In Roman law confinement in jail as a means of containment of the prisoner to his subsequent trial and conviction, which coincides with situations in which the Roman legal system to exploit the defendant in sentencing in forced labor or in in metallum or in opus publicum. However, the jail met in Rome a suitable means preventive custody and not punishment, and the Roman law was never released on imprisonment as punishment for free men through judicial, as a result of a crime; therefore the prison was conceived as a means of police coercion or administrative judges, that is a security measure before trial by way of remand or awaiting execution. In this context, we will analyze how Roman law promulgates a series of norms aimed at dignifying the prison for the imprisoned, that is, the improvement in the treatment of prisoners due to the influence of Christianity to humanity as a recurring argument in the imperial legislation.The Standard Minimum Rules for the Treatment of Prisoners constitute the universally recognized minimum standards for the management of prisons and the treatment of persons deprived of their liberty and have had immense value and influence in the development of prison laws, policies and practices In Member States around the world, in 2015 it was promulgated under the name Mandela Rules. In this study, we will analyze how some of its principles are already beginning to be glimpsed in Roman law in relation to improvement of the conditions of the confinement´s place.
Desde nuestro punto de vista, focalizado en los Derechos humanos, la normativa del ámbito penal se rige por estándares generales del debido proceso y por principios que no solo están contemplados en la normativa interna española, sino también en tratados internacionales vigentes en España, tanto derivados del sistema onusiano, es decir, las normas y resoluciones de Naciones Unidas, como del sistema regional europeo1. Igualmente, hacen parte de esos estándares las reglas de derecho internacional emergente conocidas como soft law2, que no caen dentro de la categoría de tratados y declaraciones, pero que representan recomendaciones emitidas por órganos internacionales de derechos humanos que cada vez cobran mayor vigencia como recomendaciones con un importante nivel de legitimidad. Entre esas normas, encontramos las Resoluciones de Naciones Unidas, entre ellas, encontramos una de 17 de diciembre de 2015 sobre Reglas Mínimas de Tratamiento de reclusos3, también llamadas Reglas Nelson Mandela (AGNU 70/175)4 . Dicha resolución contiene un primer párrafo del que se desprende la necesidad de garantizar los derechos humanos fundamentales: “Guiada por los propósitos principales de las Naciones Unidas, que se establecen en el Preámbulo de la Carta de las Naciones Unidas y en la Declaración Universal de Derechos Humanos , e inspirada por la determinación de reafirmar la fe en los derechos humanos fundamentales, en la dignidad y el valor del ser humano, sin distinción de ningún tipo, y en la igualdad de derechos de hombres y mujeres y de las naciones grandes y pequeñas, crear condiciones en las que puedan mantenerse la justicia y el respeto de las obligaciones derivadas de los tratados y de otras fuentes del derecho internacional y promover el progreso social y elevar el nivel de vida dentro de un concepto más amplio de la libertad”. Asimismo, el texto también pone de relieve la preocupación existente por la humanización de la justicia penal y por ende, la protección delos derechos humanos en la Administración diaria de la justicia penal y la prevención del delito. Así, la resolución onusiana pone de relieve una serie de principios y prácticas que hoy en día se reconocen idóneos en lo que respecta al tratamiento de reclusos y la administración penitenciaria.

While the conscience of the fundamental rights of the man has broadened its horizons since the onset of the third millennium, it is nonetheless true that these widely recognised rights are constantly being violated in every corner of the world, as in these last times is happening for the migrants, whose personal dignity is often humiliated. This, in turn, leads to the pressing need of an ethical and educational commitment capable of restoring vigour and favouring education towards the development and the respect of the human rights, as these are inviolable and undeniable values, guaranteeing, at the same time, their universality, indivisibility and interdependence.

At this moment, the presence of foreigners in our country is one of the importan problems aefcting society in Poland. eTh unstable situation on the eastern border with Belarus and numerous attempts to illegally cross the border by emigrants - refug from, among others, Syria, Iraq, or Afghanistan, are one of the very popular topic of public and media disputes or topics discussed by politicians. This topic is very important and crucial - it concerns first of all respect for human rights in relation those people. Nevertheless, in Poland, apart from the problem of illegal foreigne there are also citizens of other countries who reside legally in our country. Curre it is a growing group, whose members are not citizens of our country, but they ar an increasingly important part of our society. eThrefore, it is worth taking up this topic and reflecting on the situation of foreigners who reside legally in Poland. eTh subject of this article is the issue of social security of foreigners staying in Poland. Th basic research question to which this article is to answer is the question of wheth foreigners legally residing in the territory of the Republic of Poland are guaran social security - it means if they have ability to live, survive and develop. eTh article will use the method of an interview and a survey conducted among foreigners livin in our country, as well as an analysis of available documents and sources regardi the situation of foreigners in Poland. eTh results of the research and analyzes indicat that the situation of foreigners in Poland is relatively correct, but not in all are needs of this group are fully satisfied.

Opis:
Human rights discourse is one of the discourses relevant in the political discursive struggle over the migration and migration policies in particular nation states or in the European Union. Traditionally, in Western European immigration countries, this discourse has been represented by leftist political parties (socialist or social democratic) and in a more radical way by the social movements and human rights NGO’s. In Slovakia, human rights discourse on migration has never been significantly represented by relevant political parties, on the contrary, migration has been always a topic marked by considerable and unusual political consensus. Human right discourse on migration is a marginal view, represented mainly by few non-governmental organizations. Using the method of Critical discourse analysis, the paper tries to analyse the strategies of discursive struggle over the migration, and relevant social representations being used.

Plato is the first philosopher who speaks about the genesis of dialectic between civil war and outside war. The war among States may be considered a righteous war when an outside enemy threats the freedom of the polis, as freedom – from Plato’s point of view and the whole classical Greek culture point of view – is the fundamental human right that makes a man a citizen and not a slave. From Plato’s point of view this objective can be achieved by means of the education promoted by the State that helps the citizens to realize his essence as man. The State, therefore, realizes the natural order among citizens thus educated, that may only consist in a proportional equality of all citizens for their friendship and thus for peace. The polis becomes a unity and a real political community only thanks to the peace granted by that friendship.

Th e present study focuses on sexuality education as an integral part of the fundamental right to education. It analyses relevant provisions of the Convention on the Rights of Persons with Disabilities and highlights related ethical issues. Study also shows that sexuality education is ideologically saturated and morally charged topic in Slovakia. In this paper we analyse context between social constructions of intellectual disability and sexuality and their implication for sexuality education. We outline some aspects of the right to sexuality education for persons with intellectual disabilities and discuss cultural challenges and related ethical dilemmas from the liberal point of view.

The close coincidence between the 50 years of the Council and the 50 years of the Encyclical “Pacem in Terris” by John XXIII is significantly representative of the particular kind of journey undertaken by the Catholic Church, which insists on the very topic of peace. With its reflections and its concrete work on this crucial issue of human history and contemporary history in particular, the Church stands as one of the most active subjects of the scenario of today’s world engaged in the construction of theoretical and practical scenarios of peaceful coexistence among peoples. This is particularly evident considering the topics which the last two Popes Benedict XVI and Francis cared and taught about. Particularly, the central idea of the first message of Pope Francis for the International Day of Peace (January 1st 2014) talks about the brotherhood that, as the essential dimension of man as rational being, is an essential dimension for the building of a just society and of a solid and long lasting peace. This observation leads to the contemporary and delicate matter of the relationships between North and South, to the raising occurrence of immigration, to the problem of the relationship and balance between cultures and different worlds. As in this field, and more widely in the one of the acceptance and solidarity, the work of the Church seems particularly intense, and the Pope’s judgment is of a great importance. According to the Pope, the relational difficulties of men in a time of multiculturalism are born of a cultural matter and of a particular vision of the reality. The new ideologies – according to Francis – characterized by widespread individualism, egocentrism and materialistic consumerism, weaken the social bounds. Francis considers the principle of brotherhood (that is the evangelical concept quite different from the most generic concept of solidarity) as a concrete articulation of the opportunity to build peaceful human relationships. The brotherhood is a condition for concrete and political human works to reach the social justice, to defeat poverty, to set economical systems based on new economical models and lifestyles, to check fears and wars, to defeat corruption and crime, to help preserving the natural resources. The way of peace today – according to Pope Francis’ specific interpretation – is bound to the development of links of brotherly relations, mutuality and forgiveness: these concepts are not really moralistic but they are set out according to a precise way of growth of the contemporary society. This vision of dignity of man as a condition of harmonic social development, based on mutuality and global peace, comprises an in-depth analysis of the topics of social doctrine already confronted by Benedict XVI, whose reflections on the topic of peace among men and Countries, have been widely dealt with. Pope Ratzinger’s approach cares about the human being with his vital – material and spiritual – needs thus explaining his particular persistence on economical and social topics linked to today’s economical and financial crisis, as it appears clear in the message for the International Day of Peace of the year 2013. The economical growth cannot be pursued by penalizing “the social functions of the State and the webs of solidarity of civil society”, thus violating the social rights and duties, in particular the right to work. For the peace operators a high, even political, profile, is expected: to act for the affirmation of a “new model of development and economy”, that is, of a model of good global governance, bound to the binomial State of right/social State, the two faces of the same coin called humanly sustainable statehood. Thus, Pope Benedict makes his own a fundamental principle of the current international Law of human rights, the principle of interdependency and indivisibility of all person right’s, which means that the right to work, the right to feed, the right to assistance in case of necessity, the right to health, the right to education, are as fundamental as the right to freedom of association. This principle has its root in the ontological, material and spiritual truth of human being. This is the field of humanism that, according to Benedict XVI, must be “a humanism open to the transcendence”, marked by “the ethic of communion and partake” and respectful of “the unavoidable natural moral law written by God in the conscience of each and every man”. The Pope states that the first education to peace is within family, that the article 16th of the Universal Declaration defines as “the fundamental and natural core of society that has the right to be protected from the society and the State”.On the same educational field the Pope assigns a special task to “the cultural, scholastic and academic institutions” to make them undertake, besides the formation of “new generations of leaders”, “the renewal of public, national and international institutions” too. In the multi-thematic vision of Benedict XVI the considerations on freedom of religion have great relevance, which the Pope means as dual freedom: freedom from (for example, from constriction about the choosing of its own religion) and freedom to (witness, teach, etc.). Strictly linked to this passage is the affirmation that “an important cooperation to peace is that judiciary and the administration of justice recognize the right to use the principle of freedom of conscience towards the laws and governmental measures that threaten the human dignity, as abortion and euthanasia”. The widest theological interpretation of the history proposed by Pope Ratzinger gives an overall view to world and time, so that it can set contemporary culture free, mostly the Catholic one, from non-Christian lines of interpretation that have been dominant in the 20th century. Objectives The study has the purpose to go deep through the conceptual and cooperative contribution of the most recent teaching of Catholic Church about human rights, peace, peaceful interstate and intercultural relationships. The research underlines the contribution that the papal Magisterium has given to the building of a more aware sensibility, among peoples and the people in charge of the States, towards the concrete topics linked to the theme of peace. Methods The method pursued in the course of the study is about a systematic illustration of the sources, giving ample space to original the texts. The interpretation of papal documents always considers the published critical literature. The topics carried out are developed for thematic units, to give a better expositive and interpretative clarity.

Purpose of the work is to investigate theoretical principles of employees’ rights protection in the context of responsibility for mobbing. The theoretical and methodological basics of the research are general scientific and special methods of certain jurisprudence phenomena and processes’ cognition. The dialectical method was used in the synthesis of theoretical and methodological foundations of employment policy abroad and in Ukraine, as well as formulating conclusions. Thus, we used a common dialectic method which allowed us to reveal the content of employer, employee and mobbing in the context of the domestic and foreign scholars’ experience. We also have used abstract and logical investigation methods of law process in the field of employee’s rights protection. Statistical methods were used for analyzing trends of employee’s rights in different countries. The authors investigated: the main stages of the employment in Ukraine; focused attention on three events that occur during the legal employment of a hired worker; the definition of the mobbing, its concept, the experience of counteracting and establishing responsibility for this offense in the EU. The paper identified the main principles of the mobbing counteracting system’s development in Ukraine. In further investigations it is necessary to make a distinction between actions that Theoretical Principles of Employees’ Rights Protection in the Context of Responsibility for Mobbing take place exclusively at the workplace while performing employee’s duties and extending to more private aspects of a person’s life (correspondence, messengers, telephone calls at a time that is not formally a working).

The concept of human rights, which has been developing for almost two centuries, has come to a rather difficult stage. Developing this concept in a doctrinal or statutory way does not guarantee its respect. In the so-called Western culture, there are more and more cases of violations of human rights. In addition, with the development of new technologies, new problems are born related to the content of human rights and their effective protection. The subject of the article is an attempt to redefine the concept of human rights, especially fundamental rights.
Rozwijająca się od prawie dwóch wieków koncepcja praw człowieka znalazła się w dość trudnym momencie. Rozwinięcie jej, doktrynalne czy ustawowe, nie daje gwarancji respektowania praw stanowiących jej treść. Właśnie w tzw. kulturze zachodniej prawa człowieka są coraz bardziej naruszane. Ponadto, wraz z rozwojem nowych technologii rodzą się kolejne problemy związane z treścią praw człowieka i ich skuteczną ochroną. Przedmiotem artykułu jest próba nakreślenia na nowo koncepcji praw człowieka, zwłaszcza praw podstawowych.

Administracja publiczna powinna nieustannie się rozwijać i wprowadzać odpowiednie instrumenty, aby zwiększać swoje możliwości w zakresie coraz skuteczniejszego sposobu realizacji zadań publicznych. Ta skuteczność musi być oparta na przestrzeganiu zasady legalności, gdzie wszelkie działania, decyzje i kroki byłyby podejmowane zgodnie z obowiązującymi przepisami prawa. W tym zakresie kluczowe będzie odniesienie się do nurtu zarządzania humanistycznego, który w swojej nauce zwraca niezwykle silną uwagę na samego człowieka, w tym przypadku pracownika administracji publicznej. Prawo powinno być tak skonstruowane, aby było ono przyjazne i, co najważniejsze, zrozumiałe dla wszystkich jej odbiorców. Artykuł poświęcony jest roli zarządzania humanistycznego, które w sposób coraz bardziej widoczny oddziałuje na sposób tworzenia prawa, przy okazji mocno akcentując poszanowanie praw pracowniczych w administracji publicznej, wpływając pośrednio również na jakość oferowanych przez pracowników usług. W opracowaniu wykorzystano przegląd literatury dotyczącej zarządzania humanistycznego, uwzględniając przy tym pozycję pracownika i tworzonego prawa w zmieniających się uwarunkowaniach prawnych i organizacyjnych.
Public administration develops and develops instruments to increase its capacity for more effective exercise of member states. This effectiveness must be based on observance of the legal principles where actions, decisions and steps are taken in accordance with the law.
