    Opis:
    To identify the main differences prevailing in public-private partnership agreements included in individual sectors of the economy. The study is based on a comparison of 135 public-private partnership contracts concluded until the 31st of July 2019 in various economic sectors. The components of PPP proceedings were analysed that is type of entity, voivodship, duration of the contract period, implementation status, legal basis for the selection of the private partner, and gross investment expenditure. The data has been compiled by sector, which allows a broader view of the PPP aspect as a specific form of public procurement implementation. Descriptive statistics, standardization of variables and Spearman's rho correlation coefficient were used to conduct the study. The most diverse voivodships are the Masovian voivodship and the Pomeranian voivodship, in which PPP covers as many as 9 different areas. In all sectors, except for energy efficiency, where the only legal basis was PPP in PZP (Article 4. paragraph 2), there was diversity in the choice of a private partner. As for the type of contracting entity, municipalities are the only contracting entity in the following sectors: education, water and sewage management, housing, revitalization. There are many PPP analyses in the literature on the subject, but they do not refer to the sector analysis including the main components of the contracts included in the PPP.

    Od 2009 roku wraz z obowiązywaniem nowych regulacji prawnych, można zauważyć wzrost zainteresowania partnerstwem publicznoprywatnym. Celem rozdziału jest ocena stanu i perspektyw rozwoju współpracy opartej na partnerstwie publiczno-prywatnym w Polsce w latach 2009-2016. Na podstawie danych wtórnych scharakteryzowano liczbę ogłoszonych wszczętych postępowań, realnych projektów, zawartych, rozwiązanych i niezrealizowanych umów, a także postępowań w toku. Prócz tego wzięto pod uwagę rodzaj podmiotu publicznego biorącego udział w formule partnerstwa publiczno-prywatnego, strukturę sektorową rynku PPP oraz inne kryteria.
    Since 2009, with the new regulations, increased interest in publicprivate partnership can be noted. The aim of the chapter is to evaluate the state and prospects the development of cooperation based on public-private partnership in Poland in 2009-2016. On the basis of secondary data, the number of announced proceedings, real projects, concluded, resolved and unrealized contracts were characterised, as well as proceedings in progress. Moreover, the type of public entity involved in PPP, sectoral structure of the PPP market, and other criteria were taken into account.

    Opis:
    W artykule przeanalizowano problemy wynikające z prawnych uwarunkowań zaopatrzenia w energię elektryczną oraz zaprezentowano model ich rozwiązania wraz z wdrożeniem systemu zarządzania oświetleniem. Model ten, zrealizowany na podstawie formuły partnerstwa publiczno-prywatnego, porządkuje relacje właścicielskie, doprowadzając do stanu, w którym zadanie własne gminy jest realizowane wyłącznie przy wykorzystaniu mienia gminy. Artykuł jest oparty na doświadczeniach własnych autora w projekcie realizowanym w gminie Radzionków.
    The article analyzes problems arising from the legal conditions of supply of electricity and present a model to solve them with the implementation of lighting management system. The model of solving them together with the implementation of lighting management system have been presented as well. The model, which has been realised in compliance with the public-private partnership formula, organises ownership relations, which leads to the situation in which the commune's own task is realised exclusively in compliance with the commune's property. The article is based on the author's own experience in the project realised in the Radzionków Commune.

    Celem artykułu jest analiza strategicznych partnerstw publiczno-prywatnych w zakresie działalności badawczo-rozwojowej i innowacyjnej. Partnerstwa te opierają się na długoterminowych zobowiązaniach finansowych podmiotów publicznych i prywatnych do prowadzenia prac badawczo-rozwojowych i innowacyjnych ukierunkowanych na przezwy-ciężenie wyzwań lub problemów społeczno-gospodarczych określonych przez partnerów we wspólnej agendzie lub programie. W artykule przeanalizowano podobieństwa i różnice między strategicznymi partnerstwami realizowanymi na poziomie europejskim i narodowym (Holandia, Wielka Brytania, Polska) oraz omówiono główne wyzwania związane z ich realizacją, w szczególności korzyści i zagrożenia dla przedsiębiorstw. Omówiono również możliwości wykorzystania strategicznych partnerstw w krajowej polityce innowacyjnej i zaproponowano kierunki dalszych badań dotyczących partnerstw strategicznych.
    The aim of the article is to analyse strategic public-private partnerships in research and development and innovation. The partnerships are based on long-term financial commitments of public and private partners regarding research, development and innovation activities aimed at overcoming challenges or socio-economic problems. The main similarities and differences between strategic partnerships implemented at the European and national level (the Netherlands, Poland, the United Kingdom) were analysed and the main challenges related to their implementation, in particular the benefits and threats for enterprises. The article propose the modification of the definition and characteristics of strategic partnerships, analyse the possibility of using strategic partnerships in national innovation policy as well as directions for further research related to the management of strategic partnerships.

    Umowa o partnerstwie publiczno-prywatnym ma kluczowe znaczenie dla prawidłowej realizacji przedsięwzięcia, jednakże ustawa o partnerstwie publiczno-prywatnym w ograniczonym zakresie normuje zarówno samą umowę o partnerstwie, jak i umowę przenoszącą prawo własności składnika majątkowego jako wkładu własnego. Prawidłowa ocena sytuacji prawnej wymaga zatem wykładni przepisów kilku aktów prawnych i określenia ich wzajemnego stosunku. Artykuł wskazuje jakie regulacje i w jakim zakresie powinny być stosowane w przypadku wnoszenia wkładu w postaci nieruchomości, polegającego na przeniesieniu jego własności.
    The public-private partnership agreement is of key importance for the proper realization of the undertaking, however the Public-Private Partnership Act to a limited extent norms both the partnership agreement itself and the contract transferring the ownership of the property as own contribution. A correct assessment of the legal situation therefore requires an interpretation of the provisions of several legal acts and the determination of their mutual relationship. The article indicates what regulations and to what extent should be applied in the case of making a contribution in the form of real estate, consisting in the transfer of its ownership.

    Opis:
    Purpose: The main aim of this paper is to analyze political instability as a risk factor for public-private partnership (hereinafter: PPP) project success on the case of the 1992 Hungarian M1/M15 motorway project. Furthermore, it also examines the project success framework and critical success factors in PPPs, as well as project risk division and proper risk allocation. Design/methodology/approach: The text includes a review of relevant literature in the field of political instability and risk management pertaining to PPPs, in combination with a case study illustrating the impact of political instability on a PPP project. Findings: The findings of the case study suggest that Hungary’s institutions at the time of the project did not offer the necessary safeguards against governmental abuse of bargaining power. Independent courts are essential for the success of public-private partnerships, in combination with an emphasis on the protection of property rights and the rule of law. A well-functioning institutional and legal framework offer protection against the failure of public-private partnership projects and constitute a critical success factor for PPPs. Practical implications: Despite growing social infrastructure investment needs, PPP is not developing in accordance with expectations in the majority of developing and emerging economies. Political stability is an essential factor in any development process and happens to be one of the most distinguishing factors between developed and developing countries, in which PPP schemes are underutilized despite an enormous potential for more private sector involvement. Countries lacking independent courts may strongly benefit from alternative dispute resolution procedures. The retention of a larger amount of project risk by the public party may additionally prove to be helpful for the development of PPP markets in nations lacking institutional and political stability. Originality/value: The research problem identified in this paper concerns the implications of political instability – a global phenomenon of growing significance, on the success of PPP projects. The obtained results may be of interest to representatives of science and practice, especially with regards to developing countries, as well as emerging economies.

    W artykule scharakteryzowano wybrane instrumenty i źródła finansowania, które mogą znaleźć zastosowanie w działaniach rewitalizacyjnych dotyczących terenów przekształconych antropogenicznie na obszarach gmin górniczych. Skupiono się na analizie możliwości ich wykorzystania przez jednostki samorządu terytorialnego, jak również prywatnych właścicieli i potencjalnych inwestorów zainteresowanych rewitalizacją tego typu terenów.
    The article presents characteristics of selected instruments and sources of financing that can be used in activities concerning revitalization of anthropogenically transformed areas in the mining communities. An analysis was focused on the assessment of their usefulness for local governments, as well as private owners and potential investors interested in revitalization of such areas.
