    This text is a contribution to the discussion on the reform of higher education in Poland. By referring to selected examples, it shows that the planned changes are based on several fundamental myths resulting from the inefficiency of earlier attempts to heal the university system. At the same time, it aims to show why it is necessary to abandon the belief that higher education can be reformed quickly, with little financial outlays, and that the results of the implemented changes can be instant. The text offers also a criticism of the view assuming that the expected changes can be arrived at only through a reform of the law, and that it is possible to transplant solutions functioning in other countries directly to Poland. The presented considerations oppose the position according to which there exist some ideal models of education and research, whose implementation can make it possible to “breed” an ideal scholar. Arguing that education and academic success will always be an outcome of many variables, a critical analysis of selected solutions included in the law on science and higher education has been offered as well.

    Niniejszy tekst jest głosem w dyskusji nad reformą szkolnictwa wyższego w Polsce. Na wybranych przykładach pokazuje on, że planowane zmiany opierają się na kilku fundamentalnych mitach odpowiadających za nieefektywność wcześniejszych prób naprawy uniwersytetu. Jednocześnie stara się pokazać, dlaczego należy odrzucić przekonanie, że reformę szkolnictwa wyższego można przeprowadzić szybko, bez wielkich nakładów finansowych, i że rezultaty wprowadzanych zmian mogą być natychmiastowe. W tekście prowadzona jest także krytyka poglądu zakładającego, że pożądane zmiany można osiągnąć wyłącznie poprzez reformę prawa i że da się wprost zastosować w warunkach polskich rozwiązania działające w innych państwach. Prowadzone rozważania przeciwstawiają się stanowisku, zgodnie z którym istnieją jakieś idealne modele kształcenia i prowadzenia badań, których wdrożenie umożliwia „wyhodowanie” idealnego uczonego. Argumentując, że kształcenie i sukces naukowy zawsze będą wypadkową wielu zmiennych, krytycznej analizie poddano również wybrane rozwiązania wprowadzane w prawie o szkolnictwie wyższym i nauce.

    Niniejszy tekst jest głosem w dyskusji nad stanem edukacji prawniczej w Polsce. Autorka nawiązuje zwłaszcza do artykułu A. Czarnoty M. Paździory i M. Stambulskiego, dotyczącego ukrytego programu w edukacji prawniczej, opisuje sytuację zastaną oraz przedstawia propozycje zmian, jakie należałoby wprowadzić w programach studiów prawniczych oraz w metodach nauczania przyszłych prawników. Na wybranych przykładach wskazuje, w jaki sposób można przeciwstawić się dominacji dataizmu w nauczaniu uniwersyteckim na wydziałach prawa w Polsce oraz kształcić jednocześnie zarówno kompetentnych prawników, jak i świadomych obywateli.
    This text is a contribution to the discussion on the state of legal education in Poland. The author refers, in particular, to the article by A. Czarnota, M. Paździora and M. Stambulski regarding a hidden program in legal education, describes the existing situation and proposes changes that should be introduced in legal studies and teaching methods for future lawyers. On selected examples, she shows how one can oppose the domination of dataism in university teaching at law faculties in Poland and at the same time educate competent lawyers and conscious citizens.

    W ostatnich latach w Polsce szeroko dyskutowana jest problematyka dotycząca systemu kształcenia. Przyczyniła się do tego między innymi uchwalona w 2018 r. ustawa – Prawo o szkolnictwie wyższym i nauce redefiniująca zasady działania uczelni. Studia wyższe i ich organizacja osadzone są w globalnym otoczeniu, posiadającym właściwie nieskończenie wielu interesariuszy. Burzliwość i zmienność tego środowiska została jeszcze dobitniej ukazana przez pryzmat panującej pandemii COVID-19. To wszystko powoduje, że na kwestie określania programów studiów i realizacji procesu kształcenia należy spojrzeć szerzej, rozpoznając wewnętrznych i zewnętrznych interesariuszy oraz określając ich oczekiwania, a także możliwości wpływania na uczelnie i sam proces kształcenia. W artykule wskazano obszar badań w tym zakresie, nakreślając istniejący obecnie stan rzeczy.
    Recent years in Poland have been marked by a heated discussion on the system of education in place. A significant contribution to the discussion was the 2018 Law on Higher Education and Science Act, redefining the current operating model of higher education institutions. Tertiary education and the way it is organised are set in a global environment with an indefinite number of stakeholders. The turbulent nature and changeability of this environment has surfaced even more strongly in the light of the current COVID-19 pandemic. All this requires looking at the design of curricula and the delivery of the process of education from a broader angle, identifying the internal and the external stakeholders and determining their expectations as well as the capabilities to affect higher education institutions and the very process of education. The article points to the area of research made in the said domain, offering a description of the current state of affairs.
