The goal of this article is to sum up the past hundred years of the social security system in Poland, starting with establishment thereof as Poland regained statehood in 1918. The changes which occurred in that time have been divided into three subsequent stages of the history of the Polish social security system. The first was the Interwar period when efforts were made to establish a social security system in independent Poland, in areas formerly divided between Austria, Prussia and Russia with extreme systems of social security. The next period was the Polish People’s Republic (1944–1989) when the communist authorities dismantled the pre-war social security system based on cooperation between state-owned and social organisations and the Church, replacing it with inefficient structures interested only in selected social groups in need. On the other hand, the third stage, commenced in 1989, of reconstructing social security, at first offered social protection for individuals affected by the system transformation. The last dozen or so years of development of social security is characterised by increasingly visible stimulation of social and economic growth to activate people from the fringes of the society.

This article aims to analyze the common manifesto of the Christian Democratic Union of Germany and the Christian-Social Union in Bavaria regarding social security, with regard to the elections to the German parliament in 2017. The basic assumption was to verify whether the CDU/CSU grouping referred to each of the elements of social security, i.e. social security system, welfare security, community security and developmental security, in its 2017 election manifesto. The method used to complete the study was content analysis. The study shows that the CDU/CSU Union in its common manifesto of 2017 – Für ein Deutschland, in dem wir gut und gerne leben. Regierungsprogramm 2017–2021, raised issues related to building the social security of citizens. The proposals that were included in the program allow us to conclude that the CDU/CSU proposed a program that develops each of the pillars of social security in part, but which is still lacking in some ways. It should be noted that the issue of culture has been somewhat overlooked, which undoubtedly has a huge impact on the development of social capital and human capital, despite its enormous impact on two of the pillars, community and development. Other areas and proposals aimed at their development manage to fill this gap. It should also be pointed out that in the electoral proposals included in the manifesto, the most developed pillar was related to social security, implemented as part of the social policy of the state.

Acquiring blindness or low vision at the senior age usually results in decreased quality of life due to a decrease in functional performance in the areas of activities of everyday activities, spatial orientation and mobility, physical activity, spending free time and obtaining information. Loss of vision also implies serious emotional consequences, which in the absence of professional therapeutic help and social support can lead to mental health disorders. Research analyses indicate that the level of satisfying rehabilitation needs of seniors who are losing vision is relatively low, and the specificity of their functioning resulting from the coexistence of various health problems is rarely included in support programs. The aim of the article is to indicate areas that have been so far neglected in the rehabilitation of elderly people who have acquired visual impairment and to formulate proposals aimed at increasing the availability and quality of therapeutic services for this social group.

The democratic transformation in Poland, the beginning of which dates back to the 1980s, brought political and economic freedom that additionally inspired the activity of civil movements taking the form of non-governmental organizations. Since the early 1990s, Polish society has become clearly divided, which was illustrated by the emergence of three distinct areas of public activity. The Law of March 8, 1990 on Territorial Self-Government began the rapid development of local governments, which were given the task of handling local public matters. The Law on Business Operations, which was in force at the time, ensured freedom of operations and the principle of quality of all participants of business life. Other laws, the Law on Foundations of April 6, 1984 and the Law on Associations of April 7, 1989 restored the possibility of civil self-organization, working for one’s own circle and fulfilling social needs. Throughout the whole period of political transformation, and in particular in the decade after Poland’s accession to the European Union, NGOs have become one of the most active actors of public life, and a capable partner to local and regional authorities in designing policies. One significant element of politics involves ensuring the security of citizens. Social security is of particular importance. NGOs initiate a number of projects aiming to fulfill the basic needs of residents, thereby ensuring their personal development and confidence. Cooperation with territorial self-government isof exceptional importance here.

The Second Polish Republic developed an advanced and, in many ways, modern system of social care; however, the services which the citizens were entitled to seemed to be privileges available only to a small part of the population. The origins of this situation are to be found in the specific social and occupational structure of the population, low industrialization rate and the modest financial capabilities of the state and local governments. These resulted in a limited number of people with access to social insurances, a limited scope of public health care, a selective nature of access to unemployment insurance or radical differences in access to social care. And it is this unavailability of the social offer which determines the consideration of those benefits in Poland as privileges rather than commonly available rights of the Polish citizens.

The subject of the study is an analysis of the regulations of the Act of 5 August 2015 on Free Legal Assistance and Legal Education with a purpose of evaluating if free of charge legal assistance can be considered to constitute an instrument of social security. The rules of providing free legal assistance, including the scope of this assistance and persons entitled to receive it, as well as the organisational and financing solutions are presented and compared with the regulations of the procedural law on the exemption from court fees and state-funded legal aid fees. The term ‘social security’ is also discussed and analysed and against its background the regulations of the Act of 5 August 2015 are analysed.
Przedmiotem opracowania jest analiza przepisów ustawy z 5 sierpnia 2015 r. o nieodpłatnej pomocy prawnej oraz edukacji prawnej i ocena, a celem analizy jest określenie, w jakim stopniu nieodpłatna pomoc prawna może być uznana za instrument zabezpieczenia społecznego. Autor przedstawia zasady udzielania nieodpłatnej pomocy prawnej, w tym zakres przedmiotowy tej pomocy oraz krąg osób uprawnionych do jej otrzymania, a także rozwiązania organizacyjno-finansowe i porównuje je z regulacjami prawa procesowego dotyczącymi zwolnienia z kosztów sądowych oraz ustanowienia pełnomocnika z urzędu. Następnie omawia pojęcie „zabezpieczenie społeczne” i na jego tle ocenia przepisy ustawy.

This article presents a comparative study of French and Greek administrative language, as it is used by public administration institutions in their internal communication as well as in their external communi- cation with the citizens. In the present study, we employ a corpus-based contrastive approach, by using bilingual comparable corpora in the subject field of “employment”. First, we present our method concerning the compilation of the comparable corpora and the digital tools used for their processing analysis; and then, we proceed with the analysis of the textual data from a contrastive perspective. We aim to highlight the morphosyntactic, semantic, and pragmatic aspects that characterize the terms studied across the two languages.

W artykule opisano polski system ubezpieczeń społecznych rolników, z uwzględnieniem jego odrębności. Przedstawiono charakterystykę systemu w ujęciu porównawczym do powszechnego systemu ubezpieczeń. Podkreślono elementy wskazujące na uprzywilejowanie rolników i członków ich rodzin wobec pozostałej części społeczeństwa. Podniesiono również aspekt zapewnienia bezpieczeństwa socjalnego beneficjentom systemu rolniczego w kontekście wysokości przysługujących świadczeń, które kształtują się na poziomie znacznie niższym, niż w systemie ubezpieczeń powszechnych.
This article describes the Polish social insurance system for farmers, taking into account its distinct nature. The article presents characteristics of the system in comparison to the general insurance system. The author underlines privileges given to farmers and their families over the rest of the society. The aspect of ensuring social security for the beneficiaries of the system is raised in the context of benefits which are much lower than in the general insurance system.

W debacie publicznej dość często występującym problemem jest rola i zakres działań państwa w obszarze bezpieczeństwa społecznego. Związane to jest zarówno z postawą obywateli, jak i wykorzystywaniem haseł społecznych, szczególnie w kampaniach wyborczych. Można wręcz powiedzieć, że w trakcie walki wyborczej następuje pewnego rodzaju wyścig polegający na tym, które obietnice socjalne trafią do przekonania wyborców, dzięki czemu polityk/partia polityczna osiągnie sukces wyborczy. Tym samym, odwołując się do hasła bezpieczeństwa społecznego, manipuluje się danymi ekonomicznymi, ale przede wszystkim pozostawia się poza sferą refleksji wpływ obietnic wyborczych ze sfery społecznej (zazwyczaj zawężanej do socjalnej) na ewolucję systemu politycznego. Niewątpliwie jest on znaczny i bardzo często lekceważony, czego przykładem może być Rzeczpospolita Polska po 2015 roku.
The role and scope of the state’s activities in the field of social security are quite often problematic. This is related both to the attitude of citizens and to the use of social slogans, particularly in election campaigns. One could say that the electoral struggle is a kind of race, in which the winner is the politician or party whose promises are best suited to their voters. In order to address social security, politicians manipulate economic data. But above all, the influence of electoral promises (usually narrowed down to matters of welfare) on the evolution of the political system is not considered, despite the fact that this influence is considerable and very often neglected, as exemplified by the situation in the Republic of Poland after 2015.

Celem artykułu jest przedstawienie zagadnienia bezpieczeństwa socjalnego seniorów w kontekście wyzwań współczesnej polityki społecznej w Polsce realizowanej na poziomie ich lokalnego zamieszkania. Jedną bowiem z kategorii osób należących do środowiskowej polityki na szczeblu lokalnym, obok integralnie rozumianej rodziny, są seniorzy w przedostatniej i ostatniej fazie życia. Mają nie tylko poczucie przynależności do obszaru i miejsca zamieszkania, ale również świadomość bezpieczeństwa społecznego w wielowymiarowej polityce lokalnej. W argumentacji zwrócono uwagę na trzy aspekty: wyzwania seniorów w środowisku lokalnym, wyzwania lokalnej polityki stymulowanej zwiększającą się liczbą seniorów oraz ukazania strategii polityki lokalnej wobec starszej i najstarszej generacji obywateli. Podkreślono także postulaty i rekomendacje.
The article deals with the issue of social security of seniors in the context of the challenges of contemporary social policy in Poland, implemented at the level of their local residence. This is because one of the categories of people belonging to environmental policy at the local level, next to the integrally understood family, are also seniors in the penultimate and last phase of their lives. They not only have a sense of belonging to the area and place where they live, but also an awareness of social security in a multidimensional local policy. The argumentation highlights three aspects: the challenges of seniors in the local environment, the challenges of local policies stimulated by the increasing number of seniors and the demonstration of local policy strategies towards the older and oldest generation of citizens. Postulates and recommendations were also highlighted.

Opis:
The article discusses the non-adjustment of the statutory limit relating to doctoral students, which sets out the right to a survivor’s pension. First some general information on the benefits, with particular emphasis on the periodic nature of the benefit, is presented on the basis of selected decisions of the Supreme Court. This is followed by some examples of statutory regulations that equalise as well as differentiate the rights and obligations of doctoral students with those of other students. These findings are subsequently compared with the existing constitutional norms. A special emphasis has been placed on the principle of equality before the law and the right to social assistance from the State in this particular case. References have been made to the doctrine and the previous judicial decisions of the Constitutional Tribunal. In the final  summary, some legislative amendments are proposed.
Artykuł porusza pomijaną w dotychczasowym piśmiennictwie kwestię niedostosowania ustawowej granicy wyznaczającej prawo do renty rodzinnej w stosunku do uczestników studiów trzeciego stopnia (doktorantów). Inicjalnie przedstawiono podstawowe informacje dotyczące renty rodzinnej, ze szczególnym uwzględnieniem okresowego charakteru tego świadczenia, uwzględniając przy tym orzecznictwo Sądu Najwyższego. Następnie zaprezentowano wybrane przykłady ustawowych regulacji zrównujących w prawach i obowiązkach doktorantów ze studentami, jak również tych różnicujących status doktorantów. W dalszej kolejności dokonano kompilacji wcześniejszych tez, zestawiając je z unormowaniami konstytucyjnymi. Szczególny nacisk położono na wyrażoną w ustawie zasadniczej zasadę równości wobec prawa oraz prawa do pomocy socjalnej ze strony państwa, ergo tych regulacji szczególnie rzutujących na omawiany problem. Odwołano się przy tym do dotychczasowego dorobku doktryny oraz orzecznictwa Trybunału Konstytucyjnego. W podsumowaniu zasugerowano zmiany legislacyjne mające za zadanie eliminację zaobserwowanych zastrzeżeń względem Konstytucji RP.

The paper is an approach to present the category of social rights in the background of entire legal system of the human rights protection. It is particularly dealing with the issue of nature of the 2nd generation of human rights and its significance for society. It starts with a brief presentation of the philosophical (human dignity) and normative roots as well as a short historical view of the human rights’ codification; the established legal terminology (human rights, fundamental rights, individual rights and liberties) and various levels of the legal protection (international – of global or regional nature, supranational and national one). Thereafter it focuses directly on the issue of social rights. Unlike the 1st generation of human rights, they are rather connected with public activity, policy and services (facere) than with autonomy and liberty (non facere). This, in turn, demands appropriate institutional structures and procedures. Social rights are hardly provided – in a binding and effective way – by global or regional international law. Thus, the burden of their protection, guaranty and execution is satisfied by the particular state and depends on its economic and social circumstances. On the other hand – they significance is based on fact that they serve the protection of social security which is the fundamental issue for both – dignity and sense of community.

Opis:
Praca skazanych jest jednym z istotnych elementów procesu wykonywania kary pozbawienia wolności. Pracę należy zapewnić przede wszystkim skazanym zobowiązanym do świadczeń alimentacyjnych, ale również tym, którzy mają szczególnie trudną sytuację materialną, osobistą lub rodzinną. Celem artykułu jest przedstawienie podstaw prawnych zatrudniania osób odbywających karę pozbawienia wolności. W ramach niniejszego artykułu przeanalizowano normy prawne regulujące możliwość zatrudniania osób odbywających karę pozbawienia wolności na podstawie skierowania do pracy oraz innych form prawnych wymienionych w art. 121 § 2 Kodeksu karnego wykonawczego z 1997 r. Podjęte rozważania prowadzą przede wszystkim do wniosku, że niezależnie od wyboru formy prawnej zatrudnienia priorytetem jest realizowanie celów kary pozbawienia wolności, jednakże forma zatrudnienia osób odbywających karę pozbawienia wolności ma wpływ na sposób ukształtowania stosunków prawnych pomiędzy skazanym a podmiotem, na rzecz którego świadczy on pracę.
The work of convicts is one of the essential elements of the process of executing imprisonment sentences. Work should be provided primarily to convicts who are obliged to pay maintenance payments, but also to those who have a particularly difficult financial, personal or family situation. The purpose of the article is to present the legal grounds for employing people serving a prison sentence. This article presents the legal norms regulating the possibility of employing people serving a prison sentence on the basis of a referral to work and other legal forms listed in Article 121 § 2 of the Executive Penal Code of 1997. The considerations lead primarily to the conclusion that, regardless of the choice of legal form of employment, the priority is to achieve the objectives of imprisonment; however, the form of employment of people serving a sentence of imprisonment affects the manner of shaping legal relations between the convicted person and the entity for whom he is working.
