    Polyphony in legal discourse: reference markers Since the law is polyphonic, one can a fortiori consider legal discourse as polyphonic. In this article, we propose to shed some light on this phenomenon. The questions formulated for this problem are the following: What is polyphony? How does the Court construct a clear and coherent discourse by orchestrating the “voices”, “opinions” or “points of view” of different actors participating in the trial? How do these voices manifest themselves in the text of the judgment? Which reference marks make it easier to identify these “voices”? The corpus proposed for our study comes from the case law of the official website of the French Court of Cassation.

    L’état z’héros est une œuvre dans laquelle Maurice Bandaman intègre le conte dans la structure du roman. Sa discursivité repose sur un certain nombre d’intertextes oraux dont les chants rituels, les stances, les opus et des références intégrées sous la forme d’un collage littéraire. Au niveau de la narration, la voix des narrateurs interagit avec celles des personnages dans les dialogues et les monologues autonomes des personnages ou des narrateurs. Ces relations dialogiques mettent en relief des métalepses narratives qui ressortent de la polyphonie. Celle-ci est l’une des marques de la littérarité, principal moteur de l’analyse stylistique. À travers un double objectif, primo, il s’agit de montrer que le dialogisme et l’intertextualité sont deux approches qui se font écho dans l’analyse stylistique des textes romanesques, en l’occurrence de ce texte de Maurice Bandaman. Secondo, il est question de prouver que les relations intertextuelles débouchent sur la polyphonie et mettent au premier plan la littérarité.
    L’état z’héros is a work in which Maurice Bandaman integrates the tale into the frame structure of the novel. Its discursivity is based on a number of oral intertexts including ritual songs, stanzas, opuses and references integrated in the form of a literary collage. At the narrative level, the voices of the narrators interact with those of the characters in dialogues and autonomous monologues by characters or narrators. These dialogic relationships highlight narrative metalepses that are polyphonic. It is one of the marks of literarity, the main driving force of stylistic analysis. The aims of this article are, firstly, to show that dialogism and intertextuality are two approaches echoing each other in the stylistic analysis of novelistic texts and, secondly, to prove that intertextual relations lead to polyphony and bring literarity to the fore.

    In André Gide’s Les Faux-monnayeurs, counterfeit money and characters flow in a plot based on a circulatory system in which they seem to be interchangeable. Ideas flow as well in the novel, creating a polyphonic intertextuality. Gide plays with his preferred authors, such as Nietzsche, whose claims are looked into in order to create a distance and question them. Such premises are held by cynical characters as well as the protagonist Bertrand, a positive nietzscheanist icon in his will to affirm himself and radically question upper class and religious values. The money counterfeit takes its roots in the collapse of the gold standard in 1914’s France. Gide depicts a world in which all values’ authenticity are shaken, the counterfeit money serving as a metonymy to question Nietzsche’s arguments, often in an ironical way. Nietzsche’s ideas flow from a character to the next and seem to be put to the test.
    Dans Les Faux-monnayeurs d’André Gide, les fausses pièces circulent, tout comme les personnages, au sein d’une intrigue/sys économie narrative reposant sur un système de circulation et d’échange, au point qu’ils semblent parfois interchangeables. Mais, les idées également circulent dans le roman, dans un jeu d’intertextualité polyphonique. Gide joue avec ses auteurs de prédilection, comme Nietzsche, dont il reprend certaines thèses pour mieux les mettre à distance et les questionner. On retrouve certains de ses postulats aussi bien dans la bouche des personnages cyniques que chez le « héros » Bernard, figure positive du nietzschéisme par sa volonté de s’affirmer et dans sa remise en question radicale des valeurs bourgeoises et religieuses. Le motif du trafic de la fausse monnaie renvoie à l’effondrement de l’étalon-or dans la France de 1914. Gide le relie à la peinture d’un monde où l’authenticité de toutes les valeurs est ébranlée. La fausse monnaie joue le rôle métonymique du questionnement par Gide de postulats de Nietzsche, souvent sur le mode ironique. Les idées de Nietzsche circulent dans d’un personnage à l’autre, et semblent mises à l’épreuve, comme on éprouverait l’authenticité d’une pièce.

    Der vorliegende Beitrag soll ein Versuch sein, den dokumentarisch-literarischen Text aus der Sicht des Literaturdiskurses zu erhellen, indem asthetisches Subjekt im Fokus der Diskurspraktiken dargestellt wird. Die Diskursanalyse der Elias Canettis Memoiren soll kommunikative Strategien der Autorinstanz aufdecken, die den Aufschluss daruber geben, dass die Originalitat der Autorenversion des Weltbildes auf der Idee des immer offenen Lebensraums und der fruchtbaren Wechselbeziehungen vielfaltiger kultureller Erscheinungen beruht, was die Logik der Entstehung des Ich-Erzahlers bestimmt.
    The present article is intended to be an attempt to illuminate the documentary- literary text from the perspective of literary discourse by presenting an aesthetic subject in the focus of discourse practices. The discourse analysis of Elias Canetti’s memoirs would have to uncover communicative strategies of the author’s instance. They provide information that the originality of the author’s version of the worldview is based on the idea of the always-open living space and the fruitful interrelationships of diverse cultural phenomena, which is the logic of the genesis of the alter ego and determined by the narrator.

    Reading and analysing texts with a speaker/narrator who stages her/his texts as a dialogue (polyphony), provokes the question, if the speaker/narrator as the stage director characterizes her/his figures by specific word formations, or in other words, if it is possible for a reader to clearly identify polyphony by the use of word formations. The texts chosen for this analysis are Nora Gomringer’s story Recherche and excerpts from Dörte Hansen’s novel Altes Land, both published in 2015. Both texts are apt for comparison not only because of similar character-sets (e.g. one of the characters is a journalist), but also because of the permanent change between ‚written‘ language and dialogues. There is evidence that different figures use word formations in different frequencies, in the familiarity and the diversity of the respective formations. Whereas the derivations serve for mainly telling the story, the compositions serve additionally to compose convincingly rather ordinary or creative figures.
    Lektura i analiza tekstów, w których nadawca komunikatu/narrator organizuje tekst jako dialog (polifonię) skłania do pytania, czy nadawca/narrator jako reżyser nadaje cechy swoim postaciom przy użyciu produktów słowotwórczych, lub innymi słowy: czy czytelnik jest w stanie jasno zidentyfikować polifonię na podstawie użytych złożeń i derywatów? Teksty analizowane w niniejszym artykule to opowiadanie Nory Gomringer pt. Recherche (2015) oraz fragmenty powieści Dörte Hansen pt. Altes Land (2015). Porównanie tych tekstów jest zasadne nie tylko z uwagi na podobieństwo postaci (np. w obu dziełach jedną z bohaterek jest dziennikarka), ale również z powodu nieustannego przechodzenia z języka “pisanego” do “mówionego” (w dialogach). Przeprowadzone badanie wykazało, że różne postaci stosują derywaty i złożenia z różną częstotliwością, znajomością i różnorodnością poszczególnych formacji słowotwórczych. Podczas gdy derywaty służą głównie opowiadaniu historii, złożenia służą dodatkowo przekonującemu budowaniu dość zwyczajnych lub kreatywnych postaci.

    Autor artykułu analizuje powieść Heinza Strunka Der goldene Handschuh [Złota rękawiczka] w oparciu o rozważania Judith Butler Excitable Speech (Walczące słowa. Mowa nienawiści i polityka performatywu). Ukazane zostaje nie tylko zagadnienie przemocy poprzez język, lecz także język jako forma przemocy. Pierwszą płaszczyznę rozważań stanowi analiza wypowiedzi postaci oraz wewnętrzna fokalizacja postaci Fritza Honki. Na drugiej płaszczyźnie autor artykułu bada intersubiektywną strukturę zależności jako wzajemne odziaływanie różnych postaci. Na zakończenie krytycznej analizie poddana zostaje sama narracja jako mowa przedstawiona. Rozważaniom towarzyszy teza, iż asynchroniczny język postaci pozostaje na płaszczyźnie tekstu niejasny i wzmacnia tym samym opisaną w artykule zasadę języka przemocy.Motyw przemocy poprzez język na płaszczyźnie postaci znajduje odzwierciedlenie na poziomie samej narracji jako język przemocy. Zamierzeniem niniejszego artykułu jest stworzenie krytyczno-refleksyjnych ram dla omawianego tekstu uwrażliwiających czytelnika na zagadnienie języka przemocy.
    The paper analyses the novel by Heinz Strunk Der Goldene Handschuh [The Golden Glove] against Judith Butler’s comments on Excitable Speech. Alongside the presentation of violence through language, language as a form of violence is brought into focus. The first level of analysis is constructed around the investigation of utterances and internal focalization of the character of Fritz Honka. The second level encompasses the intersubjective structure of description as a dialogic interdependence between various characters. Finally, the narration itself as a form of reported speech is critically investigated. The following hypothesis is being explored: the asynchronous speech of the characters remains inexplicit on the textual level, which evokes the described principle of hurtful speech. The expression of violence at the level of the characters is transformed into the language of violence at the narrative level. The aim of the contribution is therefore to present the narration within a critical framework allowing for evoking of the awareness of the interrelationships between language and violence.
    Dieser Beitrag untersucht Heinz Strunks Roman Der goldene Handschuh auf Grundlage von Judith Butlers Ausführungen zur Excitable Speech. Neben der Darstellung von Gewalt durch Sprache wird die Sprache als Form der Gewalt in den Fokus gerückt. Die erste Ebene der Analyse bilden die wörtliche Rede und die interne Fokalisierung der Figur ›Fritz Honka‹. Auf der zweiten Ebene wird die intersubjektive Beziehungsstruktur als dialogische Wechselwirkung zwischen verschiedenen Figuren betrachtet. Abschließend wird das Erzählen selbst als vorgetragene Rede kritisch hinterfragt. Folgende These wird untersucht: Die asynchrone Sprache der Figuren bleibt auf der Textebene unvermittelt und verstärkt dadurch das beschriebene Prinzip des verletzenden Sprechens. Die Darstellung der Gewalt durch die Sprache auf der Ebene der Figuren wird durch den Erzähltext selbst als Sprache der Gewalt reproduziert. Ziel des Beitrags ist es deshalb, die Erzählung kritisch zu erschließen, um dadurch eine grundsätzliche Sensibilisierung für die Reflexion der Zusammenhänge von Sprache und Gewalt zu erreichen.
