat jego rzekomego nadużywania przez banki. Wyroki Trybunału Konstytucyjnego orzekające niekonstytucyjność mocy dokumentu urzędowego przysługującej księgom rachunkowym banków i funduszy sekurytyzacyjnych w odniesieniu do konsumentów stały się przyczynkiem dla ponownego ożywienia debaty wokół BTE. W rezultacie coraz częściej pojawiają się inicjatywy na rzecz jego wyeliminowania z systemu prawa czy też znowelizowania. Bankowy tytuł egzekucyjny stanowi pewnego rodzaju pozostałość poprzedniego systemu społeczno-gospodarczego i istniejącego w nim postrzegania banków jako quasi-organów administracyjnych, co rodzić musi wątpliwości na temat jego miejsca w nowej polityczno-ekonomicznej rzeczywistości. Sytuacja ta skłania autorów do przyjrzenia się bankowemu tytułowi egzekucyjnemu z perspektywy prawa własności i operatywności systemu prawa. Przeprowadzona analiza dogmatyczna tej instytucji oraz prawa własności w Konstytucji RP prowadzić ma do odpowiedzi na pytanie o dopuszczalność i zasadność istnienia bankowego tytułu egzekucyjnego w polskim porządku prawnym na tle konstytucyjnej zasady ochrony własności.
An institution of a bank enforcement title stirs many controversies in the Polish legal doctrine. In addition it is a subject of a heat discussion among politicians, journalists and public opinion. The bank’s debtors are often required to submit themselves to enforcement of claims arising from their relationships with the bank. Notarial deeds are not required for such a submission, which makes the process more advantageous and ess costly than the voluntary submission described above. In the event of default, the bank may issue a bank enforcement title on the basis of the debtor’s submission to enforcement. Such enforcement title is regulated in a detailed and strict manner by Polish Banking Law. In the paper the authors aimed at a scrutiny of a bank enforcement title on the ground of the right to ownership, protected by Polish Constitution of 1997. Tak- ing into account axiology of the all legal system they do investigate constitutionality and then the purposefulness of the institution.

The issue of institutionalizing non-heteronormative unions arouses great controversy in Poland and has not yet been legally regulated in any form. The issue of institutionalizing same-sex unions is multifaceted and has an interdisciplinary character. The aim of the article is to analyze selected premises, both legal and ideological, related to the admissibility of institutionalizing the form of relationships of non-heteronormative people.
Problematyka prawnego usankcjonowania związków osób nieheteronormatywnych wzbudza w Polsce duże kontrowersje i dotychczas nie została uregulowana w jakiejkolwiek formie. Zagadnienie instytucjonalizacji związków jednopłciowych jest wielopłaszczyznowe i ma interdyscyplinarny charakter. Celem artykułu jest analiza wybranych przesłanek, zarówno prawnych jak i ideologicznych, odnoszących się do możliwości instytucjonalizacji formy pożycia osób nieheteronormatywnych.

Opis:
The flexible formula of the British Constitution results in a relative openness to external influences. Notwithstanding this fact, the United Kingdom’s (UK’s) membership in the European Union’s (EU’s) structures (1973–2020) resulted in a progressive limitation of the doctrine of parliamentary sovereignty. Brexit will not reverse the effects of the ‘soft’ modification of the foundations of the UK’s system, which occurred in the sphere of the practical implementation of the competencies of the branches of governance. Prima facie, the decision on the UK’s withdrawal from the EU should result in a ‘renaissance’ of the traditional doctrine of Westminster sovereignty, per A.V. Dicey. However, judicial activism, continued validity of the European Convention on Human Rights (incorporated on the basis of Human Rights Act 1998) and the irreversible consequences of the devolution of competencies in the UK for Wales, Scotland and Northern Ireland are the factors that hinder the possible revitalisation of the sovereignty of the British Parliament.
Elastyczna formuła brytyjskiej konstytucji skutkuje względną otwartością na wpływy zewnętrzne. Tym niemniej, członkostwo Zjednoczonego Królestwa w strukturach Unii Europejskiej (1973–2020) skutkowało postępującym ograniczaniem doktryny suwerenności Parlamentu. Brexit nie odwróci skutków “miękkiego” modyfikowania fundamentów ustroju Zjednoczonego Królestwa, które częstokroć miały miejsce w sferze praktycznej realizacji kompetencji poszczególnych segmentów władzy państwowej. Prima facie, decyzja o wystąpieniu ZK z UE powinna skutkować “renesansem” tradycyjnej doktryny suwerenności Westminsteru w ujęciu Diceyowiskim. Jednakże aktywizm sędziowski, dalsze obowiązywanie Europejskiej Konwencji Praw Człowieka (inkorporowanej na podstawie ustawy o prawach człowieka z 1998 r.) oraz nieodwracalne skutki powstałe w wyniku dewolucji kompetencji w ZK na rzecz Wali, Szkocji i Irlandii Północnej stanowią czynniki hamujące ewentualną rewitalizację zasady suwerenność parlamentu brytyjskiego.

The aim of the article is to present a strategy of the educational use of art in primary school grades 1–3. The strategy is being implemented in the form of a pedagogical innovation in a school in the Silesian province. It is based on joint perception of a work of visual art and musical material as well as artistic and kinaesthetic creative activity evoked by this perception. The text includes a presentation of individualising pilot experimental studies of a selected case.

Opis:
In the light of art. 4 of the Constitution of the Republic of Poland, the nation as a sovereign has the right to steer the state’s policy, express an opinion on governing of the state, as well as codecide with the state organs in the governing process. The nation is a source of power and may assume the role of an arbitrator in conflict situations between constitutional state organs but also in disputes between the subjects of the political scene, which is reflected in the targeting of the activities of public authorities according to the will expressed via a referendum. Due to the introduction of the principle of nation sovereignty in the Constitution of the Republic of Poland, it seemed that a nationwide referendum was bound to become an important instrument allowing the expression of opinions and formulation of decisions by the sovereign.
