Opis:
On the basis of results of the contemporary researches realised according to the spirit of critical and emancipatory pedagogics a school appears not only as a very important, valuable environment of development, but unfortunately also as a place that generates different threads. In the article one has tried to show a significance of the mainstream school as an environment of discovering attitudes of one’s own identity by the pupils with a disability at an early school age. Referring to the numerous empirical studies, one has performed a school discourse in order to show up discrimination practises in relation to this group of pupils. A critical analysis is accompanied by an attempt to indicate good practices of the socialising processes realised with regard to this group of persons in the mainstream school. A hope of the positive change is arisen by a Jarome S. Bruner’s postulate to develop and implement a new, cooperative, educational culture of the school in which all subjects are concentrated on the common solving problems and launching a mutual learning process.

Children with disabled siblings grow up in specific conditions. The case study presents the profile of a young woman living with a disabled brother. Because of her family situation she has become very understanding and tolerant of people with disabilities. She has no fear of the need to help them, is very responsible and has a sense of duty to such people. However, on the negative side, the woman is afraid of the genetic determinants of the disease and fears to start her own family. She is also afraid that her husband might have a negative attitude towards disability and she has ambivalent feelings about taking over the care of her brother.

The paper presents the issue of social transmission by Kazakh parents concerning disability, especially their knowledge of disability and content of conversations with their children. Diagnostic survey method, survey technique and the author's questionnaire with open-ended questions were used. The analysis of content of the written statements shows that the parental message in the inclusive group compared to the general population more strongly emphasizes the attitude of tolerance and nondiscrimination of the disabled peer. Research confirms the impact of social context on the knowledge, attitudes and the image of a person with a disability and these results are consistent with those of other authors.

Artykuł porusza problem regulacji pełnienia funkcji członków w organach zarządzających spółek. Przesłanką przeprowadzenia badań była okoliczność w postaci braku przyjęcia przez państwa europejskie jednolitego modelu w przedmiocie dopuszczenia osób prawnych do pełnienia funkcji członków w organach zarządzających spółek. Nieudaną próbą takiej regulacji była V Dyrektywa Spółek. Celem badań jest porównanie wybranych systemów prawnych oraz ukazanie potencjalnych skutków dopuszczenia osób prawnych do pełnienia funkcji członka zarządu, a także odpowiedź na pytanie, czy konieczne jest ujednolicenie regulacji w tym aspekcie na poziomie europejskim. Powyższą analizę przeprowadzono przede wszystkim przy wykorzystaniu metody dogmatycznoprawnej oraz prawnoporównawczej. Badania wykazały, że w niektórych systemach prawnych obecność osoby prawnej w organie zarządzającym spółki jest powszechnie dozwolona – przykładowo, taką sytuację dopuszczają prawodawcy francuski, belgijski oraz brytyjski, jednakże prawodawstwo tych państw nie jest w tym aspekcie jednolite. Z kolei w Niemczech czy Polsce pełnienie funkcji członka zarządu przez osobę prawną jest zabronione z mocy samego prawa. Autor formułuje tezę, że brak jednak konkretnych podstaw do ujednolicania opisywanego mechanizmu na poziomie europejskim. Poczynione ustalenia można uznać za istotne w kontekście ewentualnej nowelizacji polskiego Kodeksu spółek handlowych i dyskusji o możliwości wprowadzenia do polskiego prawa regulacji dotyczącej zdolności osób prawnych do pełnienia funkcji członka organów spółki.
The article discusses the issue of regulations governing the roles of members in the management bodies of companies. The rationale for conducting the research was that European countries have not adopted a uniform model regarding the participation of legal entities in the management bodies of companies. An unsuccessful attempt at such regulation was the Fifth Directive on Companies. The research aimed to compare selected legal systems and emphasize the potential consequences of allowing legal entities to hold positions on the management board, as well as to address the question of whether the standardization of regulations pertaining to this issue is necessary at the European level. This analysis was primarily conducted using the legal dogmatic and comparative legal methods. The research demonstrated that in some legal systems the presence of a legal entity in the management body of a company is widely permissible – for instance, this is allowed by the French, Belgian, and British legislators, although the legislation of these countries is not uniform in this aspect. On the other hand, in Germany and Poland the participation of legal entities as members of the management board is prohibited by the law itself. The author formulates the thesis that there are no specific grounds for harmonizing the described mechanism at the European level. The conclusions drawn can be deemed significant in the context of a potential amendment to the Polish Commercial Companies Code, which could reignite the discussion about the possibility of introducing regulations concerning the capacity of legal entities to hold positions in a company’s management bodies.

Opis:
Considerations about the role of film in the life of a young person relate to the functions, which he serves with stress being put on the didactic targets that it can serve. As an example, three film productions were presented – two feature films and one documentary (‘Klub Winowajców’, ‘Powiedz prawdę, przecież cię nie biję’, ‘Dziennik.pl’) of which the main characters are young people and are mostly aimed at young people. Those propositions can form a starting point for a discussion with the youth about e.g. itself; the environment in which it lives; relations with others (parents, contemporaries, teachers).

Nowadays, social changes include the perception not only of disability itself, but also of a family with a disabled member. These changes concern the organisation of support for the family, which functions in the entire social ecosystem, including the closest social groups, e.g., the neighbourhood. Although this neighbourhood, which is also subject to changes, can become an invaluable source of support, unfortunately, it may also become an environment that contributes to the social exclusion of a family. In this paper, the author presents selected aspects of the co-existence of people with disabilities and their families with their neighbours. The paper used research on opinions about being the neighbour of a family with a disabled person, which included declarations of help or support really offered. The author asserts that a family with a disabled person can experience both positive and negative attitudes and behaviours from neighbours.

The aim of the article is to present the issues of parenting of people with visual disabilities as a factor that dynamizes development, against the background of selected interdisciplinary contexts (psychological, functional, pedagogical). The sphere of personality-emotional development was presented through a psychological context. The functional sphere is represented by the functional context, and the development in the cognitive area has been based on the pedagogical context. The study was summarized indicating areas requiring scientific penetration in the social context of the functioning of the parental practice of the blind and visually impaired. The text was based on the method of descriptive and critical literature analysis.

The article presents the reflections on the potential invalidity of an administrative decision of a public administrative body as a result of the conviction of a person performing a function for an offence under Polish law. Firstly, the author analyses the legal situation of a person convicted for an offence under the Election Code (Kodeks wyborczy), the Act on Self-Government Employees (Ustawa o pracownikach samorządowych) and the Labour Code (Kodeks pracy). He examines in detail the discrepancies between the three legislative acts which may influence the legal position of a convicted person. The conclusion is that a person with the final and valid judgment for intentional offence prosecuted by public indictment to a fine or to penalty of imprisonment retains a passive electoral right in the elections for the mayor, however it seems that under the Act on Self-Government Employees it will not be possible to establish an employment relationship with such a person to work in the capacity of a self-government employee based on election. Secondly, the author analyses the potential invalidity of administrative decisions issued by a person convicted for an offence. The two conditions that could be taken into account as grounds for declaring the invalidity of an administrative decision in the context of the conviction are: a lack of jurisdiction of the authority as a condition of declaring the invalidity of a decision and a gross breach of law as a condition of declaring invalidity of a decision. The analysis of the selected conditions leads to a conclusion that there are no grounds for declaring the invalidity of a decision, as the regulations on jurisdiction will not be breached and the decision will not be issued in gross breach of law. Therefore, even if one were to consider that under the Act on Self-Government Employees a given person cannot be a self-government employee, it seems that this does not prevent the issuance of administrative decisions.

Celem artykułu jest ustalenie, w jaki sposób przebiega sądowa ocena zasadności przyjęcia osoby z zaburzeniami psychicznymi do szpitala psychiatrycznego z perspektywy spełnienia przesłanek psychiatryczno-psychologicznych oraz przesłanek formalnych. Podjęte rozważania koncentrują się wokół analizy przesłanek przyjęcia do szpitala psychiatrycznego w tzw. trybie nagłym i obserwacyjnym. Badania aktowe przeprowadzono na terenie okręgu Sądu Okręgowego w Poznaniu i objęły one sprawy z lat 2018–2020. Wyniki badań pokazały, że konieczne jest wprowadzenie zmian legislacyjnych polegających m.in. na wprowadzeniu ustawowego terminu, w którym sąd obowiązany jest wydać orzeczenie w przedmiocie zasadności albo braku podstaw przyjęcia do szpitala psychiatrycznego, a także znowelizowaniu art. 23 ustawy o ochronie zdrowia psychicznego w taki sposób, aby przyjęcie do szpitala wymagało zatwierdzenia przez ordynatora (lekarza kierującego oddziałem) w ciągu 24 godzin od chwili przyjęcia, a kierownik szpitala zawiadamiałby o powyższym sąd w ciągu 72 godzin od chwili przyjęcia.
The purpose of the article is to determine how the judicial evaluation of the appropriateness of admitting a person with mental disorders to a psychiatric hospital is carried out, from the perspective of meeting psychiatric-psychological and formal prerequisites. The considerations undertaken focus on the analysis of the prerequisites for admission to a psychiatric hospital in the so-called emergency and observation mode. The file research was carried out at the district court in Poznań and included cases from 2018–2020. The results of the research showed that it is necessary to introduce legislative changes consisting, among other things, in the introduction of a statutory deadline within which the court is obliged to issue a decision on the validity or lack of grounds for admission to a psychiatric hospital; as well as the amendment of Article 23 of the Act on the Protection of Mental Health in such a way that admission to a hospital would require approval by the head of the ward (the doctor in charge of the ward) within 24 hours of admission, and the head of the hospital would notify the court of the above within 72 hours of admission.

Over the past four decades of research on school bullying have produced an extensive body of knowledge about the nature of this phenomenon, its determinants and consequences. Bullying has been examined and explained in individual as well as in contextual terms, and from a wide range of different theories and research methods. In the literature, it can be found some attempts to sort out scientific approaches to bullying.In this article, which should be treated as review-style essay, I will present two complementary approaches to analyzing school bullying, namely (1) person-oriented analytical approach which focuses on analyzing of individual traits and characteristics of children involved in school bullying, and (2) processual analytical approach that emphasizes the processes involved. These approaches were distinguished based on the review of Polish and foreign literature on school bullying.

The article analyzes the zoophraseologisms to denote a lazy and a hard worker. It was found that the images of a bee, a horse (in all studied languages), a donkey (the Ukrainian language), a bull, a louse (the Russian language), and an ant (the Polish language) were used in the phraseology for a positive description of person. Laziness and idleness in phraseology personify the images of a cat (in all studied languages), a bird, a louse (Polish and Ukrainian languages), a drone (Ukrainian and Russian languages), a donkey (the Russian language), a dog, a hen (the Ukrainian language). Ambivalent connotations in phraseology have images of an ox (in all studied languages), a dog (Polish and Russian languages), a hen, a donkey (the Polish language). Negatively colored phraseologies prevail over positively ones. In most cases, the semantics of phraseology is related to the way of life of animals, which people perceive it, to a lesser extent – the plots of fairy tales, pagan traditions, culinary and hunting practices. Decoding of some phraseologies is complicated by the homonymy of animal names.
