One of the most important methods of working on the condition and prospects of (disabled) people is undoubtedly communication, and dialogue within its scope.

Adaptation is a notion frequently used in legal acts which normalize the educational situation of learners with disabilities. This has made adaptive activity an immanent part of school practice. The thesis is put forward that adaptation is an ambiguous category and therefore is used in various ways or is frequently overused. In many circumstances, this notion has become a skeleton key which opens the space for free lowering of educational requirements and schematic simplification of educational situations, which frequently hinders learners’ development. The study is aimed at explaining the phenomenon of adaptation and at considering its possible variants with special regard for the context of inclusive education of disabled learners.

The presented study aims at the identifi cation of these mechanisms in the area of integrated education as well as at showing possible consequences for educational practice and the development of disabled learners. The first is related to the biological model of disability, which is determined by the notion of physiological norm and for which organism impairment is a constitutive feature. What ranks as priority in the second standpoint are special educational needs treated as a derivative of functional disorders. This point of view is particularly visible in some psychological definitions presenting disability as individual functional disorders. The last perspective of viewing the disabled learner which is discussed here is situated in the assumptions of constructivism. Each of the presented standpoints allows for slightly different handling of the disabled learner’s school problems. In the presented article, the discussed issues are rooted in the last – constructivist approach.

Opis:
The issues of eugenics, although they clearly emerged as late as in the second half of the nineteenth century, was not unknown to humanity in the distant ancient times. From the moment when F. Galton consolidated the theses currently recognized as eugenics, simultaneously introducing the concepts of “eugenics” and “eugenic”, eugenics very quickly found its supporters around the world. Its exceptional exemplification and development was noted in the first half of the twentieth century, which absolutely does not mean that it does not exist nowadays in a different form, using other methods of control and elimination of imperfections of the Homo Sapiens species, as well as undesirable social phenomena. This includes activities not only aimed at prevention, diagnosis or therapy of individual and civilization problems, but are also more radical ones, such as abortion carried out for eugenic purposes. Thus, the content of the article not only discusses eugenic issues in the theoretical context, but also presents opinions of selected groups of people with disabilities,participating in the implementation of the project entitled: “Implementation of the Convention on the Rights of Persons with Disabilities, a Common Matter”, conducted in Poland in 2016–2018, concerning the proposal to introduce a total ban on eugenic abortion into Polish legislation.

A certain percentage of disabled children are not raised in their biological families. It happens more and more often that the place of residence of such a child is not an institution but the adoptive or foster family. Increased prevalence of this type of families makes the study of this area of functioning of children with disabilities more and more important. The paper covers the issue of dealing with a child’s difference by their adoptive/foster parents. The difference has its source e. g. in a disability. The empirical part of the article is the result of qualitative research conducted with parents from 20 adoptive/foster families that raise a child with a disability (this is a part of a broader research project conducted by the authors with these families). The analysis of the interviews shows the ways to discover the otherness, the difference of the child, the ways to accept this otherness, and the importance they ascribe to the otherness of the child.

The article discusses the phenomenon of infrahumanisation in academic relations between able-bodied people (both students and academics) and students with disabilities. The main goal of the article is to show that infrahumanisation may make it difficult for young people with disabilities to build their capital for the future in the form of interpersonal relations. The paper uses Arnold van Gennep’s concept of the rite of passage as a model of entering adulthood, and focuses specifically on the stage of university education as the one which completes the transition into adulthood, and marks the beginning of a “normal” life (i.e. one consistent with social expectations). The phenomenon of infrahumanisation shown here on various levelsof academic life disrupts this process, and may hinder the inclusion/integration of disabled people into society. The relations between disabled students and non-disabled people who are part of the academic community in which the students operate may, however, also bridge the distance between the two groups, and thus contribute to paving the way to a respectful society, i.e. the way of equality.

Music therapy is a complex process conducive to the improvement of the functioning of the organism subjected to this type of action. It is a multifaceted action including various forms and methods of working with the use of music. In this text I present an analysis of the importance of such activities for the development of children with intellectual disabilities and try to assess the extent to which such activities are used in working with this group of people. The analysis of the ways of performing music therapy in relation to children with intellectual disabilities is illustrated by the results of a diagnostic survey.

A child is a member of a vulnerable group in societies. Children's rights are equal for all children and they cannot be denied, because they are a birthright. However, throughout the world, children with disabilities and their families constantly experience a barrier in regard to the enjoyment of their basic human rights and to their inclusion in society. Their abilities are overlooked, their capacities are underestimated and their needs are given low priority. The barriers they face are more frequently a result of the environment in which they live rather than a result of their impairment. The situation began to change only when requirements to include disabled children in the education system were introduced in legislation. Following the example of other countries worldwide, the Republic of North Macedonia introduced inclusion of children with disabilities in the mainstream educational process, because the right to education is a right for all children, including the ones with special educational needs. For this purpose, the Republic of North Macedonia implemented a series of changes in the educational system for successful inclusion of children with special educational needs. Hence, the main aim of our paper is to represent the actual situation in Macedonian schools regarding the problem of educational inclusion of students with disabilities in the regular school system. The research methods are based on document studies and case studies about changes in social and educational policies for students with disabilities and special educational needs who are included in primary and secondary education. At the same time we shall present some guidelines for teachers who work with these children and future directions for a proper inclusion system in the Republic of North Macedonia, because every child has a fundamental right to education and must be given the opportunity to achieve and reach an acceptable level of learning. In this frame, school societies try to support full participation of students with disabilities in areas of their lives on equal terms, conditions, social justice and basic human rights.

Maternity in the case of women with intellectual disabilities is exposed to many factors hindering its implementation. Research on this occurrence shows that one of the main reasons for that is insufficient or inept support for this group of women in different areas, such as educational, financial, informative, emotional. Teenage mothers with disabilities are in a particularly difficult situation. The article presents the analysis of statements of an adult woman with mild intellectual disability on her experience of teenage pregnancy as well as maternity as an adult woman. The humanistic attitude of giving the floor to the respondent allowed to determine other meaningful matters in the woman’s life (among others: relationships with life partners, relationship with the mother, vision of the future, financial situation) The methodology of research used was qualitative research. Two open interviews took place 8 months apart. The interviews were recorded to an electronic device. The material obtained was later transcribed. Triangulation of the sources was included (two family assistants were interviewed).

Reduction of unemployment or mitigation of its effects requires different economic, legal, or organisational instruments and may take different forms as well. The legal regulations available since 2004 include, inter alia, an institution of a social co-operative. The principles on which such a co-operative is to be organised and may function are set forth in the Act of 27 April 2006 on social co-operatives, substantially amended in 2010. Its provisions create preferential conditions for the unemployed, the disabled, and those entitled to social employment to set up, and be members of, social cooperatives. The paper contains a detailed analysis of the preferences as well as the forms of financial support available from public funds to social co-operatives. Those statutory solutions which are too rigid with regards e.g. the limited membership or employment in social co-operatives are being criticised, and the suggestion with which the paper ends calls for a wider application of those statutory provisions which allow to more accurately and more effectively account for the local needs and conditions, and make better use of the support of the units of local self-government.
Ograniczanie skali bezrobocia czy łagodzenie skutków tego zjawiska wymaga stosowania różnego rodzaju form i instrumentów ekonomicznych, prawnych, organizacyjnych itp. W obszarze regulacji prawnych od 2004 r. zadania tego rodzaju spełnia między innymi instytucja spółdzielni socjalnych. Zasady organizacji i działalności tego typu spółdzielni ustala obecnie ustawa z 27 kwietnia 2006 r. o spółdzielniach socjalnych, istotnie zmieniona w 2010 r. Przepisy tej ustawy stwarzają preferencyjne warunki do zakładania ich i przystępowania do nich osób bezrobotnych, osób niepełnosprawnych oraz uprawnionych do zatrudnienia socjalnego. Niniejsze opracowanie zawiera szczegółową analizę tego rodzaju preferencji, a nadto analizę form wsparcia finansowego spółdzielni socjalnych ze środków publicznych. W treści opracowania krytycznie odniesiono się do tych rozwiązań ustawowych, które nazbyt sztywno, schematycznie ustalają limity członkostwa, skali zatrudnienia w omawianych spółdzielniach. Stąd zaprezentowana sugestia szerszego zastosowania w ustawie odesłań do regulacji statutowych, które mogą efektywniej i precyzyjniej uwzględniać lokalne warunki potrzeb zatrudnieniowych, jak również możliwości wsparcia finansowego, szczególnie ze strony jednostek samorządu terytorialnego.

What is human dignity? How to define the dignity of a person? Is it possible to identify key features that show the principles of respecting the dignity of another person? Attempts to define the concept indicated here may inevitably fail. On the one hand, human dignity is a universal concept. It refers to all people. Nevertheless, on the other hand, each of us has our own sense of dignity. Paradoxically, e.g., humiliation of a particular person’s dignity shows us the importance of the area that has been violated. Similar violations often affect sick and disabled persons. Examples of similar activities throughout human history abound. In this context, special attention should be paid to the interventions undertaken by the Nazis before theoutbreak of WWII. Here, we are talking especially about mass and legalised activities that resulted in the sterilisation of many thousands of people with intellectual disabilities, people with physical disabilities and people experiencing mental disorders. The Nazi practices indicated here are presented as examples of human right violations. At the same time, they are examples of the unlawful rule of the state over an individual. Is there still a danger of reverting to similar practices today? Can standards of respect for human rights created years ago successfully protect disabled people against violation of their dignity? Can the knowledge of Nazi activities still be important to us? The presented article is intended as an attempt at answering these questions.

Przedmiotem artykuły jest analiza problematyki przyznania świadczenia pielęgnacyjnego osobie, której ma ustalone prawo do emerytury. Poruszony temat jest istotny ze względu na to, że dotyczy udzielenia materialnego wsparcia osobom, które rezygnują z aktywności zawodowej, by opiekować się osobą niepełnosprawną. Powstałe w ostatnim okresie rozbieżności w orzecznictwie sądów administracyjnych nie pozwalają jednoznacznie ocenić jaki wpływ ma ustalone prawo do emerytury na możliwości nabycia prawa do świadczenia pielęgnacyjnego. W ramach tego samego sądu administracyjnego różne składy orzekające zajmują odmienne stanowiska, co nie daje obywatelom poczucia pewności prawa. Autorka dokonała analizy prezentowanych w orzecznictwie stanowisk i wskazała możliwości rozwiązania zaistniałego problemu. W ocenie autorki ustawodawca nie uwzględnia zmieniającej się sytuacji ekonomicznej i społecznej w przyjętych rozwiązaniach zależności pomiędzy uprawnieniem do świadczenia pielęgnacyjnego i uprawnieniem do emerytury, co wywołuje kontrowersje w praktyce. Brak inicjatywy legislacyjnej w tym zakresie powoduje, że sądy, aby wydawać sprawiedliwe orzeczenia, zaczynają poprawiać niedostosowane przepisy.
The article analyses the issue of granting a nursing benefit to a person who has a fixed pension entitlement. The topic is important because it concerns providing material support to people who resign from professional activity to look after a disabled person. Recent discrepancies in the jurisprudence of administrative courts do not allow for an unequivocal assessment of the impact of the established right to a pension on the possibility of acquiring the right to a nursing benefit. Within the same administrative court, different adjudication panels have different views, which does not give citizens a sense of legal certainty. The author analysed the presented views in the case-law and pointed out the possibilities of solving the problem. In the author’s opinion, the legislator does not take into account the changing economic and social situation in the adopted solutions of the relationship between the entitlement to nursing benefit and the entitlement to a retirement pension,which causes controversy in practice. The lack of a legislative initiative in this area means that the courts begin to correct unadjusted provisions in order to issue fair rulings.
