The article presents the problem of cheating in Polish schools. 1,070 students of high schools were examined. The aim of the research was to establish relationships between amotivation, external motivation, introjected motivation, motivation based on identification and internal one, and cheating, help to cheat and reluctance to help to cheat. The results show that amotivation, introjected and internal motivation are predictors of cheating. Only the external motivation turned out to be the predictor of help to cheat; on the basis of internal motivation it is possible to anticipate reluctance to help to cheat.

The article presents the case of Dr. Aleck Bourne, which the author proposes to include in the catalog of borderline cases constituting the basis for in-depth discussions on ethical and legal aspects of human life with regard to the development of biology and medicine. The starting point is the presentation of the worldwide models for regulating the practice of abortion as well as the Polish regulation, together with a discussion on the role of the Constitutional Tribunal in shaping current legal provisions. The author notes that the interpretation of the right to life adopted by the Tribunal encourages the repeal of the indication model and the introduction of a complete ban on abortion, which will have significant consequences for ordinary legislation. Apart from describing the facts in the Bourne case, the strategy adopted by the defense and the sentence itself, the possible further areas of considerations regarding the limits of permissibility of termination of pregnancy have been signaled. Then, the conclusions resulting from legal analysis of the case were transferred to the exegesis of the constitutional principles of the right to life and the right to healthcare. Their constitutional form, interpretation resulting from the rulings of the Constitutional Tribunal and the ordinary legislation have been presented. The author indicates the main terminological deficiencies identified in this respect: the lack of any definition of the beginning of a human being, the existence of two separate criteria for determining death, which could lead to different results and the lack of an unambiguous definition of disease adopted by the legislator. Based on the concepts presented in the case, the right to healthcare has been defined as a legal right resulting from the right to life. The final thesis is that there are no grounds for hierarchizing these rights, as they are intertwined in content and function.

This paper offers a retrospective narrative review of research on L2 writing strategies and a prospective discussion of potential theoretical and pedagogical relevant lines of inquiry to be explored in future research agendas. The retrospective analysis will synthesize the main trends observed in the conceptualization of writing strategies as well as central directions followed in empirical research in the domain. The prospective discussion tries to advance research agendas on the basis of several observations about L2 writing that are presented as key points to be considered when analyzing existing or thinking about future research in the domain. Special mention will be made of future research avenues centrally concerned with theoretical and empirical questions on the manner in which strategic behavior during writing and during written corrective feedback processing may foster language learning. It will be suggested that following this route can result in interesting and profitable synergies between research on language learning strategies and recent SLA-oriented L2 writing research initiatives on the language learning potential associated with L2 writing.

The article aims to indicate the most important issues facing an individual wishing to protect his or her privacy on the Internet. It also describes the evolution of the concept of the right to privacy, which over the years has become one of the most important subjective rights reflected both in the Polish Constitution and in the legal acts of the Council of Europe and the European Union. The text also demonstrates the approach to the issue of the right to privacy taken by both the Polish constitutional and international judiciary. The European Court of Human Rights in Strasbourg, in the cases of Dupate v. Latvia and Brother Watch and others v. United Kingdom, dealt with both the publication of photographs of a public figure taken surreptitiously in a private situation and mass surveillance. The Court of Justice of the European Union in Luxembourg, in its judgments, has often referred to the issue of the protection of telecommunications data, including the question of access by state services to such data (H.K case) and the rights and obligations created by Articles 7 and 8 of the Charter (Kärntner Landesregierung and Digital Rights Ireland Ltd case). The European Union authorities, reacting to the increasingly widespread problem of data flows on the Internet, decided to enact the General Data Protection Regulation (GDPR). The article describes the most important objectives and tasks to be fulfilled by this legal act. In addition, the main problems associated with the use of new technologies such as cybercrimes, cyber surveillance, data theft, as well as cryptojacking and the functioning of APTs (Advanced Persistent Threat), i.e. skilled hacking groups, are also indicated.

The article presents the issues of legal regulation of termination of pregnancy in the context of the jurisprudence of the Constitutional Court (CC), in particular the ruling in the case K 1/20.The discussion opens with an analysis of models of abortion practices regulations, as well as the solutions adopted in the Polish legal system, with a short historical introduction. It is emphasized how important is the issue, which results from the fundamental differences in worldviews between the supporters and opponents of the permissibility of the practice of termination of pregnancy, which is expressed in the name given to this medical practice.The right to life as an element of the human rights system is discussed, both in terms of international law and the provisions of the Polish constitution.Next, the Polish provisions on the admissibility of termination of pregnancy are presented along with a historical outline, with particular emphasis on the ruling in the case K 26/96. Based on the above discussion, the resolution in the case K 1/20 was discussed, in which the CC found the so-called embryopathological premise for termination of pregnancy to be incompatible with Polish Constitution. A polemic with the justification of the decision is presented, including the errors of interpreta-tion committed by the CC with regard to the constitutional and international form of the right to the protection of life. It is indicated that in the Polish legal system only the right to protection of life exists, not the right to life, which is referred to both by the CC and most of the doctrine.Despite the fact that this resolution does not remove the norm from the legal system, the author draws attention to the practical consequences of issuing it, in particular the occurrence of the so-called ‘chilling effect’ and unjustified activity of the law enforcement authorities.The final part of the article presents conclusions on how to legally regulate the termination of pregnancy.

The right of access to public information is one of the fundamental constitutional civil rights in the Polish legal system. Its rules on practical implementation regulate the law of access to public information. With the increase of civic awareness among citizens there also follows a growth in applications for access to public information. This has caused a range of problems and doubts in interpretation, which local government bodies haveto contend with when dealing with submitted applications. In this article the author presents the most common problems which local government bodies must face in practice.

While Isocrates regarded rhetoric not as a rigid discipline, but as a creative and pliable art, it is not possible to standardize art. According to his point of view (Against the sophists 13.13), good speech depends on certain principles: opportunity (kairos); suitability (to prepon) and novelty (kainos). The sophists, according to Isocrates, did not pay attention to these principles, and that was their main mistake. The problem was, however, that it was difficult to teach these principles to the disciples, precisely because rhetoric was a flexible art. Still, although it is not possible to provide fixed rules concerning rhetorical principles, the ancient rhetor provided some useful suggestions in his works which make it possible to reconstruct the nature of these principles.

The article aims to examine older learners’ points of view concerning their in-class will- ingness to communicate (WTC) in English and to identify their expectations regarding an English teacher. The instrument was a questionnaire that comprised – among others – of questions referring to variables that could exert an impact on third-agers’ WTC in English in class. The factors which were used as options in the closed and open-ended questions in the study had been identified by the third agers as the ones that positively or negatively shaped their in-class WTC in an earlier piece of qualitative research (Borkowska 2021a). The data analysis revealed that the informants (63 older participants) reported an eagerness to communicate in English, and they perceived speaking with the teacher as the most motivating type of interaction. The most crucial components of language instruction that boosted older adults’ WTC was gentle error correction, a friendly atmosphere, and teacher support that seemed to have a positive effect on their lower self-esteem. Similarly, an empathetic and patient instructor could be of great help in diminishing seniors’ self-depreciating views. In contrast, negative teacher attributes (e.g., anxiety, criticism) could lead to inhibiting the older participants’ WTC and active involvement during English classes.
Celem niniejszego artykułu jest przedstawienie wyników badania ilościowego doty- czącego gotowości komunikacyjnej (GK) osób w późnej dorosłości w języku angielskim w klasie językowej. Narzędziem badawczym była ankieta zawierająca m.in. pytania odnoszące się do czynników mogących mieć wpływ na kształtowanie GK w języku angielskim. Zmienne użyte do pytań zamkniętych opracowane zostały na podstawie wcześniejszego badania jakościowego (Borkowska 2021). Analiza danych pokazała, iż respondenci (63 starszych dorosłych) byli chętni do komunikacji w języku angielskim, a najbardziej motywującą formą interakcji była rozmowa z nauczycielem. Fundamentalnym czynnikiem, który pozytywnie wpływał na GK, była delikatna poprawa błędów, przyjacielska atmosfera oraz wsparcie nauczyciela. Cierpliwość i empatia ze strony nauczyciela to cechy, który pomagały obniżyć poziom samokrytycznych poglądów senio- rów. Natomiast, negatywne cechy instruktora (tj. niepokój, krytyka) prowadziły do zmniejszenia angażowania starszych dorosłych w komunikację podczas zajęć.

All judicial proceedings are inevitably based on the formalized procedures. Procedural provisions pursue many important objectives, such ensuring the effectiveness of proceedings or protecting legal certainty by regulating the competences of procedural bodies and the rights and duties of parties. At the same time, excessive procedural formalism may disproportionately limit the right to court, making access to court illusory. Within the framework of the European Convention on Human Rights, the permissible limits of procedural formalism are set by Article 6(1). The European Court of Human Rights, assessing whether excessive formalism has occurred in a given case, examines whether relevant formal requirements served a legitimate purpose, in particular legal certainty and proper administration of justice, and did not lead to a disproportionate restriction of the right of access to court. This assessment is made on the basis of all relevant circumstances of the case, such as the stage at which the proceedings were terminated, the type of proceedings, the party’s due diligence, the existence of circumstances justifying failure to comply with a formal requirement or the fact that the party was represented by a professional representative. Therefore, not only the content of national provisions is important, but also the manner of their application by courts.

The article focuses on the socio-spatial accessibility of the city, taking into account the phenomenon of a digitally expanding urban environment: new-media mobility conditions, intermedia dataflow, hybrid space. Therefore, turning to the problem of access and to urban mobile applications complements the problem of access to the city itself. Particular attention is focused on mapping applications, considering mapping as an expression of active city exploration “from the inside” and the process of cooperative spatial knowledge production, characterized by a critical approach. Urban mapping applications dedicated to people with disabilities can be not only a form of support when they move around the city, but also a kind of tool for co-shaping urban space – exposing inequalities and seeking ways to deconstruct socio-spatial “normalization”. In this perspective, people with disabilities, taking advantage of the new spaces of mobile accessibility, place themselves in the role of political subjects, co-creators of space, “mapping citizens” fighting for their rights as urban citizens.

The author of the article analyses eights passages from the Gospel according to St. John which contain quotations from the Book of Psalms. The quotations come from Ps 22,19 (Jn 19,24), Ps 41,9 (Jn 13,18), Ps 69,5 (Jn 15,25), Ps 69,10 (Jn 2,17), Ps 69,28 (Jn 19,28); Ps 78,24 (Jn 6,31), Ps 82,6 (Jn 10,34) and Ps 118,26 (Jn 12,13). As a result of the undertaken inquiry the author states that all the quotations from the psalms were reinterpreted in a specific theological perspective. The author of the Fourth Gospel was not interested in the meaning of the quotations in their original context but rather in the Christological thought embedded in them. From those psalms, read in a Christological key within a new context, emerges an image of Jesus who is the Son of God in an absolute sense (Ps 82,6), the Messianic King (Ps 118,26), who despite unjustified hatred on the part of the world (Ps 69,5), unbelief on the part of some of His interlocutors (Ps 78,24) and His awareness of the hostility of one of His disciples (Ps 41,10), zealously fulfills the Father’s plan (Ps 69,10), surrendering himself to all the humiliations (Ps 22,19) and tribulations of salvific passion (Ps 69,22). It should also be underscored that many exegetes interpret the content of those quotations not merely literally, i.e. by linking them to historical events, but expound their deeper spiritual sense.

An epidemic caused by the coronavirus SARS-CoV-2 has been existed in Europe and worldwide for several weeks now. On 11 March 2020, the WHO declared it a global pandemic. At the time of writing, Europe, in particular Italy, is the largest outbreak of coronavirus. Italy is attempting to tackle the virus with increasingly drastic legal measures. On 31 January 2020, its Council of Ministers declared a state of emergency related to the sanitary risk of coronavirus infection. Italy has started the fight against the virus using two legal instruments: the first is the Council of Ministers’ declaration of a six-month state of emergency on 31 January 2020, and the second is a decree-law (decreto legge) issued by the Prime Minister temporarily restricting the freedom of movement throughout the state. In exceptional cases, the Italian Government has the right to issue normative legal acts. Recent legislative acts issued in Italy have undoubtedly limited the fundamental rights granted by the Constitution of 1947. These limited rights include the right of movement, but also freedom of assembly, the right to work, freedom of economic activity and freedom of conscience and religion. As a result of the legal solutions introduced, fundamental human rights are subject to justifiable restrictions in order to protect the constitutionally guaranteed right of the community to health care. In situations of epidemiological threats, protecting the lives and health of citizens is essential. Any restrictions on rights and freedoms are intended to protect these goods. However extensive these restrictions may be, in a democratic state this must be introduced under strict control and for a specified period of time linked to the duration of an epidemic.

The paper follows the numerous debates on the importance of philology that have started to emerge in the 1980s, beginning from Paul de Man’s essay Return to Philology. The assumption is that despite obvious devaluation of its importance and institutional ruination, philology survives precisely because the idea of a return is inherent in it. However, as the return is in this context grasped as the return of the repressed, it is claimed that philology survives as a paradoxical discipline whose epistemological power seeks to be represented by the figure of a specter and within hauntology, as Derrida introduced it in his works. It is argued that philology today draws strength precisely from its openness to disciplinary hybridity, institutional uncertainty, and continuous rethinking of its own social role. In conclusion, the work of Vatroslav Jagić, one of the greatest Croatian philologists and world-renowned representative of Slavic philology, whose understanding of the task of philology relates to the theses presented in the paper, is included in the discussion and introduced in the dialogue.
