One of the main human goals is to achieve the state of happiness. Almost all people ask themselves the question of how to attain this goal. For thousands of years, philosophers and spiritual leaders and, nowadays, researchers representing various disciplines of social sciences, have been searching for the right answer to this question. One of the dilemmas intertwined in the debate about the essence of happiness relates to the tension expressed by the question “to be or to have”; the tension between the spiritual and the material world; between sacrum and profanum. Can accumulation of money and material possessions make us happy? Starting with the message passed on by a German psychoanalyst Erich Fromm in his essay “To Have or to Be” and the wisdom derived from the classic philosophical and religious works, I will attempt to define the relation between the state of happiness and the attachment to money and possessions or the attachment to social and transcendent values. This difficult, yet crucial, problem will be analyzed in the context of the current psychological knowledge related to the emotional and cognitive consequences of taking a materialistic approach to life. Erich Fromm and other thinkers who had lived hundreds of years before him, suggested that greed and pursuit of material possessions did not appease the human longing for happiness. The latest experimental research, conducted by psychologists, economists and scholars representing other disciplines of science, seem to strongly confirm these assumptions.

In this paper, I show that Aristotle’s refutation of the Eleatic argument in Physics I.8 is based on the idea that a thing at the starting point of coming to be is composite and is made up of what underlies and a privation. In doing so, I clarify how the concept of accidentality as used in his solution should be understood in relation to the composite nature of what comes to be. I also suggest an explanation of why Aristotle’s discussion of the Eleatic dilemma in Physics I.8, unlike his discussion in the previous chapter, is not clear.

Nowadays, effective protection of personal data is one of the fundamental issues of a democratic state under the rule of law. Therefore, the legislator should be very precise about the principles and standards of data processing. In the last few decades, in particular, the development of new technologies, digitalisation and the increase in the need for electronic communication has become evident, which leads to the adoption of appropriate regulations for the handling of personal data. In addition, the EU legislator has introduced the General Data Protection Regulation (GDPR) in order to harmonise the regulations of EU Member States regarding the protection of personal data. This provides a framework for the proper functioning of legal provisions across the European Union regarding the handling of personal data of its citizens.The aim of the article is to identify the legal changes resulting from the Personal Data Protection Regulation, with a particular focus on the persons to which they apply and then to analyse the regulation of ‘the right to be forgotten’. In the first part of the article, attention is drawn to the way personal data are processed and the scope of obligations incumbent on data controllers. This is because data controllers are, together with the personal data protection officer, responsible for recording data processing activities, including ongoing monitoring and responding to situations of inaccurate data processing. The second part focuses on the right to be forgotten and the assessment of this entitlement in the perspective of Regulation 2016/679. The research methods include an analysis of legal acts, at the same time using the subject literature.

This paper contextualizes and analyzes the main emerging approaches to the understanding of the right to be forgotten and its application in praxis, using legislation and judicial practice of the European Union and Ukraine as reference scales. By bridging the gap between positive and interpretative orders of law implementation, which were previously imperatively opposed and considered mutually exclusive in the Ukrainian legal system, the paper supports the arguments that the process of mastering the protection of right to be forgotten requires a further mindset shift equally for-Internet providers and all involved law enforcers.

The article discusses the decisions “Right to be forgotten I” and “Right to be forgotten II” of 6 November 2019 by the Federal Constitutional Court, which redefine the relationship of cooperation between the Federal Constitutional Court and the European Court of Justice in the area of fundamental rights. The Court has decided for the first time that where EU fundamental rights take precedence over German fundamental rights, the Court itself can directly review, on the basis of EU fundamental rights, the application of EU law by German authorities. In the first part, the article presents the previous system, including the precedence of application of EU law and its exceptions (ultra-vires review; identity review), as well as the controversial question of the interpretation of Article 51 (1) of the Charter of Fundamental Rights, which is decisive for the applicability of the fundamental rights under the Charter. The focus is on the constitutional background of the German Basic Law for the protection of fundamental rights in the European multi-level system. Against this background, the second part of the article presents the facts and reasons for the decisions “Right to be forgotten I” and “Right to be forgotten II”. This is followed by an analysis of the consequences of these decisions for the protection of fundamental rights and cooperation between the European Court of Justice and the Federal Constitutional Court. In particular, the way in which fundamental EU rights can now be enforced before the Federal Constitutional Court is described in greater detail. The concluding part provides an overview of the open questions, risks and opportunities of this approach. Here the article illustrates the significant impact of the two decisions on dogmatic and procedural matters.

The article analyzes the role played by the Hearing Officer in competition proceedings conducted by the European Commission to implement Article 101 and 102 TFEU. Currently, the Hearing Officer is a guarantor of the effective exercise of procedural rights in the course of all competition proceedings before the EC, while contributing to the objectivity, transparency and efficiency of the proceedings. The article also discusses the proposals to change the scope of the powers of the Hearing Officer, as reported in doctrine and literature, and refers to the possibility and legitimacy of introducing such institution into Polish competition law.

The changes that occurred to the way work is treated have been reflected in the way free time is understood. The paper’s aim was to daw attention to the fact that a contemporary person, driven by the wish to possess, to exist and, foremost to be, may realise themselves in various ways within the two aspects of reality, namely: doing their work and spending their free time.

Opracowanie prezentuje wyniki badania, przeprowadzonego piętnaście lat po przystąpieniu Polski do Unii Europejskiej, dotyczącego tożsamości tych spośród najmłodszych dorosłych Polaków (czyli osób, które w granicach zjednoczonej Europy spędziły niemal całe swoje dotychczasowe życie), którzy zamierzają zostać nauczycielami szkolnymi i przedszkolnymi. Tożsamość ta jest reprezentowana w badaniu jako ich osobiste poczucie/przekonanie, że są obywatelami zjednoczonej Europy/Rzeczpospolitej Polskiej. Uzyskane wyniki demonstrują, że intensywność deklarowanego przez respondentów subiektywnego poczucia, że są obywatelami Europy jest istotnie niższa niż intensywność ich poczucia, że są obywatelami Polski, niezależnie od czynników sytuacyjnych, których potencjalne oddziaływanie na reakcje uczestników poddano w trakcie badania eksperymentalnej kontroli. Niemniej, tożsamość osób badanych można zaklasyfikować jako polsko-europejską, gdyż żadna z jej składowych ani nie istnieje, ani nie ulega nasileniu kosztem drugiej. Pozwala to przewidywać, że jako nauczyciele i wychowawcy będą dobrym przykładem dla przyszłych pokoleń, pokazując swoim uczniom, że można być jednocześnie Polakiem i Europejczykiem, że tożsamość europejska nie rozwija się kosztem tożsamości narodowej, że obie mogą ze sobą zgodnie współistnieć.
This paper examines the identity of the youngest Polish adults intending to be school and pre-school educators. As the examination is carried out fi fteen years after Poland joined the European Union, the respondents have spent nearly all their lives within the borders of the united Europe. The question, therefore, is how this fact has affected their identity. The identity is represented as their personal feeling/conviction of being citizens of the United Europe (and of Poland). The results demonstrate that though their conviction of being citizens of Europe, even if it is reasonably strong, is not as intensive as that of being citizens of Poland (despite the experimental control of two situational factors that might potentially affect the participants’ responses), their identity could be classifi ed as Polish-European of the positive-sum nature. That is, the young people’s Polish and European identities seem by no means to be in confl ict or at each other’s expense. This offers an optimistic view as far as their future profession of educating next generations is concerned.

Educational situation analysis sheet (AnAlySE) was used as a tool while working with university students of early education. The work with AnAlySe was monitored in order to answer the question of its meaning in developing the ability to reflect on the everyday educational reality. The observation of students’ proceedings, the interviews with them and the analysis of their work lead to the conclusion that the sheet constitutes a specific space for obtaining knowledge and developing certain skills in teacher’s both individual and group work. It fosters developing the ability to learn “with” others and “from” others “in” and “from” the everyday educational reality.

The paper attempts to reconstruct Thales’ argument about water, which is rightly considered to be the core of his philosophy of nature. It consists of two separate arguments – one biological and the other physical – which ascribe to water two different functions: in the first case, it is a source of life on the earth or, in another version, a source of life of the earth in its entirety; in the second case, it is something that supports the earth in its stationary position in the cosmos. These two arguments indicate that Thales’ notion of water was meant to answer more than just one question about nature. This, in turn, might justify the use of the concept of arche, which Aristotle attributed to the Ionian philosophers, even though Thales had obviously never used the term. The concept may somehow accurately render Thales’ more general view of water. It should be noted, however, that if the term arche can be applied to Thales’ views, then it is only in the sense related to the “coming-to-be”. Thales’ arguments did not apply – contrary to what some doxographers said and what certain scholars still maintain – to the question of the end, or perishing of physical things, the problem taken up only by later Ionians. To put it differently, Thales never claimed that the physical things which die or undergo destruction change into water.

This paper tries to get a response to the following question: When can a narrowband power amplifier (PA) be considered to be memoryless and when can it not be considered memoryless? To this end, a thorough and consistent analysis of the notions and definitions related with the above topic is carried out. In the considerations presented, two models of the narrowband PA are exploited interchangeably: the black box model widely used in the literature and a model developed here, which is based on the Volterra series. These two models complement each other. In this paper, the conditions for a linear or nonlinear narrowband PA to be memoryless or approximately memoryless or possessing memory are derived and illustrated. They are formulated in terms of the signal delay as well as in terms of the amplitude-to-phase (AM/PM) conversion of the amplifier. Furthermore, the two possible interpretations of the amplitude-to-amplitude (AM/AM) and AM/PM conversions are given a mathematical framework. That is these conversions are presented through some operations. One set of these operations allows to treat the AM/AM and AM/PM conversions as distortions of the modulating signals. Or equivalently as distortions of a given signal constellation when it passes through the PA. Finally, it is proved that the Saleh’s and Ghorbani’s models of the AM/AM and AM/PM conversions occurring in the PAs, which were published in the literature, are not memoryless ones.
