The Author concludes that the Rules Deputies’ and Immunity Affairs Committee should not continue to examine application request of the subsidiary prosecutor after the court of appeal has finally dismissed the criminal proceedings. It should be assumed that revoking of a valid procedural decision terminating these proceedings will give rise to the necessity of submitting a new application for waiver of immunity. An entity that submitted an application for waiver of immunity may freely dispose of it until the Sejm adopts a resolution regarding the consent to bring the Deputy to criminal accountability or until the Deputy’s submission of the statement referred to in Article 105 para. 4 of the Constitution.

The opinion is an answer to a question submitted by the Marshal of the Sejm, whether a former Deputy is still entitled to immunity protection in case of acts committed within the scope of the mandate. According to the author, the former Deputy (or a Senator) may be held responsible for actions violating rights of the third persons which took place during the exercise of the mandate of that Deputy, but only upon a permission of an appropriate house of Parliament. The author notes that the loophole in legislation should be filled by an amendment.

The author indicates that the legal structure of the Polish immunity regulations excludes the possibility of adopting a resolution by the Sejm on giving consent to bring several deputies to responsibility. In each individual case, the Sejm should consider a separate motion and adopt a separate resolution. Referring to the principle of discontinuity, the author concludes that regarding the two former Deputies, new motions for consent to bring them to a civil law liability should be submitted, while in the case of a Deputy holding a mandate also in the 9th term, the proceedings on the motion concerning him should be continued.

The author states that a Deputy does not have an obligation to make available document received from a private person, regardless the content of the document. Parliamentary immunity, according to the author, does not release the Deputy from an obligation to testify as a witness or does not release the Deputy from an obligation to provide public authorities with a document which may serve as an evidence. However, pursuant to Article 21 the Act on the Exercise of the Mandate of a Deputy or Senator, the Deputy might refuse to provide information about a person who has provided an information to a deputy. This principle applies to civil procedure, criminal procedure and other investigative procedures that include an obligation to testify. The scope of this privilege contains also the possibility of refusing to issue a document received within limits of exercising of the mandate whose content would reveal information of a deputy’s informer.

The application concerns a person who held the mandate of a Deputy during the seventh term of the Sejm, but is not currently a deputy. According to the art. 105 paragraph 1 sentence 2 of the Constitution, a Deputy may be brought to a court accountability for action violating the rights of third parties, which have been taken within the scope of the mandate, only upon the consent of the Sejm. This rule applies to a possible court accountability of former Deputies concerning acts committed in the course of exercise of their parliamentary mandate. The subject of the resolution adopted by the Sejm must include a whole set of behaviors constituting a persecuted act, regardless of whether all behaviors are within the scope of the mandate. Content of the application meets the required precision only with regards behaviors belonging to the third group of activities. The behaviors of the first and second group have been indicated in the application in a very general way, what means that the application does not meet the requirement under art. 7b paragraph 4 Section 4 of the Act on performance of the mandate of Deputy and Senator.

The author analyzes the possibilities and consequences of the disclosure of classified information by a person covered by the motion for waiver of immunity at a sitting of the Sejm, in the course of examination of the motion. He claims that a person to whom the motion to waive immunity pertains is entitled to comment the information contained therein, including the use of classified information, insofar as they relate to the circumstances of the case and the allegations formulated in the motion. This is a guarantee of the right to defence in the course of proceedings relating to waiver of immunity. The author points out that such proceedings must respect basic procedural standards and, in particular, take into account the constitutional right to defence.

In the opinion of the author, the scope material immunity includes the fulfilment of Deputy’s obligation to inform voters about the work of a parliamentarian and about the activities of the body to which he or she was elected. This obligation may be fulfilled through a direct information to voters at meetings with them as well as through the media. The scope of formal immunity is covers the Deputy’s responsibility for an infringement of the rights of third parties by means of informing voters about his work and the activities of the Sejm. In the light of the Supreme Court’s findings, it can be assumed that suing a Deputy to a civil court for infringement of personal rights in a statement made at a press conference in which he or she reports on his or her activities falling within the sphere of the execution of the parliamentary mandate, requires a prior consent of the Sejm.

In the opinion it was stated that although examining identity documents is associated with a temporary restriction of freedom of a Deputy by an authorized body, it does not constitute a violation of the privilege of parliamentary inviolability. Undertaking Deputy’s activities related to the exercise of the mandate in a border zone, does not require an appropriate consent. The privilege of inviolability does not absolve the Deputy from the obligation to respect the law. As a rule, a Border Guard officer cannot detain the Deputy during performing activities falling within the scope of the parliamentary mandate in the border zone. Deputies may be detained only in the event of joint fulfillment of requirements provided in the Article 105 para. 5 of the Constitution.

Opis:
A dominant view that a foreign state uses immunity in court examination of civil law cases deserves acceptance. This is the so-called limited immunity. The immunity of a foreign state in court examination of civil law cases and matters related to its examination should not be regulated in domestic law, including the Code of the Civil Procedure. Solutions for pursuing claims before national courts from a foreign state cannot be limited only to the issue of regulation of state immunity and the possibility of its waiving by the foreign state, but they also should cover issues related to the subsequent execution of a judgement delivered in such proceedings.

A Deputy, after the expiry of the mandate, is still entitled to legal protection based on art. 105 paragraph 1 sentence 2 of the Constitution. This means that even after the expiry of the mandate, the Deputy may be prosecuted for an act violating the rights of third parties upon the consent of the Sejm. The Sejm is obliged to examine the application for permission to hold Deputy responsible for the activities within the scope of the mandate (to waive the immunity of a Deputy), whose mandate has expired, provided that the application complies with the formal requirements described in the Act on Exercise of the Mandate of a Deputy and Senator.

Opis:
The author claims that applications for waiving the so‑called formal parliamentary immunity (Article 105 para. 2 of the Constitution) are examples of information about the activities of organs of public authority, regulated by Article 61 of the Constitution (public information). Therefore each citizen possesses the right to acquire access to such applications. However, it does not mean that each of applications may be disclosed. In some cases applications may include information that may be classified as secret under the relevant legislation or whose disclosure would violate the constitutional right to privacy. In case it happens, an application cannot be disclosed – due to the prohibition of granting access to such information provided by Article 5 of the Act on Access to Public Information.

A former Deputy to the Sejm of the Republic of Poland, and at the same time a former member of the Parliamentary Assembly of the Council of Europe (PACE), cannot be held responsible to the Sejm. Potentially, bringing the above-mentioned person to a criminal liability may be considered, because, according to the author, in the analyzed case, that person was not protected by immunity privileges granted under international law to the members of PACE. A possible launch of this type of legal responsibility would, however, require determining of a few strictly criminal-law matters described in the opinion.

Opis:
State immunity is based on the principle of sovereign equality of all states which is one of the main principles of international legal order. Predominant jurisprudence of national courts as well as international courts and tribunals follows the position that in case when a claim is submitted in a court in the forum-state due to war crimes and crimes against humanity, a foreign state possesses state immunity which excludes jurisdiction of national courts. There is a strong tendency in international law to limit state immunity and exclude from its scope claims concerning the aforementioned crimes, in case they were committed on the forum-state’s territory). However the International Court of Justice assumed that the immunity is of a procedural nature and it has to be evaluated in each case on the day of adjudication. Hence, in future cases relating to war crimes and crimes against humanity may be considered in forum-state’s courts.

In the light of existing international law it is not possible to hold the Minister of Defense of the Russian Federation criminally or civilly responsible before the courts of other countries (except for an action before the Russian courts) or the International Criminal Court. Claiming compensation from the Russian Federation for shooting the Malaysia Airlines aircraft is available before the Russian in compliance with Russian law, or before international courts only through interstate litigation, provided that the parties agree to accept the jurisdiction of the International Court of Justice or international arbitration and that the preconditions of responsibility are fulfilled. Claiming is also possible in the context of diplomatic protection, and – in case of actions by individuals against Russia – only before the European Court of Human Rights, after exhaustion of domestic legal remedies and demonstrating that Russia has committed a violation of the rights protected by the European Convention of Human Rights of 1950.
