Financial aspect remains a key aspect of decentralization from the point of view of local self-government, and a kind of test illustrating the nature and scope of the processes of decentralization is the category of financial independence of local governmental units, referred to in Anglo-Saxon literature as local financial autonomy. The aim of the research is to demonstrate the essence and the key role of this category in terms of the local financial system, as well as the identification and evaluation of key determinants limiting the scope of the revenue autonomy of local government in Poland. The most important determinants are stated as follows: limited stability and performance of self-government units, excessively limited range of local taxation powers, frequent practice of imposing additional tasks to the regional and local authorities without appropriate financial compensation, dominance of income transfer in the system of local government finances, dysfunctional income equalisation system of local government, restrictive system of rationing local deficit and debt, excessive politicisation of the local government.

Artykuł przedstawia historię reform decentralizacyjnych w Ukrainie od początku lat dziewięćdziesiątych XX stulecia do końca 2021 r., ze szczególnym uwzględnieniem reformy terytorialno-administracyjnej przeprowadzonej w latach 2015–2020. Poziom autonomii samorządów lokalnych w Ukrainie odnoszony jest do stworzonego na podstawie identycznej metodologii wskaźnika autonomii lokalnej w innych krajach europejskich.
The article presents the history of decentralisation reforms in Ukraine beginning with the last decade of the 20th century until the end of the year 2021, with a special focus on the territorial-administrative reform implemented in 2015–2020. The level of local autonomy in Ukraine is compared to the local autonomy index in other European countries, which was created on the basis of the same methodology.

The subject of the study is to present the concept of local autonomy from a historical and comparative perspective. The work will analyze the provisions of Roman law and Polish law. The work also includes references to the solutions in other selected legal systems. The basic assumption of the author is to accept the hypothesis that the autonomy of ancient municipalities was much wider than today. This was undoubtedly due to a different concept of the state.
Przedmiotem opracowania jest przedstawienie koncepcji autonomii lokalnej z perspektywy historyczno-porównawczej. W pracy zostaną poddane analizie przepisy prawa rzymskiego oraz prawa polskie. Znajdują się w niej również odniesienia do rozwiązań obecnych w innych wybranych systemach prawnych. Podstawowym założeniem Autora jest przyjęcie hipotezy, że autonomia antycznych municypiów była znacznie szersza niż to jest obecnie. Wynikało to niewątpliwie z odmiennej koncepcji państwa. Współczesne państwo dąży do pełnej kontroli nad organizacją społeczeństwa. Państwo rzymskie ograniczało się do podejmowania takich działań, które były konieczne. Tym samym zasada pomocniczości w starożytności była lepiej realizowana. Interwencja organów centralnych ograniczała się zasadniczo do realizacji takich zadań, które przekraczały możliwości lokalnej społeczności. Obecnie to władza centralna decyduje o formie i zakresie samorządów.

In this article, the authors investigate the connection between the level of detail in constitutional regulations of local financial autonomy and its overall quality in Hungary, Slovakia, Poland and the Czech Republic. The article aims to either confirm or refute the hypothesis that more comprehensive constitutional rules result in an enhanced quality of local financial autonomy. To be able to test the hypothesis, the authors first examine the relevant constitutional regulation in these four countries. Thereafter, they employ two different indicators, selected statistical data and the conclusions from the monitoring procedure of the European Charter of Local Self-Government to measure the quality of local financial autonomy in the studied countries. Finally, they compare the results of the quality assessment with the degree of the constitutional framework’s specificity to see if the hypothesis was correct or not.
W niniejszym artykule autorzy badają związek pomiędzy poziomem szczegółowości konstytucyjnych regulacji dotyczących lokalnej autonomii finansowej a jej ogólną jakością na Węgrzech, Słowacji, w Polsce i Czechach. Artykuł ma na celu potwierdzenie albo obalenie hipotezy mówiącej o tym, że bardziej kompleksowe przepisy konstytucyjne skutkują wyższą jakością lokalnej autonomii finansowej. Dla umożliwienia przetestowania tej hipotezy autorzy najpierw badają odpowiednie regulacje konstytucyjne w tych czterech państwach, następnie stosują dwa różne wskaźniki, wybrane dane statystyczne i wnioski z procedury monitorowania z Europejskiej Karty Samorządu Lokalnego do pomiaru jakości lokalnej autonomii finansowej w państwach objętych opracowaniem, a na koniec porównują wyniki oceny jakości ze stopniem szczegółowości ram konstytucyjnych celem sprawdzenia trafności bądź nietrafności hipotezy.

Zasadnicze znaczenie w dojściu do takiej formuły funkcjonowania energetyki po jej transformacji będzie miało zwiększenie produkcji energii elektrycznej z odnawialnych źródeł energii (OZE), inteligentna integracja OZE oraz intensywne zaangażowanie społeczne w proces tworzenia obszarów samodzielności energetycznej (klastry, spółdzielnie energetyczne i in.). W artykule zwrócono szczególną uwagę na pożądany kierunek rozwoju autonomicznych wspólnot energetycznych, które mają szansę w nieodległej przyszłości skutecznie zapewniać miedzy innymi obszarową równowagę podażowo-popytową w zakresie energii elektrycznej.
The currently observed dynamic development of distributed energy in the country and in the world, progressing due to the departure from high-emission energy carriers in favor of creating an energy sector based largely on renewable sources, means that distributed energy may soon become a significant element improving the country’s energy security, influencing the level of energy prices and stimulating the development of selected regions of the country. In reaching this formula for the functioning of the energy sector after its transformation, it will be essential to increase the production of electricity from renewable energy sources (RES), intelligent integration of renewable energy sources and intense social involvement in the process of creating energy independence areas (clusters, energy cooperatives, etc.). The article pays special attention to the desired direction of development of autonomous energy communities, which have a chance in the near future to effectively ensure, among others, the area-related balance of supply and demand in the field of electricity, and not only.

The study examined local government autonomy and local government service delivery in Nigeria. the study discovered that, Nigerian local government needs to be autonomous in the discharge of its statutory responsibility, if ongoing agitation for local government autonomy from different quarters in Nigeria is given an approval, this will strengthen local government’s service delivery. The study discovered that some states in Nigeria oppose local government autonomy due to political and economic considerations. The study further revealed that Irepodun local government (the micro-case study) in Nigeria is not totally autonomous. Although, local governance is transparent and accountable in Irepodun Local Government, especially in the identification, formulation and execution of its projects, Irepodun local government authority has a huge financial challenge in carrying out service delivery. The study therefore recommends that; the state joint local government account should be abolished from the Nigerian constitution to enable allocation of funds directly to the local governments from Federation account. they should also put a stop to the persistence deduction from the monthly allocation of local governments. Again, states should henceforth be made to remit regularly the constitutional 10% of their internally generated revenue to the local government authorities. Irepodun local government and other local government authorities in Nigeria emplace more efforts on sustainable wealth creation rather than depending solely on the grants from the federal and state governments.
W artykule przeanalizowano autonomię samorządu lokalnego i świadczeń usług samorządowych w Nigerii. Badanie wykazało, że nigeryjski samorząd lokalny musi być niezależny w wykonywaniu swoich ustawowych obowiązków. Czynnikiem wzmacniającym świadczenie usług przez samorząd lokalny może być skuteczna agitacja różnych środowisk na rzecz niezależności samorządu Nigerii. Analiza wykazała, że niektóre stany w Nigerii sprzeciwiają się autonomii samorządów lokalnych ze względów politycznych i ekonomicznych. Wykazano ponadto, że samorząd lokalny Irepodun (studium przypadku mikro) w Nigerii nie jest całkowicie autonomiczny. Chociaż samorząd lokalny w Irepodun jest przejrzysty i odpowiedzialny, zwłaszcza w zakresie identyfikacji, formułowania i realizacji swoich projektów. Musi on sprostać ogromnemu wyzwaniu finansowemu w realizacji świadczenia usług. W związku z tym badanie rekomenduje, usunięcie z konstytucji Nigerii zapisu dotyczącego wspólnego konta samorządowego, aby umożliwić alokację środków bezpośrednio do samorządów z konta Federacji. Należy zmusić państwo do regularnego przekazywania władzom samorządowym konstytucyjnych 10% ich wewnętrznie wytworzonych dochodów. Samorząd lokalny Irepodun i inne władze samorządowe w Nigerii powinny podjąć więcej wysiłków na rzecz trwałego tworzenia dobrobytu, zamiast polegać wyłącznie na dotacjach od rządu federalnego i władz stanowych.

In the Polish legal system, shares of local government units in state Personal Income Tax (PIT) falls into the category of the local government’s own revenues. Such assignment does not meet the basic attribute of the so-called decentralized taxes, which is the taxing power. The local authorities cannot affect the income tax revenue in this case, while at the same time they suffer financial consequences of amendments in the construction of this tax. In Poland, this issue, among other things, fueled a discussion on the need to reduce the dependence of local government units’ revenues on central tax decisions in the form of “local-governmentalization” of the Personal Income Tax and introduction of the so-called municipal (local) PIT. Not only does the article aim to present this concept, but also to identify potential advantages and risks connected with the possible introduction of municipal PIT in the Polish system of local finance.
Udział jednostek samorządu terytorialnego w państwowym podatku dochodowym od osób fizycznych (PIT) jest zaliczany w polskim systemie prawnym do kategorii dochodów własnych samorządu. Taka kwalifikacja nie spełnia jednak podstawowego atrybutu tzw. podatków zdecentralizowanych, jakim jest władztwo podatkowe. W tym przypadku władze lokalne nie tylko nie mają żadnego wpływu na wysokość dochodów z tego tytułu, ale jednocześnie ponoszą finansowe konsekwencje systemowych zmian wprowadzanych w konstrukcji tego podatku. Między innymi w tym kontekście w Polsce nasiliła się ostatnio dyskusja nad koniecznością zmniejszenia zależności dochodów jednostek samorządu terytorialnego od centralnych decyzji podatkowych w formule „usamorządowienia” podatku PIT i wprowadzenia tzw. PIT-u komunalnego (lokalnego). Celem artykułu jest nie tylko ukazanie tej koncepcji, ale również identyfikacja potencjalnych zalet i zagrożeń związanych z ewentualnym wprowadzeniem PIT-u komunalnego w polskim systemie finansów lokalnych.

The aim of this paper is to identify the relationship between non-returnable sources of financing for local development and the ability to repay and service the debt by local government units in Poland. The formulated research problem becomes particularly important in the situation of limiting the level of own-source revenues (reduction of income independence) due to the influence of external factors, independent from local authorities. The research was carried out on the entire population of local government units in Poland, considering their statutory types, municipalities, powiats, cities with powiat status, and voivodeships. The existence of a strong correlation between own-source revenues and the operating surplus was confirmed. The obtained results indicate that it is possible to assess creditworthiness, taking into account own-source revenue and the operating surplus.

This work seeks to analyse the normative determinants of the exercise of administrative power by local self-government units within their legislative competences. The influence of the normative autonomy of local self-government units on the exercise of legislative competences bytheir different bodies is presented. Among the normative determinants of exercising legislative competences, special attention is paid to the form of competence and task norms, including their mutual relations. The methods of interpretation of such norms are pointed out. An assessment of the impact of norms which determine the formal aspect of using delegation of legislative power on the manner of exercising legislative competences is also made. The considerations described in the paper were based on the views presented in the doctrine of law and illustrated by examples of selected judicial decisions.
W przedstawionym opracowaniu podjęto próbę analizy normatywnych determinant realizowania władztwa administracyjnego organów jednostek samorządu terytorialnego w ramach ich kompetencji prawodawczych. Przedstawiono wpływ normatywnej kategorii samodzielności jednostek samorządu terytorialnego na sposób realizowania kompetencji prawodawczych przez organy tych jednostek. Wśród normatywnych determinant realizowania kompetencji prawodawczych zwrócono uwagę na charakter norm kompetencyjnych i norm zadaniowych, a także wzajemne relacje między nimi. Zasygnalizowano problematykę metod wykładni tych norm. Dokonano także oceny wpływu norm, które determinują formalny aspekt korzystania z upoważnienia ustawowego, na sposób korzystania z kompetencji prawodawczych. Rozważania osadzono na tle poglądów prezentowanych w doktrynie prawa i zilustrowano aktualnymi przykładami analizowanymi w orzecznictwie.

The article provides an analysis of the essence, scope and basic determinants of the revenue autonomy of local government units in Poland. The considerations are theoretical, based on a critical review of the relevant literature and on the analysis of the most important legal acts determining the Polish legal and financial system of local government. What is worth emphasizing is that autonomy is the paramount value of local government. In accordance with Polish constitutional law, local government bodies participate in the exercise of public authority, perform public tasks in their own name and under their own responsibility, and require autonomy that is subject to judicial protection. The autonomy of local government units is a complex and multifaceted issue. It can and should be considered with regard to legal, organizational, political, property, economic and financial aspects. Financial autonomy, especially in terms of revenues, plays a significant role in activities and development prospects of local government units.

The present paper raises the issues of financial autonomy of Polish cities with regard to the aspect of social and economic development of provinces, in which they are located – the topic being of crucial importance both from the theoretical and practical point of view. The significance of the undertaken research follows mainly from the fact that self-reliance and autonomy of a city in the area of financial management are indispensable conditions for its functioning. What potentially leads cities to harmonious and sustainable development is the fact that they possess legal personality, complete their tasks on their own account, manage their property and have their own, independent of the state finances, financial system. In spite of the fact that the goal of a city is not to make maximum profits but to satisfy collective public needs, the most important aim of local self-government authorities while making financial decisions should be to manage their financial resources in a rational way but, at the same time, to keep in mind the priority of the public interest.

The aim of this paper is to highlight specific features related to the performance of public duties by local self-governments, focusing on their autonomy. Hence, it is essential that the conceptual boundaries of such notions as ‘public duties’ and duties associated with ‘public services’ are established at the outset. The current lack of clarity contributes to the complexity of the issue, and this is further complicated by a lack of clear legal regulations which would explicitly define the acceptable way in which public duties assigned to local self-governments are to be implemented. These issues suffice to explain the choice of the topic tackled in this study. Admittedly, it will not provide answers to all the problems associated with the public utility services which fall within the scope of the public duties discharged by particular local self-government units: gmina (municipality/commune), powiat (county), or województwo (voivodeship). However, it may form the basis for further research to be conducted in this field. Therefore, within the framework of this paper, issues related to local self-governments, their autonomy, and the concepts of ‘public duties’ and ‘duties in the field of public utility’ will be discussed. These issues are important, as they are inextricable from the decentralization of public authority, which consists in assigning numerous public duties to be fulfilled by local self-governments.

Opis:
The public administration is composed of state and local administration. Both administrations are condemned to cooperate with each other in the implementation of various tasks for the local community and they are part of the interests of the entire society. Despite this, in practice. it can occur and there is a conflict between the local administration and the state administration. As a result, both parts of the public administration go to the court, which resolves these disputes. However, there are many areas and examples of cooperation between the two administrations, which complement each other.
Administracja publiczna składa się z administracji państwowej i samorządowej. Obie administracje są skazane na współpracę ze sobą przy realizacji różnych zadań dla lokalnej społeczności, które jednak stanowią część interesów całego społeczeń- stwa. Mimo to może w praktyce dochodzić i dochodzi do konfliktu na linii administracja samorządowa a państwowa. W efekcie tego konfliktu obie części administracji publicznej stają przed sądem, który rozstrzyga te spory. Liczne są jednak obszary i przykłady współpracy obu administracji, które wzajemnie się uzupełniają.
