    Opis:
    Flood plain forests are the richest and highly picturesque forest ecosystems. Unfortunately, river regulation and flood control contribute to their degradation. In Poland only 0.2% of total area is covered by flood plain forests. The Uroczysko Warta forest district constitutes one of the most important clusters of these sites. The construction of the Jeziorsko reservoir in the middle course of the Warta River has contributed to changes in the river regime (reduced flooding areas and decreased flooding frequency). It seems that the use of simple land improvement systems, i.e. gates, river bars and culverts with flap check valves, may result in the recreation of advantageous hydrological conditions. In such a case storage volume of oxbow lakes would be increased and ground water would be maintained at a higher level over longer periods of time. This study presents a concept for protection of the Uroczysko Warta, thanks to the construction of appropriate engineering infrastructure.

Niniejszy artykuł jest próbą syntetycznego ujęcia głównych założeń pedagogicznych Edmunda Bojanowskiego, ze szczególnym uwzględnieniem roli ochrony oraz wartości życia codziennego.
    Edmund Bojanowski built his vision of raising children on the concept of protection. The protection is not only a notion or an institution, but it should be understood as an action and a pedagogical activity in a broad sense. Bojanowski tried to protect by raising. He based his concept on pillars: nature, culture and religion which complement one another in everyday life. This article is an attempt to present his main pedagogical assumptions with particular emphasis on the role of protection and value of everyday life.

Prezentowana dyskusja stanowi pokłosie zmian w zakresie kierowania działami administracji rządowej mających kluczowe znaczenie z perspektywy zapewnienia bezpieczeństwa funkcjonowania infrastruktury krytycznej.
    The article presents the concept of critical infrastructure protection for the years 2015-2017 resulting from the updating of the National Program for Critical Infrastructure Protection, as well as a range of legal solutions that have a direct impact on critical infrastructure. Discussed solutions are the aftermath of changes in the management of government administration of key importance from the perspective of ensuring the protection of the critical infrastructure.

    The noise generated by aircraft during departure and arrival flight operations continues to be significant problem at most major airports. Environmental impacts due to aviation operations in the vicinity of airports have become a serious concern to the community. A variety of techniques can be employed to reduce the noise impacts of aircraft. Continuous Descent Approach (CDA) is the new promising technique, which can significantly reduce noise impact by keeping aircraft higher and at lower engine thrust for longer by eliminating the level segments in conventional "step down" approaches. These procedures (implemented in different ways) are fixed routes that are vertically optimized. With the changing traffic, conditions and variable noise abatement rules the benefits of CDA operations are not yet fully realized. Actually, at many airports, CDA techniques are implemented for environmental improvements. This article presents the concept of optimized CDA. The modified flight procedure has been shown in measurement and analysis for Warsaw International Airport example. In this demonstration test, the procedure was shown to reduce the A-weighted noise level for the selected location along the flight path for different aircraft. Depending on aircraft type, the noise benefit from a CDA compared to a conventional approach was up to about 9.5 decibels (this change is noticeable to the human ear). Measurements have shown that Continuous Descent Approach have the potential for significant environmental benefits including reductions in noise.

    This paper comments on a recent ruling concerning the choice of law to the individual employment contract according to the Rome I Regulation. In the judgement in the joined cases C–152/20 and C–218/20 (DG, EH v. SC Gruber Logistics SRL and Sindicatul Lucrătorilor din Transporturi, TD v. SC Samidani Trans SRL), the Court of Justice of the European Union (CJEU) provided the interpretation of Article 8 of the Rome I Regulation on two issues. At first, the EU Court was asked about the freedom of choice of law applicable to the individual employment contract if (a) national law required the inclusion of a clause into that contract under which the contractual provisions are supplemented by national law and (b) the contractual clause concerning that choice was drafted by the employer. The second issue was connected with the concept of the employee’s protection, under which the choice of law may not have the result of depriving the employee of the protection afforded to him (her) by provisions that cannot be derogated from by agreement, under the law that would have been applicable to the contract in the absence of choice. Regarding the first question, the CJEU admitted that the parties to an individual employment contract dispose of freedom to choose the law applicable to that contract, even if the contractual provisions are supplemented by national labour law under a (relevant) national provision, if “the national provision in question does not require the parties to choose national law as the law applicable to that contract”. Secondly, the Court found that the parties to an individual employment contract were “to be regarded as being, in principle, free to choose the law applicable to that contract, even if the contractual clause concerning that choice is drafted by the employer”. Therefore, the CJEU confirmed the application of the rules concerning the choice of law resulting from Article 3 of the Rome I Regulation to the individual employment contracts. Referring to the second issue of the commented ruling, the CJEU confirmed that Article 8 (1) of the Rome I Regulation must be interpreted as meaning that, where the parties have chosen the law governing the individual employment contract, the application of the law that would apply to the contract in the absence of choice must be excluded, with the exception of “provisions that cannot be derogated from by agreement”, if those provisions offer the employee concerned greater protection than those of the law chosen by the parties. The EU Court underlined that rules on the minimum wage could be treated as “provisions that cannot be derogated from by agreement” and the law that, in the absence of choice, would be applicable should decide about it. Unfortunately, it is necessary to follow the commented judgment’s justification to correctly understand the concept of an employee’s protection applied in Article 8 (1) of the Rome I Regulation. The thesis of the ruling in this regard seems to be too laconic, and it can be misinterpreted.

    One of the key components of The Blue-Green Network in Łódź are valuable natural areas like the relicts of the natural wildlife (called “Green Treasures of Łódź”) which parts have been preserved in Łódź in spite of two hundred years, very intense urbanization processes. The result of years of geobotanical research in the city was establishing 23 areas of nature protection and proposing of 12 additional natural areas which need to be protected (8 areas of landscape protection and 4 ecological sites). Existing and proposed areas of nature protection, including river valleys, build the wildlife system of Łódź. Predominantly the important role in this concept play the Łódź’s river valleys with their vegetation potential. The Sokolowka River Valley which is located in the Northern-West part of Łódź was the exemplary research field for geobotanical and sozological valorization of the natural habitat of the Blue-Green Network. Within the Sokolowka valley there are retained fragments of precious nature ecosystems.

    The beginning of twenty-first century is characterized with important changes in world shipping and exploitation of ocean resources. Three important trends are clearly visible: environment protection, safety and economy. They materialize in important changes in the structure of world fleet where some existing ship types are going to disappear and new ship types emerge. Increasing the size of some ship types is another visible tendency. Stress on environment protection has serious impact on the hydrodynamic characteristics of ships whether with regard to safety zero accident rate is the goal. Important challenges to ship hydrodynamics caused by those tendencies are discussed in the paper.

    Poczucie bezpieczeństwa jest jedną z podstawowych potrzeb człowieka, którą może zagwarantować państwo dzięki dostępnym środkom i technikom. Obecnie wyróżnia się kategorie bezpieczeństwa, wśród których swoje miejsce znalazło bezpieczeństwo informacyjne. Z uwagi na rolę, jaką we współczesnym świecie odgrywa informacja, i na to, jaki wpływ wywiera ona na państwa, społeczeństwa i jednostki, w literaturze przedmiotu zaczęto analizować informacyjną naturę bezpieczeństwa. Szeroki zakres omawianego zagadnienia oraz powiązana z nim tematyka wpłynęły na pojawienie się definicji bezpieczeństwa informacyjnego tak w ujęciu negatywnym, jak i pozytywnym. Celem artykułu jest wybór jednej spośród stworzonych przez doktrynę naukową definicji, najtrafniej ujmującej istotę bezpieczeństwa informacyjnego. Autorka w pracy wykorzystała metodologię opisową, a w szczególności posłużyła się metodą porównawczo-analityczną.
    A sense of security is one of the basic human needs that can be guaranteed by the state using the available methods and techniques. At present, security categories are distinguished where information security has found its place. Due to the role of information and its impact on states, societies and entities, the literature has highlighted this issue. The wide scope of information security and related topics have led to the creation of concepts that do not reflect current knowledge about information security. The aim of the article is to select, among the definitions presented by the doctrine – the definition of information security most aptly capturing its essence. In this work the author used the descriptive methodology, focusing on the comparative analytical method.

    Opis:
    Bernardine monastery garden in Kraków boasts a history of several centuries, while the spatial changes that occurred therein have been described and illustrated by many authors. The present state of the compound in question is not contrary to the general principles of monastic gardens’ composition or to historical sources about this particular garden realisation. As a result, it was possible to develop a project for the redesign of the garden (approved by the Małopolska Regional Monument Conservation Authority), under which specific design solutions were adopted, legitimised by the data contained in written sources or resulting from the analysis of the historical plans of the garden.
    Celem niniejszej pracy była próba wyznaczenia obszarów predysponowanych do lokowania działalności gospodarczej w powiecie wielickim w oparciu o przyjęty zestaw kryteriów wykluczających oraz analiza ich atrakcyjności inwestycyjnej. Działalność gospodarcza obejmuje swym zagadnieniem obiekty inwestycyjne, mogące negatywnie oddziaływać na środowisko i zdrowie ludzi. Zastosowany zestaw cech przestrzennych wynikał z dostępności pozyskanego materiału i obejmował 39 warstw tematycznych, podzielonych merytorycznie na 12 grup. Dane w postaci map cyfrowych pozyskano z Małopolskiej Biblioteki Cyfrowej. Delimitacji przestrzennej jednostek dokonano za pomocą Systemu Informacji Geograficznej (GIS), w programie MapInfo Professional 8. W wyniku przeprowadzonej delimitacji otrzymano dwie lokalizacje obszarów predysponowanych w obrębie gmin: Gdów i Wieliczka. Uznano, że istnieje możliwość lokowania działalności gospodarczej na wyodrębnionych terenach a wyróżnione lokalizacje charakteryzuje bogata infrastruktura inwestycyjna, świadcząca o ich atrakcyjności gospodarczej.

    Coraz więcej uwagi zwraca się nie tylko na renowację pojedynczych budynków, całych kompleksów obiektów budowlanych, ale także na rewitalizację dużych obszarów miejskich, całych kwartałów śródmieścia czy całych osiedli mieszkaniowych. Coraz więcej troski poświęca się zieleni i środowisku naturalnemu. W każdym jednak przypadku podstawowym założeniem rewitalizacji obszarów miejskich jest dostosowanie jej zabudowy, infrastruktury drogowej do współczesnych wymagań cywilizacyjnych, a uzupełniającym postulatem (warunkiem) - zachowanie środowiska naturalnego, ewentualnie jego uporządkowanie. Takie postępowanie jest uznawane jako racjonalne, społecznie i ekonomicznie uzasadnione. Jest też powszechnie akceptowane.
    Increasing attention is currently paid not only to the renovation of single buildings and complexes of buildings, but also to the revitalization of large urban areas, entire city centre districts or entire residential estates. An ever greater emphasis is placed on greenery and the natural environment. However, in every case, a basic objective of the revitalization of urban areas is to bring their buildings and road infrastructure into line with contemporary social needs, while a supplementary objective (condition) is to preserve the natural environment, or possibly to place it in better order. This is considered to be a rational way of proceeding which is socially and economically justified, and it enjoys wide acceptance.

    Opis:
    This article focuses on the process of establishing and determining the essential elements of work as subject to copyright protection. This issue is considered as the most crucial challenge faced by the present day copyright law. When it comes to determining the creativity and individual character of a copyrightable work, an examination of judicial decisions and the theoretical analysis of the term ‘work’ only highlights the powerlessness of science and practice. The existing multitude of definitions of the object of copyright protection, especially relating to so called borderline cases, may be eliminated only after profound scientific research. The article emphasizes the potential benefits of expanding the research perspective by taking into account various fields of scientific study, including neuroaesthetics, and seeks to contribute to the discussion on the issue described above as well as to further research on the subject.
    W artykule przedstawiono nowe spojrzenie na centralny i najpoważniejszy problem, przed którym stoi dziś prawo autorskie, a jest nim stwierdzanie istnienia koniecznych cech utworu. Na tle krótkiej charakterystyki przedmiotu ochrony prawa autorskiego oraz koncepcji doktrynalnych i orzeczeń sądowych dotykających kwestii istnienia cechy „twórczości o indywidualnym charakterze”, zwrócono uwagę na bezsilność nauki i praktyki w zakresie definiowania przedmiotu ochrony prawa autorskiego. W artykule zaakcentowano potrzebę poszerzania perspektywy badawczej o dorobek innych nauk, w tym nie tylko takich, jak filozofia i psychologia, ale także o zdobycze rozwijającej się ostatnio dynamicznie nowej dyscypliny, jaką jest neuroestetyka.
