    In the opinion of the author, Deputies have the right to exercise their powers of control over government and local government administration bodies pursuant to the provisions of the Act on the Exercise of the Member’s and Senator’s Mandate. The author points herein to companies with the State Treasury’s shareholding, state and local government establishments and enterprises as well as social organisations and non-state economy units. The analysed regulations do not explicitly name foundations among these entities. On the other hand, the subjective scope of Deputy’s control covers State Treasury foundations established on the basis of statutes, and the scope of control of State Treasury foundations is determined by the contents of binding statutory rules and internal statutes of such foundations.

    The opinion deals with a motion to convene a meeting of a Sejm committee to consider the consequences of a particular court decision. In the author’s view, the subject matter of the motion is outside the scope of a committee’s competence as provided in the Standing Orders of the Sejm. Therefore, the motion is defective and the convening of a committee meeting to consider the abovementioned matter is inadmissible.

    Zgodnie z Konstytucją Rzeczypospolitej Polskiej, Sejm sprawuje kontrolę nad działaniami podejmowanymi przez Radę Ministrów. Kontrola ta może przybierać różne formy, w zależności od tego, jaki organ Sejmu podejmie się tego zadania. W niniejszym artykule opisane zostały mechanizmy kontroli, jakie przysługują Sejmowi in pleno, oraz komisjom sejmowym, stanowiącym jeden z organów tej izby parlamentarnej. Przeanalizowane zostały takie instytucje prawne, jak: wotum zaufania, absolutorium, komisje śledcze, dezyderat oraz opinia, a także instytucja informacji bieżącej.
    In accordance with the Constitution of the Republic of Poland, the Sejm exercises control over actions taken by the Council of Ministers. This control may take various forms, depending on which body of the Sejm undertakes this task. This article describes the control mechanisms for the Sejm in pleno and the Sejm committees, which are one of the organs of this parliamentary chamber. The analysis covered such legal institutions as: vote of confidence, vote of approval, committees of inquiry, desiderata and opinion, as well as the institution of current information.

    Opis:
    This work focuses on the parliamentary control in Uzbekistan. Currently, besides the Constitution of Uzbekistan, the issue of parliamentary control is subject to the Act from 11 April 2016 „on parliamentary control” and other legislative acts, in particular relating to the constitutional position of Oliy Majlis. The law provides for various mechanisms of control over the executive power (e.g. vote for budget approval, parliamentary inquiry, parliamentary investigation, presenting information about their business by the executive power). Currently, the most important challenge related to the development of parliamentary control in Uzbekistan is further democratisation of the political regime, increasing political pluralism.

    The author discussed the matter of managing Polish special services, including the liquidation of the security service created in the period of the Polish People’s Republic and the establishment of the State Protection Office (SPO). The attention was paid inter alia to changes in the organization and in the scope of supervision over the SPO, which took place in 1996, as well as to the establishment in 1995 of the Sejm’s Special Services Committee. In 2002, the Internal Security Agency and the Foreign Intelligence Agency were established in the place of the SPO. Four years later, the Central Anticorruption Bureau was formed. The author came to the conclusion that changes in the scope of supervision and control over civil special services in the Polish state between 1990 and 2016 were connected, above all, to ongoing political events in Poland.

    Niniejszy artykuł poświęcony jest kwestii kontroli parlamentarnej, jako instytucji zapewniającej realizację przez organ ustawodawczy funkcji przedstawicielskiej, nie tylko za pośrednictwem tworzenia prawa, ale również przy odwoływaniu się do mechanizmu egzekwowania jego należytego wykonania oraz stosowania. Stanowi to niezbędny warunek stabilizacji systemu prawnego, bez którego nie może zostać zapewniony ład społeczny, który jest podstawą do zapewnienia bezpieczeństwa państwa. Rozpatrywany jest przykład działalności parlamentu Federacji Rosyjskiej, historii jego powstania, kompetencjom kontrolnym na etapie współczesnym oraz warsztatowi prawnemu, jaki jest w jego dyspozycji.
    This article is devoted to the issue of parliamentary control, as an institution ensuring the realization of the representative function by the legislative body, not only through the process of stating the law, but also by referring to the mechanism of its respecting. This is an essential condition for the stabilization of the legal system, without which social order cannot be guaranteed, as an insurance of the security of state. Is considers an example of activity of Russian Federation’s parliament, its history, competence of control nowadays and the legislation, that provides all necessary means to obtain such goal.

    Author argues in the article that under the legal status preceding the 2009 amendment to the Act on the Public Prosecutor’s Office, the Sejm’s control over the actions of the Minister of Justice – Prosecutor General found a direct basis in the constitutional norm, which entrusts the Sejm with the control over the Council of Ministers. Under the 2009 prosecution model, where the functions of the Prosecutor General and the Minister of Justice were separated, the Prosecutor General, directing the activities of the prosecution service, was an autonomous body in relation to Council of Ministers, President, Sejm and Senate. The reconnection of the functions of the Minister of Justice and Prosecutor General by the 2016 Act gives the Sejm the possibility of parliamentary control of the Prosecutor General. Author indicates the instruments of parliamentary control emphasizing that the Sejm is entitled only to such powers of control that have been clearly defined in the Constitution and laws. Author justifies the thesis that the diversity of the models of functioning of the prosecutor’s office in Poland, as an institution beyond the framework of the classical Montesquieu classification, does not deprive the Sejm of the right to control the prosecutor’s office, which he realizes with the help of diverse means.
    Autorka podnosi w artykule, iż na gruncie stanu prawnego poprzedzającego nowelizację ustawy o prokuraturze z 2009 r., kontrola Sejmu nad działaniami Ministra Sprawiedliwości – Prokuratora Generalnego znajdowała bezpośrednią podstawę w normie konstytucyjnej, która powierza Sejmowi kontrolę nad Radą Ministrów. W modelu prokuratury z 2009 r., gdzie funkcje Prokuratora Generalnego i Ministra Sprawiedliwości zostały rozłączone, Prokurator Generalny, kierujący działalnością prokuratury, był organem „autonomicznym” na zasadach określonych w ustawie względem Rady Ministrów, Prezydenta, Sejmu i Senatu. Ponowne połączenie funkcji Ministra Sprawiedliwości i Prokuratora Generalnego ustawą z 2016 r. daje Sejmowi szerszą możliwość kontroli parlamentarnej Prokuratora Generalnego. Autorka wskazuje instrumenty kontroli parlamentarnej podkreślając, że Sejmowi przysługują tylko takie kompetencje kontrolne, które zostały wyraźnie określone w konstytucji i ustawach. Autorka uzasadnia tezę, iż zróżnicowanie modeli funkcjonowania prokuratury w Polsce jako instytucji wykraczającą poza ramy klasycznej monteskiuszowskiej klasyfikacji, nie odbiera Sejmowi prawa do kontroli prokuratury, a ten realizuje ją przy pomocy zróżnicowanych środków.

    Uprawnienia tych parlamentów narodowych, które dysponują możliwościami współdecydowania o udziale sil zbrojnych w operacjach wojskowych nie są identyczne. Istotą procedur decyzyjnych w demokratycznych warunkach ustrojowych jest uregulowane współdziałanie władzy wykonawczej z władzą ustawodawczą. Świadczy to o demokratycznym charakterze państwa i jego wiarygodności jako partnera. Jakość współdziałania sojuszników zależy od sprawnego udostępniania przez nich zdolności militarnych, a zatem także od efektywnego procesu decyzyjnego w poszczególnych krajach. Zależność między zasadą kontroli parlamentu nad sprawami wojskowymi a koniecznością sprostania zobowiązaniom sojuszniczym jest widoczna szczególnie w przypadku Niemiec, dysponujących procedurami decyzyjnymi w zakresie użycia siły militarnej, które cechują silną partycypację władzy ustawodawczej. Aktywne zaangażowanie Niemiec w operacjach militarnych podlega aprobacie Bundestagu. Specjalna komisja Bundestagu odpowiadała za usprawnienie procesu decyzyjnego. Komisja zaproponowała, aby roczny raport dotyczył oceny zdolności Bundeswehry do kooperowania z sojuszniczymi siłami zbrojnymi i zapowiedziała, że zgoda Bundestagu na operacje nie będzie obejmowała konieczności autoryzowania obecności żołnierzy w wielonarodowych centrach dowodzenia/sztabach NATO i samolotach AWACS, o ile nie będą one zlokalizowane na obszarach konfliktu.
    Not every national parliament vested with the authority to partake in decisions to deploy armed forces in military operations enjoys identical powers. In essence, democratic decision-making procedures govern collaboration between the executive and legislative branches of government. Having such procedures in place is a test of the democratic nature of a state and a prerequisite for its credibility as an international partner. The quality of collaboration among allies depends on their efficiency in deploying military force. It is therefore vital that each participating country be able to make its decisions effectively. The connection between the principle of parliamentary control over military matters and the need to deliver on alliance obligations is evident in Germany whose procedures on the use of military force envision a strong involvement on the part of legislative authorities. Germany’s active involvement in military operations is subject to the Bundestag’s approval. A special Bundestag committee has been put in charge of streamlining the decision-making process. The committee has proposed that annual reports be filed on the Bundeswehr’s capacity to cooperate with allied armed forces and announced that Bundestag’s consent for operations will not be required to authorize the posting of soldiers in multinational command centers of NATO and crews of AWACS’s as long as they are not located in conflict areas.

    Opis:
    The article is focused on financing of Polish support to displaced persons arriving to Poland from Ukraine after 24 February 2022, so after the Russian invasion on Ukraine. Poland has introduced a new statute and has amended general rules applicable in mass influx situations. That area of law is regulated also by Directive 2001/55/EC which establishes a minimum standard of displaced persons’ rights, leaving their financing primarily to national budgets. The Council Implementing Decision (EU) 2022/382 is the first law which has activated the Directive. Under the amended Polish law, support to persons from Ukraine is subject to the availability of national financial resources, which contradicts the principles of public finance law because Polish law does not establish predictable sources of financing, and spendings are not controlled by the Polish Parliament.

    Przedmiotem przedkładanego tekstu uczyniono Izbę Obrachunkową jako organ kontroli finansowo- budżetowej. Analizuje się jej usytuowanie w systemie organów władzy publicznej, niezależność i wynikające z tego konsekwencje dla sprawności działania Izby Obrachunkowej. W pracy formułuje się tezę, że Izba Obrachunkowa jest kluczowym instrumentem kontroli parlamentarnej w zakresie zagadnień finansowo-budżetowych, umożliwiającym obu izbom Zgromadzenia Federalnego efektywne wykonywanie powierzonych zadań.
    The subject of the present text is the Accounts Chamber as an organ of the financial and budgetary control. The paper analyzes its place in the system of organs of public authority and its independence as well as the resulting consequences for the efficiency of the work of the Accounts Chamber. The paper formulates the thesis that the Accounts Chamber is the key instrument of parliamentary control in the sphere of financial and budgetary issues which enables both chambers of the Federal Assembly to effectively realize the tasks they are entrusted with.

    Posłowie są – obok Sejmu in pleno i komisji sejmowych – jednym z podmiotów sejmowej kontroli działalności szeroko rozumianego rządu, na który składają się: Rada Ministrów in gremio, Prezes Rady Ministrów i pozostali członkowie Rady Ministrów, a także centralne i terenowe organy administracji rządowej. Celem artykułu jest analiza statusu posłów jako podmiotów kontroli sejmowej w świetle regulacji normatywnych, zwłaszcza konstytucyjnych. Na ten status kontrolny posłów składa się kilka zasadniczych elementów: 1) ogólny status prawny posła, wyznaczany przez dwie grupy czynników: a) generalnie przez pozycję Sejmu w systemie organów państwowych RP i koncepcję stosunku przedstawicieli do wyborców, b) na płaszczyźnie szczegółowej przez przepisy aktów normatywnych – Konstytucji RP z 1997 r., ustawy z 1996 r. o wykonywaniu mandatu posła i senatora, Regulaminu Sejmu; 2) zakres podmiotowy i przedmiotowy uprawnień posłów do kontroli działalności rządu, który jest identyczny z zakresem podmiotowym i przedmiotowym takiej kontroli określonym w art. 95 ust. 2 Konstytucji z 1997 r.; 3) pozostające w dyspozycji posłów instytucje służące kontroli działalności rządu, którymi są: a) interpelacje poselskie, b) zapytania poselskie, c) pytania w sprawach bieżących, d) informacje bieżące.
    Members of Parliament are together with Sejm in pleno, and parliamentary commissions, one of the entities entitled to control widely understood states government, which consists of: the Council of Ministers in gremio, Prime minister, other members of the Council of Ministers, as well as central and local organs of governmental administration. The purpose of this work is an analysis of members of Parliament position as parliamentary control entities, according to normative regulations, in particular provisions of Constitution. The above mentioned position consists of following elements: 1) general status of deputy determined by two groups of features: a) in general by position of Sejm in the system of govering bodies in the Republic of Poland, and concept of relation of deputies to electors, b) on the detailed ground by normative acts regulations – The Constitution of The Republic of Poland of 2nd April 1997, Act on performance of deputy, and senators mandate, Sejm's regulation; 2) subjective, and objective scope of deputies rights to control governments activity, which is identical with subjective, and objective scope of such control determined in art. 95 of 1997 Constitution; 3) institutions remaining in deputies disposal which aim is control, which are: a) deputies interpellations, b) deputies questions, deputies questions in ongoing matters, d) information in ongoing matters.

    Opis:
    The practice of political life often indicates that the implementation of the control function is one of the most important elements of the Polish parliament’s competency. The possibility of appointing parliamentary committees of inquiry guaranteed by the Constitution is undoubtedly the clearest, and the most spectacular form of its exercise. However, It would seem that the clear form of the accepted political solutions does not eliminate various doubts of procedural, political and legal nature relating to their functioning. It is no wonder that parliamentary committees of inquiry, becoming media phenomena, are increasingly seen as a weak link in the process of political reality. The main objective of this paper is to show the form and the position of committees of inquiry, arising not only from the accepted legal and constitutional solutions, but also non-formal conditions shaped by political, media as well as social culture. The intention of the authors is an attempt to present the actual importance of parliamentary committees of inquiry in view of the perception of their activities by the electorate of particular parties.

    The article discusses the role of the committee in the control function of the Sejm of the Republic of Poland. Committees are one of the key bodies of the Sejm. They perform a significant range of work, both legislative and control. The article discusses the competences of parliamentary committees, highlights the importance of the presence of the most important people in the state at their meetings and indicates the possibilities of increasing the effectiveness of the committee’s control activities.
    W artykule omówiono rolę komisji w funkcji kontrolnej Sejmu RP. Komisje są jednym z kluczowych organów Sejmu. Wykonują one znaczny zakres prac, zarówno legislacyjnych, jak i kontrolnych. W artykule omówiono kompetencje komisji sejmowych, uwypuklono znaczenie obecności najważniejszych osób w państwie na ich posiedzeniach oraz wskazano możliwości zwiększenia skuteczności działań kontrolnych komisji.

    Opis:
    One of the aspects of the principle of separation of powers in the state is control of the executive by the legislature. As regards the Polish lands in the early nineteenth century, we can speak about Polish parliamentarism only in the Duchy of Warsaw, the Kingdom of Poland and the Republic of Cracow. Although these states did not recognize the principle of parliamentary accountability, their parliaments voiced criticism of the authorities and there occurred the problem of controlling the executive. Parliament of the Duchy of Warsaw tried to usurp this right itself. Parliament of the Kingdom of Poland claimed the right to charge a civil officer of the government with crimes committed while in office. In that state the ability to control emerged during the November Uprising. In the Republic of Cracow all attempts at obtaining the right of control encountered the objection on the part of three supervising neighbours (Russia, Prussia, and Austria).

    Artykuł ma na celu analizę pozycji głowy państwa i jego uprawnień o charakterze hamującym wobec legislatywy. W pracy przedstawione zostały warunki skorzystania przez Prezydenta RP z mechanizmu skrócenia kadencji parlamentu, zgłoszenia weta ustawodawczego oraz zwrócenia się do Trybunału Konstytucyjnego z wnioskiem o przeprowadzenie prewencyjnej kontroli konstytucyjności. W artykule dokonana została analiza uprawnień, które posiada Prezydent wobec władzy ustawodawczej i podejmowanych przez nią działań, a także jego roli arbitra w sytuacji kryzysu w izbach parlamentu. Omówione zostały przesłanki oraz ograniczenia dotyczące stosowania przez głowę państwa uprawnień hamujących wobec legislatywy. Podczas sporządzenia niniejszego artykułu wykorzystano metodę dogmatyczno-prawną celem przeprowadzenia analizy skuteczności stosowania po 1997 r. przysługujących Prezydentowi kompetencji wobec władzy ustawodawczej.
    The article aims to analyze the position of the head of state and his powers of an inhibitory nature against the legislature. The paper presents the conditions for the President of the Republic of Poland to use the mechanism of shortening the term of parliament, filing a legislative veto and applying to the Constitutional Court for a preventive constitutionality review. The article analyzes the powers that the President has vis-à-vis the legislature and the actions it takes, as well as his role as an arbiter in a crisis situation in the chambers of parliament. The rationale and limitations on the use of inhibitory powers by the head of state against the legislature are discussed. In drafting this article, the dogmatic-legal method was used to analyze the effectiveness of the post-1997 application of the powers vested in the President against the legislature.
